Introduction

Rape, or date rape, happens when someone is forced to have sex by someone they know. Acquaintance rape can happen anywhere, anytime, and to anyone. Most often, however, it happens to college students, particularly freshmen. Twenty-seven percent of all girls who are between 14 and 19 years old are victims of rape or attempted rape, usually while on a date. Not only are the young women in this age group the most vulnerable to rape, but they are also the least likely to report the crime. It s estimated that for every reported rape, 10 to 20 rapes go unreported. Acquaintance rape is a traumatic event. Victims of rape often feel fear, guilt, shame, anger, helplessness, or a sense of betrayal. These feelings can be particularly strong after being raped by someone you know, who you may have trusted. Particularly in acquaintance rape, the perpetrator will often blame the victim by denying that she or he said no to sex or by saying, You really wanted it. The rapist may threaten the victim s reputation or integrity. It is important to understand that false reports of rape are uncommon, even when a spouse or a boyfriend/girlfriend is accused. This is true no matter what the relationship or how long the victim and perpetrator have known each other. If a spouse forces intercourse with his or her mate, it is still rape, not sex.

Definition of Rape
y In criminal law, rape is a type of sexual assault usually involving sexual intercourse against another person without that person's consent. y Rape is forced, unwanted sexual intercourse. Rape, sometimes also called sexual assault, can happen to both men and women of any age. y Rape is about power, not sex. A rapist uses actual force or violence or the threat of it to take control over another human being. Some rapists use drugs to take away a person's ability to fight back. Rape is a crime, whether the person committing it is a stranger, a date, an acquaintance, or a family member. y Rape is the act of forced penetration of any bodily orifice (vaginally, anally, or orally) or forced cunillingous, involving violation of the survivor's body and psychological person. The assault is accomplished by the use of force, the threat of force, or without force when the survivor is unable to physically or mentally give her consent. It is the destruction of a feeling of control over one's body, life, and the course of events. Rape is an experience of violation, degradation, and humiliation. It often infuses the survivors with the shock of their own vulnerability.

Types of Rape
Date rape Date rape, also called acquaintance rape, is a non-domestic rape committed by someone who knows the victim. This constitutes the vast majority of rapes reported. It can occur between two people who know one another usually in social situations, between people who are dating as a couple and have had consensual sex in the past, between two people who are starting to date, between people who are just friends, and between acquaintances. They include rapes of co-workers, schoolmates, friends, and other acquaintance. Spousal rape Also known as spouse, marital rape, wife rape, husband rape, partner rape or intimate partner sexual assault (IPSA), is rape between a married or de facto couple. Research reveals that victims of marital/partner rape suffer longer lasting trauma than victims of stranger rape.

Gang rape Gang rape, or mass rape, occurs when a group of people participate in the rape of a single victim. Rape involving at least two or more violators is widely reported to occur in many parts of the world. Systematic information on the extent of the problem, however, is scant. One study showed that offenders and victims in gang rape incidents were younger with a higher possibility of being unemployed. Gang rapes involved more alcohol and drug use, night attacks and severe sexual assault outcomes and less victim resistance and fewer weapons than individual rapes.[5] Another study found that group sexual assaults were more violent and had greater resistance from the victim than individual sexual assaults and that victims of group sexual assaults were more likely to seek crisis and police services, to contemplate suicide and seek therapy than those involved in individual assaults. The two groups were about the same in the amount of drug use and drinking during the assault. Rape of children Rape of a child is a form of child sexual abuse. When committed by another child (usually older or stronger), it is a form of child-on-child sexual abuse. When committed by a parent or other close relatives such as grandparents, aunts and uncles, it is a form of incest and can result in serious and long-term psychological trauma.[10] When a child is raped by an adult who is not a family member but in a caregiver or in a position of authority over the child, such as school teachers, religious authorities, or therapists, to name a few, on whom the child is dependent, the effects can be similar to incestual rape. Effects of child rape include depression, post-traumatic stress disorder, anxiety, propensity to re-victimization in adulthood. And physical injury to the child, among other problems. Children, including but not limited to adolescents, raped by their parents and other close elders are often called 'secret survivors' by psychologists, as they often are unable or unwilling to tell anyone about these rapes due to implicit or explicit threats by the adult rapist, fear of abandonment by the rapist, and/or overwhelming shame. Since the signs of these rapes are usually invisible except to trained professionals, these children often suffer ongoing offenses in silence until independence from the adult rapist is attained. By that time, the statute of limitations is often long-expired, the adult victim's repressed memories are often considered inadmissible as evidence and the child-rapist is able to avoid punishment.

