Score Donald Trump 3, Barack Obama 1

by Gerry Nance

On or about March 28, 2011, Donald Trump released a copy of his

own hospital-generated birth certificate to the media today,
listing New York City's Jamaica Hospital as his place of birth on
June 14, 1946.

Later, following complaint from "birthers" as to the inadequacy of

the hospital document, Donald Trump published his long form
birth certificate.

From his bio (http://en.wikipedia.org/wiki/Donald_Trump ):

"Donald Trump is a son of Fred Christ Trump (October 11, 1905 –
June 25, 1999) and wife Mary Anne MacLeod (May 10, 1912,
Stornoway, Scotland – August 7, 2000), who married in 1936 and
had five children."

From the above statement an important point is raised, Donald

Trump's mother Mary Anne MacLeod, was foreign born which
begs the question, when did she naturalize to become a US
Citizen?

In answer to the question a receipt of naturalization was

published, showing Mary Anne MacLeod naturalized on March 10,
1942 (4 years before Donald was born).

Is Donald Trump a natural born citizen?

John Bingham in the Congressional Globe, House of

Representatives, 39th Congress, 1st Session 1866
Who are natural born citizens?
“All persons born within the Republic, OF PARENTS OWING
ALLEGIANCE TO NO OTHER SOVEREIGNTY, ARE NATURAL
BORN CITIZENS.”

“Citizenship is membership in a political society, and

implies a duty of allegiance on the part of the member
and a duty of protection on the part of the society.
These are reciprocal obligations, one being a
compensation for the other. Under our Constitution, a
naturalized citizen stands on an equal footing with the
native citizen in all respects, save that of eligibility to
the Presidency. Minor v. Happersett, 21 Wall. 162, 165,
22 L. ed. 627; Elk v. Wilkins, 112 U.S. 94, 101 , 28 S. L.
ed. 643, 645, 5 Sup. Ct. Rep. 41; Osborn v. Bank of
United States, 9 Wheat. 738, 827, 6 L. ed. 204, 225.
Turning to the naturalization laws preceding the act of
1906, being [231 U.S. 9, 23] those under which Luria
obtained his certificate, we find that they required, first,
that the alien, after coming to this country, should
declare on oath, before a court or its clerk, that it was
bona fide his intention to become a citizen of the United
States, and to renounce forever all allegiance and
fidelity to any foreign sovereignty; second, that at least
two years should elapse between the making of that
declaration and his application for admission to
citizenship; third, that as a condition to his admission
the court should be satisfied, through the testimony of
citizens, that he had resided within the United States
five years at least, and that during that time he had
behaved as a man of good moral character, attached to
the principles of the Constitution of the United States,
and well disposed to the good order and happiness of
the same; and, fourth, that at the time of his admission
he should declare on oath that he would support the
Constitution of the United States, and that he
absolutely and entirely renounced and abjured all
allegiance and fidelity to every foreign sovereignty.
These requirements plainly contemplated that the
applicant, if admitted, should be a citizen in fact as well
as in name,-that he should assume and bear the
obligations and duties of that status as well as enjoy its
rights and privileges. In other words, it was
contemplated that his admission should be mutually
beneficial to the government and himself, the proof in
respect of his established residence, moral character,
and attachment to the principles of the Constitution
being exacted because of what they promised for the
future, rather than for what they told of the past.”

But wait, there's more!!

Barack H Obama has published his COLB, on his website

FighttheSmears.org and FactCheck.org proving he was born in
Honolulu, HI, on August 4, 1961.

On FighttheSmears.org
(http://www.fightthesmears.com/articles/5/birthcertificate.html ):
... "FactCheck.org Clarifies Barack’s Citizenship

“When Barack Obama Jr. was born on Aug. 4, 1961, in Honolulu,

Kenya was a British colony, still part of the United Kingdom’s
dwindling empire. As a Kenyan native, Barack Obama Sr. was a
British subject whose citizenship status was governed by The
British Nationality Act of 1948. That same act governed the status
of Obama Sr.‘s children.

Since Sen. Obama has neither renounced his U.S. citizenship nor
sworn an oath of allegiance to Kenya, his Kenyan citizenship
automatically expired on Aug. 4,1982.” ...

Statements from Obama's own websites raises the following

points:

If Barack H Obama II, was born with dual-citizenship, then he

never was a natural born citizen, so that if after his birth Kenya
won independence, and his Kenyan citizenship automatically
expired on August 4,1982, then he could not be converted into a
natural born citizen.

You simply cannot reverse the circumstances of a birth, unless

you can travel back in time.

Since Barack H Obama II was born with the options under dual-
citizenship owing foreign allegiance, therefore he is not a natural
born citizen.

If Barack H Obama II was born in the USA to a US citizen mother

and a US citizen father, then he would be a US Natural Born
Citizen, therefore his citizenship would not be affected by the
British Nationality Act of 1948 or the 1963 Kenyan Constitution.

Barack H Obama II was born in the USA to a US citizen mother

and a British citizen so at birth he was a Native Born US/British
Dual Citizen, his citizenship was affected by the British Nationality
Act of 1948 and later by the 1963 Kenyan Constitution, therefore
he is a US Citizen, but not a US Natural Born Citizen.

Open Challenge to Barack Obama:

So, now here is a challenge to Barack H Obama II. Produce
documentation proving your father Barack Obama Sr. became a
naturalized US Citizen before August 4, 1961, and publish it not
later than December 31, 2011.
