As the Minutes and discussion notes relating to this proposal are not visible on Hansard, please will you supply me with the full Minutes and all discussion concerning the Integrated Maritime Policy that took place during the Select Committee's scrutiny of the proposal, under the terms of the Freedom of Information Act. You asked us for the full Minutes and all discussion concerning the Integrated Maritime Policy that took place during the Select Committee's scrutiny of the proposal Dossier COD/2010/0257: 'Proposal for a Regulation of the European Parliament and of the Council establishing a Programme to support the further development of an Integrated Maritime Policy'. On 17 November 2011, the European Scrutiny Committee agreed its Eighth Report of Session 2010-12, which was published on by TSO in hard copy and free of charge on the intranet as HC428viii at http://www.publications.parliament.uk/pa/cm201011/cmselect/cmeuleg/428-viii/42802.htm.

Paragraphs 4.1 to 4.11 in the published Report deal with the Draft Regulation establishing a programme to support the further development of an integrated maritime policy The Formal Minutes of the Committee are published at page 72 of that Report. They include the following statement: Paragraphs 2.1 to 9.7 read and agreed to. In accordance with normal select committee practice, the European Scrutiny Committee meets in private to deliberate and to consider draft Reports. Once agreed, those Reports are published as soon as possible, with the Formal Minutes recording the Committees decisions. Any other information which may or may not be held by the House of Commons on any discussion in the European Scrutiny Committee on this item is exempt information under section 34 of the Freedom of Information Act 2000. Under this section, information is exempt if it its exemption is required to avoid infringing the privileges of the House of Commons, which include the right to decide whether, when and how to publish information about proceedings in Parliament, such as meetings of select committees held in private. You may, if dissatisfied with the treatment of your request, ask the House of Commons to conduct an internal review of this decision. Requests for internal review should be addressed to: Freedom of Information Officer, Department of resources, House of Commons, London SW1A 0AA or foicommons@parliament.uk. Please ensure that you specify the nature of your complaint and any arguments or points that you wish to make. If the decision to apply section 34 of the 2000 Act in respect of your request is upheld by review, a certificate signed by the Speaker may be issued. This certificate would provide conclusive evidence that the exemption was required for the purpose described above.
