(3) Some policies have been made by GoI such as : a. Presidential Instruction on Combating Illegal Logging at Gunung Leuser National Park and Tanjung Putting National Park. b. Joint Ministerial Decree on Log Export Ban (between Minister of Forestry and Minister of Industry and Trade) c. Cooperation between the Ministry of Forestry and the National Indonesian Police on Wanalaga Operation; Cooperation between the Ministry of Forestry and the Indonesian Navy on Wanabahari Operation; d. Ministerial Decree on Moratorium of Ramin e. Ministerial Decree on IPK, HPHH, IPPK Control and P2LHP, P3KB status. Implementing forestry law effectively, some actions will be taken by the Ministry of Forestry, such as: 1. 2. 3. 4. 5.

(5) 1. Joint statement between Government Indonesia and Government Malaysia in combating illegal logging and illegal trade of forest products. 2. Continuing to investigate the twelve intellectual actors of illegal logging and identify additional goals of forest security operation on illegal logging in specific spots (border regions, national parks). 3. Forest products circulation securities in Java island. 4. Monitoring judicial process of illegal logging cases. 5. Evaluating and improving implementation for Wanalaga and Wanabahari. 6. Press release at national newspaper TV Broadcast ( News, interactive Dialogue interactive) and Radio Broadcast (RRI & Private Radio) 7. SUGGESTIONS
(6) Utilizing remaining natural forest wisely while if it is necessary to conserve them during approaching/balance between supply and demand of timber. Specifying Illegal Logging as a top-case priority through Presidential Decree. Improving forest security operation. Monitoring and evaluating of the Illegal Logging judicial process. Increasing fund, and improving infrastructure of supervision, security and protection. Using foreign aids wisely for the purpose of operational activities and capacity building. Propose Presidential Decree to regulate the civil public servant investigator (PPNS) of forestry. Forming Forest Police Specialist Unit both in central and province area. Improving dialogue and communication, socialization and campaign of the forestry constitution and policy regulation (UU no. 41/1999, TUK, etc)

Continue National campaign on Combating Illegal Logging, particularly for forestry staffs at the central level and field level. Improve mechanism on timber distribution, particularly in Java in order to counter timber smuggling from out of Java. Develop a national integrated development in 9 national parks of which illegal logging activities are rampant (Berbak, Bukit Tiga Puluh, Kerinci Seblat, Meru Beitir, Gunung Palung, Betung Kerihun, Tanjung Putting, Kutai, and Lore Lindu National Parks). Strengthen coordination between central forestry offices and local forestry offices to combat illegal logging. Encourage motivation and spirit of staff in implementing forest protection by incentive system considering the forest protection operations findings of which its legal aspects are being discussed within the Ministry of Forestry.

(3) 1. Improving forest and land fires management system including institutional strengthening, human resource development, etc. 2. There are several national laws and regulations for forest fire, such as Act No. 23/1997 on Environment, Government Regulation No. 4/2001 concerning Control of Environmental Degradation and or Pollution Related to Forest and or Land Fires. etc. 3. To improve the facilities of forest fire management, on April 2002 a series of forest fire suppression funded by the Government of JAPAN (JICA) 4. to form forest fire brigades in three national park: Gajah Kambas Lampung, Kayung Ketapang, and Bekantan Palung. 1.

(4) Extern/macro/inter-department : a. Lack of awareness to control forest fire (prevention, fire extinction or post-fire trauma) b. Other inter-sector and stake-holder still depend upon and put the responsibility burden of forest fire fully to the Ministry of Forestry Internal/micro/inter- Deputy MoF: a. Forest Fire control authority conducted in the autonomy era are facing many obstacles related with the hierarchical conduct on the field. b. Lack of regional command in conducting forest-fire control. c. Lack of regional command in conducting forest-fire control. d. In fact, most of society still apply slash and burning system for farm land preparation.

