IMPLEMENTING RULES AND REGULATIONS OF ORDINANCE NO.

2010-005
ESTABLISHING SCHOLARSHIP FUND FOR POOR BUT DESERVING STUDENTS IN
SCHOOLS LOCATED WITHIN THE JURISDICTION OF GUBAT, SORSOGON RESIDING
WITHIN THE MUNICIPALITY OF GUBAT

RULE 1 - GENERAL PROVISIONS

Section 1. Scope and Application

1.1. These Implementing Rules and Regulations (IRR) shall govern and apply to the
implementation of the Scholarship Program under Ordinance No. 2010-05
enacted and approved by the Sanggunian Bayan on its 11th Regular Session for the
year 2010. These IRR shall set the general requirements, guidelines and policies
for the implementation of the subject ordinance which includes the (a) criteria for
application, selection and approval of applicants, (b) the basis of the yearly
appropriations, and (c) the adoption of general set of rules and procedures for the
effective and efficient implementation thereof.

Section 2. Statement of Policy

The provisions of this IRR are hereby adopted to strictly conform to the
legislative intent of the ordinance that the Scholarship Program shall be available
only to poor but deserving students at the tertiary level of the Bicol University,
Gubat Campus, who are permanently residing in the municipality of Gubat,
Sorsogon. It is further a declared policy hereof that the implementation of any
part and/or portion of these provisions shall be liberally construed to carry out
the general objectives of establishing the scholarship program to poor but
deserving students in acquiring accessible, quality, adequate education in tertiary
level who are permanently residing to this municipality .

Section 3. Definition of Terms

To aid in the interpretation of this IRR, the following terms are hereby
defined:

Scholarship – an endowment or allowance to be granted to student


scholars of this municipality;

Endowment/Allowance – the amount of money given to a particular


scholar under the program as may be determined by the Scholarship Committee;

Scholar – refers to the student accepted to avail the scholarship program


under this ordinance who may be qualified based on the guidelines formulated by
the Scholarship Committee.

School – in this Ordinance and IRR, shall refer to the Bicol University, Gubat
Campus;

Poor Students – those students who belong to the low income families, the
income bracket must not to exceed SIX THOUSAND PESOS (P6,000.00) monthly. A
certification from their respective barangay captain and the BIR is required to
prove that the parents are earning within the bracket of P6,000.00;

Deserving Students – those students from the poor families who are
determined to finish their studies at tertiary level and who are qualified and who
complied with all the requirements set forth under this IRR;

Residing Permanently – those students who dwell permanently and for a


long time or continuously occupy a place within the municipality as one’s legal
domicile;

IRR – shall stand for this Implementing Rules and Regulations;

Committee – shall refer to the Scholarship Committee created under the


Ordinance.

Ordinance – shall refer to this Ordinance No. 2010-05 Establishing


Scholarship Fund For Poor But Deserving Students in Schools Located Within The
Jurisdiction of Gubat, Sorsogon Residing Within the Municipality of Gubat.

TITLE II – CREATION, COMPOSITION , FUNCTIONS


AND POWERS OF SCHOLARSHIP COMMITEE

Section 4. Creation of Scholarship Committee. A Scholarship Committee shall be


created for the effective implementation of these IRR and to carry out its
mandated duties and functions consistent with the legislative intent embodied in
the Ordinance.

Section 5. Composition of Scholarship Committee. The Scholarship Committee


shall be composed of the following:

5.1. The Municipal Mayor - Chairman


5.2. The Vice Mayor - Vice Chairman
5.3. The Chairman and Members of the Committee on Education
and Culture of the Sanggunian Bayan shall serve as members of the
Committee.

Section 6. Term of Office. The chairman, vice chairman and members of the
Scholarship Committee shall hold office only for the duration of the terms of the
office to which they were elected.

Section 7. Meetings and Quorum. The Scholarship Committee whenever it
deemed necessary shall convene for purposes of carrying out their duties and
functions mandated under these IRR. The majority of members present during the
meeting shall constitute its quorum. The order and decision of the Committee
relating to the determination, selection, eligibility and acceptance of the
applicants in accordance with this existing rules and regulations shall be final and
executory.

Section 8. Functions and Powers of Scholarship Committee. The Committee shall


have the following functions and powers:

1. Set the criteria and requirements for the application to the scholarship
program;

2. Determine the eligibility and fitness of every applicant for the scholarship
program based on the criteria set by this rules;

3. Review and examine the requirements submitted by the applicants if the


same is in conformity with the requirements set by this rules;

4. Approve application and determine the number of scholars and/or


recipient of the program for every calendar year;

5. Issue a Certificate of Eligibility for those who qualified in the scholarship


program;

6. Recommend to the Sanggunian Bayan the release and increase of


appropriation intended for the program;

7. Conduct periodic monitoring and assessment of the status and scholastic


records of the recipient of the program;

8. Coordinate with the concerned officials of the Bicol University relative to


the implementation of the scholarship program; and

9. Perform such other functions pertinent and/or necessary in carrying out


the above functions and objectives of the program.

