Dear director Boyle: I, Irandokht Toorzani, who is representing herself in the above matter, am in receipt of thecopyofRespondentsJune24,2011,RequesttoSchoolEthicscommissionforathirtyday extension of time to file their answer or Motion to Dismiss this case. I am respectfully writing this letter to inform you that this request has not been made in a goodfaithandrespectfullyaskyoutodenyRespondentsrequestforanextension.The Respondents intention is just stalling this complaint to give them opportunity to go forward with filing tenure charges against me with the commissioner of education based on the false and falsified information which they have been recording in my personnel file, and on my observation and evaluation reports. Respondent Tomko, Superintendent, has brought tenure charges against me by knowingly relying on the false and falsified statements of facts which he (Superintendent) has made under the oath (which is perjury; all of his claims can be refuted by my direct physical evidences; as

just one example, the charge 22 of TH E SWORN TENURE C HARG E S can be refuted by the attached exhibit) to defraud the commissioner of education. Not to mention that those false and
falsified statements of facts (28 charges) that Respondent Tomko (Superintendent) has made under oath to bring tenure charges against me and has been submitted to the Elmwood Park Board of Education to be discussed in their July 28, 2011, meeting, are the issues that caused me to file a complaint with the US District Court of New Jersey as the last resort on 8/20/2009, and are parts of my Re- amended complaint which was filed on 11/3/2010 (which still is pending in

the appellate court because of fraud upon the court) under:

1. Violations of Title VII based upon race, sex, religion, ethnicity and national origin 2. ViolationsofAmericanswithDisabilitiesActADA 3. Retaliation under Title VII 4. Continuing Discriminatory and Retaliatory Acts, Harassment, and Hostile Work Environment 5. Violation of Section 1983 6. Violation of CEPA, N.J.S.A. 34:19-1 to 34:19-8 7. ConspiracytoDeprivingPersonsofEqualProtectionoftheLaws(42U.S.C.1985) 8. Intentional Misrepresentation 9. Defamation 10. Intentional Infliction of Emotional Distress. EDELSTEIN & CELSO LLC is the same firm that is representing Respondent Tomko and Elmwood Park BOE and helping them to build their case to file the tenure charges against me with the commissioner of Education, therefore they should be fully aware of the issues and it should not be hard for them to provide an answer in the time period determined by the School Ethics Commission if they truly believe that the 28 charges which they have brought against me under the oath are the truth. In addition to all aforementioned, because of a personal issue, I will be away and I will not be available during the month of August to reply to the respondents response. Again, I have gotten a reprimanded letter from you dated October 14 which has been postmarked on October 15, 2008. Although I want to have privacy regarding my medical problem but because you have sent a copy of this letter to all administrators, now even though it is against my will, I have to explain for all of them that at the night of 10/14/08 I was in sever back pain that I could not get sleep at all, so around 4:30 AM I left a message for sub- services (the process that everybody has to do it) and I let them know that I was sick and I was not able to go to school on 10/14/08. In the morning I felt a little better and I fell asleep, when I woke up it was around 8:45 and it was too late to make a phone call to main office (Any time I have been out sick, I have called main office before 7:55 AM and I have let the secretary of main office know). When I came to school on 10/15/08, I gave the above explanation regarding the reason of not calling main office to Mrs. Kaplan and Mrs. Cardone and I am sure that they have reported to you why I have not been able to make a phone call to main office. Regardlessofeverythingthathashappened,Ahumanbeingsmindcouldgivethebenefitof doubt and think that any time she has been out sick she has called us, so something might have happened (you did not know maybe a heart attack) but you did not think like that and your reprimanded letter dated 10/14/08 (same day that I was absent) was ready to be put in my personnel file. You have been monitoring me very closely during last six years (since you have become memorial high school principal). Last year when I was In sever back pain and I left the school early, you accused me of being deceptive and not seeking any medical assistance based on the information that you had gotten from your sources, even though I had sought medical assistant and I had been visited by a neurologist (Even it is not necessary for staff member who is signing out sick to seek medical assistance) and you requested to dock my salary for that part of the day. They did it with the approval of superintendent and they still have that money which is mine.

I am sure if another staff member was in the situation that I was on 10/14/08, you would ask them first for a verbal explanation instead of giving them a reprimanded letter on the same day of absence but as I said I have always been monitored very closely and there has been a high interest in putting reprimanded letters in my personnel file. I have learned my lesson from all the incidents which have happened, that because I am Iranian Muslim, no matter what my conditions are, I cannot sign out early because I am going to be accused of being deceptive and putting the welfare of students in danger and as a result I have to get disciplined by partial-day docking of my salary, I cannot use same material that other teachers use in Math department to improve the quality of teaching and learning (I was teaching 4 sections of algebra 1 last year and I asked Mrs. Jackter for the software that we had in Math department, first she denied that Math department had such a software and when I proved to her that the software existed then she told me she might not have recalled it. Same story the other years and this year [please look at the attachment], I have to beg them to get something to use in school) and lots of other things. Anyway that is the situation which I am in and I have to live with it for now. Attachment:
