Ttulo preliminar
1.1 A los efectos de este Reglamento, se denomina: 1.1.1 IRAM. Instituto Argentino de Normalizacin y Certificacin. 1.1.2 Sello IRAM de Conformidad con Norma IRAM (Sello IRAM). Marca registrada por IRAM que se otorga bajo las clusulas del presente Reglamento de Contratacin y Uso, que indica con un nivel suficiente de confianza que un producto, proceso o servicio, debidamente identificado, est en conformidad con una norma IRAM. El sistema de Sello IRAM determina la conformidad con las normas IRAM en base a la evaluacin y aceptacin del sistema de la calidad del Postulante, ensayos iniciales y, una vez otorgado el Sello IRAM, a la auditora peridica de la continuidad del sistema de la calidad, y al control de muestras tomadas en fbrica, en el mercado o en ambos.
Nota: En los casos de sistemas de certificacin conjunta con otras instituciones se podr utilizar una sigla mixta para el Sello.
1.1.3 Norma IRAM. Es la aprobada por IRAM, de acuerdo con el Reglamento para el estudio de normas. Bajo esta denominacin se incluyen tambin las normas con sigla mixta. 1.1.4 Consejo. Consejo Directivo del Instituto Argentino de Normalizacin y Certificacin. 1.1.5 Comit General de Certificacin (CGC).Organismo, independiente y honorario, creado por el Consejo Directivo de IRAM para: a) asegurar la imparcialidad de las actividades de IRAM como organismo de certificacin; b) desarrollar las polticas y principios para establecer los Reglamentos de Certificacin de IRAM; c) supervisar el funcionamiento de los sistemas de certificacin de IRAM; d) otorgar, mantener, renovar, ampliar, reducir, suspender y cancelar Licencias de certificacin y certificados emitidos por IRAM.
Nota: Para facilitar la lectura de este Reglamento se usarn las siglas "CGC".
1.1.6 Licenciatario. Persona fsica o jurdica a la cual IRAM haya concedido la autorizacin para utilizar el Sello IRAM de Conformidad con Norma IRAM. 1.1.7 Postulante. Persona fsica o jurdica que solicite la autorizacin para utilizar el Sello IRAM de Conformidad con Norma IRAM. 1.1.8 Secretara. Funcin tcnica y administrativa ejercida por la Direccin de Certificacin de IRAM. 1.1.9 Servicio de Sello IRAM. Servicio dependiente de la Direccin de Certificacin del IRAM, encargado del trmite para el otorgamiento y dems actividades relacionadas con la certificacin destinada a distinguir a los productos que cumplen con las exigencias del presente Reglamento, as como el seguimiento respectivo, en sus diversas etapas. 1.1.10 Cada vez que en este Reglamento se mencione el trmino "producto" deber entenderse "producto, proceso o servicio".

Introduction
1.1 To the purpose of these Rules the following applies: 1.1.1 IRAM. Instituto Argentino de Normalizacin y Certificacin. 1.1.2 IRAM Mark of Conformity with IRAM Standard (IRAM Mark) Mark registered by IRAM and granted in accordance with the provisions in this Rules for the Contracting and Use which indicates, with a sufficient level of confidence, that a duly identify product, process or service is in conformity with an IRAM Standard. The IRAM Mark System establishes the conformity with IRAM Standard based on the assessment and acceptance of the Applicants Quality System and the initial testing and, once the Mark has been granted, the periodic audit of the quality system continuity and the control of the sampling at the manufacturers facilities, the marketplace, or both.
Note: In the cases of joint certification with another bodies, the Mark may hold a mixed acronym
1.1.3 Norma IRAM. The technical document approved by IRAM in accordance with the Rules for the Development of Standards. This denomination also includes those standards having mixed acronyms. 1.1.4 Council: Council of the Instituto Argentino de Normalizacin y Certificacin. 1.1.5 General Certification Comit (GCC): Independent and honorary body, created by the IRAM Council in order to: a) ensure the impartiality of the activities of IRAM as a certification body; b) develop the polices and principles needed to establish the certification Rules; c) supervise the running of IRAMs Certification Systems; d) grant, maintain, renew, extend, reduce suspend and cancel certification licenses and certificates issued by IRAM.
Note: In order to facilitate the reading of this document, the abbreviation GCC has been used.
1.1.6 Mark holder. The individual or legal entity authorized by IRAM to use the IRAM Mark of Conformity with IRAM Standard. 1.1.7 Applicant. The individual or legal entity applying for the authorization to use the IRAM Mark of Conformity with IRAM Standard. 1.1.8 Secretariat. The technical and administrative role developed by the Certification Management of IRAM. 1.1.9 IRAM Mark Service. Service dependent on IRAM, in charge of the processes for the granting of the mark and other activities concerning the identification of the products meeting the requirements of these Rules, as well as the relevant surveillance at its different stages. 1.1.10 Whenever the term product appears in these Rules, it shall be understood as product, process and service.

Alcance
2.1 Este Reglamento tiene por objeto establecer las condiciones que rigen para el otorgamiento y el uso del Sello IRAM. 2.2 La Licencia que se otorgue para el uso del Sello IRAM resultar, en cada caso, un elemento contractual de carcter especialsimo, que obliga al Licenciatario a aplicarlo de buena fe y a poner de su parte el mximo empeo para corresponder al prestigio que significa su uso. 2.3 El Licenciatario es el nico responsable frente a terceros de cualquier dao o perjuicio que pudiere derivarse por la utilizacin o consumo de los productos, procesos o servicios con Sello IRAM. 2.4 Haciendo uso de la autonoma de la voluntad conflictual, las partes acuerdan que el derecho aplicable al presente contrato (validez intrnseca, extrnseca o formal y obligaciones de las partes) es el Derecho Privado Argentino. 2.5 El Licenciatario e IRAM convienen que slo tendrn jurisdiccin internacional directa para entender en cualquier diferendo derivado del presente contrato, nica y exclusivamente, los tribunales ordinarios de la Ciudad Autnoma de Buenos Aires - Repblica Argentina.
Generalidades
3.1 El Sello IRAM es marca registrada de IRAM, la cual se encuentra vigente conforme a las disposiciones legales establecidas por la ley de marcas 22.362. La marca registrada otorga a IRAM una propiedad exclusiva de uso. El Licenciatario reconoce el derecho de propiedad de IRAM sobre el Sello IRAM y se compromete a no adoptar ninguna medida o realizar cualquier acto que ponga en peligro o cuestione la titularidad del Sello IRAM o dae su imagen. 3.2 El Sello IRAM se aplicar a los productos que cumplan con todas las prescripciones de las normas IRAM pertinentes y se otorgar bajo las condiciones que establece el presente Reglamento y las que consten en la Licencia para el uso del Sello IRAM. 3.3 La representacin material del Sello IRAM es un signo distintivo constituido por un sello o rtulo como el indicado en la figura, que se aplica, adhiere o incorpora a la unidad, conjunto de unidades, envases, etc., que corresponde distinguir, de acuerdo con las disposiciones del CGC. Pueden existir otros diseos cuando se trate de Sellos otorgados bajo sistemas de certificacin conjunta con otras instituciones. En todos los casos, el nmero de la norma IRAM deber figurar en la etiqueta u otra forma de identificacin que lleve el producto. IRAM puede requerir la incorporacin de una seal adicional o complementaria, tal como hilo, cuo, etc. 3.4 El servicio de Sello IRAM es exclusivo de IRAM, es inalienable y slo puede prescribir por disposicin de sus autoridades estatutarias. El ttulo de marca de Sello IRAM, se encuentra debidamente registrado por ante la Direccin Nacional de Marcas, dependiente del Instituto Nacional de Propiedad Industrial (INPI).

3.5 Por excepcin, cuando el CGC lo considere necesario, se deber indicar en el logo, adems, el nmero de la norma IRAM correspondiente y las dos ltimas cifras que indican el ao de su aprobacin.

Scope
2.1 The objective of these Rules is to establish the conditions for the granting and use of the IRAM Mark. 2.2 The license granted for the use of the IRAM Mark shall be, in each case, a contractual element of a very special nature, by which the Mark-holder is obliged to apply it by acting in good faith and making his best efforts to be equal to the prestige the use of the Mark implies. 2.3 The Mark-holder is the only accountable to third parties for any damage that should arise from the use or consumption of the products, processes or services bearing IRAM Mark. 2.4 Making use of the contractual freedom principle and in case of disputes, both parties agree that this Agreement (both intrinsic and extrinsic or formal effectiveness and the duties of the parties) shall be construed and enforced in accordance with, and governed by, the Argentine Private Law. 2.5 The Mark-holder and IRAM agree that the only entity having direct international jurisdiction to intervene in any dispute arising from this contract are uniquely and exclusively the ordinary courts in Buenos Aires City, Argentina.
General
3.1. IRAM Mark of Management System Certification is a registered trademark of IRAM which is in full force according to all legal provisions stated in the Trade Mark Registration Act (22362). The trademark grants IRAM an exclusive right of use. The Licensee acknowledges that IRAM has a proprietary right as a trademark holder and commits himself not to take any measure or perform any act that may affect IRAMs rights. Likewise Licensee shall not raise questions of ownership of IRAM Mark of Management System Certification or attack in any way the good character of the trademark 3.2 The IRAM Mark shall be applied to those products meeting all of the provisions established in the relevant IRAM Standards and shall be granted under the conditions set by this Rules and by the License for the use of the IRAM Mark. 3.3 The material representation of the IRAM Mark is a distinctive sign conformed by a stamp or label as those shown in the figure, which is applied, stuck or incorporated to the units, unit sets, packages, etc, which are to be distinguished, according to the provisions of the GCC. Other designs are allowed in the case of Marks granted under joint certification systems with other organizations. In all of the cases, the number of the IRAM Standard shall be indicated in the label or another identification system on the product. IRAM may require the incorporation of an additional or complementary signal, such as a water-mark, a stamp, etc. 3.4 The service provided by IRAM for the granting of the IRAM Mark is exclusive to IRAM, inalienable and can be prescribed only by decision of the statutory authorities. The IRAM Mark is duly registered at the Direccin Nacional de Marcas), dependant of the INPI Instituto Nacional de Propiedad Industrial.

