EFFECT OF COUNTERFIET PRODUCT ON BRAND GOOD WILL 1. INTRODUCTION


This study has been conducted on the negative effect on the good will of the brands just because of the counterfeit product that is present in the market. As counterfeit product does not full fill the needs & want of the consumers as they are expecting & as a result the image & good will of the brand affected, it also has adverse effect of counterfeiting is on the economy as a whole. The presence of counterfeits might shake the confidence of shoppers in product quality being available in the country shoppers paradise could get damaged. Counterfeiters, attracted by low costs and high margins could even push genuine retailers out of the market affected by cost and profit pressures.

Now a days counterfeit product have capture a very large market all over the world so far but the biggest market of the counterfeit product are in Asian countries mainly in Pakistan, India, Bangladesh e.tc. The impact & market of counterfeit product seems to very high in Pakistan because there are no followers of rules and regulation, although there is a law against the counterfeit product but it is not implemented & there is no such type of check & balance. In Pakistan the concept of counterfeit product is on the peak due to which the brand manufactures are facing allots of problem. This studies is conducted for the purpose how to overcome with the effect of counterfeit product & what prevented action should be taken against them. So far the researches conducted on this topic are on other countries, so far this research going to be the first that is conducted in Pakistan.

In the case of non-deceptive counterfeiting, where the consumer recognizes that the product is not authentic and so pays an adjusted price for it, the branded manufacturer would not be affected, as these consumers are unlikely to purchase the genuine product in the absence of counterfeits. However, this negatively affects the business and trading environment of the economy. After using the counterfeit product the consumer always go for the counterfeit product who are price conscious because they think the same about the brand product that both will have the same performance as a matter of fact it is destroying the hole market for the brand & highly effect the brand good will. Although there are many research studies conducted in the area of

counterfeit product they have only focus on few i.e brand good will, effect on market, laws against such product e.t.c, but they have missed the important thing on which they have the study will be focus these dimension are proper check of retailers, awareness, serve should be conducted after a specific time period & distributer should have the lenses. The primary data source will geather with the help of question ears & interviews from Manufacturers Retailers, Distributers & consumers. Peshawar, Pindi & Lahore reason are taken for the consideration of the research.

SIGNIFICANCE OF STUDY
This study will benefit both the consumer & the manufacturer to stay away from such product & will help the economy to grow. This study will provide the way & different methods to stop & decreases the number of counterfeit product which are effecting the brand good will. Further on the study can also be used by the corporate law to introduce new law or can be helpful in building the policies for the organizations. This study can be used by the teachers & student of Pakistan to know about the current status and the law which are using in Pakistan against the counterfeit product & what manufacturers are doing to prevent their Good Will.

ORGANIZATION OF STUDY
The organizational structure of the body is that, the study is being organized in few chapters which are elaborated as chapter 1 includes the introduction, chapter 2 of the study is about the review of the literature, then comes chapter 3 which explains about the methodology of the study, chapter 4 refers to the theoretical framework of the research and relations of the variables, chapter 5 is about the analysis and the findings which are taken out of the analysis, chapter 6 elaborates the conclusion and recommendation of the study and in chapter 7 study is giving the references and appendix.

Review:
In this article the author (Vithlani, March 1997) disused & reported that the counterfeiting in not only the problem one or two industries but it is the world wild problem, as the article show that this problem is not limited to a few products or certain countries actually , it is a global problem affecting a wide range of industries. Moreover the impact of it is devastating on our society as a whole. In this article he discussed about the protection against counterfeiting & present different type of policies which would help in fighting against the counterfeiting. It lists contact details of organizations that can assist in the fight against counterfeiting. Some of his main findings are as following: provide for criminal procedures and penalties to be applied at least in cases of willful trademark counterfeiting or copyright piracy on a commercial scale adopt procedures to enable a right holder, who has valid grounds for suspecting that the importation of counterfeit trademarks or pirated copyright goods may take place, to lodge an application in writing with competent authorities, administrative or judicial, for the suspension by customs authorities of the release into free circulation of such goods

