Investigators Statement

Notification:
At 0807 hours I received a telephone call from Ramiro Calderon to inform me that vehicle # 140 was involved
in a traffic collision. I responded and arrived on scene at 0825 hours, this was later determined to be a non
injury collision.

Scene:
This collision occurred within the N/B traffic lanes of Sierra Madre Avenue at the “T“ intersection with Avenida
Vejar. Sierra Madre Avenue at this location is straight, flat and relatively level. The street width is the
equivalent of four traffic lanes; however the traffic lanes are not delineated with any markings. There were no
vision obscurements noted or claimed and the weather was clear, cool and dry at the time of this
investigation.

Parties / vehicles:
D-01 (Sepulveda) was located at the scene standing next to V-02; D-01 was identified by her California Drivers
License, with matching photo and description. D-01 was established as the driver of V-01 based on her
statement of driving. D-01 did not sustain any injuries as a result of this collision.

D-02 (Mariscal) was located at the scene standing next to V-02; D-02 was identified by his California Drivers
License with matching photo and description.D-02 was established as the driver of V-02 based on his
statement of driving.D-02 did not sustain any injuries as a result of this collision.

V-01 (Ford) was located at the scene following the collision.V-01 sustained moderate damage to the right side
as a result of this collision, but not limited to the following: Contact and induced damage to the right front
fender, right front tire and wheel, right side front and rear passenger door, and right side ¼ panel.

V-02 (Toyota) was located at the scene following the collision. V-02 sustained moderate damage to the left
side front end as a result of this collision, including but not limited to the following: Contact and induced
damage to the left side fender, left side marker light, left front tire, left front wheel, components behind the
left side of the front bumper and the front bumper.

Physical Evidence:
The damage to the vehicles previously described.

Statements:
D-01 was contacted at the scene and stated in essence that she was driving V-01 N/B on Sierra Madre Avenue
at a speed of about 25 MPH looking for an address on the same street, as she was approaching the cross
street of Avenida Vejar she noticed a white vehicle facing N/B stopped on the right side of the street, just
before she passed this vehicle (later determined to be V-02) this vehicle made a left turn into the right side of

V-01 causing the previously mentioned damage. D-01 made contact with D-02 and a few moments later a
female adult came out of a residence screaming. This female adult turned out to be the wife of D-02.

D-02 was contacted at the scene and stated in essence that he was driving V-02 N/B on Sierra Madre Avenue
after exiting the driveway of his residence located south of the accident scene. He stated he was attempting to
make a left turn onto Avenida Vejar when all of a sudden he was struck by V-01 on the left side of his vehicle.
He said he did not see V-01 prior to the collision but believed V-01 was going at an unknown high rate of
speed, like 25 to 30 MPH.

Opinion and Conclusions:

Summary:
D-01 was driving V-01 N/B on Sierra Madre Avenue at a approximate speed of 25 MPH approaching the “T”
intersection with Avenida Vejar, at the same time D-02 was driving V-02 N/B on Sierra Madre Avenue Stopped
on the right side of street, as V-01 was approaching V-02, D-02 attempted to make a left turn or a U turn and
at this point both vehicle collided.

This is based on statements and the damage to the involved vehicles.

Opinion:
D-02 caused this collision by traveling at an unsafe speed for approaching traffic and merging into traffic in a
unsafe manner. This is a violation of the California Vehicle Code .This resulted in the left front side of V-02 to
collide into the right side of V-01.

Recommendation:
That D-02 be held responsible for the damage to V-01 because D-02 caused this collision by failing to yield to
approaching traffic and traveling at an unsafe speed for approaching traffic, which is a violation of the
California Vehicle Code