3.5 Exceptionally, in case the GCC deems it necessary, the logo shall include, in addition, the number of the relevant IRAM Standard and the last two numbers of the year of the standards approval.

Condiciones exigidas a los productos

4.1 El Sello IRAM se otorgar nicamente a los productos que cumplan con todas las prescripciones de la norma IRAM correspondiente en vigencia, que establezca todas las condiciones y requisitos que debe cumplir el producto para ser apto para el uso al que est destinado. 4.2 Cuando el CGC considere que la norma IRAM en vigencia no responde a los requisitos tecnolgicos del momento, por ser una norma no actualizada, solicitar la revisin de la norma. En tales casos el otorgamiento del Sello IRAM quedar a criterio del CGC. 4.3 De considerarlo necesario por razones de excepcin fundamentadas, el CGC podr aprobar el agregado o modificacin de requisitos especficos, informando a la Direccin de Normalizacin con la debida fundamentacin.
Condiciones a cumplir por el POSTULANTE

5.1 Todo Postulante que solicite el Sello IRAM debe ser propietario de la marca para la que solicita el servicio. Adems debe estar legalmente autorizado para comercializar y/o producir, segn los casos. 5.2 Todo Postulante demostrar, a juicio de IRAM, que en la elaboracin del producto se dispone de medios de fabricacin y un sistema de la calidad (ver prrafo 8.1 inciso ) que le permiten asegurar que los productos de su fabricacin o comercializacin estn elaborados cumpliendo la norma IRAM aplicable de acuerdo con mtodos y controles que garantizan la constancia de la calidad de tales productos y su concordancia con las muestras sobre las que se realizaran los ensayos para la aprobacin. 5.3 Todo Postulante debe asegurar a IRAM el acceso a sus fbricas y laboratorios para todas las verificaciones que juzgue necesarias y, en caso de que haga fabricar total o parcialmente el o los productos para los que solicita el Sello IRAM fuera de sus propias fbricas, deber informarlo a IRAM, y la inspeccin se extender a todas las fbricas y laboratorios que corresponda. Estos ltimos sern considerados como una extensin de los del Postulante, quien es el nico responsable de las clusulas de este Reglamento que le son aplicables. 5.4 En caso de que el Postulante hubiera sido Licenciatario de un Sello IRAM u otro servicio de certificacin de IRAM cancelado por incumplimientos de tipo tico o tcnico, el CGC tomar en consideracin los antecedentes que dieron lugar a dicha cancelacin para disponer la iniciacin o no del trmite de la nueva solicitud. 5.5 Igual procedimiento al indicado en el prrafo 5.4, regir cuando hubiera renunciado a un Sello IRAM. 5.6 El Postulante se compromete a no difundir, ni dejar trascender documentacin alguna relacionada con los trmites, sin expreso consentimiento de IRAM. El no cumplir con lo indicado ser causal para la no continuidad de los trmites por el tiempo que determine el CGC. 5.7 Aranceles. El Postulante deber abonar los aranceles iniciales en el plazo fijado por la Secretara (ver prrafo 7.4 inciso j)).

Conditions to be fulfilled by the products

4.1 The IRAM Mark shall be granted only to those products meeting all of the requirements in the relevant Standard currently in force that sets down all the conditions and requirements the product must fulfill to qualify for its intended use. 4.2 When the GCC considers that the applicable IRAM Standard does not address the technological requirements of the moment, it shall request the revision of the standard, as it is a non updated standard. In such cases, the granting of the IRAM Mark shall be left to the GCCs discretion. 4.3 If deemed necessary due to exceptional well based reasons, the GCC may approve the addition or modification of specify requirements, notifying such decision with duly foundation to the Standardization Management. De considerarlo necesario por razones de excepcin fundamentadas, el CGC podr aprobar el agregado o modificacin de requisitos especficos, informando a la Direccin de Normalizacin con la debida fundamentacin.
Conditions to be fulfilled by the APPLICANT

5.1 The Applicant requesting the IRAM Mark shall be the owner of the trademark for which the service is requested and shall be, in addition, legally authorized to trade or produce his products. 5.2 The Applicant shall demonstrate, at IRAMs discretion, that the manufacturer has manufacturing and control means and a quality system (see 8.1 )) to ensure that the products manufactured or traded are produced complying with the relevant IRAM Standard, in accordance with methods and control systems that guarantee the constant quality of such products and their concordance with the samples on which the tests for approval were performed. 5.3 The Applicant shall guarantee IRAM the free access to his installations and laboratories for all the verifications deemed necessary by IRAM and, in case the products for which the IRAM Mark is requested are totally or partially manufactured outside the Applicants installations, the Applicant shall inform IRAM so that the inspection is extended to all the factories and laboratories concerned. The latter shall be considered as being an extension of the installations of the Applicant, who shall be solely responsible for the compliance of the applicable provisions in these Rules. 5.4 In case the Applicant were the License holder of an IRAM Mark or other certification service provided by IRAM that was cancelled due to non compliance of ethical or technical nature, the GCC shall take into account the precedents for such cancellation in order to authorize or not the initiation of the new application process. . 5.5 A procedure similar to that indicated in 5.4 shall be applied when the Applicant would have resigned an IRAM Mark. 5.6 The Applicant shall not spread or make known to third parties any documentation related with the process for the granting of the Mark without IRAMs authorization. Failure to comply with this condition shall lead to the cancellation of the process for the period determined by the GCC. 5.7 Fees. The Applicant shall pay the initial fees within the period set out by the Secretariat (see 7.4 j)).

Condiciones de los ensayos para el otorgamiento y seguimiento del Sello IRAM

6.1 Los ensayos correspondientes al otorgamiento y seguimiento del Sello IRAM, sern efectuados o supervisados por IRAM, de acuerdo con las normas IRAM pertinentes, a decisin de IRAM: a) en los propios laboratorios del Postulante o Licenciatario; b) en los laboratorios que IRAM designe para cada caso; c) en ambos. En cualquiera de los tres casos los ensayos se realizarn sobre muestras extradas por IRAM. 6.2 En caso de que el Postulante o el Licenciatario haga fabricar total o parcialmente el o los productos para los que solicita el Sello IRAM, fuera de sus propias fbricas, la inspeccin se extender a todas las fbricas y laboratorios que corresponda. 6.3 Si la norma particular del producto especifica ensayos de tipo o de calificacin del diseo, pero no la validez en el tiempo ni la periodicidad con que deben repetirse, los ensayos de tipo no tendrn vencimiento. Para que ello sea vlido, los productos comercializados deben coincidir en un todo con el tipo ensayado. Al respecto el fabricante, independientemente de la muestra que pueda tener el laboratorio que ensay el tipo aprobado, deber disponer de una muestra de referencia con la cual IRAM pueda comparar un producto, en fabricacin o proveniente del mercado, con el tipo aprobado. El fabricante o el representante deber informar sobre cualquier cambio que se realice sobre el tipo aprobado, debiendo convalidar la validez de los ensayos de tipo realizados sobre el producto modificado en el laboratorio que realizara los ensayos o el que IRAM decida, asegurando as que los cambios no alteran el comportamiento del producto original, cumpliendo con todos los requisitos establecidos en la respectiva norma. Los cambios no informados o no debidamente ensayados, verificados por IRAM, sern causa para la suspensin o cancelacin del Sello IRAM, siguiendo los procedimientos establecidos al respecto en este Reglamento. Independientemente IRAM, a su criterio, podr hacer repetir los ensayos de tipo, total o parcialmente, cuando lo considere conveniente. El CGC podr solicitar a la Direccin de Normalizacin que se especifique la validez en el tiempo o periodicidad de repeticin de los ensayos de tipo, para un producto dado.

Testing conditions for the granting and surveillance of the IRAM Mark
6.1 The testing for the granting and surveillance of the IRAM Mark shall be performed and verified by IRAM, in accordance with the applicable IRAM Standards, at: a) the Applicants or Mark-holders own laboratories; b) the laboratories designated by IRAM for each case or; c) both. In any of the above cases, testing shall be performed on samples obtained by IRAM. 6.2 In case the Applicant or the Mark-holder has totally or partially subcontracted the manufacture of the products for which the IRAM Mark is being requested, the inspection shall be extended to all the factories and laboratories involved. 6.3 If the standard applicable to the product specifies type or design qualification tests, but not their validity period or the frequency at which they must be repeated, type tests shall not have an expiration date. For this to be valid, the commercialized products shall coincide by completely with the type tested. In this regard and independently of the samples the laboratory that tested the approved type may have, the manufacturer shall have a reference sample with which IRAM can compare the product, whether obtained from the manufacturers or from the market, with the type approved. The manufacturer or his representative, shall inform IRAM about any change in the approved type and validate the type tests on the modified product at the same laboratory that performed tests or the laboratory assigned by IRAM, thus ensuring that the changes do not alter the performance of the original product and meet all the requirements established by the relevant standard. Unreported or improperly tested changes verified by IRAM shall lead the suspension or the cancellation of the IRAM Mark, in accordance with the procedures established by these Rules in this regard. Independently and at IRAMs discretion it is deemed advisable, IRAM may request the total or partial repletion of the type tests. The GCC may request IRAM Standardization Management to specify the validly in time or the frequency of the type test repetition for a given product.