(5) 1. Forming of Forest Fire-Fighter Brigade in five Provinces, namely North Sumatra, Riau, Jambi, West and Central Kalimantan; 2. The brigade will place at provincial PHKA office ( KSDA And TN); 3. (6) Finalizing Government Regulation on forest protection. Forest-fire prevention needs an optimal management operational support (budgeting, materials, etc). Regulation needed to address forest-fire as a DISASTER so that role of all stakeholders should involved in preventing forest fire. Forming forest fire brigades at province level and functioning technical unit (UPT) of DG PHKA. Operation areas will be developed according to the level of danger. It is proposed necessary support to developed training and equipments of fire extinguishing. It is proposed research and development expert in usage of fire / combustion which save, cheap and low impact of smoke to the environment.

3. In many cases, fire also occurred outside forest land. For example, in Sumatera, fire happened in oil palm plantations while in Kalimantan fire occurred in small scale farmings.

Forest industry restructuring

1. Compilation strategy of industrial forestry development in Indonesia by ITTO aids; 2. Executing steps of solving restructuring team (HPH, HTI and industrial of forestry under IBRA; 3. Re-inventory of forest industry in colaboration with Central Beurau of Statistics (BPS) and Ministry of Industry and Trade (Depperindag); 4. Improving coordination with Depperindag, IBRA and Coordinating Ministry of Industrial, Finance and Economic through IDCF forum.

1. Different institutions have different vision to handle the same issue. 2. Intensive coordination is required among related departments concerning forest industries in the long run. It will takes many expenses to support the action.

1. Conducting Industrial Survey at 14 provinces ( year 2001 have been surveyed 6 provinces), executed by BPS with Dephut ( 8 provinces ) and Depperindag funded (6 province). 2. Collecting plan data of wood production from natural forests, social forestry and other sources to fulfill the wood industries. 3. Dephut will complete data-profile company which have been compiled with data / information result of investigation of forestry company / industry under IBRA. 4. 1. KKSK should coordinate the problems under the Joint Committee that consists of the Ministry of Forestry, Ministry of Industry and Trade, IBRA, Local Government and other related institutions. It is expected that the Committee could formulate a firm policy and steps to deal with the problems and carefully pay attention to the vision held by each institution. 2. There is a hope that we can get foreign aids to execute the action, both in the term of formulating strategy and verification activity prior to field audit.

(2) Reforestation and forest industries capacity

(3) 1. A new policy has been set up, such as self mandatory for companies to develop their own annual management plan. 3. Provide information on indicative areas that need to rehabilitate within and outside forest areas. 4. A Task Force (POKJA) under the DG of Forest Production Development (Ditjen BPK) has been established to enhance Plantation Forest Development. 5. Another Task Force (POKJA) under the MoF has also been established to take account on Restructuring Process of Allocated DR for HTI Development 6. The MoF has established and executed Plantation Forest Development Projects namely Hutan Tanaman Swakelola Project in 16 Provinces such as Bali, Sultra, Bengkulu. 1.

CONSTRAINTS
(4) Reaction to the development of plantation forest (HTI) is relatively low or unfit with cultivation schedule (properness to plantation cycle plan) and it does not match between the place and the species chosen, also unprofessional management. Discontinuing of DR as incentive of HTI development. The location of HTI are spread over and relatively small, so that it has small access to the market. Channeling of DR to the forest plantation is unclear. Occupation by society to farm which not yet been cultivated or which have been cultivated (conflict of land). Legal status (it hard to find a clear and clean area). Forest and land fire still rampant in remote areas

(5) 1. Forming of POKJA of restructuring of joint investment timber estate / HTI . 2. Working Group of Restructuring HTI Have been formed under Coordination Secretary general of MoF. The Working Group have worked intensively. 3. Compiling Criteria & Indicator to Evaluate HTI in Restructuring joint venture HTI (Completed and is proposing to Minister of Forestry to be ratified). 4. Coordinating with Forest Planning Agency (Baplan) to collect information and make a map of spreading Log Over Areas for HTI development under working group (WG/POKJA) namely Akselerasi Development Forest Sector. 5. Pilot project location of those WG will be plotted in Jambi and South Kalimantan for the development of crop forest investment scheme and its management. 6. Evaluation and monitoring of tumpang sari activity in HPHTI in year 2002. 7. Conducting evaluation and monitoring of tumpang sari activity in social forestry in 16 provinces. This activities is in cooperation with Depart-ment of Agriculture and Crop Food agency in the province. 8. Establishing the guidelines activity to community development in coopera-tion with WG Akselerasi Develop-ment Forest Sector. 1.

