CALL TO ORDER At 4:00 p.m. of Monday, November 21, 2011, Speaker Feliciano Belmonte Jr. called the session to order. NATIONAL ANTHEM AND PRAYER Pursuant to Section 72, Rule XI of the Rules of the House, the Volunteers International for Development, Education and Solidarity (VIDES) Choir, in celebration of the 22nd anniversary of the United Nations Convention on the Rights of the Child (UNCRC), led the singing of the National Anthem and thereafter, sang the Doxology. SUSPENSION OF SESSION The Speaker motu proprio suspended the session at 4:05 p.m. RESUMPTION OF SESSION At 4:09 p.m., the session resumed with Deputy Speaker Maria Isabelle Beng G. Climaco presiding. ROLL CALL DISPENSED WITH On motion of Representative Francisco Emmanuel R. Ortega III, there being no objection, the Body dispensed with the Roll Call. TO THE COMMITTEE ON RULES THE PRIVILEGE HOUR It being a Monday, on motion of Rep. Ortega (F.), there being no objection, the Chair declared a Privilege Hour. Thereafter, on motion of Rep. Ortega (F.), the Chair recognized Rep. Aurora E. Cerilles to deliver her speech. PRIVILEGE SPEECH OF REP. CERILLES Rep. Cerilles spoke about the commemoration of the 22nd anniversary of the United Nations Convention on the Rights of the Child (UNCRC) for which an exhibit of photographs depicting the core principles of the Convention was being held at the North Wing lobby of the House of Representatives main building with the participation of the Child

MONDAY, NOVEMBER 21, 2011 Rights Network (CRN), the Philippine NGO Coalition on the UNCRC, and the House Committee on the Welfare of Children. Furthermore, she disclosed that the Committee Affairs Department of the House has spearheaded the development of the childrens checklist as a tool guide for assessing the compliance of proposed measures with the UNCRC, which was launched earlier that day. She added that Deputy Speaker Climaco and Minority Leader Edcel C. Lagman had filed House Resolution No. 1902 which seeks the utilization of a childrens checklist in the legislative process thus ensuring a human rights-based approach to policymaking.

5 Rep. Herrera-Dy thereafter pointed out that the laws that Congress had passed to protect the rights of children and juveniles from enforced labor and employment, discrimination in social status, physical and psychological violence, sexual exploitation and the lack of legal protection, had been complemented by the creation of the Committee on Welfare of Children in the 14th Congress and the proposal to create an Ombudsman for Children to ensure the protection of their rights under the law. She then appealed to her colleagues not to rest on these legislative accomplishments, but rather work on the more comprehensive legislative undertakings that will serve the best interest of the Filipino child. REFERRAL OF REP. HERRERA-DYS SPEECH On motion of Rep. Ortega (F.), there being no objection, the Body referred the speech of Rep. Herrera-Dy to the appropriate Committee. ACKNOWLEDGMENT OF GUESTS With the permission of the Chair, Rep. Ortega (F.) acknowledged the presence in the Session Hall of guests of Rep. Jocelyn S. Limkaichong. Whereupon, on motion of Rep. Ortega (F.), the Chair recognized Rep. Cinchona C. Cruz-Gonzales for her privilege speech. PRIVILEGE SPEECH OF REP. CRUZ-GONZALES Rep. Cruz-Gonzales informed the Body of the extra-precaution and safety that will have to be undertaken in the wake of the report and findings of the EcoWaste Coalition regarding the rampant proliferation in the market of childrens toys contaminated with substantial amounts of hazardous toxic chemicals which pose major health risks to children. She said that the findings of the EcoWaste Coalition should be taken seriously and thereafter called for the conduct of congressional inquiry in aid of legislation on the said issue. She likewise called on the different government agencies to assist in the investigation to urgently address the problem. Thereafter, on motion of Rep. Ortega (F.), the Chair recognized Rep. Walden F. Bello for his interpellation, however, before his interpellation, the Chair recognized Rep. Orlando B. Fua for a parliamentary inquiry.