Organizacin del servicio

7.1 El Servicio de Sello IRAM estar regido por: a) el Comit General de Certificacin (CGC), cuyo Reglamento de Organizacin y Funcionamiento (DC/PA 006) fue aprobado por el Consejo Directivo de IRAM; b) la Secretara. 7.2 Sern funciones del CGC: a) considerar si la documentacin presentada por el Postulante satisface las exigencias del presente Reglamento y las condiciones adicionales que el CGC fije para cada producto o grupo de productos; b) designar, cuando as lo resuelva, una comisin para realizar la visita de evaluacin segn 8.5; c) considerar los informes de la Secretara; d) otorgar el uso del Sello IRAM al Postulante y mantenerlo, renovarlo, ampliarlo, reducirlo, suspenderlo o cancelarlo al Licenciatario; e) estudiar los reclamos que se produzcan por el uso indebido del Sello IRAM; f) considerar los antecedentes e informe de la Secretara en cada caso en que se presuma una transgresin a las disposiciones del presente Reglamento, por parte del Licenciatario; g) adoptar, cuando lo considere adecuado, la sancin de apercibimiento. Refrendar o anular dicha sancin cuando haya sido aplicada por la Secretara; h) adoptar, cuando lo considere necesario, la sancin de suspensin del Sello IRAM. Refrendar o anular la sancin de suspensin cuando haya sido aplicada por la Secretara con carcter preventivo; i) aplicar la sancin de cancelacin del Sello IRAM, cuando se comprueben transgresiones a las disposiciones del presente Reglamento; j) proponer a la Secretara la iniciacin de acciones legales contra el Licenciatario, cuando el carcter de la transgresin as lo justifique; k) proponer a la Secretara la denuncia de la transgresin ante el organismo oficial competente, cuando el CGC lo considere necesario; l) atender los reclamos, apelaciones y denuncias presentados por los Licenciatarios, Postulantes u otras partes. 7.3 Secretara. La Secretara estar bajo la dependencia directa del Director de Certificacin y estar integrada por el personal tcnico y administrativo que IRAM designe. 7.4 Sern funciones de la Secretara: a) citar y asistir al CGC; b) estudiar la documentacin entregada por el Postulante, realizar la visita previa y presentar el informe, junto con su opinin, al CGC; c) realizar la visita de evaluacin, con la comisin del CGC designada segn el prrafo 7.2 inciso b); d) realizar las inspecciones a las fbricas y laboratorios del Postulante;

7.1 IRAM Marks Service shall be ruled by: a) The General Certification Comit (CGC), whose Rules for Organization and Operation (DC/PA 006) was approved by IRAMs Council; b) the Secretariat. 7.2 The GCC shall : a) verify that the documentation submitted by the Applicant meets the requirements of this Rules and the additional conditions set out by the GCC for every product or group of products; b) designate, as necessary, a commission to carry out the assessment visit as per 8.5; c) consider the reports from the Secretariat; d) grant the Applicant the use of the IRAM Mark, and maintain, renew, enhance, reduce, suspend or cancel it, as appropriate to the Mark-holder; e) analyze the claims arising from the improper use of the IRAM Mark; f) consider the background documents and reports from the Secretariat for each case in which the provisions in this Rules are presumed to have been transgressed by the Mark-holder; g) adopt, when deemed necessary, the admonitory sanction. This sanction shall be endorsed or cancelled when it has been imposed by the Secretariat; h) adopt, when deemed necessary, the sanction for the suspension of the IRAM Mark. This sanction shall be endorsed or cancelled when it has been applied by the Secretariat on a preventive basis; i) impose the sanction for the cancellation of the IRAM Mark, when transgressions to the dispositions in this Rules have been proved. j) propose to the Secretariat the prosecution of legal actions against the Mark-holder where it is justified by the nature of the transgressions: k) to propose to the Secretariat report the transgression to the relevant official body, when the GCC deems it necessary; l) to consider the claims, appeals and reports submitted by Mark-holders, Applicants or other parties. 7.3 Secretariat. The Secretariat shall report directly to the Certification Manager and shall be integrated by the technical and administrative personnel designated by IRAM. 7.4 The Secretariat shall: a) summon and assist the GCC; b) analyze the documentation furnished by the Applicant, perform the assessment visit and submit a report together with its opinion, to the GCC; c) carry out the assessment visit, with the GCC commissions, designated as indicated in 7.2 b); d) carry out the inspections to the Applicants plants and laboratories;

e) evaluar los laboratorios de ensayo del Postulante y de los particulares u oficiales designados para cada caso; f) evaluar los medios de fabricacin y el sistema de la calidad de los que dispone el Postulante para determinar si satisfacen las exigencias establecidas en el prrafo 5.2; g) programar las inspecciones que haya que efectuar, previas al otorgamiento del Sello IRAM, y el control peridico una vez otorgado. Realizar las inspecciones; y presenciar los ensayos, cuando corresponda a criterio de IRAM; h) redactar los informes de las inspecciones previas para ser presentados al CGC; i) elevar un resumen mensual al CGC sobre los aspectos de fondo que hagan a la marcha del Sello IRAM y, en particular, las transgresiones que se verifiquen; j) establecer el arancel inicial que deber abonar cada Postulante y los aranceles que deben abonar los Licenciatarios por el uso del Sello IRAM, con la documentacin que lo fundamente; k) informar al Postulante los aranceles iniciales y los posteriores al otorgamiento del Sello IRAM, as como los plazos de pago; l) ejecutar lo resuelto por el CGC; m) adoptar, la sancin de apercibimiento, con la obligacin de informar al CGC en la reunin inmediata siguiente; n) adoptar, con carcter preventivo, la sancin de suspensin cuando se presente la situacin prevista en el prrafo 11.3, con la obligacin de informar al CGC en la reunin inmediata siguiente; ) informar mensualmente al Consejo Directivo, el listado de los Sellos IRAM otorgados y cancelados.

e) evaluate the conditions of the testing laboratories of the Applicant as well as those of the particular or official laboratories designated for each case; f) evaluate the Applicants manufacturing means and quality system and determine if they meet the requirements established in 5.2; g) schedule the inspections to be performed before the granting of the IRAM Mark, and the periodic control after the granting of the IRAM Mark, as well as witness the tests when it is relevant at IRAMs discretion; h) draw up the reports of the previous inspections for their submission to the GCC; i) submit to the GCC a summary on a monthly basis of the fundamental aspects concerning the progress of the IRAM Mark and, in particular, the transgressions verified.
j) establish the initial fees to be paid by the Applicant and tose to be paid by the Mark-holder for the use of the IRAM Mark, with the backing up documentation; k) inform the Applicant the initial fees and the fees to be paid after the granting of the IRAM Mark, as well as the payment terms; l) put into effect the GCCs resolutions; m) adopt, the admonitory sanction, with the obligation of reporting it to the GCC at the next meeting; n) adopt, on a preventive basis, the sanction of temporary suspension in the event of the situation described in 11.3, with the obligation of reporting it to the GCC at the next meeting; o) inform, on a monthly basis, to the IRAM Council the list of the IRAM Marks that have been granted and cancelled.

Trmites para el otorgamiento del Sello IRAM

8.1 Todo Postulante que desee obtener el derecho de utilizar el Sello IRAM para un tipo de producto determinado deber presentar, por escrito, una solicitud a la Secretara adjuntando la siguiente documentacin y/o la indicada en el Reglamento particular vigente: a) nombre del Postulante y domicilio; b) nombre o razn social del Titular de la Licencia (si difiere del Postulante), domicilio, direccin de las oficinas y de la fbrica y de todos los depsitos donde se conservan los materiales o productos para la venta; c) nombre o razn social del Representante/s y/o Importadores designados y sus direcciones en el Pas. Dicho Representante o Importador ser el Responsable Legal por el producto en Argentina; d) tipo o tipos de productos para los que solicita el Sello IRAM, los que debern estar perfectamente identificados por su marca y su referencia de catlogo y cdigo de fabricacin o similar y, en los casos que corresponda, fotografas y planos del producto y sus componentes principales, en formato A-4 u otro normalizado; e) norma o normas IRAM a las que responde el producto para el que solicita el uso del Sello IRAM; f) fotocopia, autenticada por escribano, del ttulo de propiedad del registro de marca del producto para el que solicita el uso del Sello IRAM y/o la autorizacin del propietario de la marca para comercializar o producir, segn el caso. Para empresas del exterior del pas, fotocopia autenticada por los mecanismos consulares vigentes. De no tener el ttulo de propiedad, deber presentar el comprobante de inicio del trmite de marca y una nota eximiendo de responsabilidad a IRAM en caso de oposiciones u otros problemas; g) un ejemplar de este Reglamento debidamente conformado; h) constancia de su inscripcin en el Registro Pblico de Comercio o en el que correspondiere. En caso de que no estuviera inscripto, la constancia de la documentacin en trmite; i) un organigrama y descripcin de funciones de la empresa. El organigrama detallar especialmente todos los aspectos relacionados con el control de la calidad del producto, indicando las funciones y responsabilidades de cada jefatura, as como los nombres y ttulos oficiales reconocidos de sus responsables; j) diagrama de flujo del proceso, indicando los puntos de inspeccin y cules son los criterios utilizados; k) procedimiento de identificacin y trazabilidad del producto/s; l) procedimientos de inspeccin y ensayos; m) listado de instrumentos y equipos, aplicables al producto, para inspeccin, medicin, ensayos y verificacin de que dispone; n) constancia del control y calibracin de los instrumentos y equipos de inspeccin, medicin y ensayo, indicando la trazabilidad de los patrones utilizados, detallando el sistema utilizado para el registro y control peridico previsto de los mismos; ) una descripcin detallada del sistema de la calidad establecido por la empresa, dividido en: I) recepcin de materias primas o de productos semielaborados; II) proceso de fabricacin; III) producto final. De no realizarse algunas de las etapas indicadas (I; II; III), se fundamentarn las razones tcnicas que lo avalen;