SUGGESTIONS
(6) To make activity of the HTI restructuring using DR effectively by balancing fund composition between Reforestation Fee (DR) and private, liquidation, transfer of management and sell some assets to interested investors. To formulate policies of plantation forest development in order to replanting and to improve the quality of production forest and investing plantation forest to fulfill the need of industry raw materials. To formulate several alternatives funding policy of plantation forest develop-ment through investment profile or investment scheme regulation. Reforestation Fee (DR) is needed as part of an incentive of plantation forest development through project mechanism (motivation building) and soft loan mechanism.

(5) 9. Final draft of Government Regulation of Reforestation Fee / DR have been completed as asked by Act No.41 / 1999 about Forestry. 14. In coordination with Baplan, the Development of Forest Crop as one of the priority forestry development program to put in National Forestry Program (NFP). 10. Evaluation and monitoring progress of Social Forestry Project conducted in 16 Provinces. 11. Assisting implementation of Meranti Development Plantation Forest project in 5 Provinces (Kaltim, Kalsel, Sumsel, Sumbar, and Jambi). 12. 1. As implementation of No. 41 Act, MoF has finished discussing 11 Government regulations. Those regulations are : a. Proposed government regulation concerning Forest Management Plan, Forest Utilization and Forest Land Use and Forest Arrangement. b. Proposed government regulation concerning about Forest Management Planning. c. Proposed government regulation concerning Forest Protection and Nature Conservation. d. Proposed government regulation concerning Local adat. community e. Proposed government regulation concerning Forest Rehabilitation and Forest Reclamation. f. Proposed government regulation concerning Urban Forest. g. Proposed government regulation concerning Education and Training in Forest Extension h. Proposed government regulation concerning Peoples Participation in Forestry Development. i. Proposed government regulation concerning Supervision. j. Proposed government regulation concerning Reforestation Fee. k. Proposed government regulation concerning Performance Fee Guarantee and Infestation on Forest Conservation.

1. Different interpretation and overlap competency between central and local government in managing the forests due to unclear regulations. 2. The availability of foresters and infrastructures are limited, especially in the rural area. 3. Lack of guidance, criteria and standard of forestry management for those officials in the field level. 4. Inconsistency of regulation according to UU no. 22/99, PP 25/2000 and UU 41/1999.

Government Regulation about Planning Forestry have been studied by cross MoF official; 3. RPP about Protection of Forest and Natural Conservation is discussed by cross MoF official; 4. RPP about Society Customary Law is discussed by cross MoF official 5. RPP about Rehabilitating Forest and Farm and Forest Reclamation is done by cross MoF official; 6. RPP about Urban Forest is done by cross MoF official; 7. RPP about LITBANG-DIKLATLUH Forestry is done by cross MoF official; 8. RPP about Role And Society In Development Forestry is done by cross MoF official;

To improve understanding among central and local government staffs on the regulations. It is also needed to regulate duty and functional relationship between central and local government. 3. Giving guidance, training of instruction, tuition and supervision to local government in conducting autonomy policy in forestry sector. 4. Need of support from foreign aids for some activities that cant budget by GoI. 5. Improving dialogue between Governor and Regent in developing the feeling to trust each other. 6. (5) 11. RPP about Guarantee Performance fund (Dana Jaminan Kinerja/DJK) and Investment Fund of Forest Protection (DUPH) is discussed by cross MoF official 12. Socialization responsibility of district level according to Act No. 41/1999. To Evaluate some of District and Governor regulations (PERDA) which is not in line with Act No. 41/1999. The evaluation process are being done by the team from Ministry of Internal Affair (MENDAGRI) 8.

SUGGESTIONS
