WARDEN COMMENTARY ON
IMMIGRATION ISSUES

Local Newspaper Bans Political Activist

Today the Arizona Daily Star (reluctantly) published news that the United States
Supreme Court had just upheld Arizona’s Employer’s Sanctions Law, effectively
ending two decades of Arizona and Tucson City “Pro-Raza,” Cheap Mexican
Labor, Open Border Policy.

And it took The Star all of two minutes to continue to engage in the suppression
of the truth, by refusing to publish Warden’s commentary regarding the ruling.

“My comment was #17 in the line,” Warden claims, “but The Star refused to
publish it, because I implicitly held them and the rest of the local media, as well
as the left and right wings, accountable for decades of Open Border Policy.”

And to prove his claim, Warden published the Arizona Star story on Scribd, along
with his censored comment.

“Just click on the following link, Arizona Daily Star Censors Public Commentary,
read the story and my response, and see for yourself,” Warden said.

Warden, often referred to by the local media as “The Notorious Mexican Flag
Burner,” first challenged the Tucson City and Pima County establishment on
April 10, 2006, when he and 15 other activists marched into Tucson’s Armory
Park to confront 15, 000 “Pro-Raza” Open Border Activists, including thousands
of students enrolled in, or recent graduates of, Tucson Unified School District’s
Raza Studies Program.

“The crowd became incensed and rioted when we expressed our opinions, gave
speeches, challenged Open Border Policy, hollered ‘Viva Zapata! Return to
Mexico and finish Zapata’s Revolution,’ and burned two Mexican Flags to protest
Mexico’s expulsion of some two million migrants each year,” Warden says.

“The next day I was interviewed by Jennie Rose of KGUN News. Prior to the
interview Ms. Rose cheerfully said, “My goodness Mr. Warden, you won’t believe
just how many people you’ve got upset. They don’t know what to do with you.”
Later that afternoon, after intense lobbying from Pima County Legal Defender
and proprietress of Derechos Humanos Isabel Garcia, Warden was arrested and
charged with numerous misdemeanors, including Reckless Burning, which is a
subset of Arizona’s Felony Arson Statute.

“When the cops came through my door to arrest me, I remembered Ms. Rose’s
comment, and thought, ‘Well, I guess the City of Tucson has figured out what to
do with me!’”

Subsequently, over the next five years Warden endured the following:

• An unlawful eviction and the confiscation of all his belongings;


• 13 arrests and prosecutions for incidents arising out of his lawful political
conduct;
• A warning from Tucson Municipal Court Judge Eugene Hays he would
face arrest if he returned to address the Tucson City Council;
• The suspension of his First Amendment rights (unlawfully) by order of the
Tucson Municipal Court.

Over the years, Warden fought back by continuing to write articles and send
information to all Arizona Legislators, including trial testimony from numerous
Tucson Police officers, which confirmed Tucson’s “Pro Raza” Open Border Policy,
and the negative impact of TUSD’s Raza Studies program, resulting in what he
claims was a passage of SB 1070 and HB 2281.

Warden, who has already filed a lawsuit to address the unlawful taking of his
belongings, says he’s not done.

“Within the next several months I’ll be back in U.S. District Court seeking
damages and to enjoin the Tucson Police Department from enforcing the
unconstitutional suspension of my rights,” Warden says.

Ultimately, Warden believes the Rule of Law will prevail.

“The Arizona Daily Star will be held accountable for suppressing the truth, and
local government will be held accountable for the promulgation of Open Border
Policy and the use of the police and the courts to silence my right to speak the
truth and expose their unlawful conduct.”
