This document provides the guidelines of leave policy for all Acesoft Labs (India) Pvt Ltd employees and associates. Unless the policy is changed, all employees have to adhere to this policy statement. Admin 1/3/2011

Leave Policy

1.0

Introduction

This document details the leave policy of Acesoft Labs (India) Pvt Ltd. Unless notified organizational wide, this policy remains in full force and all employees of Acesoft are required to adhere to it. Acesoft Labs (Company) encourages all employees to take time off to refresh themselves so they can give their all to their jobs. Acesoft Labs actively encourages managers and employees to plan and use the leaves that employees are eligible for. This policy covers guidelines for seeking approval for leave, the formalities to be followed, the entitlement, and carry forward and encashment thereof Leave is a provision to stay away from work for genuine reasons with prior approval of the authorities. It may be granted for a casual purpose or a planned activity, on medical grounds or in extra-ordinary conditions. Leave cannot be claimed as a matter of right. Accordingly, leave rules and norms have been categorized under various heads. Vacation and leave are governed by a set of rules and norms as laid down by the Government of India. The following leave rules and norms give details about the different types of leave and how they can be availed of. These rules should be used for the better understanding and utilization of the leave rules and norms and are only complementary and explanatory in nature and in no way meant to super cede the leave provisions of the Government of India. 2.0

Sick leave

An employee of Acesoft is entitled to twelve (12) days of sick leave in a year. A year for this calculation and for keeping records thereof would be the calendar year, i.e. from January to December each year. Sick leaves cannot be carried forward for successive years. An employee is required to notify within 48 hours of availing the sick leave either via phone or email to his reporting manager or Human resource manager at Acesoft Labs.

3.0

Earned Leave

An employee of Acesoft is entitled to Six (6) days of earned leave in a year. A year for this calculation and for keeping records thereof would be the calendar year, i.e. from January to December each year. Earned leaves can be carried forward for successive years. An employee cannot carry more than 12 days of earned leaves. The Earned leave will have to be earned before being utilized, which implies that leave entitlement will be calculated based on the days / period actually worked and an employee will not be entitled to leave with pay, if s/he has no credit for leave in his/her account, whereas sick leave can be availed at any time of the year to the maximum as mentioned above considering that the employee will be in the company till the end of the year. If an employee quits the company before the end of the year, for example an employee quits in the month of July but has taken all 12 days sick leave whereas s/he is entitled for only 7 days sick leave s/he will have a LOP of 5 days. An employee will not be entitled for leave with pay during the notice period at the time of his/her exit. Leave to the credit of an employee will not be allowed to be adjusted against his/her notice period. The calculation of leave will be the actual days of leave without considering Sundays and National Holidays (as indicated by the Company for that year), unless such Sunday has been substituted as a working day for any other day declared as a holiday, as a special case. This would imply that if leave is taken from Friday to Monday inclusive of Sunday, It will not be taken as leave and only three days of leave will be counted

4.0

Carry Forward

As mentioned earlier out of the 18 days leave per year, an employee is entitled to avail 6 days of earned leave and 12 days of sick leave in a year. It is to be noted that the 12 days of sick leave to the extent not taken by year end will lapse and one will not be able to carry this forward. Upon termination, employees will be paid for accrued paid leave subject to a maximum of 12 days. For encashment purposes as stated above, only basic salary and dearness allowance will be covered. It is to be noted that during employment, no cash payouts of earned leave balances will be made to employees.

Maternity Leave

The Maternity Benefit Act, 1961 As per the Central Government passed the Maternity Benefit Act in 1961 which extends to the whole of India, and to every establishment belonging to the government industrial, commercial or agricultural. It provides for certain benefits which are granted to a woman during her pregnancy. Also she cannot be dismissed from service on account of her pregnancy. The maximum permissible period of maternity leave is 12 weeks, with 6 weeks leave to be taken before delivery and 6 weeks immediately after the child is born. A woman can ask for light work before she goes off on leave. The employer cannot reduce her salary in this scenario. The maternity benefits can only be withdrawn if the employee joins some other organisation during that time. Maternity Leave may be granted to a female staff for a period of upto 90 days. Maternity Leave may also be granted on full pay in cases of miscarriage including abortion, subject to the condition that the leave applied for does not exceed 45 days in entire service and the application for leave is supported by a medical certificate. >Maternity Leave shall not be debited to the leave account. Maternity Leave may be combined with leave of any other kind During maternity leave, leave salary equal to last pay drawn is admissible.

Acesoft Labs will provide 12 weeks of paid maternity leave to all female employees. Maternity leave can be used before and/or after childbirth. The employee can take a maximum of 6 weeks inclusive of Sunday and Holidays after childbirth under this heading. The employee must be employed with Acesoft Labs for a minimum of 1 Year prior to the expected date of delivery, before becoming eligible for maternity leave All benefits continue to accrue during/while on paid Maternity Leave.

6.0

Paternity Leave

Acesoft Labs will provide 1 working day of paid paternity leave to all male employees. Paternity Leave can be used before and or after birth of his/her child. The employee must be employed with Acesoft Labs for a minimum of 180 days prior to the expected date of delivery, before becoming eligible for paternity leave.

7.0

Bereavement Leave

An employee will be entitled to 1 working day of Bereavement Leave in aggregate during each year. This leave entitlement will cover the unfortunate demise of his immediate family.

8.0

Comp Off

All employees of Acesoft are eligible for a comp off holidays provided it is approved by the reporting managers. If employees are required to work on holidays or weekends to support Acesoft business, then they can take comp off on alternate working days upon approval from their reporting Managers. All Comp Off should be availed in way not to impact the functioning of Acesoft Labs business.

9.0

Application and Procedure for taking leave

Except in the case of sickness or emergency, employees need to apply for leave in advance and get approval for the same from their reporting Manager. In case of sickness or emergency, the employee needs to get in touch with his/her reporting manager and inform him/her of the need to take the sudden leave, the duration thereof, the pending urgent work at the office, contact number/address and other information as needed. S/he can make an oral request for leave. If ones reporting manager is not contactable then one needs to contact the supervisor of ones reporting manager and seek permission. reporting manager with a CC to the HR person in Acesoft for leave documentation purpose without which the leave taken will not be considered. In case of sick leave & the employee is not able to send the mail, S/he needs to inform the reporting manager on the same and also send message via phone & keep them updated. On resuming duty, the employee needs to complete the formalities by making a formal written request by using the Leave Record Form. In case of planned leave, the employee should apply for the same at least 10 days in advance. In case of leave being denied when applied for in advance, employee has the right to seek a review of his/her application by his/her reporting managers superior with a CC to the Acesoft HR person and seek assistance, and the latters decision will be final.

10.0 Leave without pay


Any Leave taken in excess of leave accrued or if an employee takes leave without prior permission or despite leave being denied by their Manager, the same would be treated as leave without pay, and the employee will be liable for appropriate disciplinary action. Leave without pay would inter alia imply that salary for that period will not be paid. For purposes of this calculation all items covered under the CTC (Cost to Company) will not be paid for that period.

11.0 Leave Record


The Human Resources Department will maintain a Leave Record for the leaves availed by the employee till the last working date and every month the employees will be notified on their respective leave statuses by the HR person.

12.0 Conclusion
The Leave Policy will be reviewed periodically and management has the right to modify this policy from time to time, as they may deem fit and will be in effect only after the policy has been released for all employees.
