______ Effective date: _______________ TITLE: THE CITY OF TRAVERSE CITY ORDAINS: That Section 410.03, of the Traverse City Code of Ordinances, be amended to read in its entirety as follows: 410.03 AMENDMENTS TO UNIFORM TRAFFIC CODE. The following sections and subsections of the Uniform Traffic Code for Cities, Townships and Villages, as adopted in Section 410.01, are hereby amended or deleted as set forth and additional sections and subsections are added as indicated. R 28.1001 Rule 1. (Amended) Words and phrases. (1) As used in this code: (a) (b) (c) (d) Act means the Michigan vehicle code, 1949 PA 300, MCL 257.1 et seq. Alley means a minor thoroughfare, opened to public use, for the purpose of ingress and egress to service adjacent buildings. Bicycle lane means a portion of a street or highway that is adjacent to the roadway and that is established for the use of persons riding bicycles. Bicycle path means a portion of a street or highway that is separated from the roadway by an open, unpaved space or by a barrier and that is established for the use of persons riding bicycles. Bus stand or bus stop means a fixed area in the roadway, parallel and adjacent to the curb, to be occupied exclusively by buses for layover in operating schedules or by buses waiting for, loading, or unloading passengers. Clerk means the person who keeps the records and performs the regular business of a governmental unit. Curb loading zone means a space that is adjacent to a curb and that is reserved for the exclusive use of vehicles during the loading or unloading of passengers or materials. Freight curb loading zone means a space that is adjacent to a curb and that is provided for the exclusive use of vehicles during the loading or unloading of freight.

Governmental unit or municipality means an incorporated city, an incorporated village, or a township. (Added) Marked crosswalk means any portion of a roadway distinctly indicated for pedestrian crossing by appropriate markings, signs, barriers, or other devices to give notice thereof. Official time standard means the hours named in this code are hours of standard time or daylight-saving time, whichever is in current use in this governmental unit. Parking meter zone means an area that is adjacent to a parking meter and that is set aside for the exclusive use of vehicles upon the deposit of a coin of United States currency in the parking meter as specified on the meter. Passenger curb loading zone means a place that is adjacent to a curb and that is reserved for the exclusive use of vehicles during the loading or unloading of passengers. Stand or Standing means the halting of a vehicle, other than for the purpose of, and while actually engaged in, receiving or discharging passengers. Stop, when required, means the complete cessation of movement. Stop or stopping, when prohibited, means the halting, even momentarily, of a vehicle, whether occupied or not. The terms do not apply to the halting of a vehicle that is necessary to avoid conflict with other traffic or that is in compliance with the directions of a police officer or traffic-control sign or signal. Taxicab means a licensed public motor vehicle for hire that is designated and constructed to seat not more than 10 persons and that is operated as a common carrier on call or demand. Taxicab stand means a fixed area in the roadway that is set aside for taxicabs to stand or wait for passengers. (Added) Through or thru, when prohibited, means a vehicle traveling a highway or street that does not have an origin, destination, or scheduled stop on that highway or street. Tow-away zone means a zone where parking, stopping, or standing is not permitted, as indicated by proper signs, and where vehicles parked in violation of the signs are towed away to keep the roadway clear for traffic

movement. (u) U-turn means a turn made on a roadway or in an intersection by a vehicle for the purpose of reversing its direction of travel.

(a) Rule 159. Presumption of vehicle weight. (Added) A presumption of the minimum weight of a vehicle shall be established by evidence of the weight indicated on the Michigan registration certificate for the truck or other commercial vehicle in question. (b) Rule 160. Authority of City Engineer; closing streets. (Added) Unless otherwise provided by law, the City Engineer is hereby authorized to close any highway, street, alley or other rightof-way or portion thereof which is under process of construction, improvement or repair, by placing traffic control devices in accordance with the Michigan Vehicle Code. A person who violates this section is responsible for a civil infraction. (c) from Rule 551 Boarding or alighting from vehicles. (Added) No person shall board or alight

any vehicle while such vehicle is in motion. A person who violates this section is responsible for a civil infraction. (d) Rule 619. Lights and reflectors. (Added) No person shall operate a bicycle on any street, alley or public place from one-half hour after sunset to one-half hour before sunrise, unless the bicycle is equipped with lights and reflectors as required by the Motor Vehicle Code applicable to bicycles, and unless the same are operating. A person who violates this section is responsible for a civil infraction. (e) or Rule 631. Bicycle parking. (Added) No person shall park a bicycle in any street, alley public place, except in a standing position, and no person shall park a bicycle on any sidewalk except in standards provided therefore. A person who violates this section is responsible for a civil infraction. (f) Rule 702. (Amended) (1) marked (2) to so yield, Pedestrians; right-of-way in crosswalk; violation as a civil infraction.

When traffic-control signals are not in place or not in operation, the driver of a vehicle shall stop and yield the right-of-way to every pedestrian within a crosswalk. the Uniform Traffic Code, no person shall operate a snowmobile in the City unless authorized by the Police Chief. A person who violates this section is responsible for a civil infraction.