TITLE II – REQUIREMENTS, CRITERIA FOR THE SELECTION AND


ELIGIBILITY OF THE APPLICANT

Section 9. Requirements. To be eligible for the scholarship, every student


scholarship program must be required to submit the following requirements:

9.1. Duly accomplished Application Form;

9.2. Certificate from their respective Barangay Chairman stating that


applicant is a permanent resident of their barangay and belongs to the indigent
family;

9.3. Applicant’s Report Card in the 4th Year of high school;

9.4. Latest Income Tax Return or Certification from the BIR as to the income
of his/her family;

9.5. Sworn Statement attesting to the fact that applicant is not enjoying any
other scholarship program in private or government entities;

9.6. Passing Rate for College Admission Test at Bicol University, Gubat
Campus; and

Section 10. Criteria for the Selection of the Applicant. No applicant shall qualify
for the scholarship program unless the following criteria for the selection and
eligibility have been satisfactorily met:

10.1. Applicant must be a permanent resident of the Municipality of Gubat;

10.2. He/she must belong to a family whose income does not exceed
P6,000.00 monthly;

10.3. General Weighted Average of at least 85% during the 4th year in high
school (Report Card);

10.4. He/she must be one of the top 30 students as ranked based on


combined BU college admission test score and test score in the examination
conducted by the municipality;

10.5. He/she must have passed the college admission test administered by
the Bicol University, Gubat Campus;

TITLE III – SCHOLARSHIP FUND

Section 11. The following shall be the basis for the yearly appropriations from the
General Fund and its corresponding number of scholars. The budget may be
increased or augmented as may be deemed necessary, subject to an
appropriation ordinance.

Year 1 - 30 scholars at P8,000.00 each (P480,000.00/year)


Year 2 - with additional 30 scholars (P960,000.00 for 1 year)

Year 3 - with additional 30 scholars (P1,440,000.00 for 1 year)
Year 4 - with additional 30 scholars (P1,920,000.00 for 1 year)
Year 5 and onwards (P1,920,000.00 for 1 year)

Section 12. Each qualified applicant shall be entitled to a total allowance in the
amount of EIGHT THOUSAND PESOS (Php 8,000) per semester for the duration of
his/her scholarship program. This amount, to be released in four monthly
tranches of Php 2,000.00 for the months of June, July, August, September for the
1st semester, and the months of November, December, January, and February for
the 2nd semester, is intended to help augment the student’s budget for tuition,
daily miscellaneous expenses, uniform, book allowance and other incidental
expenses.

Section 13. The allowance of every recipient of the program shall be released
through a payroll system attaching therewith their respective college
assessment/enrollment form issued by the Bicol University, Gubat Campus and
the Certificate of Eligibility to the Scholarship Program duly signed by the
Chairman of the Scholarship Committee, as supporting papers thereof, subject to
the usual Accounting and Auditing Procedures.

TITLE IV – DUTIES AND RESPONSIBILITIES OF THE SCHOLAR

Section 14. It shall be the duties and responsibilities of every scholar to:

14.1. Enrol in his respective course of choice with at least the minimum
regular academic load required by the course /college for every semester;

14.2. Maintain his status as recipient of the program by obtaining a general


weighted average not falling below 2.0 per semester;

14.3. Pass all the subjects required for the course and/or make sure not to
incur a failing grades;

14.4. Submit his respective enrollment and assessment form for every start
of school semester for purposes of the release of the allowance;

14.5. Submit at the end of every school semester the certificate of grades
duly signed by the University Registrar;

14.6. Attend all seminars and meetings duly called by the scholarship
committee;

14.7. Report to the scholarship committee any incidents affecting his


studies such as health problem, transfer of residence, availment of other

scholarship program and/or grant and any other occurrences which may tend to
affect or hamper the continuance of the scholarship grant;

14.8. Report to the scholarship committee any plan and change to present
curriculum and courses;

14.9. Coordinate regularly with the scholarship committee for updates and
information relevant to the new policies and conduct of the scholarship program;
and

14.10. Perform any other duties and responsibilities material to the


transparency and smooth implementation of the program.

14.11 Render ten days of community service every year either in the
municipality or in the barangay.

Section 15. Discontinuance of the scholarhip

Failure to accomplish any of the duties and responsibilities mentioned in


Article 14 shall constitute a valid ground for the discontinuance of the allowance
and the expulsion of the student from the scholarship program of the
municipality. Any of the following shall also be grounds for discontinuance of the
schoalrship grant:

15.1 Shifting to another degree program or dropping of any subject;


15.2 Extension of the period for the completion of the course beyond that
which is prescribed in the approved curriculum of the school;
15.3 Falsification of records;
15.4 Gross violation of Bicol University’s policies; and
15.5 Conduct unbecoming a responsible student.

Section 16. Amendment

These Implementing Rules and Regulations (IRR) may be amended by the


Scholarship Committee as the need arises subject to the ratification and approval
of the Sanggunian Bayan.

Section 16. Separability

If any provision in these IRR, or application of such provision to any


circumstance, is held invalid, the remainder of these IRR shall not be affected
thereby.

Section 17. Effectivity

These IRR shall take effect after its ratification and approval of the
Sangguniang Bayan.
