2 TO DEFENDANTS AND THEIR COUNSEL:
3 PLEASE TAKE NOTICE THAT, at 10:00 a.m. on Friday, October 29, 2010, or as soon
4 thereafter as counsel may be heard, in the courtroom of the Honorable Charles Breyer, located at
5 450 Golden Gate Avenue, San Francisco, CA 94102, plaintiff Karen Golinski will move for a
6 preliminary injunction pursuant to Fed. R. Civ. P. 65 and Civil L.R. 65-1.
7 This matter had previously been assigned to the Honorable Saundra Brown Armstrong,
8 was reassigned to Judge Illston on September 20, 2010, and to this Court, Judge Breyer presiding,
9 on September 22, 2010. Plaintiff’s motion for a preliminary injunction was filed on January 26,
10 2010. The motion has been fully briefed since March 19, 2010, and had originally been
11 scheduled to be heard on June 15, 2010. The Court had taken that hearing date off calendar and
12 no hearing has occurred at this point.
13 Plaintiff’s motion is based upon this notice of motion; the notice of motion and motion
14 filed on January 26, 2010 and amended to add defendant John Berry on March 10, 2010; the
15 memorandum of points and authorities filed on January 26, 2010; the accompanying declarations
16 and request for judicial notice filed on that date; plaintiffs’ reply brief and the accompanying
17 request for judicial notice and declaration filed on March 19, 2010; plaintiffs’ supplemental
18 declaration filed on July 9, 2010; plaintiffs’ notices of recent decision filed on July 26, 2010,
19 August 3, 2010, and August 16, 2010; the pleadings and papers on file herein; and such further
20 evidence and arguments as may be presented.