Tips to protect you from acquaintance rape


1. Avoid being alone with someone you don t know well. If you think you might want to date a particular person, get to know this person first and consider double dating. This is especially recommended for women dating men. 2. Set your sexual limits. Be clear in your own mind about what you do and don t want to do and speak up if you don t feel comfortable. If you are a woman dating a man, remember that men may interpret silence or being passive as permission. 3. Pay attention to the signals in a person s behavior that raise red flags. If you are a woman dating a man, he may constantly put you down or ignore your opinion. He may talk negatively about women. He may appear to want power and control over you. Or he may drink heavily or use drugs, or try to make you do so. Trust your instincts. If something feels wrong, it probably is. 4. Be aware that being drunk, high, sick, or tired can decrease your ability to set limits and to protect yourself. 5. If you find yourself in a situation that feels dangerous, try to get away or try to talk your way out of it. If these approaches don t work and you are raped, remember that it was not your fault. You had no choice. Even if you thought you knew the person, you are not to blame. 6. Men are also raped. This is more common than you may think. Male rape is under reported. It is just as important for men to get medical and emotional help following a rape. These services are not just for women.

What to do if you've been raped


If you re a person who has just been raped, remember it is not your fault, and you are not to blame. Take time to take care of yourself and find support through loving family and friends. However, there are other important things we recommend you do. It is important that you find a safe place and then tell someone, such as a family member, a friend or neighbor, or call the rape crisis hotline. Call for an urgent appointment or go to the emergency room so that you get immediate medical attention as well as support and counseling. Even if you believe that you were not

physically hurt and even if you know the rapist well, a medical examination is important. You will need help in preventing sexually transmitted diseases and

pregnancy, if you're a woman. If you want to press charges or may want to do so in the future, it is important not to wash, shower, bathe, or change clothes before you see a physician. It is okay to be scared about seeking medical care and pressing charges. It is often difficult to handle this situation alone, and we strongly recommend that you do not try to do so. There are many people who can help you at this painful time, including your physician or other medical professionals. Ask your doctor if you would like a referral to a mental health professional. If you are a woman Seeking medical attention soon after a sexual assault will allow you to talk to your physician about preventing pregnancy. If you seek medical attention within 3-5 days, the doctor may be able to prescribe the morning after pill to prevent pregnancy. The sooner you take the morning after pill after having had unprotected sex, the better it will work to prevent pregnancy. If you are a man If you had a sexual response (such as an erection or ejaculation) during the sexual assault, these are just physiological reactions and do not mean that the assault was wanted or enjoyed.

Philippines Republic Act 8353: Anti Rape Law


AN ACT EXPANDING THE DEFINITION OF THE CRIME OF RAPE, RECLASSIFYING THE SAME AS A CRIME AGAINST PERSONS, AMENDING FOR THE PURPOSE ACT NO. 3815, AS AMENDED, OTHERWISE KNOWN AS THE REVISED PENAL CODE, AND FOR OTHER PURPOSES. Be it enacted by the Senate and House of Representatives of the Philippines in Congress assembled: SECTION 1. Short Title. This Act shall be known as The Anti-Rape Law of 1997.

SECTION 2. Rape as a Crime Against Persons. The crime of rape shall hereafter be classified as a Crime Against Persons under Title Eight of Act No. 3815, as amended, otherwise known as the Revised Penal Code.