Rep. Cerilles thereafter expressed her gratitude to the Members of the House for their help in the approval on Third Reading of several measures that will protect Filipino children from homelessness, violence and exploitation. She further sought the help of the Committee on Appropriations and the Members of the House to enact into law the Special Education Bill and provide for the necessary appropriations to create special education centers for children with special needs. REFERRAL OF REP. CERILLES SPEECH On motion of Rep. Ortega (F.), there being no objection, the Body referred the speech of Rep. Cerilles to the appropriate Committee. On motion of Rep. Ortega (F.), the Chair subsequently recognized Rep. Bernadette R. HerreraDy for her privilege speech. PRIVILEGE SPEECH OF REP. HERRERA-DY Rep. Herrera-Dy underscored the significance of the UNCRC which also forms part of the law of the land as well as the importance of the full implementation of the laws that Congress had enacted to conform to the countrys ratification of the Convention. She stressed that in principle, the UNCRC fundamentally provides for the best interests and rights of children to life, survival and development, nondiscrimination, and to participate in all important socio-political processes affecting their welfare.

6 PARLIAMENTARY INQUIRY OF REP. FUA Rep. Fua inquired whether the rule that a member of the Minority should be the first to be recognized during interpellations still stands. The Chair replied in the affirmative. With the indulgence of Rep. Bello, the Chair recognized Rep. Fua for his interpellation. INTERPELLATION OF REP. FUA To Rep. Fuas concerns, Rep. Cruz-Gonzales explained that she had proposed for a congressional inquiry because the Department of Trade and Industry (DTI) had taken samples from the market showing that most toys made from China were contaminated with toxic chemicals. She however agreed to Rep. Fuas suggestions, especially on the need for representatives of the Executive department, to meet with their counterparts in China so as to urgently address the matter and added that government agencies should exert every effort to put a stop to the proliferation of chemically contaminated products in the local market. Thereafter, the Chair recognized Rep. Bello for his interpellation. INTERPELLATION OF REP. BELLO

MONDAY, NOVEMBER 21, 2011 INTERPELLATION OF REP. CAGAS Rep. Cruz- Gonzales agreed with Rep. Cagas that in addressing the aforecited problem, local government effort rather than legislative action would be faster and more practical and the Members could just coordinate with government agencies. She however explained that Congress could help evaluate the implementation and effectivity of laws and executive issuances on product standards. MANIFESTATION OF REP. DEL ROSARIO (A.G.) Recognized by the Chair, Rep. Anthony G. Del Rosario informed the Body that he had filed House Resolution No. 1669, calling for a congressional inquiry into the proliferation of toxic toys and school supplies in the domestic market. QUERY OF REP. CAGAS Rep. Cagas subsequently asked what the status of the Resolution was. SUSPENSION OF SESSION On motion of Rep. Garin (J.), the Chair suspended the session at 5:17 p.m. RESUMPTION OF SESSION

In his interpellation, Rep. Bello urged the Members to study the preventive measures being undertaken by other countries in limiting such kinds of imported products from China and emphasized that the Philippine government is empowered to restrict such imports pursuant to a section on sanitary and phytosanitary standards under an agreement in the World Trade Organization (WTO)-Uruguay Round. While he agreed to Rep. Fuas earlier suggestions, Rep. Bello stated that invoking phytosanitary and sanitary standards agreement under the WTO was an even more direct way of dealing with the matter. Reps. Cruz-Gonzales and Bello then exchanged views regarding urgent government action on the matter, possible smuggling, and the identification of importers of the contaminated Chinese toy products; the need for a congressional inquiry and a meeting with Chinese manufacturers; and the proposals to restrict entry of contaminated imports into the country and to upgrade laws on product safety. On motion of Rep. Janette L. Garin, the Chair next recognized Rep. Marc Douglas C. Cagas IV.

