Marie Curie Fellows (Early Stage Researchers and Experienced Researchers): guidelines for appointment, remuneration and training

Appointment 1. Marie Curie fellows are employed by TUD on a fixed-term contract. 2. In the case of an Early Stage Researcher, the duration of that contract shall be no less than three months and no more than 36 months; in the case of an Experienced Researcher, it shall be no less than two months and no more than 24 months. 3. The appointment shall be subject to the terms and conditions of the CAO NU (Collective Labour Agreement for University Academic Staff) and Appendix III of the EUTU Delft contract. 4. The appointment is deemed to be full time. UFO profile 1. An Early Stage Researcher appointed further to a doctoral research project falls under the 'UFO' profile (job description) for postgraduate (doctoral) researchers. Where the doctorate is gained prior to the termination of the appointment, the profile of Researcher Level 4 shall apply. 2. The Experienced Research is subject to the UFO profile of Researcher. Remuneration 1. In the case of an Early Stage Researcher, the salary scale of postgraduate (doctoral) researcher or Salary Scale 10 shall apply, depending on the applicable UFO profile. 2. Upon appointment, the starting salary will be that applying to step 0 of the relevant scale. 3. In the case of an Experienced Researcher with four years' experience (gained in postgraduate research), the salary will be according to step 5 of Salary Scale 10, this amount being subject to increment according to actual experience in years. Payment according to Scale 11 shall be made where the UFO criteria for a Researcher Level 3 are met, and the researcher has at least 7 years' experience (including that gained during the doctoral research project). Payment according to Salary Scale 12 shall be made where the UFO criteria for a Researcher Level 2 are met, and the researcher has at least 13 years' experience (including that gained during the doctoral research project). Payment according to Salary Scale 13 shall be made where the UFO criteria for Researcher Level 1 are met and the research has at least 18 years' experience (including that gained during the doctoral research project). 4. The gross monthly salary includes the 'cost-of-living' allowance as described in Appendix III of the EU TU Delft contract, and the mobility allowance. 5. A holiday bonus in the amount of 8% of the annual gross salary will be paid annually in May. 6. A bonus in the amount of 3% of the annual gross salary will be paid annually in December. 7. Where an appointment is made for a duration exceeding one year, a one-time 'career development allowance' in the amount of 2000 may be paid. This allowance is tax-free and the recipient is not required to account for its disbursement. 8. Further to the Marie Curie programme conditions, an annual travel allowance will be paid according to the rates stated in Appendix III of the EU-TU Delft. This allowance is tax-free and the recipient is not required to account for its disbursement. 9. All payments will be reviewed upon termination of the appointment, whereupon surpluses and deficits will be paid or repaid in full.

Personal Career and Development Plan The faculty will produce a 'Personal Career and Development Plan' for all fellows holding an appointment of more than six months' duration. Health insurance A fellow is obliged by law to obtain adequate personal health insurance.

6. Taxation A fellow with at least 2 years' research experience and specialist knowledge which is not available in the Netherlands may be eligible for the '30% rule'. Further information will be provided during the discussion of terms and conditions of employment. It falls to the Inspector of Taxes to decide whether the 30% rule can be applied. If the 30% rule is applied, the fellow is no longer eligible for the 'extra-territorial' tax-free allowances such as the annual travel allowance. Such allowances will therefore not be listed separately in the letter of appointment. 7. Informing the EC of the appointment The faculty is required to forward a copy of the letter of appointment to the European Commission, doing so within twenty days of the confirmation of appointment.

