Department of Motor Vehicles Since the end of the NYTEST the DMV has been working on regulations that will put a cap to the number of inspection stations in a given area. The DMV regulation regarding the inspection station license cap has been published in the State Register. You can see them by visiting the link below, then from the administrative rules page, click on RULE MAKING ACTIVITIES to view the document. We will be heading up to Albany to speak with the DMV to get more clarification on these regs. Meeting with the Attorney Generals office Last month we informed you of a meeting we had with the Attorney Generals office in New York City. Since then we had a follow up conference call with the White Plains division which then led to another meeting in White Plains with Gary Brown of the Attorney Generals office. Mr. Brown was extremely interested in pursuing this investigation. We gave him all the data we collected which shows that zone pricing is being practiced. He does need more data and we are reaching out to all Mobil Dealers and Shell Dealers to please get us this information. We will not stand for this unfair treatment that the independent dealers are receiving. We are working closely with the AGs office and it is imperative that all the dealers work closely with us. Tobacco Litigation As many of you have known, in 2009 we entered into a lawsuit against the State of New York in which we were defending all places of business who sell tobacco products and were now being subject to pay the license fee based on their gross sales. Since then, while the lawsuit was going on a stay was issued and retail dealers were only to pay the fee of $100.00 per location and vending machine. If the case was lost then the state would have been allowed to collect fees based on gross sales for the last two years. Well goods news, the case was won!!! The annual registration fees are now a flat rate of $300.00 for each retail location and $100.00 for each vending. These fees are retroactive to the 2010 and 2011 calendar years. If you are a dealer that paid a fee based on your gross sales you will be issued a refund for those years. If you paid the $100.00 fee you will be required to pay the difference of $200.00 for each year. The refunds will be generated automatically there is no need for you to fill out an application. If you do not receive your refund by September 1, 2011 contact the NYS Dept of Taxation and Finance at 518-4857652.

JOSEPH ENGELDRUM MEMORIAL SCHOLARSHIP Enclosed in your May billing was the application for the Joseph Engeldrum Memorial Scholarship. Be sure to send in your application as soon as possible. To be entered in the drawing all applications must be received no later than May 31, 2011. Drawing will be held on June 7, 2011. Winner will be notified shortly thereafter. If you need another application please contact the office.