The session resumed at 5:21 p.m. REMARKS OF REP. GARIN (J.) In answer to the previous query, Rep. Garin (J.) stated that the Committee on Rules had included House Resolution No. 1669 in the plenary agenda for the following day, which measure would be accordingly referred to the appropriate Committee. REMARKS OF REP. CAGAS In relation to the speeches delivered that day and the filing of House Resolution No. 1669, Rep. Cagas urged the Committee on Rules to take a decisive action on the matter. Rep. Garin (J.) noted the same. REFERRAL OF REP. CRUZ-GONZALES SPEECH Thereupon, on motion of Rep. Garin (J.), there being no objection, the Body referred the speech of Rep. Cruz-Gonzales, together with the interpellations thereon, to the appropriate Committee.

MONDAY, NOVEMBER 21, 2011 SUSPENSION OF SESSION The session was suspended at 5:22 p.m., on motion of Rep. Garin (J.). RESUMPTION OF SESSION The session resumed at 5:23 p.m. ACKNOWLEDGMENT OF GUESTS Rep. Garin (J.) acknowledged the presence in the Session Hall of guests of Reps. Raymond V. Palatino, Rodolfo W. Antonino, Aurora E. Cerilles and officials of the National Youth Commission headed by Honorable Leon Flores. Thereafter, on motion of Rep. Garin (J.), the Chair recognized the Minority Leader, Rep. Edcel C. Lagman, for his privilege speech. PRIVILEGE SPEECH OF REP. LAGMAN Rep. Lagman spoke on the continued assault on the Constitution and the mockery of the Supreme Court by the Aquino Administration when the Department of Justice (DOJ) defied the temporary restraining order (TRO) issued by the Supreme Court allowing former President Gloria Macapagal-Arroyo to leave for medical treatment abroad. He stressed that the consuming obsession to persecute and incarcerate the former President has impaired the government and has even trampled upon civil liberties like the constitutional right to travel, presumption of innocence and freedom from arrest except upon independent finding of probable cause by the judge after due process which constitute feeble anchorage for supplanting the Constitution and the rule of law. He stated that the issue of justice, fair play and constitutionality are not to be determined by opinion polls or the public pulse as these are justiciable issues for adjudication by the Supreme Court. In light of the foregoing, Rep. Lagman requested the Members to shed off their partisan loyalties and uphold fealty to the Constitution and support the Supreme Court as the final arbiter of justiciable issues. He expressed hope that once the Supreme Court has ruled, the Executive Department would obey and follow the latters ruling. INTERPELLATION OF REP. BIAZON Upon recognition by the Chair, Rep. Rodolfo G. Biazon stressed that DOJ Circular No. 41 is still in effect and continues to be its guideline to issue a watch list order (WLO) against former President

7 Gloria Macapagal-Arroyo as it has not been amended nor declared unconstitutional. Rep. Lagman stated however that the effectivity of Circular No. 41 was suspended because the Supreme Court had already issued a TRO restraining the enforcement of said circular. He thereafter discussed in detail with Rep. Biazon the legality and constitutionality of the TRO issuance, the conditions imposed by the Supreme Court, and the DOJs receipt of a copy of the TRO. In answer to Rep. Biazons other concerns, Rep. Lagman maintained that the litigant did not know what the Supreme Courts decision would be and that it was not wrong for her to anticipate a favorable decision, exercise her right to travel and seek medical treatment. The Members then focused their debate on the issuance of a warrant of arrest by a lower court against the former President for election sabotage, and whether the arrest warrant rendered the TRO and Circular No. 41 moot and academic. Rep. Lagman clarified that the governments motion for reconsideration of the high courts issuance of a TRO became moot and academic when the Supreme Court junked the motion and that the election sabotage case referred to the inferior court was again subject to question before the Supreme Court because of a pending petition challenging the constitutionality, legitimacy and jurisdiction of a joint DOJCommission on Elections panel which recommended the filing of poll sabotage charges against exPresident Arroyo. At this juncture, the Chair recognized Rep. Fua for his interpellation. INTERPELLATION OF REP. FUA Reps. Fua and Lagman discussed the issues of 1) whether the act of former President Arroyo in booking a flight to Singapore was considered a crime or an exercise of her right to travel; and 2) whether the issuance of a TRO by the Supreme Court was aimed to mitigate if not eliminate the possible damages which the former President might suffer, pending the resolution of the constitutionality of Circular No. 41. Rep. Lagman explained that ex-President Arroyos Singapore flight booking was guaranteed by the Constitution and that the TRO is an interlocutory order issued by the High Tribunal to protect the rights of the citizens against possible abuses by the State pending adjudication of a principal case.