Notes: Para 1: The Marie Curie programme not only permits the appointment of fellows, but allows a study/research grant to be paid to fellows. The current guidelines apply only to those fellows with a formal appointment. The term 'Early Stage Researcher' refers to a fellow who has not yet been awarded a doctorate. The term 'Experienced Researcher' refers to a fellow who holds a doctorate degree and who has at least four years' research experience (including that gained on the doctoral research project itself). Para 3.3 The UFO (job description) criteria for the profile of Researcher Level 3 are as follows: Independent, able to define, delineate and structure his/her own research, and to make a contribution to the flows of agency and contract funding for both his/her own research and that of others. To be classified as a Researcher Level 2, at least three of the following four criteria must be met: Able to conduct research fully independently, whether in a broad or specialist area. Able to coordinate and implement a number of interrelated research projects which together form a substantial part of the overall research programme. Able to initiate, acquire and account for the flows of agency and contract funding for both his/her own research and that of others. Able to demonstrate an active contribution to workgroups, committees or project teams within the relevant capacity group. Classification as Researcher Level two requires that 3 out of 4 of the above criteria are met. Classification as Researcher Level one requires the following criteria to be met: Able to conduct research fully independently, whether in a broad or specialist area. Able to manage, direct and supervise scientific personnel in the performance of research. Able to coordinate and implement a full research programme. Able to initiate, acquire and account for the flows of agency and contract funding for both his/her own research and that of others. Able to lead (chair) workgroups, committees or project team within the relevant capacity group. Para 3.4:

The 'cost-of-living' allowance as described in Appendix III of the EU- TU Delft is paid as an annual amount, and is subject to all statutory deductions. Where the fellow is resident in the Netherlands, the stated amount is subject to an increment of 3.9%. The mobility allowance is paid monthly; the amounts stated are gross (before taxes, where applicable). For researchers without dependent relatives, the amount is 500. For those with dependent relatives (spouse, registered partner and/or children) it is 800. Where the fellow is resident in the Netherlands, the stated amount is subject to an increment of 3.9%. Para 3.7: The Career Development Allowance is paid at the beginning of the second year. Para 3.8: The amount of the annual travel allowance is calculated according to the table shown in Appendix III of the EUTU Delft contract. The first payment is made immediately upon appointment; subsequent payments are made at annual intervals. Para 3.9: Upon termination of the appointment, TU Delft will pay any deficit between the actual payments made (salary and allowances as described in Paras 3.1 3.9) and the payments which should have been made further to the terms and conditions of the Marie Curie programme. This compensatory payment is taxable. TU Delft reserves the right to reclaim any amount paid in excess of that which should have been made further to the terms and conditions of the Marie Curie programme. Para 4: The Personal Career and Development Plan is mandatory for all fellows with an appointment exceeding six months. The plan is devised jointly by the researcher and his or her supervisor. It sets out the further requirements in terms of education and training, together with academic objectives and the measures which can help the researcher achieve those objectives. The Personal Career and Development Plan forms an appendix to the letter of appointment (to which it is to be attached). Where no Personal Career and Development Plan is required, a list of planned activities should be attached to the letter of appointment. Para 5: The fellow is required to pay income tax ("Pay as You Earn") in the Netherlands, and therefore falls under the terms of the Health Insurance Act. The only possible exception is if the fellow is working in two countries and is officially domiciled (resident) in another country. If this is the case, the faculty must inform the International Office of HR Services prior to the commencement of the appointment period. Para 6: A fellow with at least 2 years' research experience who possesses knowledge or expertise which is not readily available in the Netherlands may be eligible for the '30% rule'. This will reduce his/her tax liability in the Netherlands. During the initial discussion of terms and conditions, the fellow will be offered the choice between: a. a higher gross salary to include the relevant pension accrual entitlement (at the normal salary scale) or b. a higher net salary by virtue of the 30% -rule (a lower salary scale, plus tax-free supplement). The fellow will be made aware that Option b) will have consequences in terms of his/her entitlement to certain allowances and salary-related benefits, including retirement pension and social welfare benefits.

If the fellow agrees that the 30% rule should be applied, further action will be taken in line with the official TU Delft policy (Implementation Guidelines for the Application of the 30% rule for international staff"). The relevant professor will substantiate the 'specialist knowledge or expertise' if required to do so by the tax authorities. It falls to the Inspector of Taxes to decide whether the 30% rule can be applied.