Procedures for the granting of the IRAM Mark

8.1 Any Applicant wishing to be granted the right to use the IRAM Mark for a given type of product, shall submit a written application form to the Secretariat, including the following documentation and/or the documentation requested by the particular Rules in force: a) the Applicants name and address; b) the name, or the registered name of the Licence-holder (if other than the Applicant), the address of all his offices, the plant and the warehouses where the materials or products for sale are stored; c) the name, or registered named of his designated Representative(s)/Importer(s) and their addresses in the country. The Representative or Importer shall hold the Legal Liability for the product in Argentina; d) the type(s) of products for which the IRAM Mark is being requested, which shall be clearly identified by their trade mark or catalogue reference and manufacturing code or equivalent and, where applicable, photographs or blueprints of the products and their main components, in A-4 or any other standard format. e) the IRAM Standard (s) applicable to the product for which the IRAM Mark is requested; f) a copy, attested by a notary public, of the title to the property of the trade mark of the product for which the IRAM Mark is being requested and the authorization of the trade mark owner for the commercialization or the production of the product. Foreign companies shall submit a copy authenticated by the consular mechanisms currently in force. In case the Applicant has not the title to the property of the trade mark yet , he shall submit a proof that the trade mark is undergoing the formal process and a note by which IRAM is exempted from responsibility in case of opposition or other problems; g) an authorized copy of this Rules; h) a record of the Applicants registration at the Public Trade Register or where applicable. In case the Applicant were not registered yet, the written evidence that his registration is undergoing the relevant formal process; i) a companys flowchart and roles description. The flow-chart shall specify, in particular, every aspect related to the product quality control, indicating the functions and responsibilities assigned to each of the department heads, as well as their names and official titles; j) a process flow-chart, indicating the inspecting points and the criteria that have been applied; k) the procedure for the identification and traceability of the product(s); l) the procedures for the inspection and testing of the product(s); m) a list of the instruments and the equipment, for the inspection, measurement, testing and verification of the product(s), owned by the company; n) the calibration and control procedures for the inspection, measurement and testing equipments, indicating the traceability of the standards used, describing the system used for their recording and periodic control; o) a detailed description of the quality control system established by the company, divided into: I) receipt of raw materials or intermediate products; II) manufacturing process; III) end product. If any of the above stages (I; II; III) were suppressed, the technical reasons supporting such suppression shall be given;

o) procedimiento para el tratamiento de producto no conforme; p) procedimiento de manipuleo, almacenamiento, embalaje, conservacin y entrega; q) copia de las especificaciones internas establecidas por la empresa para su sistema de la calidad y planillas y registros utilizados en el sistema de la calidad; r) documentacin que demuestre que la empresa mantiene un registro de reclamos de clientes, actualizado; s) informacin sobre los perodos y frecuencia de fabricacin. 8.2 La solicitud mencionada en el prrafo 8.1 ser considerada por la Secretara, la que podr solicitar, si lo considera conveniente, una ampliacin de la presentacin que podr incluir referencias comerciales o de otro tipo. Dichos antecedentes, a criterio de IRAM, podrn condicionar el otorgamiento del Sello IRAM. 8.3 Previo a su presentacin al CGC, la Secretara realizar una inspeccin en la fbrica y en los laboratorios del Postulante para verificar que est en condiciones de continuar con la tramitacin. En caso de que ste haga fabricar total o parcialmente el o los productos para los que solicita el Sello IRAM fuera de sus propias fbricas, la inspeccin se extender a todas las fbricas y laboratorios que corresponda. En los casos de convenios con organismos de certificacin extranjeros, la inspeccin podr ser realizada por ellos, si as IRAM lo decidiera. 8.4 Una vez que la Secretara considere que el Postulante est en condiciones de recibir la visita previa del Comit, elevar al CGC la solicitud con el correspondiente informe. 8.5 El CGC considerar la solicitud y el informe a los que se refiere el prrafo 8.4, decidiendo si designa una comisin de su seno a los efectos que realice, junto con la Secretara, una visita de evaluacin de la fbrica y los laboratorios del Postulante, previa a la realizacin de los ensayos iniciales, o autoriza su realizacin directa. 8.6 La Secretara comunicar al Postulante la admisin de su solicitud indicndole, adems, los aranceles siguientes: a) los derechos que deber abonar por los gastos que origine el trmite de verificacin y ensayos iniciales previos al otorgamiento; b) los derechos que deber abonar por el uso del Sello IRAM; c) los derechos que deber abonar por la eventual realizacin de los controles y ensayos indicados en el prrafo 8.8 inciso d), en el caso de ser necesarios. 8.7 La Secretara elevar al CGC un informe escrito en el que consten las comprobaciones efectuadas durante la visita de evaluacin realizada segn el prrafo 8.5. 8.8 El CGC considerar el informe de la Secretara y resolver si: a) se procede a realizar los ensayos iniciales para el otorgamiento del Sello IRAM, b) se autoriza a comenzar los ensayos una vez corregidos los desvos informados por la Secretara; c) se suspenden los trmites porque el Postulante no dispone de un mnimo de personal profesional y tcnico, o de los medios de fabricacin y control en funcin del tipo y envergadura de la empresa que le permitan garantizar, a juicio de IRAM, que los productos cumplan en forma permanente con la norma IRAM respectiva;

p) the procedure for the treatment of non conforming products; q) the procedure for the handling, storage, parking, conservation and delivery of the product(s); r) a copy of the internal specifications established for the company for its quality system and the forms and records used in the quality system; s) documentation proving that the company keeps updated customer complaint records; t) information on the manufacturing periods and frequency. 8.2 The application form mentioned in 8.1 shall be considered by the Secretariat, which may request, if deemed appropriate, a more detail information including commercial or other type of references. Such records may conditionate the granting of the IRAM Mark. 8.3 Before submitting the application form to the GCC, the Secretariat shall conduct an inspection at the plant and the laboratories of the Applicant, in order to verify that he is conditions to continuo the procedures for the granting of the IRAM Mark. In case the Applicant has ordered the total or partial manufacturing of the product(s) for which the IRAM Mark is being requested out of his own plant, the inspection shall be extended to all the relevant plants and laboratories involved. In case of agreement with foreing certification bodies, the inspection may be carried out by one of them, if so decided by IRAM. 8.4 Once the Secretariat considers that the Applicant is in conditions to receive the previous visit of the Comit, it shall submit to the GCC the application form and the relevant report. . 8.5 The GCC shall consider the application form and the report mentioned in 8.4, and decide wether to designate a commission integrated by some of its members to conduct, together with the Secretariat, and assessment visit to the Applicants plant and laboratories, previous the testing activities, or to authorize that tests be directly carried out. 8.6 The Secretariat shall communicate to the Applicant the admission of his application form, and specify the following fees: a) fees to be paid for the expenses derived the initial verification process and the testing procedures, previous to the granting of the marks; b) fees to be paid for the use of the IRAM Mark; c) fees to be paid for the incidental control and test activities indicated in 8.8 d), in case they are necessary. 8.7 The Secretariat shall report to the GCC the verifications made during the assessment inspection carried out as indicated in 8.5. 8.8 The GCC shall consider the Secretariat and shall decide whether: a) to carry out the initial test for the granting of the IRAM Mark, or b) to authorize the initiation of the test once the deviations reported by the Secretariat have been corrected, or c) to suspend the procedures because the Applicant has not the minimal technical and professional staff or manufacturing and control means requested by the type and magnitude of the company which allow him to ensure, to IRAMs discretion, that the products permanently meets the relevant standard;

d) se resuelve mantener, durante no menos de un mes, un control de los propios sistemas de la calidad del Postulante pudiendo, durante ese lapso, realizar los ensayos que considere adecuados para verificar si los medios de fabricacin y control permiten asegurar constancia en la calidad. e) se discontinan los trmites, ante situaciones relacionadas con lo indicado en el prrafo 5.6. 8.9 En caso de autorizarse, segn el prrafo 8.5, la realizacin directa de los ensayos iniciales para el otorgamiento, o de adoptarse el criterio indicado en el prrafo 8.8 inciso d), y antes de proseguir los trmites, el Postulante deber abonar los aranceles indicados en el prrafo 8.6. No se proseguir ningn trmite de no haberse satisfecho este requisito. 8.10 Los ensayos iniciales para el otorgamiento del Sello IRAM se realizarn sobre muestras representativas de la produccin normal, tomada de la cantidad de lotes o tiempo de produccin que se definir en funcin del tipo de producto y proceso de fabricacin, de manera de obtener una evidencia razonable respecto a la uniformidad y continuidad de la calidad del proceso. El criterio se fijar para cada nuevo producto y proceso y ser luego uniforme en los productos similares que se incorporen, informndolo la Secretara al CGC al presentar la solicitud segn el prrafo 8.4. En aquellos casos, particularmente por razones de distancia, en que resulte conveniente, la Secretara podr realizar la toma de muestras y eventuales ensayos iniciales conjuntamente con su inspeccin a fbrica. 8.11 La incorporacin de nuevos tipos, diseos o capacidades de productos de aquellas empresas que ya posean el Sello IRAM en productos similares, se realizar con el ensayo de la cantidad de muestras determinadas por la Secretara. 8.12 Las muestras de los lotes indicados en los prrafos 8.10 y 8.11 sern extradas de la fbrica o de los depsitos del Postulante. Tales muestras se entregarn a los laboratorios designados para cada caso, del fabricante y/o de terceros, para realizar las verificaciones y ensayos establecidos en la norma correspondiente. 8.13 Realizados los ensayos iniciales para el otorgamiento del Sello IRAM, la Secretara analizar sus resultados y, junto con toda la documentacin mencionada en los prrafos precedentes, elaborar un informe que elevar al CGC. 8.14 El CGC considerar el informe de la Secretara y tomar su decisin teniendo en cuenta el resultado de la visita de evaluacin, de la inspeccin en fbrica, del sistema de la calidad del fabricante y de los resultados de los ensayos iniciales. 8.15 En caso de que: a) la evaluacin final del sistema de la calidad de la empresa sea satisfactoria; b) los resultados de los ensayos iniciales para el otorgamiento cumplan con todas las condiciones generales y requisitos de la norma IRAM correspondiente; c) se satisfagan las prescripciones de este Reglamento, el CGC otorgar la Licencia del Sello IRAM, para el tipo de producto para el que fuera solicitado. 8.16 Acordado el derecho a usar el Sello IRAM, la Secretara lo notificar al Postulante en forma fehaciente. 8.17 Los derechos y obligaciones que resultaren para el Postulante de su admisin en el Sello IRAM, comenzarn a regir desde la fecha de notificacin fehaciente de la autorizacin de uso. 8.18 Si se rechazara el otorgamiento del Sello IRAM, la Secretara en informe escrito, aprobado previamente por el CGC, comunicar al Postulante las causas por las cuales se produce el rechazo.

