The undersigned through a letter dated: 18-11-2010 has expressed his inability to remit three months pay and requested to consider three months notice from 05-10-2010, the date of intimation and intention to join in new job given through Annexure-II. But, surprisingly, the undersigned has received another Memorandum dated: 01-12-2010 from.Officer In Charge, SRO, Patancheru, denying the commencement of the notice period from 05-10-2010 and considering the same as 1811-2010 and also directing me to tender my written resignation. (The said Memorandum dated: 01-12-2010 is annexed here as Annexure-V).

As per the requirement of the competent authority of EPFO, Regional Office, Hyderabad, the undersigned has again represented through the letter dated: 03-122010 to relieve on Technical Resignation on lien basis by Regulation 10(1) & 18 of the Employees' Provident Fund (Officers and Employees' Conditions of Services) Regulations2008. (The said representation Dated: 03-1202010 is annexed herewith as AnnexureVI) But the Competent Authority has not responded to the said Technical Resignation immediately. As the Competent Authority of EPFO, has rejected my immediate relieving through Annexure-M, the undersigned requested the Joint Secretary of CISR, New Delhi to give three months time to join the new job vide letter dated: 12-11-2010, and to my surprise, the said requisition was also denied by the joint secretary, CSIR, New Delhi, vide letter dated: 09-12-2010. (These two letters dated: 12-11-2010 and 09-122010 are annexed herewith as Annexure VII & tam Thus the applicant is really in a

suffocating situation, that the competent authority of the EPFO has not relieved to join the new assignment and also the joint secretary of CSIR has denied the extension of Three (.3) months time to join the new job. As the Competent Authority of EPFO, has not responded to the technical resignation dated: 03-12-2010 (Annexure-VI) and the Joint Secretary, CSIR, New Delhi also denied extension of time to join the new job, the undersigned has no other option except to remit three months pay to EPFO to get relieved. Though there is no mention of the rule prOvision/regulation under which such a demand was made by the competent authority of EPFO, the undersigned paid an amount of Rs. 20,6001(Rupees Twenty Thousand Six Hundred only) through Demand Draft No.185079 dated: 16-12-2010 drawn on State Bank of H deraba Patancheru branch favouring Regional P.F. Commissioner-II, SRO, Patancheru on 16-12-2010 and requested to relieve on 22-12-2010. The said representation of the undersigned was forwarded by the RPFC-II, SRO, Patancheru to the Conipetent AuthoritY :,:(RpFC,

Hyderabad) on 21-12-2010 with a submission that the applicant's resignation might be accepted on technical formality. (The said letter dated: 21-12-2010 by RPFC-II to the Competent Authority is enclosed and marked as Annexure-IX). But even then the undersigned has not got any relieving orders from the competent authority. The Regional P. F Commissioner-II & OIC of SRO, Patancheru, through a letter dated:24-12-2010 submitted to the competent authority (RPFC, Hyderabad) that an endorsement was made by RPFC-II, SRO, Patancheru in the application of the undersigned to the new job, in CSIR, New Delhi. The said Letter dated: 24-12-2010 is enclosed herewith as Annexure-X for your ready reference). It is not known, whether the competent

authority has taken these facts in to consideration before -disposing the applicants technical resignation on lien basis. Now, the undersigned has visited the Office of the Competent Authority, Hyderabad on 27-12-2010 and enquired about the relieving order and learned that, the date of notice commenced from 18-11-2010 and though requested to get relieving orders from 22-12-2010, they consider only one month from 18-11-2010 to 18-12-2010 as expired portion and need to remit two months pay to get relieved.(Here my pay including grade pay is Rs.10840/-) Thus I was instructed to remit another Rs.1080/(Rupees One Thousand and Eighty only). Through the Demand Draft No.091386 dated: 28-12-2010 drawn on Indian bank, Hyderabad, the undersigned remitted the same. Thus a total amount of Rs. 21,680/- (Rupees Twenty One Thousand Six Hundred and Eighty only) (@ Rs 10,840 per month) was remitted though actually relived from 28-122010 (AN).

Through the Annexure-III, the undersigned categorically requested to refund the remitted amount of Rs. 21,680/-, as it is a technical resignation, and has to be accepted on technical formality, no correspondence was received till date in this regard. The relieving order dated: 28-12-2010 has also not mentioned whether the resignation was accepted on technical formality or not. Through the Annexure-III, the undersigned has also requested to pay the encashment amount for the earned leave at credit as on the date of relieving. Around 70 (Seventy) earned leaves are at the credit of the undersigned as on the date of relieving.

