Dated: 20.09.2011 To The C.P.I.O Department of Science and Technology, Ministry of Science and Technology, Technology Bhawan, New Mehrauli Road, New Delhi 110016. Ref:- Your Letter No. CO/AD/G01/2010 dated 15.09.2011 to me from your division, regarding CIC Order No. CIC/LS/A/2011/001213 Dated 21.06.2011. Sir, 1. I would like to inform you that I wanted to inspect some files for that I filed an RTI dated 20.07.2010 to CPIO, DST. CPIO did not provide correct information and refused to allow my personal inspection of relevant documents and files. Aggrieved with this I appealed to the FAA, DST, who realised that CPIO DST is at fault and ordered CPIO to provide relief. But CPIO once again acted half heartedly and refused to allow me to inspect relevant files. 2. Aggrieved with this I appealed CIC (2nd Appellate Authority) on 07.02.2011 which issued vide order No. CIC/LS/A/2011/001213, dated 21.08.2011 to allow me to inspect relevant files and provide relevant certified copies within four weeks. 3. CPIO, DST did not take any cognizance of this order of CIC even after passing of more than a week, I tried to remind them and wrote a letter, separately to Sh. Chander Mohan, who appeared on the behalf of CPIO, DST. 4. Thereafter, I received an information regarding inspection from Head of the Division, Dr. B.P.Singh, though that time it was late and inappropriate, as the order was to be complied within four week. Still I agreed to cooperate with the Department. 5. On 03.08.2011, I was allowed to inspect only two files (CO/FP/G163/2008, & CO/FP/PE215/08) which were sanctioned by NCSTC, DST. 1/3

6. However CPIO shown his reluctant and wrongly interpreted RTI Act 2005 and refused to appreciate the letter and spirit of CIC order No. CIC/LS/A/2011/001213 dated 21.06.2011. I clarified and explained the position to the C.P.I.O that order has been passed on the basis of my R.T.I dated 20.07.2010. Kindly do not interpret the order with a clerical mind and allow me to inspect and obtain certified copies of the File No, CO/FP/C08/2008. 7. Thereafter with much reluctance C.P.I.O allowed me to inspect the said file by taking my written request as treated it as a personal obligation to show the file and twisted my written request into a verbal request and extended courtesy to me as informed by Dr. (Mrs.) Shashi Ahuja SC-F, vide her letter CO/AD/G01/2010 dated 15.09.2011 by registered post, received on 19.09.2011. 8. Hence, both the C.P.I.O and Dr. (Mrs.) Shashi Ahuja are wrongly interpreting the letter and spirit of RTI Act 2005 and treating the inspection of file as a matter of extended courtesy on my written request on 03.08.2011. In this regard I would like to inform you that, a decided case of Girdhari Lal vs. Municipal Corporation of Delhi (Decision No.CIC/WB. /2006/00472), in which the Judgment was given, those dealing with the RTI Act are advised to be more careful in dealing with the Act, and are advised to understand the law correctly before dispensing the orders under it. 9. In view of the position stated above Dr. (Mrs) Shashi Ahuja again informed me through letter No. CO/AD/G01/2010, dt. 15.09.2011. That CIC Order No. CIC/LS/A/2011/001213. Dt. 21.06.2011. Does not mention of File No. CO/FP/C08/2008. In this connection it is pointed out that CPIO as well as Dr. (Mrs) Shashi Ahuja have wrongly interpreted and negligence on their part, caused harassment, mental agony and caused delay for more than a year to obtain the information as requested in my RTI. 10.The above action of both officers (CPIO and Dr. Shashi Ahuja), forced me to obtain another order on 20.09.2011 regarding CIC Order No. CIC/LS/A/2011/001213 Dated 21.06.2011. Which directed the CPIO of the Department of Science and Technology, to give inspection of file No. CO/FP/C08/2008, to me officially so that I can obtain certified copies within three weeks without any further delay.

11.However as desired by Shashi Ahuja I am enclosing a Cheque No. 025773 Dated 20.09.2011 for Rs. 124/- (Rupees One Hundred Twenty Four Only) for 62 Pages as informed by Shashi Ahuja with a request to fill the name of the payee officer concerned/designated officer. As regards the fee for file No.CO/FP/C08/2008, will be deposited on the date of inspection of this file officially without any delay. 12.Kindly intimate the convenient date for inspection of File No. CO/FP/C08/2008, so that I can take the extract on payment within three week as per order. Otherwise it will be construed as contempt of CIC, which you have already done once in my case. If it happens second time I will be compelled to take action as per law. 13.The copy of CIC Order dt. 20.09.2011 is enclosed herewith for compliance. Thanking you Yours faithfully
