No /11, dated 04.07.11 >>><<< This association raises the objection regarding appointment by transfer of certain In the reference 1st cited, the integrated services particulars of Sub Engineers (Electrical) and O&M staff, who have acquired Diploma in EEE as on 31.01.2010 was communicated and called for any objections against length of service and seniority. Regarding the length of service and seniority for the Sub Engineers, the following cases are pending with High Court of Andhra Pradesh 1. WP 7303 / 2009: B. Venkaiah and 27 others of West Godavari Dist were filed a case regarding counting of the service weightage for O&M staff and construction staff before acquiring Diploma as arbitrary and irrational and unconstitutional and requested to strike down the same. Now the case is pending. 2. WP 2473 / 2009: M. Niranjan babu and 18 others were filed a case regarding counting of the service rendered in the Y.C.B. period as regular service as illegal, arbitrary, unjust and requested to strike down the same. Now the case is pending. 3. WP 592 / 2009: N. Murali Krishna and 2 others were filed a case regarding counting of the service rendered in the Y.C.B. period as regular service as illegal, arbitrary, unjust and requested to strike down the same. Now the case is pending. 4. WP 16159 / 2010: E. Krishna and 8 others were filed a case regarding counting of the service rendered in the Y.C.B. period as regular service as valid and lawful and requested to implement the same. Now the case is pending.

But, now in the reference (2nd) & (3rd), Orders issued for appointment by transfer of certain Sub Engineers (El) as Addl. Asst. Engineers (El) subject to the result of (a) W.P 7303/2009 (b) W.P 2473/2009 and (c) W.P. 592/2009 (WP 16159/2010 not mentioned in the orders) As aware of the cases regarding Counting of O&M service/ Construction Service prior to the acquiring Diploma and Counting of Y.C.B period as regular service, Orders were issued for appointment by transfers duly considering the O&M service/ Construction Service prior to the acquiring Diploma for some candidates and ignoring the service rendered in the Y.C.B period for some candidates is injustice.