Accordingly, there shall be incorporated into Title Eight of the same Code a new chapter to be known as Chapter Three on Rape, to read as follows: Chapter Three Rape Article 266-A. Rape: When And How Committed. Rape is committed: 1) By a man who shall have carnal knowledge of a woman under any of the following circumstances: a) Through force, threat, or intimidation; b) When the offended party is deprived of reason or otherwise unconscious; c) By means of fraudulent machination or grave abuse of authority; and d) When the offended party is under twelve (12) years of age or is demented, even though none of the circumstances mentioned above be present. 2) By any person who, under any of the circumstances mentioned in paragraph 1 hereof, shall commit an act of sexual assault by inserting his penis into another person s mouth or anal orifice, or any instrument or object, into the genital or anal orifice of another person. Article 266-B. Penalty. Rape under paragraph 1 of the next preceding article shall be punished by reclusion perpetua. Whenever the rape is committed with the use of a deadly weapon or by two or more persons, the penalty shall be reclusion perpetua to death. When by reason or on the occasion of the rape, the victim has become insane, the penalty shall become reclusion perpetua to death. When the rape is attempted and a homicide is committed by reason or on the occasion thereof, the penalty shall be reclusion perpetua to death. When by reason or on the occasion of the rape, homicide is committed, the penalty shall be death.

The death penalty shall also be imposed if the crime of rape is committed with any of the following aggravating/qualifying circumstances: l) When the victim is under eighteen (18) years of age and the offender is a parent, ascendant, step-parent, guardian, relative by consanguinity or affinity within the third civil degree, or the common-law spouse of the parent of the victim; 2) When the victim is under the custody of the police or military authorities or any law enforcement or penal institution; 3) When the rape is committed in full view of the spouse, parent, any of the children or other relatives within the third civil degree of consanguinity; 4) When the victim is a religious engaged in legitimate religious vocation or calling and is personally known to be such by the offender before or at the time of the commission of the crime; 5) When the victim is a child below seven (7) years old; 6) When the offender knows that he is afflicted with the Human ImmunoDeficiency Virus (HIV)/Acquired Immune Deficiency Syndrome (AIDS) or any other sexually transmissible disease and the virus or disease is transmitted to the victim; 7) When committed by any member of the Armed Forces of the Philippines or para-military units thereof or the Philippine National Police or any law enforcement agency or penal institution, when the offender took advantage of his position to facilitate the commission of the crime; 8) When by reason or on the occasion of the rape, the victim has suffered permanent physical mutilation or disability; 9) When the offender knew of the pregnancy of the offended party at the time of the commission of the crime; and 10) When the offender knew of the mental disability, emotional disorder and/or physical handicap of the offended party at the time of the commission of the crime. Rape under paragraph 2 of the next preceding article shall be punished by prison mayor.

Whenever the rape is committed with the use of a deadly weapon or by two or more persons, the penalty shall be prison mayor to reclusion temporal. When by reason or on the occasion of the rape, the victim has become insane, the penalty shall be reclusion temporal. When the rape is attempted and a homicide is committed by reason or on the occasion thereof, the penalty shall be reclusion temporal to reclusion perpetua. When by reason or on the occasion of the rape, homicide is committed, the penalty shall be reclusion perpetua. Reclusion temporal shall be imposed if the rape is committed with any of the ten aggravating/ qualifying circumstances mentioned in this article. Article 266-C. Effect of Pardon. The subsequent valid marriage between the offended party shall extinguish the criminal action or the penalty imposed. In case it is the legal husband who is the offender, the subsequent forgiveness by the wife as the offended party shall extinguish the criminal action or the penalty: Provided, That the crime shall not be extinguished or the penalty shall not be abated if the marriage is void and initio. Article 266-D. Presumptions. Any physical overt act manifesting resistance against the act of rape in any degree from the offended party, or where the offended party is so situated as to render her/him incapable of giving valid consent, may be accepted as evidence in the prosecution of the acts punished under Article 266-A. SECTION 3. Reparability Clause. If any part, section, or provision of this Act is declared invalid or unconstitutional, the other parts thereof not affected thereby shall remain valid. SECTION 4. Repealing Clause. Article 336 of Act No. 3815, as amended, and all laws, acts, presidential decrees, executive orders, administrative orders, rules and regulations inconsistent with or contrary to the provisions of this Act are deemed amended, modified or repealed accordingly.

Conclusion
Rape is considered to be one of the most serious teenage relationship dangers. If you are forced to engage in sexual activity after saying no to the advances, or offers, it is rape. There are many manipulation strategies used by individuals who are seeking to have sex with you despite the fact that you may not agree. It's important to educate yourself, and your friends, on these strategies and to learn as much as you can. This way, this will not be one of the teenage relationship dangers that you have to deal with in the future.
