Intellectual Property Law in a European and International Perspective, autumn 2002 Please answer all four questions. 1.

In basic terms, define and discuss the traditional "agenda" (aims, rationale etc) of copyright law. 2. Using concrete examples, describe how developments in information and communications technology challenge the efficacy of copyright law. 3. With focus on the WIPO Copyright Treaty and Directive 2001/29/EC, discuss how copyright law is attempting to meet the challenges posed by ICT developments. 4. Discuss how the regulatory strategies identified in question 3 are changing the character of copyright law. Please note that each question is weighted equally. E-Commerce Law, spring 2003 BlackJack Limited, a company registered in England, is planning to set up a webshop offering goods and services in particular books, music CDs and software - to Internet clients. The server supporting BlackJack Limited's website shall be located in Liberia in West Africa. Answer all the following questions which carry equal marks. 1. Clients purchasing goods or obtaining services will be required to fill in an order form and agree to BlackJack Limited's standard contractual terms and conditions. Discuss how BlackJack Limited should best set this up, so that these terms are incorporated. Assume that the main target client base will be in European Union countries. Is BlackJack Limited restricted in the type of contractual terms and conditions and/or information it may use in its contract? 2. BlackJack Limited intends to include a clause in the standard contractual terms and conditions whereby any dispute arising therefrom would be submitted to the exclusive jurisdiction of the courts of Liberia, and that the law of Liberia will be the applicable law. Discuss the effect of such a clause on a customer domiciled in Italy who wants to sue for delivery of the wrong kind of software which the customer had downloaded from the website. Explain the obligations that the NRA may impose on undertakings with significant market power. Telecommunication Law 1. What is Significant Market Power (SMP), what is the procedure for establishing SMP and what are the consequences of having SMP under directive 2002/19/EC. How has the concept developed from the old EC regulatory regime to the new regulatory framework? 2. What are universal service obligations (USO), what is the reasoning behind USO and how can USO be financed. Can universal service obligations constitute a threat to competition and how? Please answer both questions.
