17 Pursuant to the local rules of Court for the Federal District Court for the Northern District of
California, Civil Rule 79-5, defendant HARMON, through counsel, respectfully petitions this

Court for an order permitting her to file under seal her Motion to dismiss the indictment
19 against her for prosecutorial misconduct during grand jury proceedings.
20 The defense submits that this document is sealable under the terms of the local rules, along
21 with its exhibits, pursuant to Rule 6(e) of the Federal Rules of Criminal Procedure.
Specifically, Defendant’s motion includes quotes from, citation to, and exhibit of secret Grand
22 Jury transcripts.

I, Victor D. Vertner, do hereby declare:

1. That I am an attorney licensed to practice in the State of California and am admitted to
19 practice before this Court.

2. That I represent the defendant in the above entitled action:

3. The defense believes that it has a legitimate and proper motion under Rule 12(b) of the
22 Federal Rules of Criminal Procedure which requires citation to grand jury records
made secret pursuant to Rule 6(e) of the Federal Rules of Criminal Procedure.

4. I believe the defense request is narrowly tailored to protect the public and the grand jury
24 process.

IT IS HEREBY ORDERED JAMIE HARMON is permitted to file her Motion to dismiss

indictment for prosecutorial misconduct during grand jury proceedings, along with exhibits and a

complete copy of the transcripts as have been provided to the defense, under seal pursuant
