COURSE BACKGROUND
• In 2005, and since, the NEC family has expanded quite considerably. This BRAND NEW 1 DAY
COURSE will review the various contracts now in that family, their role and the appropriate use of them
in the industry, as well as provide an overview of the allocation of risk and administrative
responsibilities under each form.
• The Seminar would be very useful for those people who have no working knowledge of NEC contracts
and those that have used one form, but need to extend their knowledge and understanding, whether
working for Employer, Project Manager, Contractor, Subcontractor, Supplier or Consultant.

SPEAKERS’ PANEL
The speaker for each course will be from a panel of Lorne Alway, Ryland Ash, Nigel Clayton, Peter
Ormston and Michael Rowlinson

OVERVIEW

NEC ECC
• Overview of the main Contract and the Subcontract, including main and secondary options, Contract
Data, Works and Site Information, Contractor Design, role of the Project Manager and Supervisor.
• Provide an insight into the administration of the Contract and the operation of the Compensation event
and payment mechanism.

Minor work and maintenance


• Consider the appropriate form of contract for small work, refurbishment and maintenance.
• Review the Engineering and Construction Short Contract and Subcontract including preparing the
documentation, Contract Data, Price List, Works Information and Site Information.
• Use of the Term Service Contract in planned and reactive maintenance including work and monitoring,
reporting and associated minor project work. Go through the main and secondary options, consider the
contract documentation, the role of the Service Manager and Contractor and review the main
provisions.

Professional services contract
• The form, now in its third edition, is suitable for a wide range of professional service providers and up
and down the contractual chain, where the NEC construction contracts are in use.
• The layout and make up of the form, including the main and secondary options, the Services to be
provided along with the role of the Consultant. Also consider many aspects of performance and
payment including Defects, Completion, Scope of Information, Charges and payments, and the
standards to be achieved.

Framework contract
• Consider the concept in law and practice of framework contracting, along with a review of the form of
contract itself and the creation of a framework arrangement.

Supply - contract and short contract


• The forms, first published in 2009, provide for ‘off the shelf’ supply arrangements (short) and project
specific procurement.
• The Course will consider the content of the documents and contract formation, look at the role of the
Supply Manager, Purchaser and the Supplier.
• It will also address issues concerning the administration of the Contracts and problem scenarios.

The New Construction Act


• Brief Review of the Local Democracy, Economic Development and Construction Act 2009 and its
impact on payment and adjudication provisions.
