ADDENDUM TO PUBLIC NOTICE NO.09/2008 dated 17.01.2008

Sub:- Lev of Light-dues under the Lighthouse Act, 1927

The provisions of Section 10 of the Light-house Act, 1927 have been thoroughly examined. In
accordance with Section 10(2) of the Light-house Act, 1927, light-dues payable in respect of a Ship
shall be paid on its arrival at, and on its departure from, any port in India. Under the proviso to sub-
section (2) of Section 10, if the light-dues have been paid in accordance with provisions of the Act, no
further light-dues shall become payable in respect of that Ship for a period of 30 days from the date on
which the dues so paid became payable. Accordingly, differential light-dues shall not be recovered
from a vessel, the Deck Cargo of which is increased during the period of exemption of 30 days
allowed by the proviso mentioned above. Thus Light-dues shall be levied on a ship after the expiration
of the free period of 30 days in respect of her registered tonnage and the Deck Cargo Tonnage, if any,
on the date of her liability to pay dues

2. In view of the foregoing position, para 8 of the Public Notice No..09/2008 dated 17.01.2008
issued by Jawaharlal Nehru Custom House which reads: The one o he Mae of he Ship hall

is amended as follows :
The owner or the Master of the Ship shall pay light dues on the Registered Tonnage of her Ship as
well as on the Deck Cargo Tonnage, if any, on the date of her liability to pay light dues. In accordance
with the provisions of Section 10(2) of the Light House Act, 1927, no further light dues shall become
payable even if the Ship picks up any additional Deck Cargo during the free period of 30 days.

3. A sample calculation of Light Dues with liability dates is annexed for
clarification.

Siaion :

1. Suppose Ship departs on 14.07.2008 with 1000 20 Containers as Deck Cargo.
The Ship need not pay any additional light dues in respect of the excess 100 containers
carried at the time of departure.

2. Date 10.07.2008 is the relevant date or the liability date. The liability date is not the date on
which the light dues payment is actually made.

3. In terms of Section 10(2) of the L.H Act, 1927.
For a period of 30 days from 10.07.2008 onwards the vessel will not pay any further light dues
i.e from the liability date 10.07.2008 light dues paid by the Ship are valid till the midnight of 09.08.2008.

4. If the Ship returns in her next Voyage on 06.08.2008 no light dues become payable on arrival.
If the Ship departs from JNPT on or after 10.08.2008 light dues shall be payable on the Net Tonnage
and Deck Cargo Tonnage carried by the vessel at the time of departure.