Annexure I' to X are enclosed herewith for speedy disposal of this RTI application and also for the needful action. Now it is humbly requested to provide:

(a) A Certified .Copy of the Rule Provision/Regulation under which the Memorandum Dated: 16-11-2010 & Letter dated: 15-11-2010 (Annexure III & IV) were issued.

(b) A Certified copy of the note sheets in which the competent authority has taken a

decision to demand three months pay to relieve the undersigned.

undersigned requested to consider commencement of the notice period from 05-

'10 , 2010 the date of Annexure-II, where as the Competent Authority denied the same and considered the date of Notice as 18-11-2010. A certified copy of the note sheet in which reasons were recorded not to consider notice period from 05-10-2010 and to consider the same as 18-11-2010 be provided please. A copy of the specific instructions that the competent authority relied on to take such a decision may also be provided to the undersigned please.

(d) The undersigned tendered technical resignation dated: 03-12-2010 (Annexure-VI). It is not known, whether the resignation was accepted on technical formality or not. If not accepted on technical formality, it is requested to provide the certified copies of the note sheet portion on which the reasons were recorded not to consider the resignation as technical resignation. It is also requested to provide a copy of the orders on which the competent authority relied on not to consider the resignation on technical formality.

(e) It is also requested to provide the copies of the rules/regulation under which the technical resignations are accepted by the Employees' Provident Fund Organisation.

(f) It is also requested to provide the details of the latest TEN (10) Technical Resignations accepted by the EPFO submitted by the officials who were selected on open competitive examinations and absorbed in Central Government Departments/Statutory Bodies/Autonomous Bodies/Organisations/Public Sector Undertakings etc., in the following format.

Now the applicant was forced to remit the balance amount of Rs.1080/(Rs.21,680 minus Rs 20,600) to get a relieving order. But the date of relieving was 28-12-2010. Thus the unexpired portion will be One month and Twenty Days only, but the . itithorities were demanded two months pay to get relieving orders. It is now recuested to provide a certified cony of the specific orders that the competent authority relied in this regard not to consider the unexpired portion of the notice in days and to consider it only in months.

(h) The uncle . signed through the letter dated: 16-12-2010, requested for encashment ._ of..
the earned leave at credit. But till date, no correspondengein this regard/no encashment amount has been received by the applicant. Now it is requested to provide the details of the date wise action taken by the Competent Authority/RPFC:.II,H$RO, .Pata.nCheru in this regard. Certified copies of the note sheets in this regard may also be provided to the undersigned..

(i) The Officer In Charge, SRO, Patancheru through Annexure-IX & X mentioned that,
Regulation 18 of the Employees Provident Fund (Officers & Employees Conditions of SerVice) Regulations 2008, the applicant technical resignation can be accepted and

the application to the new job was endorsed by RPFC-II, SRO, PAtancheru. Now it is
requested to provide, a certified copy of the note sheet in which, the above facts were not considered/considered or differed by the competent authority.

(j) As the applicant is an employee who was recruited on or after 01-01-2004, come under New Pension Scheme, Till date the undersigned has not received PRAN Number. It is now requested to provide PRAN Number. Please provide the certified New Pension Scheme copies ci the instructions issued for settlement/transfer of the Contributions in respect of the cases as of the undersigned. If no such orders are issued, please provide me the method in which NPS Contributions has to be

With reference to the subjected cited above, I, K. Venkata Subbaiah, (Roll No. 63503710) was selected to the post of Assistant and was posted at NGRI, Uppal Road, Hyderabad. I got my appointment order on 11-11-2010 from NGRI. Presently I am working in Employees P.F. Organisation (www.epfindia.com ), which is a statutory body under the Ministry of Labour, Government of India. I gave a representation on 12-11-2010 for relieving order. I received a Memorandum under reference (2) cited above is enclosed for your reference. As per the said Memorandum, I need to pay Three months pay to get my relieving order as per the EPF ( Staff and Conditions of Service ) Regulation 1962. I am working in the present organization in a clerical cadre, and. I am unable to remit the said amount in lump sum so as to get relieved and also to join NGRI, Hyderabad.