(Pollinger, 2007) He focused & discus the main issue of the world that is terrorism & relate it with the counterfeiting. Author says that the production and sales of counterfeit products is an increasingly serious problem in the international trade market. There is the notion that counterfeit sales directly fund terrorist organizations beside the issue of intellectual property theft and consumer safety. The author uses number of economic controls to analyze the effect of two proxies of annual counterfeit sales on two measures of international terrorism. (LEWIS, 2008) Counterfeiting poses significant threats to Americans and the nations economy, there are many steps that businesses, consumers, and governmental entities can take to make counterfeiting more difficult, more risky, and less profitable. If these entities cooperate, then it is quite possible that their efforts will reduce the global incidence of counterfeiting, make consumers safer, eliminate disincentives to innovation and growth, and remove opportunities for unscrupulous criminals to finance deadly activities, and protect the ideas and concepts that form the backbone of our economy. It will not be easy; encouraging enforcement of intellectual property rights will be met with obstacles, as counterfeiters will do anything to protect their

livelihoods. Nevertheless, we must fight back, lest counterfeiters fill the world with fakes. We must fight back, and we must fight back now.

(Deisingh, December 2004) In his article he says Pharmaceutical counterfeiting is becoming a serious problem both in developed and developing countries. This paper considers the extent of the problem and provides several examples of drugs which have been counterfeited. Additionally, the effects of counterfeit products on consumers, health care providers, drug manufacturers and governments are discussed. Several of the currently used methods of detection are described and these include near-infrared spectroscopy, Raman spectroscopy, isotopic characterization, tensiography, chromatographic and mass spectrometric approaches. Finally, anti-counterfeiting measures such as the use of holograms, tracers and tangents and electronic tracking are summarized.

(Michele Forzley, July 2003) This is the first study to systematically review available materials in an effort to define the problem and begin the scientific study of counterfeit goods as a disease mechanism. There are public health and safety consequences to counterfeiting but no quantitative or qualitative measures in support are presented nor have studies been conducted. Among the findings and recommendations of this study are: Worldwide, children and adults are experiencing injuries, harm and death associated with counterfeit goods, particularly; drugs, alcohol, cigarettes, foods, and personal care items. Injuries and harm from counterfeits include death, blindness, headache, illnesses, swelling and rash, failure to recover from illness, burns, hospital admissions and other adverse reactions. In addition: o Counterfeit cigarettes are associated with tobacco related diseases. o Crime, terrorism and the attendant mental and physical health consequences are associated with counterfeit goods.

(IBRAHIM, 2008) This author adopts the view that personal goodwill, like business goodwill, should be deemed marketable property. Under this view, buyers receive a step-up in basis in the goodwill and can amortize it for tax purposes. C corporation sellers can sell the goodwill ancillary to the sale of their corporations and avoid double taxation. All sellers may receive

favorable capital gains treatment on the sale. If personal goodwill is treated as property that can be sold ancillary to the sale of the corporation's assets or stock, it can produce a more favorable after-tax result for both buyer and seller. An effective transfer of personal goodwill is also necessary to give buyer the benefit of its bargain.

(Lecours, March 2011) In this article the author says that a manufacture may take into its own hands the commercialization of its product. However, this cause manufacture to allocate large quantity of resources & time to operate. Furthermore, when opportunities to enter new foreign markets, the manufacture itself dose nit always possess the necessary experience & contact. It will often be advantage for the manufacturer to secure the assistant of a business partner whose expertise & distribution network will allow efficient marketing for the product. His main findings were that during the negotiation of a distribution agreement, two important aspects must be taken: Territorial exclusivity & ownership of product good will.

(Day, 2008) Author says about the GOODWILL, Goodwill is the difference between the value of a business enterprise as a whole and the sum of the current fair values of its identifiable tangible and intangible net assets. Net assets are the assets that are left after subtracting the companys liabilities. Goodwill is only recorded when its amount is substantiated by an arms-length transaction. Goodwill cannot be sold or acquired separately but has to be included in a purchase with the net assets of a business enterprise.