Rep. Daza initially questioned the position of Rep. Lagman regarding DOJ Circular No. 41 which the latter did not consider a law because as the latter had pointed out, Congress has not passed a statute on the subject matter of hold departure and watch list. They then debated on the difference between Executive Orders (E.O.) No. 1 and 2 issued by the late President Corazon C. Aquino and the Circular No. 41 issued by former Secretary Alberto Agra in June 2010. Rep. Daza cited the reasons why he believed that Circular No. 41 has legal efficacy: issuances by government agencies are presumed to be lawful until declared otherwise by the court; and said Circular which was issued during the administration of former President Gloria Macapagal-Arroyo was in fact applied to some cases during the past administration. Thereafter, Rep. Daza sought the position of the Minority Leader regarding the conditions enumerated therein in the TRO issued by the Supreme Court. He expressed reservations regarding the DOJs response thereto and explained that the DOJ need not take any legal action to comply therewith considering that there was noncompliance with one of the specified conditions sine qua non in the TRO. He pointed out that the DOJ Secretary cannot be faulted for disregarding the TRO of the Supreme Court. Rep. Daza also expressed the opinion that the TRO had been rendered academic not because of the denial by the Supreme Court of the petition of the Solicitor General but rather, because of a supervening event -- the issuance of a warrant of arrest for the former President. He explained that the Administrator of the Supreme Court, Attorney Marquez, had expressed the same opinion in a news conference. In his rejoinder, Rep. Lagman explained that the conditions accompanying the TRO are not conditions precedent but rather conditions subsequent which do not suspend the immediate executory character of the TRO, and thus, the allotted five days for the required compliance to prohibit an automatic lifting of the TRO. He further argued that the TRO remains effective until the same is recalled by the High Tribunal and the reason that it could not be enforced is due to a supervening warrant of arrest with its validity now pending for resolution before the Supreme Court.

