Rosario, voluntarily and willfully has full knowledge of her mothers valid contract entered with other parties but she took ownership of the land deliberately and mortgaged it to another. She committed dishonesty, grave misconduct and became notoriously undesirable. 1. For dishonesty, she took possession of the mortgaged property with full knowledge of the prior obligation, though she did not make any redemption and worst she mortgaged it to another person as if she had no knowledge of the fact. 2. For grave misconduct, the act of claiming ownership of the land gave her siblings The idea of not observing other deed of mortgaged executed by her mother to other party, particulary to Mr. Gansan. Which result to legal disputes directed to her aged mother 84 years old to face charges in court for the same cause : unable to harvest coco fruits, her mother was eventually issued a warrant of arrest. And the same public school teacher, did not care despite pleadings to help in the solving the problem, finding solutions for her mothers liberty. She offered no single cent or even word to comfort the embattled mother who did not understand her legal fate orchestrated by this public teacher Eleanor A. Rosario, the mothers only crime she commit is that she still owns the land in document but not in reality. Leaving the fate of her mother to the judge mercy. 3. For notoriously undesirable, she fenced concretely the barangay road or camino vicinal in Purok 2 Demologan, Bacolod Lanao del Norte blocking the passing community in their way to mountain or farm, she even had one house owned by a landless being fenced inside causing it half.. . She threatens anyone to be sued and subjected to ejectment if in conversation she felt bad. And the latest is that she attempt to dishonor a tenant but when ask by the DARAB lawyer to pay for the tenant services she decline. She instigated a series of disputes as record shows can be seen in the Barangay of Demologan and Bacolod Lanao del Norte. This complaint is addressed to your office for as a PUBLIC OF|FICIAL she must set good example to her family, community and the public. In contrast she is the first one to break the rules and abuse the trust and confidence embodied in a public officer. She acted as if she owns the law and it would be unwise and conduct unbecoming for her as a public official- teacher to continue in her profession knowing the unlawfulness and oppressive act in the family, community and in public.