d) to maintain, during not less than a month, a control of the Applicants quality systems, being capable, during that period, to carry out the adequate tests in order to verify if the manufacturing and control means allow to ensure a constant quality, or . e) the procedures are to be discontinued in case of situations related with what it is indicated in 5.6 8.9 In case that, as indicated in 8.5, it is authorized the direct conduction of the initial tests for the granting of the IRAM Mark, or if the criterium indicated in 8.8 d) is followed, and before the continuation of the procedures, the Applicant shall pay the fees established in 8.6. No procedure shall be continued if this requirement is not fulfilled. 8.10 The initial tests for the granting of the IRAM Mark shall be conducted on samples that are representative of the normal production, taken from the number of lots or production time defined accordingly to the product type and the manufacturing process, in order to obtain a reasonable evidence of the uniformity and continuity of the process quality. This criterium shall be established for each product and process and shall be uniform for the similar products subsequently incorporated, and shall be informed to the GCC by the Secretariat in submitting the application form as per 8.4. In cases where, due particularly to distance reasons it is deemed adequate, the Secretariat may carry out the sampling and the incidental initial tests together with the inspection at the plant. 8.11 The incorporation of new product types, designs or capacities of companies that have already been granted the IRAM Mark for similar products shall be done with the test on the number of simples established by the Secretariat. . 8.12 The samples of the lots indicated in 8.10 and 8.11 shall be taken from the Applicants plant or warehouses. Such samples shall be delivered to the laboratories designated for each case, whether those of the Applicant and/or third parties, in order to carry out the verifications and tests established in the relevant standard. 8.13 Once the initial tests for the granting of the IRAM Mark have been performed, the Secretariat shall evaluate the results and with the above documentation, it shall prepare a report, including recommendations, which shall be submitted to the GCC. 8.14 The GCC shall consider the Secretariats report and shall take its decision based on the results form the assessment visit, the inspection conducted at the plant, the manufacturers quality system and on the initial test results. 8.15 In case that: a) the final assessment of the companys quality system has been found to be satisfactory; b) the results of the initial tests for the granting of the IRAM Mark meet all the general conditions and requirements of the relevant IRAM Standard; c) the provisions of this Rules have been met, the GCC shall grant the IRAM Mark License for the product type for which it has been requested. 8.16 Once it has been agreed the right to use the IRAM Mark, the Secretariat shall notify the Applicant on this decision. 8.17 The rights and duties of the Applicant resulting from his being granted the IRAM Mark, shall be valid as of the date of the Secretariats formal notification of authorization to use the IRAM Mark. 8.18 If the granting of the IRAM Mark were rejected, the Secretariat shall deliver the Applicant a report, previously approved by the GCC, explaining the reasons that led to the rejection.

8.19 El Postulante al que se le rechazara el otorgamiento podr solicitar, por escrito, en forma debidamente fundamentada, una reconsideracin dentro de los 30 das de ser notificado, incluyendo en su solicitud, si lo desea, su pedido de ser citado por el CGC. 8.20 El CGC proceder a tratar el pedido de reconsideracin. Si el Postulante lo hubiera solicitado, lo citar y, en caso de que no lo hubiera solicitado, podr citarlo o no. En los casos que el CGC lo citara, el Postulante expondr su posicin. El CGC comunicar al Postulante la resolucin que adopte, por escrito. 8.21 En caso de que no se hubiera otorgado el derecho a usar el Sello IRAM para un producto determinado, el Postulante podr volver a presentar una nueva solicitud de admisin, siempre que se encuadre dentro de lo establecido en el prrafo 8.22. 8.22 Para la presentacin de nuevas solicitudes se deber cumplir lo siguiente: a) la segunda solicitud podr ser presentada luego de haberse cumplido las recomendaciones del CGC o la Secretara, por las cuales se rechaz la primera solicitud; b) para las solicitudes posteriores deber expedirse el CGC sobre los plazos o condiciones en que podrn ser presentadas.
Empleo del Sello IRAM

9.1 El Licenciatario del Sello IRAM para un producto determinado debe, obligatoriamente, hacer figurar dicho Sello IRAM en la forma que indique el CGC y de acuerdo con las indicaciones de ste, en todas las unidades de venta del tipo, modelo y marca aprobados. En caso de que, adems, fabrique dicho producto sin Sello IRAM, ste deber tener una marca, completamente distinta a la que obtuvo el Sello IRAM, salvo casos excepcionales que el CGC lo permita. En algunos rubros de productos, a criterio de IRAM, no se admitir la produccin o comercializacin sin Sello IRAM. 9.2 El Licenciatario no podr marcar con el Sello IRAM el producto de la misma marca, tipo y modelo para el que posee el Sello IRAM, que elabore en fbricas no aprobadas o ensaye en laboratorios no inspeccionados. 9.3 El Licenciatario es el nico responsable por la aplicacin del Sello IRAM a las unidades de venta que l debe comprobar, por su propio sistema de la calidad, que cumplen con la norma IRAM correspondiente y lo establecido en el presente Reglamento. 9.4 La responsabilidad de IRAM es la de auditar que el sistema de la calidad del Licenciatario cumple, como mnimo, con las condiciones indicadas en el prrafo 8.1 y que no se han producido cambios no aprobados; realizar los controles sobre el tipo, establecidos en el prrafo 6.3, segn corresponda, y verificar si las muestras del producto, tomadas en fbrica o retiradas del mercado, cumplen con la norma IRAM correspondiente. 9.5 Con el fin de evitar confusin en el usuario, el Licenciatario diferenciar en forma clara en su publicidad los productos con Sello IRAM de aquellos que no lo posean. No podr efectuarse, ningn tipo de publicidad que pueda inducir a engao o confusin al usuario. 9.6 Para asegurar el cumplimiento indicado en el prrafo 9.5, el Licenciatario debe enviar a IRAM, con anterioridad a su confeccin para su publicacin o difusin pblica, rtulos, envases, catlogos, anuncios y literatura publicitaria o tcnica y todo otro medio en el que se mencione el Sello IRAM, para su correspondiente verificacin y aprobacin. A resultas de dicha verificacin y conforme al libre arbitrio de IRAM, ste podr exigir al Licenciatario el cambio de alguno o todos los elementos sometidos a consideracin.

8.19 The Applicant to whom the granting of the IRAM Mark has been refused, may request in writing and with due foundation, a reconsideration of that decision, within 30 days following the Secretariats notification, including, if so he wishes, a petition of being summoned by the GCC. 8.20 The GCC shall considerate the Applicants request of reconsideration. If requested by the Applicant, he shall be summoned by the GCC, and in case he has not made such petition, the GCC may or not summon him. If summoned by the GCC, the Applicant shall expose to the GCC his position and the GCC shall inform him, in written, on the resolution adopted 8.21 In case the right to use the IRAM Mark for a given product were not granted, the Applicant may submit a new admission request, whenever it agrees with the provisions established in 8.22. 8.22 For the submittal of new request, the following conditions shall be met: a) The second application may be submitted once the recommendations from the GCC or the Secretariat, by which the first application was rejected, have been met; b) for further applications, the GCC shall decide on the terms and conditions for their submittal.
Use of the IRAM Mark

9.1 The holder of the IRAM Mark for a given product is obliged to exhibit the IRAM Mark as established by the GCC and accordingly with its indications, on all the units for sale of the product type, model and trademark approved. In case that, in addition, the Licensee manufactures such product without IRAM Mark, that product shall have a trademark that is completely different from the one the IRAM Mark was granted. En caso de que, adems, fabrique dicho producto sin Sello IRAM, ste deber tener una marca, completamente distinta a la que obtuvo el Sello IRAM. The production and marketing of products not having IRAM Mark, shall not be allowed for some product categories. 9.2 The Licensee shall not use the IRAM Mark on products of the same trademark, type and model as tose having the IRAM Mark, when the former are produced at plants or tested at laboratories that have not been inspected. 9.3 The Licensee shall be the sole responsible individual for the application of the IRAM Mark in the units for sale that he must verify, by means of his own quality system, meet the relevant IRAM Standard and the provisions in these Rules of Procedure. 9.4 It is the responsibility of IRAM to verify that Licensees quality system meets, as a minimum, the conditions established in 8.1 and that non approved changes were not introduced, as well as carry out the controls on the type established in 6.3, as relevant, and verify if the product samples taken from the plant or the market, meet the relevant IRAM Standard. . 9.5 In order to prevent the users confusion, the Licensee shall clearly differentiate in his advertising the products that have been granted the IRAM Mark from those without it. No advertising leading to mislead or confuse the user shall be permitted. 9.6 In order to ensure compliance with 9.5, the Licensee shall send to IRAM, before they are ready for their publication or public circulation, labels, packaging, catalogues, advertisements, advertising or technical literature and any other mean mentioning the IRAM Management System Certification, for verification and approval. As a result from such verification and according to IRAMs free will, the Licensee may be required to change some or all the elements submitted for consideration.

