Financing Statement on record with Secretary Of State for Delaware. 2. SECOND CLAIM; All complaints must be prosecuted in the name of the real parties involved (Sup Court Civil Rule 17). To bring a false claim against a party is fraud. I Am the holder in due course of the land Lot # 173 also known as 317 Macarthur Drive. 3. THIRD CLAIM; Contract. Any contraet must have 1) Offer 2) Consideration 3) Acceptance by all parties in the contract. 4) The Signatures by all parties involved in the contract. FIFTH CLAIM; Alll Judges Should Have A Copy Of The United States Constitution, And The United Nations Declaration Of The Rights Of Indigenous Peoples On Their Desk While Proceeding In Court. 6. SIXTH CLAIM; Jurisdiction. The Superior Court for Kent County was not the proper venue and did not have jurisdiction to pass any judgement in the matter as it is a dry doc vessel on indigenous land (hittp://sites.google.com/site/authenticexport/atsikhata-1), 7, SEVENTH CLAIM; A Judge should respect and comply with the law (DCJC Rulel.1). Abuse Of Authority of judicial and court officers (Del Code Of Judicial Conduct Rule 1.2), A Judge should be fair and impartial and avoid impropriety and the appearance of impropriety (DCJC Rule 2.3). 8. EIGTH CLAIM ‘The judge nor the alleged plaintiff, Bank Of America and it’s lawyers (Hereafter “they” )have not present any letters of Marque and Reprisal and to date have not responded to any affidavit presented to them with regard to the above mentioned case nor have they returned any of the instruments/payments tendered. By holding the tender mentioned in Appelor’s January 6" Affidavit and not responding they agreed by tacit procurement, silence and acquiescence to the terms of Appelor’s Guarenteed Bond Placed on record with the prothonotary for Kent County, Delaware . ATIVE AVI 1, FIRST NEGATIVE AVERTMENT BAC HOME LOANS SERVICING LP, and it’s attorneys hereafter plaintiff have not brought forth any proof that they are in fact the holder in due course of the mortgage contract and note, despite my repeated requests for them to do so. 2. SECOND NEGATIVE AVERTMENT ‘The plaintiff has intentionally brought fraud upon the court by filing a claim against a fictitious entity which is my intellectual property. The claims brought by the lawyers for the plaintiff are on their face fraud as they are neither in the name of the real parties of interest nor is the plaintiff proved to be the authorized representative of the original parties to the alleged contract. THIRD NEGATIVE AVERTMENT With all of the recent news headlines regarding court decisions on mortgage fraud and bank foreclosures the most recent of which having came down on January 7 2011 which I provide as proof herein (U.S. Bank N.A. v. Ibanez and Wells Fargo Bank NA v. LaRace et al, Supreme Judicial Court of Massachusetts, No. SIC-10694), Judge Young did not act in the interest of justice in the January 7™ hearing. 4, FOURTH NEGATIVE AVERTMENT. FIRST HORIZON HOME LOANS CORPORATION and it’s agents did not provide full contract disclosure at settlement nor did it provide any valuable consideration (ie. Check or property) for acceptance because the property was paid for at closing in lawfull/ constitutional money of the united States of America, as clearly stated and proved in my Affidavit placed on record with the prothonitary in and for Kent County Superior Court on January 6" 2011. 5, FIFTH NEGATIVE AVERTMENT ‘On July 1* 2010 the plaintiff and judge were tendered a certified registered security as payment to discharge the alleged debt and to date has not returned the tender or answered any of the claims/ counter claim presented in my affidavits as stated in my January 6" affidavit. They have not rebutted 6. SIXTH NEGATIVE AVERTMENT Niether the plaintiff or Judge Robert Young have presented any letters of Marque And Reprisal as proof that they are lawfully chartered to conduct business on indigenous land, 7. SEVENTH NEGATIVE AVERTMENT During the January 7" hearing Judge Young acted not in the interest of justice by refusing to hear my claims but also purgered himself when he stated on the record that the vessel in which the hearing was held was not in “Admiralty” however as I pointed out for the record for his consideration that there was a mutilated flag (A. Altered united States of America Flag with gold fringe around it Title 21 § 306) behind him to his right. 8. EIGTH NEGATIVE AVERTMENT Secured Party/Appelor Has Not Agreed To Contract With Superior Court Or BAC HOME LOANS SERVICING andor Its’ Agents. And Has No Contracts With Either. 9.
