Analysis of ex-Gen. U Thein Sein's government
and
Report to the people

Regarding the post-2010 election government led by ex-Gen. U Thein Sein assuming the
Presidency, there should be a correct assessment of its character. In order to assess it, we believe that
only by looking back at its origin could we get a realistic view on the current government and the
political system being pursued in Burma.
In 1988, a mass uprising demanding abolishment of one-party military dictatorship and
establishment of a multi-party democracy occurred. As a consequence, the National League for
Democracy won the election in 1990 in a landslide victory.
The current government of ex-Gen. President U Thein Sein is none other than the one that arises out of
a plot by the SLORC-SPDC military regime which has defaced the 1988 popular uprising by various
means and has tried to prevent handover of state power to the 1990 election-winning NLD party for
more than twenty years.
Moreover, the whole world has seen SPDC military regime's publication of a seven-point road
map on 2003 August 30 to systematically implement the process of post-2010 government formation.
Regarding the matter, we have issued a position paper marked 1/2010 and named "Analysis of
fraudulent election held to transform into a military regime in mufti" on 2010 December 7. In the
paper we have portrayed SPDC regime's road map process as "Military regime's Machiavellian
efforts to bring about a constitution concealing long-term military dictatorship and creating a
nominal multi-party elective parliament."
The 2008 Constitution is the foundation of post-2010 government. Hence, we have issued a
"Joint statement denouncing the SPDC militarist constitution and not recognizing it as the State

Constitution" on 2008 June 4 after the forced adoption of 2008 Constitution by the SPDC military
regime. In that statement we have outlined our main reasons for not recognizing that constitution:

(1) Elected people's representatives from 1990 election were not allowed to participate in
constitution drafting process; freedom of people's participation was prohibited by Order 5/96;
ethnic ceasefire groups' views were ignored;
(2) No democratic and fundamental human rights as well as ethnic rights are provided in the
Constitution;
(3) Approval of constitution was carried out unilaterally through coercion, pressures and
deceptions amidst Cyclone Nargis' heavy toll on the people;
(4) Thus the 2008 Constitution is a military hegemony constitution designed to nurture a military
ruling elite that would perpetuate their power and wealth;
(5) Hence we do not recognize nor accept the 2008 Constitution as a State Constitution, and would
strive persistently for emergence of a State Constitution reflecting people's interests and a
government representing the people, in collusion with the people and seeking and
implementing various means suited to the situation and time;
We have already publicized these points through our statement to the people.
When the post-2010 government led by President U Thein Sein the ex-General arose, it is found
that junta's top brass have entrenched themselves in the State's crucial legislative, executive and
judicial branches in the form of uniformed military officers, civilian-veiled army officers or as members
of USDP sponsored by the military.
In the legislative branch, posts of speaker and deputy speaker of Union Assembly are taken up
by U Khin Aung Myint (ex-Maj.-Gen.) for the first thirty months and Thura U Shwe Mann (ex-Gen.) for
the second thirty months, posts of Speaker of People's Assembly and National Assembly are taken
respectively by Thura U Shwe Mann (ex-Gen.) and U Khin Aung Myint (ex-Maj.-Gen.) with U Nanda
Kyawswa (USDP member) and U Mya Nyein (USDP member) respectively taking the posts of Deputy
Speaker of People's Assembly and National Assembly.
In the executive branch, twenty-six out of a total of thirty-five minister posts are assumed by
military officers with USDP members filling up the rest.

With regard to the judicial branch, a Union Supreme Court has been set up. However the 2008
Constitution stipulates no freedom of judiciary.
According to Article 294 of the Constitution, the highest court in Burma is the Union Supreme
Court but Articles 299, 311, 327, 302 and 344 provide right of arbitrary sacking of judges by the
government in addition to Court's obligation to comply to government's order. Chapter 6 Articles 293
and 319 grant independent jurisdiction to military courts while Articles 294 and 343 prohibit civilian
courts under the Union Supreme Court from trying cases arising between soldiers and civilians.
Apart from above sectors, Article 201 of the 2008 Constitution has set up a National Defense
and Security Council as the highest organ of power for nation's administrative matters as well as States
and Divisions' administrative matters. Almost all its members are army officers while the sole civilian is
a USDP member.

Military officers have also taken up remaining important posts of the country. U Tin Aye (ex-
Gen.) and U Thein Soe (ex-Maj.-Gen.) have assumed the posts of Union Election Commission
Chairmanship and Constitutional Tribunal Chairmanship respectively.
Above facts are evident of post-2010 election government being a continuation of the military
regime under the State Peace and Development Council format to a parliamentary format.
We have issued our position on the 2008 Constitution by proclaiming that it is a constitution of military
junta's domination and that the government emerging from the 2010 election is also a militarist USDP
government that would rule the country through the militarist constitution.
President (Ex-Gen.) U Thein Sein's address to the Union Assembly on March 30 provided USDP
military regime's stand on the militarist constitution as follows:

- We have got the responsibility to respect, observe and protect the Constitution of the Union of
Burma;
- Because of this responsibility, all representatives and I should earnestly believe in, cherish and
defend with our lives the Constitution and the democratic nation built in accordance with the
constitution;
- As the Constitution of the Union of Burma has been endorsed, our cabinet would properly
implement the stipulations of the constitution;
- The Union government would welcome all acts done inside the constitutional framework, and
would reject and rightfully prevent all acts done outside the constitution;
Ex-Gen. President U Thein Sein has thus shown the USDP regime's stand on the militarist
constitution and also asserted, "Chapter 12 of the Constitution has provided the opportunity to
amend the Constitution in accordance with prescribed procedures." The procedures state that
75% of Union Assembly representatives have to agree to amend the constitution. In fact, more than
80% of representatives are military officer and USDP members, giving rise to impossibility of revising
the military dictatorship-bolstering 2008 Constitution inside the parliament.
In reality, even whether to put a motion on agenda in parliament by Mon State Ye Township National
Assembly Representative Naing Banyar Aung Moe alias Dr. Banyar Aung Moe "urging the
government to carry out national reconciliation and internal peace" was defeated sweepingly by
106 ayes, 520 nays and 20 abstaining before getting to the debate phase inside the parliament.
Therefore the current position of the USDP military regime is manifest from such killing of a motion,
making constitution-revision out of question.
Therefore, in order to make a government truly proceeding long the course of democracy
instead of a government representing the military dictatorship, the USDP military regime coming out of
2010 election need to carry out following initial points:

(1) Unconditionally release all political prisoners;


(2) Immediately stop the civil war and conduct internal peace;
(3) Repeal decrees and notifications inhibiting fundamental democratic rights in political,
economic, social and cultural realms throughout the era of SLORC-SPDC;
(4) Allow freedom of association including right to form political parties and freedom of
campaigning for all strata;
(5) Conduct dialogue with all stakeholders to revise the 2008 Constitution.

Refraining from said deeds would amount to continuation of the military dictatorship and
deceiving the country in essence, whatever the government is called or however the parliament is
convened.
Hence we regard the government of ex-Gen. President U Thein Sein as the USDP military regime
which would carry on oppressing the people of all ethnicities, and we proclaim our continued efforts in
the interests of entire people to abolish the military dictatorship and the 2008 Constitution.
In order to promptly succeed in implementing our efforts, we solemnly urge the people to join
us and work in cooperation.