9.7 El Sello IRAM slo podr usarse en el producto para el que haya sido solicitado y acordado, y su aplicacin excluye la utilizacin de todo otro sello o marca con la misma finalidad, salvo autorizacin expresa de IRAM, presentando la documentacin correspondiente, si IRAM as lo solicita. Dicha autorizacin no ser necesaria cuando se trate de marcas efectuadas por disposiciones oficiales en vigencia. En estos casos se har la comunicacin correspondiente a IRAM. 9.8 La autorizacin para usar el Sello IRAM, no puede ser cedida a terceros, salvo autorizacin expresa de IRAM y nicamente bajo condiciones estipuladas por IRAM. 9.9 Por el solo hecho de solicitar el Sello IRAM para un tipo de producto determinado, el Postulante da su aceptacin, sin reservas, al presente Reglamento y se obliga particularmente a: a) justificar que emplea los medios de fabricacin y de control que le permitan asegurar en forma permanente que las unidades de venta mantienen la calidad de la muestra en la que se bas la aprobacin, procediendo a realizar tales controles y a consignar en un registro especial la cantidad de muestras sometidas a los controles y los resultados obtenidos. Este registro estar a disposicin del servicio del Sello IRAM; b) enviar a IRAM, con la periodicidad y en la forma que IRAM establezca, los resultados de los ensayos efectuados sobre su produccin de material con Sello IRAM o presentar dichos resultados a la inspeccin peridica de IRAM; c) someterse al control indicado en este Reglamento, de acuerdo con el captulo 10; d) respetar las conclusiones del Servicio de Sello IRAM con respecto a los controles, procediendo a efectuar las acciones establecidas por IRAM sobre el proceso o producto, cuando se compruebe la falta de cumplimiento de la norma IRAM respectiva u otra anormalidad; e) proveer los aranceles y los gastos que origina el servicio de Sello IRAM; f) poner a disposicin de IRAM un registro actualizado que incluya todos los reclamos relativos al producto con Sello IRAM, as como las acciones correctivas aplicadas, convenientemente documentadas y acciones preventivas correspondientes. 9.10 En caso de que la autorizacin para usar el Sello IRAM est suspendida o cancelada, el Licenciatario no deber continuar marcando sus unidades de venta con el Sello IRAM, estando obligado a cesar inmediatamente toda propaganda que haga relacin al Sello IRAM. 9.11 La Licencia para la utilizacin del Sello IRAM tendr validez por un ao y quedar automticamente renovada si no es denunciada por el Licenciatario o por el IRAM con un mes de antelacin, por lo menos, a la fecha de su vencimiento. 9.12 El uso del Sello IRAM quedar interrumpido por una de las causas, no penales, siguientes: a) por imposibilidad, por parte del Licenciatario, de seguir cumpliendo con las exigencias de los prrafos 5.1 y 5.2; b) a solicitud del Licenciatario; c) por haber sido denunciada la Licencia respectiva, en las condiciones del prrafo 9.11; d) cuando la produccin sea interrumpida por un perodo de 6 meses, excepto que mediare un acuerdo por efecto del prrafo 8.1 inciso s);

9.7 The IRAM Mark shall be used only for the product for which it has been requested and approved, and its use excludes the use of any other mark with the same purpose, except authorized by IRAM, submitting the relevant documentation, if requested by IRAM. Such authorization shall not be necessary in case of marks resulting from current official regulations. In this case, IRAM shall be duly and timely informed.. 9.8 The authorization for the use of the IRAM Mark cannot be transferred to third parties, unless it is clearly authorized by IRAM and under the conditions established by IRAM. 9.9 By merely applying for an IRAM Mark for a given type of product, the Applicant openly accepts this Rules of Procedure and is particularly obliged to: a) prove that he uses the manufacturing and control means whereby he can permanently assure that the units for sale maintain the quality of the simple on which the approval was based, carrying out tests and keeping a special record on the number of samples tested and the results obtained. Such record shall be at the disposal of the IRAM Mark service; b) deliver to IRAM as often as established by IRAM, the results from the tests carried out on the production of the material with the IRAM Mark, or submit such result to IRAMs periodic inspection; c) undergo the control specified in these Rules of Procedure, in accordance with Chapter 10; d) respect the conclusions of the IRAM Mark service regarding control, by taking the actions established by IRAM on the process or product when it has been found it fails to comply with the relevant IRAM Standard or other anomaly; e) pay the fees and expenses derived from the IRAM Mark service; f) make available to IRAM an updated record including all the claims concerning the product having the IRAM Mark, as well as the corrective actions taken, duly documented, and the relevant preventive actions. 9.10 In case the authorization for the use of the IRAM Mark is suspended or cancelled, the Licensee shall not continue using the IRAM Mark on his units for sale, being obliged to interrupt immediately any advertising mentioning the IRAM Mark. 9.11 The license for the use of the IRAM Mark shall be valid for one year and automatically renewed unless the Licensee or IRAM gives notice of cancellation at least one month in advance to the expiration date. 9.12 The use of the IRAM Mark shall be interrupted by one of the following non-punishable reasons: a) impossibility, on the part of the Licensee, to continue meeting the requirements in 5.1 y 5.2; b) at the Licensees request; c) a cancellation notice concerning the respective License, given in accordance with 9.11; d) when production is interrupted for a six-month period, unless there is an agreement arising from 8.1 s);

e) por falta de pago, en los plazos establecidos por IRAM, de los derechos o aranceles por el uso del Sello IRAM u otros gastos previamente acordados fehacientemente, relacionados con el Sello IRAM IRAM publicar las renuncias o interrupciones, indicando, cuando lo considere conveniente, las causales respectivas. 9.13 Caducar la aplicacin del Sello IRAM en caso de que se modifique la norma IRAM si, despus de tres meses contados desde la vigencia de la nueva norma, el Licenciatario no satisface las condiciones establecidas en ella. El CGC podr autorizar, cuando razones fundamentadas lo justifiquen, plazos mayores. 9.14 En caso de que el Licenciatario fuera a introducir alguna modificacin en su diseo, fabricacin o sistema de la calidad (medios humanos o tcnicos), comunicar por escrito a la Secretara su intencin de hacerlo, a efectos de que sta o el CGC, segn corresponda, dictamine si podr seguir utilizando el Sello IRAM en sus productos, o si son necesarios nuevos trmites. 9.15 Todo cambio de domicilio o traslado de la produccin a otro predio, deber ser informado e implicar la evaluacin y aprobacin previa por parte de IRAM para dar continuidad al uso del Sello IRAM. 9.16 A partir del otorgamiento del certificado, el Licenciatario es el responsable exclusivo del mantenimiento y resguardo de las condiciones de calidad exigidas por IRAM. El Licenciatario se obliga a denunciar y dar aviso inmediato a IRAM acerca de los productos que por su evaluacin, o con motivo de la falta de cumplimiento por parte del responsable con la exigencia sealada, hubiesen perdido tales condiciones. La comercializacin de los productos sin cumplimentar las previsiones establecidas por IRAM es responsabilidad exclusiva del Licenciatario del certificado. El Licenciatario exonera a IRAM de responsabilidad por todo Riesgo de Desarrollo. A tales efectos las partes denominan Riesgo de Desarrollo a aquel defecto que en el momento en que el producto fue puesto en circulacin, no estaba contemplado en el documento normativo aplicable.

e) non payment, within the terms established by IRAM, of the rights or fees derived from the use of the IRAM Mark or another expenses previously agreed, concerning the IRAM Mark. IRAM shall publish the resignations or interruptions concerning the IRAM Mark, indicating, when deemed appropriate, the reasons for such decisions. 9.13 In case the relevant IRAM Standard is modified, the application of the IRAM Mark shall expire if, after three months from the validation date of the new standard the Licensee does not meet the conditions it establishes. The GCC may authorize, whenever it is reasonably justified, longer terms. 9.14 In case the Licensee should introduce any modification in the product design, manufacturing or quality system (made by human or technical means), he shall give written notice to IRAM about his intentions, so that the Secretariat or the GCC, as relevant, determine whether he can continue using the IRAM Mark on his product or a new granting process is requested. 9.15 Any change in the address or moving the production to other installations shall be informed and shall imply the previous evaluation and approval by IRAM for the continuity of the use of the IRAM Mark. 9.16 Since the IRAM Mark certificate is granted, the Licensee remains the sole responsible for the maintenance and safeguard of the quality conditions requested by IRAM. The Licensee is obliged to report and give immediate notice to IRAM on the products that, upon their evaluation have been found non compliant with the requirement. The marketing of products that not fulfil the requirements establish by IRAM is the sole responsibility of the Licensee. The Licensee exempts IRAM from all possible failure or omission during the granting and surveillance process, as well as from any responsibility for any Development Risk. To this purpose, the parties denominate Development Risk any defect that could not be detected by the state of the art at the moment the product is put into circulation.

