GENERAL BACKGROUND:
Broad range of legal experience, both civil and criminal. Extensive
trial work. Over 44 jury trials and many more court trials.
Depositions. Motion hearings. Writs. Mediation. Arbitration.
Substantial Civil research, writing and oral argument experience in
private practice in state and Federal, trial and appellate courts.
Board member of significant non-profit groups.
Taught paralegals at Lone Mountain College and Heald College and law
students at Golden Gate College, both in San Francisco. Mentored
interns throughout career. First two paralegals hired at SFDA were
exclusively trained by Hehmeyer.
EMPLOYMENT:
SAN FRANCISCO DISTRICT ATTORNEY'S OFFICE:
Two terms total of 15 years: Law and Motion, writs, search and
seizure, and appeals Assistant District Attorney in 1970's.
Conviction in almost all cases (one acquittal) was best trial record
in office at the time. Was also chosen to write two amicus briefs to
the California Supreme Court for the California District Attorney's
office. a" Worked in the consumer division during each term (total
of over 7 years). Handled extensive civil litigation of section 17200
and 17500 Business and Professions Code (consumer fraud and false
advertising) cases, civil fraud, and some criminal litigation in the
fraud area. Intensive discovery and law and motion practice in all
aspects of civil litigation with emphasis on injunctive practice, and
the enforcement of unfair business practices and false advertising
laws. Prosecuted major unlawful practice of medicine case for state
department of Health Services, and environmental cases for department
of Fish and Game. These cases involved oil spills and unlawful
discharges to the waters of the state.
FARRAND, MALTI, & COOPER
General business litigation. Contract disputes. Non-delivery of
commercial products. Employment litigation (defense). Real estate
disputes. Left to join Bancroft Avery and McAlister.
BANCROFT, AVERY probate fee dispute; litigation regarding conversion
of property from trust; some personal injury defense; negotiation of
termination packages for executives; Representation of creditors in
bankruptcy actions. Left to be come in house counsel for a client.
GARAVENTA ENTERPRISES
Eight months in house at this Contra Costa County Waste Disposal
company attempting to site a landfill for them. This was not
politically successful. During the period successfully settled
numerous lawsuits that had been pending against them (oil leaks and
others) and represented them before the Air Resources Quality Board,
successfully.
Left to form own firm.
HEHMEYER LAW OFFICES:
Founder of law office with up to eight employees, including
attorneys, paralegals, secretaries and clerks. Representation of
defendants in major civil fraud/RICO litigation in Federal District
Court in Law Vegas, Nevada. Prevailed through settlement induced by
motions for summary judgment filed for client. Defended accountant in
complex real estate malpractice litigation. Represented plaintiffs in
two major employment law disputes. Handled one of these cases against
a major corporation which owns and operates hotels, and another
against NASA. Both cases successfully settled in the clients' favor.
Appointed member of the VISA bankruptcy fraud panel of attorneys.
Appointed outside counsel for the Resolution Trust Corporation (RTC)
in numerous lawsuits, including many in bankruptcy court. Closed
practice when RTC ceased operation, as it was anchor client.
