CRIMINAL COMPLAINT - ARREST WARRANT AFFIDAVIT


The undersigned, under penalty of perjury, complains and says that on or about the 1st day of January , 2012 , in the County of Bernalillo, State of New Mexico, the above-named defendant(s) Did (here state the essential facts):
On 1/1/12 at 0158 hours I was in the area of 3rd and Central SW on the Northwest corner. The street on Central Ave W was blocked off between 3rd St SW and 5th . With Northbound and Southbound blocked on 4th from Gold St SW. This allows pedestrian traffic to have access to the roadway due to the high amount of foot traffic in this area. There are approximately seven bars in this section including, but not limited too, One Up, Knockouts, Library, Maloneys, and Effex Night Club. The bars had let out by this time and I estimated four to five hundred people on Central W. I heard and then observed a fight starting in front of Knockouts. There were what appeared to be eight individuals actively engaged in the fist fight. Approximately fifty to one hundred people crowded around the individuals engaged in the fight. I informed dispatch of the situation via radio and I requested back up to the area. As officers arrived to the scene I walked into the crowed. The fight dissipated and I was not able to find the individuals engaged in the fight. There were no victims or offenders found or detained at that time. According to most witnesses the fight that started here, restarted at the Southeast corner of 3rd and Central SW. At 0202 hours I was on the Northwest corner of 3rd and Central NW when I observed what appeared to be another altercation beginning on the Southeast corner of 3rd and Central SW. As I began to walk over to the large crowd to identify what was happening approximately five gun shots went off from an unknown offender. On the street corner I observed what appeared to be around one hundred people in the area. Near the benches on Central W just east of the intersection I observed a heavy set Hispanic male on the ground and it appeared that he was bleeding. The male was identified as Ricardo Cordova. Ricardo was shot multiple times. As the gun shots were going off I informed dispatch that there were shots fired at my location. I observed the large crowed go into a frenzy of motion with individuals going in multiple directions. I observed people pointing to the Southeast and I observed multiple males running in that direction toward the Lotus Night club. I crossed the street and made it to the South side of the fence on the Southside of Central just east of 3rd St SW. That is when I heard five more gun shots go off. At this time I still could not identify the unknown gunman. The gunshots appeared to come from the middle of the parking lot on the Southeast corner of Central and 3rd St SW. I took cover behind an engine block because I was in fear that the offender had observed me and was firing gun shots at me. After the gun shots stopped again I observed a small group of males in the middle of the parking lot. Officer D. Heshley, Sergeant Armijo, and I were told that the gunman was the black male near us. We assisted the black male to the ground. I observed that the male was wearing a blue sweater and was bleeding profusely. At that time I did take his right arm to place him into handcuffs to ensure he was not armed with a handgun. As I got him rolled over to get his other arm I observed he had multiple punctures to his chest and stomach area. I was able to determine that he was not armed and I took the handcuff off of him. The black male was identified as, Charles Britt. As soon as I knew Britt was not armed I informed dispatch that we had a male conscious and breathing but had sustained multiple stab wounds and he had a large amount of blood coming out of his wounds. A bystander came and assisted me by applying pressure to his chest. I observed rescue crews at the scene on Central attending to the gunshot wound victim, Ricardo Cordova. At the stabbing scene I made contact with Jason Sanchez. He stated that Britt hit him over the head with a bear bottle. I observed a large mark matching the shape of a beer bottle on Jasons forehead. Officer Heshley was with Britt at this time. There was another Officer, I do not recall who, I told to keep Jason at the scene. Jason was found to have left the scene in an unknown direction. It is unknown what his involvement was at this time other than he was hit in the head with what appeared to be a beer bottle.

At that time I could still see rescue and ambulance crew arriving to the scene but not coming over to my location. I ran and showed an EMT where Britt was in order to give him medical care. I made contact with a witness, Asa Keyes. I recalled seeing Asa near me just prior to the gunshots going off. Asa stated that he observed Britt with the gun originally at the corner of 3rd and Central SW on the Southeast corner. Asa described that Britt pulled the gun from his waist band from the front of his jeans. Asa stated that he observed a male run to the middle of the parking lot. Asa believes that another male with dreadlocks had a gun. Asa was with his girlfriend, Jasmin Jaekel. Jasmin only observed the original fight it moved over to the other side of 3rd and Central SW. I then made contact with a witness named Tyler Wade. As I was approaching Britt, Tyler stated that the male with gun was Britt and that he observed the altercation from when it started near One Up. Tyler stated he watched the altercation start at One Up between the two males. Tyler stated he does not know any of the males involved. Tyler believed the original fight was because of a disrespect issue. Tyler observed Ricardo punch and take three black males to the ground which started an even bigger fight. Officers began to walk in and all the males that were fighting went to the Southeast corner of 3rd and Central. Tyler began to walk to his car and observed one of the black males, Britt run by himself into the parking lot ahead of everyone else. Tyler then saw Britt walking hunched over with his hand inside his waistband as if he was concealing something and appeared to be stalking up to Ricardo who was at the Corner of 3rd and Central SW. When Britt got to the fence he pulled an all black handgun out and began to fire. Tyler was very close to Ricardo and could see the blood spattering away from him. Tyler took cover and tried to leave the scene. That is when Britt ran from the scene and ran right to Tyler. Tyler stated that Britt pointed the gun at him and stated, Get the fuck out of my way. Tyler put his hands in the air and went for cover. Tyler could see Britt run towards the middle of the parking lot where he could see a group of guys in a car confront Britt. Britt began to fire his gun again. Tyler observed Britt and the males get into a physical altercation. That is when Tyler observed a black male with dreadlocks run up and grab the gun off the ground and enter a near by SUV. That is when Tyler observed officers approach Britt. Tyler told officers that was the shooter. I then made contact with two witnesses that were in their vehicle in the parking lot when the altercation occurred. Amanda Lucero and Carlos Lucero, observed a male in a light blue sweater pull a gun out of his waist line. They stated that they observed, Rircardo Cordova, throw a metal box at the unknown black male in the light blue sweater. That is when the unknown black male pulled out the gun. With the information gathered I respectfully request at a warrant be issued for Charles Britt.
