Julia, as a CONSTITUTIONALIST I have my concerns as to the dragging on of matters which may be just to serve you trying to get Bills through the Parliament that otherwise may not. The purported CARBON TAX is one of them. If I was a member of parliament I merely had to object to the constitutional validity of the Bill and that would terminate it until and unless the Bill is declared to be constitutionally valid but lack of proper understanding and knowledge by Members of Parliament means they are not aware that the Framers of the Constitution embedded this legal principle in the constitution.

Mr. CARRUTHERS (New South Wales).-It is worth while considering the stages that a proposed law has to go through, and the opportunity afforded to a member of either House or a member of the Executive to call attention to any infraction or infringement of the Constitution. It does not require a majority of the members of the House of Representatives to insist that the Constitution shall be obeyed in the matter of procedure; it only requires one solitary member to rise to a point of order, and the Speaker has to give a legal interpretation of the rules of procedure. It only requires one member of the Senate to call the attention of the President to the fact that a Bill is introduced contrary to the Constitution for that proposed law to be ruled out of order. It does not require a majority of the states to insist that the Constitution shall be obeyed, because a majority of the states cannot by resolution infringe the Constitution. Neither House could pass the standing order which would give the majority power to dissent from the Speaker's or President's ruling. The standing orders only confer certain explicit power. They give no power to either House to pass an order which would enable its members to amend the Constitution. END QUOTE

For sure you are entitled to be deemed innocent until proven guilty but I view you also must need to consider that with your personal knowledge as to what did eventuate if it would be in the circumstances appropriate for you to remain a member of parliament rather then perhaps draw it out and then have placed the Parliament by this in disrepute. In my view you are as a Member of Parliament obligated to uphold appropriate standard this so that constituents can respect you for this. While for political reasons it might suit Julia Gillard for you to drag this on and stay in the parliament in the end what should be considered is that the Constitution is above us all and no one should place his/her self-interest above the constitution which is in existence not for the personal benefit of any particular person but for all Australians. The moment we place out self-interest or our political issues, including a political partys interest, above that of the general community then we have we have lost our democracy. Regardless what in the end may eventuate with any charges, if any are laid, the issue is that this case is crippling our society and more important issues are left unattended. While a COS (Chief of Staff) is in my view appointed to serve a Minister without political favour, it now appears to me that Julia Gillard had her COS involved but then concealed it as to so to say shore up her own political survival. Is this what you are about to protect her skin or are you more interested in doing the right thing to society and stop this rot by resigning as a Member of Parliament and let others sort out the mesh while you can concentrate upon issues that for your own personal future are more important? If your political motives are more important than to preserve credibility in our Parliament and so democracy then you may seek to stick it out as long as you can if anything to shore up the security for Julia Gillard but if you are more concerned not to place in question the credibility of the Parliament then I look forwards that you will tender to the Governor-General your resignation irrespective of if the allegations levelled against you may or may not be factual. Again you are entitled to be deemed innocent until proven guilty but now a much greater issue is at steak and that is the credibility of the Parliament and if Julia Gillard is willing to stick it out so as to try to force through the Parliament Bills at a cost that otherwise may not be passed. As such, is ty6oyur support for Julia Gillard more important than that to do the right thing to your constituents and other Australians? Do consider that if certain bills were to be passed which would not have been had you resigned, and later it were to be concluded by a court that you did inappropriately obtain monies, etc, and by the provisions of s44 this judgment would effectively disqualify you from being a Member of Parliament then the end result would

be far greater then whatever the court may determine because then the general community have been caused to suffer by Bills that should or could have been avoided and in the process then may have placed your credibility further into question. As the Framers of the Constitution made clear that any person convicted of a crime or bankrupt but having concluded this then may take his place amongst others to sit in the Parliament. Therefore, even if there was a conviction (not that I seek to imply there will be a conviction), you could always after completing any sentence, if there is any, stand again for the parliament, however if your current position were such to protract the harm to the parliament as well as society then electors may rather shy away from having you returning to the Parliament. Therefore, in the circumstances it might be advisable, regardless of any guilt or innocence, to resign from your seat and concentrate on the issues at hand. Without seeking to imply any guilt by you it should be considered that ordinary people who are accused may seek to remain silent and then the evidence has to be born out, after all this is precisely I do when the police alleged I was speeding by 5 kilometres an hour, but it appears to me that in your circumstances there appears to have been payments from your private account to the Mastercard and obviously then there are what may be self-incriminating circumstances. After all if any other person were to have unauthorized used the Mastercard then I view your obligation would have been then to report matters to the Police. Therefore, even if you had not committed any fraud yourself nevertheless your reported in action not to report then alleged unauthorized usage is a serious issue that then allowed it to go on and on. Recently I was accessing one of my bank accounts and suspected unauthorized usage of an account I never use for ATM withdrawals and so I immediately within mere second contacted the bank to stop any transactions. It was later that I discovered the bank by error had changed the accounts where monies were wrongly drawn from one account. As such no monies were unauthorized withdraw just from the wrong account. Now, the bank subsequently praised me for acting first as to avoid any ongoing damage in case unauthorized deductions were made. Likewise, if I can do so then why didnt you than do likewise if unauthorized deductions were made? The bank also refunded it charges when it realised they had made the error that monies were drawn from the wrong account. We all must be vigilant and I view that in the position you then held any failure to report any alleged unauthorized withdrawals should be deemed to have been an error of judgment and by it also permitted whomever was involved with this able to continue the same. . In my view Ms Jackson allegedly having indicated to cooperate with the Police can only be respected for doing so as after all it can now be open for scrutiny if anyone did unauthorized withdraw funds and so clear your name in that regard or if there is more to it. . As a CONSTITUTIONALIST I look forward to you showing to the general community that you hold the credibility of the Parliament above that of your self-interest, the political party you belong to and the interest of Julia Gillard and if you do clear your name of any allegations and/or have completed any sentence, if any were to eventuate, then you can still be a shining example that ultimately you upheld the integrity and the credibility of the Parliament above your own and you are ready to serve again, without further distraction of the importance of governing, etc. .
