[4] Tracing of title for 25 to 30 years next before scrutiny:
A larger extent of property comprised in R.S.No.242/1 of Egmore Village,
Egmore-Nungambakkam Taluk, Chennai District, measuring 5 Cawnies and 147
sq.ft., originally belonged to Mrs.Kaveri Bai Ammal, she having purchased the same
from Ms.Kanakarathinammal and Ms.Hithavachanammal under a Sale deed dated
20.01.1910 registered as Doct.No.99 of 1910 in the office of Sub-Registrar, West
Madras.
The said Mrs.Kaveri Bai Ammal released her right, title and interest in the said
property to and in favour of her sons Mr,G.Krishna Rao and Mr.G.Srinivasa Rao
under a Release deed dated 28.11.1916 registered as Doct.No.2222 of 1916 in the

office of Sub-Registrar, West Madras as she purchased the said property out of the
funds provided by her sons Mr,G.Krishna Rao and Mr.G.Srinivasa Rao.
It appears that the said Mr.G.Krishna Rao died intestate leaving behind him
his wife Mrs.K.Radha Bai, his sons Mr.K.Govinda Rao, Mr.K.Padmanabhan,
Mr.K.Venkat Rao, and his daughter Ms.Shanta Bai as his legal heirs to succeed to
his estate.
Further it appears that the said Mr.G.Srinivasa Rao died intestate leaving
behind him his sons Mr.S.Raghavendra Rao and Mr.S.Sridhar Rao as his legal heirs
to succeed to his estate.
The said Mrs.K.Radha Bai, Mr.K.Govinda Rao, Mr.K.Padmanabhan,
Mr.K.Venkat Rao, Ms.Shanta Bai, by way of abundant caution along with their
respective children released their 50% share in the property bearing Old Door No.2/1
& 2/2, New Door No.5, Subbaraya Gramani Street, Shenoy Nagar, Chennai-600 030
comprised in R.S.No.242/1 part of Egmore Village, Egmore-Nungambakkam Taluk,
Chennai District, measuring 6277 sq.ft., to and in favour of Mr.S.Raghavendra Rao
and Mr.S.Sridhar Rao under a Release deed dated 15.10.1973 registered as
Doct.No.672 of 1974 in the office of District Registrar, Madras.
The said Mr.S.Raghavendra Rao died intestate as unmarried on 04.10.1999
leaving behind him his sisters Ms.Hemalatha Bai, Mrs.Sudha Bai Murthy, Ms.Vatsala
Bai and his brother Mr.Swami Chidananda Saraswathi @ S.Sridhar Rao as his legal
heirs to succeed to his estate. As the said Mr.S.Raghavendra Rao died as
unmarried, his brother and sisters are class-II legal heirs to succeed to his estate.
The said Ms.Hemalatha Bai died intestate on 27.09.2005 leaving behind her
daughter Mrs.Vibha Srinivasan and her son Mr.Sudhindra Bhavani as her legal heirs
to succeed to his estate.
The said Mr.Swami Chidananda Saraswathi @ S.Sridhar Rao died on
28.08.2008 as a bachelor and therefore the said Mrs.Sudha Bai Murthy and
Ms.Vatsala Bai jointly entitled to 33.33% share each in the said property and the said
Mrs.Vibha Srinivasan and Dr.Sudhindra K.Bhavani jointly entitled to 16.67% share
each.
Thus the said Ms.Vatsala Bai, Mrs.Sudha Bai Murthy, Dr.Sudhindra
K.Bhavani, Mrs.Vibha Srinivasan had become the absolute owner of the property
bearing Old Door No.2/1 & 2/2, New Door No.5, Subbaraya Gramani Street, Shenoy
Nagar, Chennai-600 030 comprised in R.S.No.242/1 part, New R.S.No.242/57,
Block