Seguimiento del uso del Sello IRAM

10.1 A los efectos establecidos en este Reglamento, se instituye un seguimiento del uso del Sello IRAM. Este seguimiento estar a cargo de la Secretara y su misin ser la de asegurar que el Licenciatario somete su produccin al control previsto en el prrafo 9.9 inciso a). 10.2 La Secretara realizar el seguimiento por si misma o por organismos con convenio: a) tomando muestras de la produccin, de los depsitos del Licenciatario o del mercado y, cuando sea posible, de los usuarios; b) verificando la eficacia del sistema de la calidad del Licenciatario. 10.3 La Secretara analizar los resultados de los controles del fabricante y los de sus propios controles, a los efectos de determinar si el producto sigue cumpliendo, en forma permanente, con las condiciones que permitieron otorgar el Sello IRAM. 10.4 La Secretara elevar un resumen mensual al CGC sobre los aspectos de fondo que hagan a la marcha del Sello IRAM y, en particular, sobre las transgresiones que se cometan. 10.5 El material o producto retirado de los comercios para las verificaciones, ser con cargo al Licenciatario y las unidades no destruidas por los ensayos sern devueltas por IRAM al Licenciatario. 10.6 Cuando los ensayos de control se efecten en fbrica con el equipo de verificacin existente en ella, el inspector de IRAM exigir la certificacin actualizada de la calibracin o contraste peridico de los instrumentos por un laboratorio aceptado por IRAM. Sin perjuicio de lo anterior, el inspector podr llevar sus propios instrumentos de medicin y verificar los del Licenciatario. 10.7 En todos los casos IRAM comunicar al Licenciatario el resultado de los anlisis y ensayos realizados sobre las muestras.

Surveillance of the Use of the IRAM Mark

10.1 To the purpose established in these Rules of Procedure, it is established a surveillance process for the use of the IRAM Mark. The surveillance shall be in charge of the Secretariat and its duty shall be to ensure that the Licensees production undergo the control process specified in 9.9 a). 10.2 The Secretariat shall carry out the surveillance by itself or through the bodies under agreement, by: a) taking samples form the Licensees production, warehouses or the market and, when practical, from the users; b) verifying the effectiveness of the Licensees quality system. 10.3 The Secretariat shall analyze the results from the manufacturers and its own controls in order to determine if the product compiles on a permanent basis with the conditions by which it was granted de IRAM Mark. 10.4 The Secretariat shall submit to the GCC a report, on a monthly basis, on the aspects concerning the progress of the IRAM Mark and, in particular, on the transgressions committed. 10.5 The material or product withdrawn from the market for verifications shall be charged to the Licensee and the units that have been not destroyed by testing shall be returned to him by IRAM. 10.6 When control tests are carried out at the plant with the manufacturers equipment, the IRAMs inspector shall require the updated certification of the equipment calibration made by a laboratory accepted by IRAM. Without detriment to the aforesaid, the IRAMs inspector may use his own measurement equipment and verify those of the Licensee. 10.7 In every case, IRAM shall inform the Licensee the results of the analysis and tests conducted on the simples.

Sanciones
11.1 Se considerar que el Licenciatario ha violado la Licencia para el uso del Sello IRAM cuando cometa alguno de los hechos siguientes: a) no cumplir, para el producto de que se trate, con la norma IRAM correspondiente; b) llevar deficientemente los controles de la calidad; c) usar el Sello IRAM en productos o publicidades para los que no haya sido autorizado; d) no marcar el Sello IRAM en los productos para los que haya sido otorgado, de acuerdo con la reglamentacin vigente; e) no abonar en trmino los aranceles pactados; f) transgredir lo establecido en el presente Reglamento o en la Licencia correspondiente. 11.2 En caso de que el Licenciatario haya violado el Reglamento o la Licencia para el uso del Sello IRAM, la Secretara reunir todos los antecedentes. Los presuntos incumplimientos de carcter tico o tcnico se presentarn al CGC, en tanto que los de carcter econmico sern elevados a la Direccin General. Toda comercializacin de producto en condiciones inferiores a las acordadas con IRAM, decidida, avalada o ejecutada con el conocimiento de la Direccin o el rea Comercial del Licenciatario, se considerar falta tica, independientemente de lo que adems determine el CGC como falta tica al estudiar cada caso en particular. 11.3 En aquellos casos en que las caractersticas del incumplimiento lo justifiquen, y sea posible de realizarse, la Secretara proceder a la inmovilizacin e inspeccin de todos los productos que se encuentren en la fbrica y, aun de los productos entregados que sea posible ubicar. Los gastos de esta inspeccin especial estarn a cargo del Licenciatario. 11.4 Si la gravedad de la transgresin lo justificare, la Secretara estar autorizada a aplicar la suspensin preventiva del derecho de usar el Sello IRAM, solicitando al Licenciatario su descargo por escrito y elevando los antecedentes al CGC para que ste adopte la decisin definitiva segn el prrafo 7.2 inciso h). Simultneamente citar al Licenciatario a la prxima reunin del CGC. 11.5 En los casos de incumplimiento tico o tcnico, que pudieran justificar una suspensin o cancelacin, el CGC, considerados los antecedentes elevados, recibir al Licenciatario, segn lo indicado en el prrafo 11.4, a los efectos de que ste aclare o ample su descargo, de considerarlo pertinente. 11.6 El CGC o la Direccin General, segn lo indicado en el prrafo 11.2, podr tomar la resolucin de sancionar al Licenciatario con las medidas indicadas en el prrafo 11.7 incisos a), b) c) notificando esta resolucin al Consejo Directivo en los casos del inciso c). 11.7 Las sanciones sern notificadas al Licenciatario por medio fehaciente, rigiendo desde el momento de la recepcin de la notificacin. Se prevn las siguientes sanciones: a) apercibimiento escrito, en cuyo caso el Licenciatario ser intimado a ajustarse a las disposiciones del presente Reglamento o la Licencia; b) suspensin del derecho a usar el Sello IRAM, indicando el lapso durante el cual no podr usar dicho Sello IRAM y las condiciones que debe satisfacer para obtener nuevamente el derecho a su utilizacin;

a) failure to meet the applicable standard; b) inadequate quality control;
Sanctions
11.1 The Licensee shall be regarded as violating the IRAM Management System Certification when he incurs in any of the following:
c) using the IRAM Mark on products or advertisements for which it has not been authorized; d) the products fail to bear the IRAM Mark granted, in accordance with the current regulations; e) the fees agreed upon are not paid in due term; f) the provisions established in these Rules of Procedure or in the relevant License have been transgressed. 11.2 In case the Licensee should have violated the Rules of Procedure or the License for the use of the IRAM Mark, the Secretariat shall gather all the background information. The alleged ethical or technical transgressions shall be submitted to the GCC, while those of economical nature shall be submitted to the Director General. The commercialization of the product under conditions inferior to those agreed with IRAM, that have been determined, approved and carried out with the awareness of the Top Management or the Commercial Area of the Licensee, shall be considered to be an ethical misdemeanour, regardless what in addition the GCC should regard as an ethical misdemeanour to be analyzed in every particular case. 11.3 Where it is justified by the nature of the transgression and if practicable, the Secretariat shall request the Licensee to hold all the products at the plant and recall the products in the market place, and even those products that may be located, for inspection. The expenses arising from such special inspection shall be charged to the Licensee. 11.4 Where it is justified by the seriousness of the transgression, the Secretariat shall be authorized to apply a preventive suspension of the right to use the IRAM Mark, requesting the Licensee to submit his discharge in written and submitting the background Information to the GCC for a final decision as established in 7.2 h). The Licensee shall be simultaneously summoned for the next meeting of the GCC. 11.5 In those cases of ethical or technical non compliance that could lead to a suspension or cancellation once the background information has been analyzed, the GCC shall interview the Licensee, as indicated in 11.3, so that the Licensee is able to explain or expand his discharge, if relevant. 11.6 As established in 11.2, the GCC or the Director General, may resolve to sanction the Licensee with the measures described in 11.7 a), b) or c), notifying the Council on such decision in the cases described in c). 11.7 The sanctions shall be duly informed to the Licensee and shall be current as from the date the notification is received. The established sanctions are the following: a) written warning, but which the Licensee shall be called on to comply with the provisions in these Rules of Procedure or in the License. b) suspension of the right to use the IRAM Mark, specifying the period during which the Licensee shall not use the IRAM Mark and the conditions to be met to recover the right to use that Mark.

