VIII. ADDITIONAL INFORMATION OR EXPLANATIONS.

The Non-Investment lnoome reported under Part III-A was compensation received from my employm~at at Parr Waddoups before I assumed the bench on October 23, 2008. The assets in my 40 lk Aeeonnt as reporled on the Nomination Disclosure Form was rolled over in 2008 to National Financial Servlees, then used to purohase the MassMatual RetireEase Annunity, MassMutual Odessy Fund and the MMLISI Brokerage Account. The MMLISI Brokerage Account is the same as the Fidelity Mmtagement Trust Company. Distributions in 2009 were from these accounts.