No.16 of Egmore Village, Egmore-Nungambakkam Taluk, Chennai District,
measuring 6277 sq.ft., and to that effect a certificate of extract from the Permanent
Land Register had been issued by the Tahsildar, Egmore-Nungambakkam Taluk on
01.03.2010.
The said Ms.Vatsala Bai appointed Mr.M.A.Abdul Samad as her power agent
to do acts, deeds and things in respect her share in the said property under a Deed
of General Power of Attorney dated 23.09.2009 registered as Doct.No.1603 of 2009
in the Office of Sub-Registrar, Adayar.
The said Mrs.Sudha Bai Murthy appointed Mr.M.A.Abdul Samad as her power
agent to do acts, deeds and things in respect her share in the said property under a
Deed of General Power of Attorney dated 22.09.2009 registered as Doct.No.293 of
2009 in the Office of Sub-Registrar, Uttrakhand.
The said Dr.Sudhindra K.Bhavani appointed Mr.M.A.Abdul Samad as his
power agent to do acts, deeds and things in respect his share in the said property
under a Deed of General Power of Attorney dated 15.09.2009 registered as
Doct.No.207 of 2010 in the Office of Sub-Registrar, Periamet.
The said Mrs.Vibha Srinivasan appointed Mr.M.A.Abdul Samad as her power
agent to do acts, deeds and things in respect her share in the said property under a
Deed of General Power of Attorney dated 18.09.2009 registered as Doct.No.2258 of
2009 in the Office of Sub-Registrar, Virugambakkam.
The said Ms.Vatsala Bai, Mrs.Sudha Bai Murthy, Dr.Sudhindra K.Bhavani,
Mrs.Vibha Srinivasan through their power agent Mr.M.A.Abdul Samad conveyed the
southern portion of the said property bearing part of Old Door No.2/1 & 2/2, part of
New Door No.5, Subbaraya Gramani Street, Shenoy Nagar, Chennai-600 030,
comprised in R.S.No.242/1 part; present R.S.No.242/57, Block No.16 of Egmore
Village, Egmore-Nungambakkam Taluk, Chennai District, measuring 3138.5 sq.ft., to
and in favour of Mr.Sujai Anand Devi Reddy under a Sale Deed dated 22.03.2010
registered as Doct.No.844 of 2010 in the Office Sub-Registrar, Periamet.
The said Mr.Sujai Anand Devi Reddy conveyed the said property to and in
favour of M/s.Fifth Field Realtors Pvt. Ltd., rep. by its Directors Mr.A.Riyaz Ahmed
Khan and Mrs.S.Sarada Sundaramurthi under a Sale Deed dated 14.07.2010
registered as Doct.No.1434 of 2010 in the Office Sub-Registrar, Periamet.
The Tahsildar, Egmore-Nungambakkam Taluk issued a certificate of extract
from the Permanent Land Register in respect of the property comprised in R.S.No.

242/57, Block No.16 of Egmore Village, Egmore-Nungambakkam Taluk, Chennai
District, measuring 3138 sq.ft., in the name of M/s.Fifth Field Realtors Pvt. Ltd., on
20.03.2010.
The said M/s.Fifth Field Realtors Pvt. Ltd., rep. by its Directors Mr.A.Riyaz
Ahmed Khan and Mrs.S.Sarada Sundaramurthi applied for demolition of the old
building and construction of new residential building on the said property and
Corporation of Chennai issued the Planning and Construction permission on
28.09.2010 for demolition of the old building and construction of new residential
building on the said property and the building plan has been duly approved by
Corporation of Chennai as seen from the endorsement made available on the
approved construction plan.
The said M/s.Fifth Field Realtors Pvt. Ltd., rep. by its Directors Mr.A.Riyaz
Ahmed Khan and Mrs.S.Sarada Sundaramurthi entered into a Sale-cum-
Construction Agreement dated 03.11.2010 with Mr.A.T.Kamaraj, agreeing to convey
405 sq.ft., undivided share in the said land to them for a valid consideration free from
encumbrances and further agreeing to construct a residential apartment bearing Flat
No.3 on the first floor measuring 838 sq.ft., with a covered car park in the stilt floor
as per approved plan.
The encumbrance certificate produced does not reveal any other transaction
except the above discussed.

On a careful perusal of documents mentioned in column(3), I am of the
opinion that the described property of M/s.Fifth Field Realtors Pvt. Ltd., rep. by its
Directors Mr.A.Riyaz Ahmed Khan and Mrs.S.Sarada Sundaramurthi is CLEAR,
ABSOLUTE and MARKETABLE.
Pursuant to the said agreement dated 03.11.2010, if the said M/s.Fifth Field
Realtors Pvt. Ltd., rep. by its Directors Mr.A.Riyaz Ahmed Khan and Mrs.S.Sarada
Sundaramurthi executes and registers the sale deed in respect of 405 sq.ft.,
undivided share in the land bearing part of Old Door No.2/1 & 2/2 & part of New
Door

No.5, Subbaraya Gramani Street, Shenoy Nagar, Chennai-600 030, comprised in
R.S.No.242/1 part; present R.S.No.242/57, Block No.16 of Egmore Village, Egmore-
Nungambakkam Taluk, Chennai District, measuring 3138 sq.ft., to and in favour
Mr.A.T.Kamaraj, the Applicant herein, then he will become the absolute owner of the
same and further if the said M/s.Fifth Field Realtors Pvt. Ltd., rep. by its Directors
Mr.A.Riyaz Ahmed Khan and Mrs.S.Sarada Sundaramurthi hands over the vacant
possession of the said residential apartment bearing Flat No.3 on the first floor
measuring 838 sq.ft., with a covered car park in the stilt floor after completion of
construction as per approved plan to Mr.A.T.Kamaraj, the Applicant herein, then he
will become the absolute owner of the described property.
The Applicant may be directed to create an EMG with your Bank by
depositing the following documents :-
(i) Xerox copies of Doct.No.1 to 18 mentioned in column(3) supra;
(ii) A letter of undertaking from the Applicants that they would produce the
original sale deed in respect of the above discussed UDS, after
completion of registration of sale deed together with original E.C. from
16.08.2010 till date of registration of sale deed, reflecting the said sale
deed.