Sanciones
c) cancelacin del derecho a usar el Sello IRAM para el producto por un tiempo mnimo de un ao. En caso de que las causales de la sancin fueran de carcter tico, y la empresa fuera Licenciatario en otros productos, adems del merecedor de la sancin, el CGC podr resolver la cancelacin de todos los Sellos IRAM del Licenciatario. 11.8 Si el Licenciatario tiene ms de una certificacin otorgada por IRAM (por ejemplo: producto y sistemas), ante un desvo que implique suspender o cancelar una de ellas, el CGC evaluar el impacto de esta sancin sobre otras certificaciones, y tomar las medidas que considere necesarias para preservar la integridad de la certificacin de IRAM. 11.9 En caso de que el Licenciatario presente la renuncia al Sello IRAM y existan causas que lo hagan pasible de una sancin, dicha renuncia ser considerada por el CGC, que decidir sobre la aceptacin de la renuncia o la aplicacin de la sancin. 11.10 La suspensin o cancelacin del derecho de utilizar el Sello IRAM de Conformidad con norma IRAM implica la renuncia, por parte del Licenciatario, a cualquier accin de indemnizacin contra IRAM, sin derecho a reclamo alguno por aranceles oblados. 11.11 IRAM dar a publicidad, por los medios que considere pertinente, las renuncias y las sanciones aplicadas segn los incisos b) c) del prrafo 11.7, indicando, cuando lo considere conveniente, las causales. 11.12 En caso de que la autorizacin para usar el Sello IRAM est suspendida o cancelada, IRAM efectuar todas las verificaciones que sean necesarias para asegurar que no se haga uso indebido del Sello IRAM. 11.13 Ordenada la suspensin o cancelacin del uso del Sello IRAM, el Licenciatario no podr seguir usndolo, ni an durante el trmite de una eventual reclamacin. 11.14 El Licenciatario e IRAM convienen en que la falta de cumplimiento de lo indicado en el prrafo 11.13, dar derecho a IRAM a ejercer una accin legal. 11.15 La revocacin de la autorizacin de uso del Sello IRAM no afectar las posibles acciones u otras medidas legales que IRAM podr ejercer contra el Licenciatario para resarcirse de los daos o perjuicios que haya sufrido o sean imputables a este ltimo. 11.16 En caso de incumplimiento, adems de las penalidades indicadas en los prrafos anteriores, el Licenciatario deber cumplir las clusulas siguientes: a) a eleccin del comprador reintegrar, en un perodo acordado con el comprador, los importes abonados o repondr las unidades defectuosas con otras similares con Sello IRAM, que cumplan con la norma respectiva; b) aceptar la destruccin de las seales identificatorias del Sello IRAM, y los rtulos que IRAM objete en los productos hallados defectuosos; c) cuando, por la naturaleza de los defectos hallados en las unidades observadas, pueda presuponerse la existencia de peligro o inseguridad para la vida o los bienes de personas, aceptar, a criterio de IRAM, la destruccin de dichas unidades. La medida deber hacerse extensiva, en forma inmediata, a todas las unidades existentes en igualdad de condiciones que puedan recuperarse; d) asumir la responsabilidad judicial y/o extra-judicial exclusiva y total frente a terceros por los daos y perjuicios que pudieran derivarse por falta de cumplimiento de lo indicado en este Reglamento, eximiendo en todos los casos y en cualesquiera circunstancia a IRAM de tal responsabilidad; e) comunicar a los compradores y usuarios lo que corresponda segn la indicacin de IRAM.

In case that the reasons for the cancellation were of an ethical nature and the organization should have been granted the IRAM Mark for products other than those being sanctioned, the GCC may resolve the cancellation of all the IRAM Marks granted to the Licensee. . 11.8 If the Licensee has more than one certification granted by IRAM (e.g., for product and systems) in the event of a deviation implying the suspension or cancellation of one of those certifications, the GCC shall evaluate the impact of such sanction on the other certifications and take the measures adequate to preserve the integrity of the IRAM Certification. 11.9 In case the Licensee should tender a resignation to the IRAM Mark and there were reasons for a sanction to be imponed on him, his resignation shall be considered by the GCC, which shall decide whether to accept the resignation or to impose the sanction. . 11.10 The suspension or cancellation of the right to use the IRAM Management System Certification implies the resignation on the part of the Licensee to any action for compensation against IRAM, without any right to claim for the certification fees paid. . 11.11 IRAM shall publish, by the means it considers to be suitable, the resignations and the sanctions applied as indicated in 11.7 b) or c), explaining, where appropriate, the reasons for such resignations or sanctions. 11.12 In case the authorization for the use of the IRAM Certification is suspended or cancelled, IRAM shall carry out all the necessary verifications to ensure that the Certification is not being improperly used. 11.13 Once the suspension or cancellation of the IRAM Management System Certification is sanctioned, the Licensee shall not use it, not even during the claim process. 11.14 The Licensee and IRAM agree that disregarding the provisions in 11.13 shall give IRAM the right to initiate legal actions. 11.15 The revocation of the authorization to use the IRAM Management System Certification shall not affect the possible actions or other legal measures from IRAM against the Licensee as a compensation for any damage caused by the actions of the Licensee. 11.16 In case of transgression, in addition to the above indicated penalties, the Licensee shall: a) reimburse to the purchaser, and within a period agreed with the latter, the amounts paid or replace the faulty units with other similar units bearing the IRAM Mark and in conformity with the relevant Standard; b) accept the destruction of the identification signals of the IRAM Mark and the labels objected by IRAM on the faulty units; c) accept, at IRAMs discretion, the destruction of defective units when, due to the nature of the faults observed, they might be assumed as posing dangerous or unsafe conditions for the life or the goods of the users. This measure shall immediately reach all the existing units in equal conditions that could be recalled; d) assume the sole and total judicial and extra-judicial liability to third parties for any damages derived from non compliance with the provisions established in these Rules of Procedure, IRAM being exempted in every case and circumstance of such liability. e) communicate to purchasers and users what IRAM deems to be relevant.

Apelaciones
12.1 En caso de que un Postulante o un Licenciatario no est de acuerdo con una decisin que le concierne, puede presentar una apelacin a la Direccin General de IRAM en los temas relativos a la Direccin de Certificacin o al CGC en los que hace a sus decisiones. Las apelaciones se presentarn dentro de los treinta (30) das corridos de comunicada la decisin y consistirn en la presentacin formal del caso. La respuesta que respalde la decisin tomada se realizar por medio de una declaracin escrita. La decisin ltima del CGC es inapelable.

Licencia
13.1 El otorgamiento y el derecho de usar el Sello IRAM, resultar de un elemento contractual (Licencia) cuyos derechos fiscales sern abonados por el Licenciatario que contendr, como clusulas especiales, las que se convengan al otorgarle el Sello IRAM. Ser, adems, instrumento principal de la Licencia el presente Reglamento, que formar parte integrante e indivisible de dicha Licencia. El Licenciatario firmar tambin un ejemplar de este Reglamento, como constancia de su conformidad con todas sus clusulas. 13.2 La suspensin o la cancelacin del derecho de utilizar el Sello IRAM implica la renuncia, por parte del Licenciatario, a cualquier accin por indemnizacin contra el IRAM. 13.3 La suspensin o la cancelacin del derecho de utilizar el Sello IRAM obliga al Licenciatario a cesar en forma inmediata en el uso del Sello IRAM objeto del presente Reglamento, comprometindose a no efectuar actos que pongan en peligro o afecten la marca Sello IRAM. 13.4 Toda controversia que se suscitare ser dirimida ante los Tribunales de la Ciudad de Buenos Aires de la Repblica Argentina, con exclusin de cualquier otra jurisdiccin territorial.

Uso no autorizado
14.1 Todo uso no autorizado, uso abusivo o uso indebido del Sello IRAM, o si existiera el peligro que se produjera una infraccin de los derechos de propiedad sobre el Sello IRAM por un Licenciatario o un tercero, dar derecho a que IRAM adopte las medidas legales pertinentes y/o inicie las acciones legales que se encuentren a su alcance en defensa de sus derechos de propiedad objeto del presente Reglamento.

Confidencialidad
15.1 Todos los que intervengan en las tramitaciones del Sello IRAM estn obligados a mantener la confidencialidad sobre toda la informacin obtenida durante el proceso de certificacin. As mismo el Postulante o Licenciatario se compromete a no utilizar la informacin o fragmentos de sta, para fines distintos de la ejecucin del presente Reglamento.

Appeals
12.1 In the event that an Applicant or Licensee disagrees with a decision concerning him, he may appeal to the IRAMs Top Management regarding the issues related to the Certification Managements or the GCCs decisions. Appeals shall be submitted within thirty (30) days from the date the decision was communicated and shall consist of the formal presentation of the case. The reply supporting the decision taken shall be given by means of a written statement. The GCCs decision shall be unappealable.

License
13.1 The granting of and the right to use the IRAM Mark shall result from a contractual element (License) whose fiscal duties shall be paid by the Licensee. The License shall include, as special clauses, the terms agreed upon granting the IRAM Mark. These Rules of Procedure shall be, in addition, the main instrument and an indivisible part of the License. The Licensee shall sign as well a copy of these Rules of Procedure as the evidence of his agreement with all its provisions. 13.2 The suspension or cancellation of the right to use the IRAM Mark implies the resignation, on the part of the Licensee, to any action for compensation against IRAM. 13.3 The suspension or cancellation of the right to use the IRAM Mark obliges the Licensee to immediately discontinue the use of the IRAM Mark, subject of these Rules of Procedure, through his commitment to refrain from taking any action that could compromise or affect the IRAM Mark. 13.4 Any arising controversy shall be settled at the court of the city of Buenos Aires, Argentina, with the exclusion of any other territorial jurisdiction. .
14
Non Authorized Use

14.1 In case of any non authorized, abusive or improper use of the IRAM Mark, or when the IRAM property rights on the IRAM Mark could be transgressed by a Licensee or a third party, IRAM shall have the right to adopt any relevant legal measure, including the initiation of the legal actions within its reach, in defense of its property rights established in these Rules of Procedure.

Confidentiality
15.1 All the parties involved in the procedures for the granting of the IRAM Management System certification shall be obliged to maintain confidentiality regarding all the information obtained during the certification process. The Applicant or Licensee commits himself not to use partial or whole information for purposes other than the application of these Rules of Procedure.

Modificaciones al Reglamento
16.1 Este Reglamento podr ser modificado por IRAM cuando las necesidades lo aconsejen. Los interesados harn llegar sus observaciones, fundamentadas y por escrito, al CGC o a la Direccin General del IRAM.

16.1 These Rules of Procedure may be modified by IRAM when deemed necessary. Interested parties shall send their observations, duly justified and in writing, to the GCC or to the Top Management of IRAM.
