MEMORANDUM OF UNDERSTANDING BETWEEN


SALEM-KEIZER PUBLIC SCHOOLS, DISTRICT 24J
MARION COUNTY, OREGON
AND
ASSOCIATION of SALEM-KEIZER EDUCATION SUPPORT PROFESSIONALS

In response to the ongoing economic crisis and the District budget shortfall, the parties
above agree to make adjustments to the current collective bargaining agreement.

Holding the following values as important:

1. Cause the least impact to student achievement.


2. Maintain jobs for our district Education Support Professionals as much as
possible.
3. Maintain level of service for students.
4. Least impact possible on retirement and insurance.
5. Honor our relationship by using an interest-based collaborative process.

The reductions are based upon the pro-rata share of the shortfall (based on the payroll
and associated payroll costs) of the Association of Salem-Keizer Education Support
Professionals (ASK ESP) employee group. The parties agree to the following:

Agree to take six days without pay: on September 5, 2011, October 14, 2011,
November 11, 2011, February 13, 2012, April 16, 2012 and May 28, 2012 (Memorial
Day Holiday). ESPs whose duties include providing services to District contracted
schools and/or programs will work their full hours on October 14, 2011 and November
11, 2011, if required. In Lieu of October 14, 2011 and November 11, 2001 they will take
an unpaid day on January 1, 2012, and another day to be determined later by
agreement of the parties. The parties also agree to take a salary reduction of 2.6% of
the 2011-2012 salary schedule. In 2011-12 ASK ESP employees will receive step if
eligible and longevity if eligible. The insurance contribution by the district will remain the
same at $1063.00. PERS pick-up will continue at 6%. Days taken without pay will not
effect bus driver insurance benefit rate calculation.

The Parties agree to reopen discussions about this MOU in the event the District
General Fund Allocation increases above the statewide 5.8 billion dollar assumption on
which the SKSD budget was built or in the event District General Fund Allocation
decreases below the statewide 5.8 billion dollar assumption on which the SKSD budget
was built.

The parties further agree to reopen discussions regarding this MOU in the event of a
change in the May adjustment or State Allocation of the General Fund (i.e. delivering
52% in the first year and 48% in the second year of the biennium) that would
significantly increase/decrease the budget shortfall (meaning the 55 Million dollar gap
that is currently expected in 2011-12).

The parties also agree that the District will make reasonable efforts to avoid contracting
with private bus companies for trips other than during route conflict times, during the life
of this agreement. The District also agrees that it will not use private temporary
services, outside of professional contracting services, but rather will rely on its own
substitute pool for casual employment. Qualified laid off employees will be given
preference for substitute assignments to the degree possible.

The District’s expectation is that the adjustments agreed to by ASK ESP within this
MOU will not exceed the proportionate share as previously defined.

This agreement will be in force from July 1, 2011 until June 30, 2012. If the budget
shortfall continues, the parties agree to meet again and discuss continuing this
agreement or crafting a new agreement.
