AFFIDAVIT OF COMPLAINT

STATE OF TENNESSEE SHELBY COUNTY

Personally appeared before me Afliant Mary Christy Cain and Co-Affiant Sgt. K. Davis made oath that on or about the 24 day of December 2010, in said County. and within the jurisdiction of the Criminal Court of Shelby County. Tennessee, one Joseph Sampson Ford age 57, sex male, whose last known address is 9330 Jayne Lewis ve Bartlett. Tennessee 38133, did unlawfully commit the offense (s)of Theft of Property $1000-$I0,O OOiCA 39-l4.3 and the essential facts constituting said offense (s) and the source of the affiants information are asflldws: On Thursday December 24, 20)0, Joseph Ford went into Las Savell Jewelry store located at 6) S. Lcan in Memphis Tennessee and purchased a mans black Rolex watch and a ladies white gold Rolex satch in the attunt of ; 55.835.3) from Mr. Savell and Mrs. Mary Cain assisted with the transaction. Mr. Ford issued ajiersonal che#547 in the style of Regions Bank, for the purchase of the watches. Mr. Ford handed his check to Mr. Savell for paymend then Mr. Save)) handed the check to Mrs. Cain. Mr. Ford advised not to cash the check until 01/10/2011 iid wrote thi1Cte on the back of his check, because he would not have the money in the bank until then. Mr. Ford then ltbthejewelryiore with the two watches. Mr. Fords check was processed on 01/18/2011 and was returned from the bank asjo1 Sufficieunds. The check was sent through again and was returned again on 01/21/2011 as Not Sufficient Funds. Mrs. Cain made several phone calls to Mr. Ford and he stated that he would come to the jewelry store and pay the money owed for the watches and never did. Mrs. Cain made approximately 7 calls to Mr. Ford along with sending 2 collection letters for payment by certified mail. Investigator spoke with Mr. Ford on the phone on Thursday June 9, 2011 and was assured by him that he would pay the debt by Monday June 13, 2011 but Mr. Ford did not pay the money owed. Investigator spoke again with Mr. Joseph Ford on 09/74/2011 and was assured that he would pay the outstanding amount owed on Friday September 16,2011 but did not show up to pay the balance owed. Mr. Joseph Fords bank account was subpoenaed for which the check was written from and it showed that between December 23, 2010 and January 20, 2011, Mr. Ford did not have enough money in his account to pay for the watches. Mrs. Cain positively identified Mr. Ford from a photo line up as the one who presented the check for payment of the watches. The documentation was tagged as evidence. Total loss to Las Savell Jewelry Store is $5,835.31. This offense occurred in Memphis, Shelby County. Tennessee