Garcia (P.) to finish his speech and reminded him of a House Rule that privilege speeches should not be about matters pending before the Body. PRIVILEGE SPEECH OF REP. GARCIA (P.) Daza underscored in Filipino, what he perceived to be baseless, unfair and reflected not only on the dignity of Rep. Emmanuel D. Pacquiao but as well as on the integrity of the House of Representatives itself, the statement made by a former Senator calling on Rep. Pacquiao to resign as a Member of the House in order to do better as a boxer as he lacked focus in preparing for his recent fight against Mr. Juan Manuel Marquez. Citing the mechanics of a 10-point must system, the scorecards of the three judges and statistics from the computer box which showed that Rep. Pacquiao threw and landed more punches against Mr. Marquez, Rep. Daza stressed that the former was the clear winner of the bout despite the hardship and pain he had endured. Rep. Daza concluded that given Rep. Pacquiaos accomplishment, it was but fitting that the nation should be grateful to Rep. Pacquiao not only as a boxer and a Member of the House but as a Filipino who had given pride and dignity to the country. Thereafter, the Chair recognized Rep. Amado S. After congratulating Rep. Daza for watching the Pacquiao-Marquez bout live at the MGM Grand in Las Vegas, Rep. Bagatsing inquired whether during the preliminaries, Rep. Pacquiao was being booed every time his video was flashed on the screen. At this juncture, Deputy Speaker Remulla relinquished the Chair to Rep. Magtanggol T. Gunigundo I. As he stressed that 80% of the audience during the fight were Mexicans, Rep. Bagatsing also asked whether the Filipino people belong to a lost race because some of them wanted Rep. 19 AN ACT PROVIDING FOR A COMPREHENSIVE POLICY ON RESPONSIBLE PARENTHOOD, REPRODUCTIVE HEALTH, AND POPULATION AND DEVELOPMENT, AND FOR OTHER PURPOSES. After clarifying that the measure was in the period of interpellations, Rep. Ortega (F.) moved for the recognition of Rep. Rodante D. Marcoleta to sponsor the Bill and Rep. Pedro P. Romualdo to interpellate thereon. INTERPELLATION OF REP. ROMUALDO Rep. Marcoleta clarified the issues raised by Rep. Romualdo on the three interrelated subject matters of the Bill, namely, reproductive health, responsible parenthood and population and development. He pointed out that these do not violate the constitutional rule that each bill shall embrace only one subject, because they are all subsumed under the basic thrust of the Reproductive Health (RH) Bill towards strengthening the Filipino family. At this juncture, Rep. Gunigundo relinquished the Chair to Rep. Janette L. Garin. Reps. Romualdo and Marcoleta then debated on certain issues relative to the RH Bill which included the following, among others: 1) the inconsistency in the provisions of Section 2 of the measure mandating the State to recognize and guarantee a persons exercise of the universal basic human right to reproductive health, which contradicted the main objectives of the Bill; 2) the conflicting provisions in Section 3 regarding the provision of medically safe, legal and accessible birth control services and supplies, which Rep. Romualdo argued would be tantamount to abortion; and 3) the constitutional provisions which define the term essential goods as referring to nonlife threatening products and not to contraceptives that are considered abortifacients and which mandate the State to adopt an integrated and comprehensive policy on health development and not a comprehensive policy on reproductive health program. At this point, Rep. Garin (J.) relinquished the Chair to Rep. Gunigundo. Rep. Romualdo likewise adverted to the provisions of Section 3 of House Bill No. 4244 and argued on the following issues: the progress of a country depends not only on its natural resources but also upon its vast human resources; the focus of development should be on the eradication of poverty

20 by providing better economic and employment opportunities to the poor and a paradigm shift in development policies; and it is inconsistent to recognize abortion as illegal and punishable under the law while at the same time promoting and advocating the use of contraceptive pills that are known to have abortifacient properties. For his part, Rep. Marcoleta maintained that a comprehensive policy on health development also speaks about the rights of women to reproductive health; a growing population and abundance in human resources is an impetus to political and socioeconomic development which would be feasible and sustainable only if the government would be able to provide for the peoples basic needs; the countrys resources must be rationalized to support its rapid population growth; and the use of government funds to implement the purposes of reproductive health cannot be considered a waste of public funds inasmuch as the Bill seeks to implement the constitutional mandate on responsible parenthood. Sy-Alvarado and Albert Raymond S. Garcia. Thereafter, on motion of Rep. Gunigundo, the Chair recognized Rep. Sy-Alvarado from the First District of Bulacan on a question of personal and collective privilege. QUESTION OF PRIVILEGE OF REP. SY-ALVARADO Rep. Sy-Alvarado rose to speak the truth behind the recent flooding that devastated most of the barangays in her district and put the lives of her constituents, including that of her family, in jeopardy. She belied the accusation that the flooding was caused by her fish ponds considering that she follows her local governments fishery regulations and even supports its agricultural programs. After emphasizing that the dams situated in the upper portion of Bulacan and not the fish pens caused the floodings in Hagonoy and Calumpit, she stressed that since his assumption into office, incumbent Bulacan Governor Wilhelmino M. Sy-Alvarado has strictly implemented the provisions of the 1988

24 Fisheries Code throughout the province. On the other hand, she lamented that the Provincial Board headed by the Vice Governor has allowed private water concessionaire Maynilad to use the Ipo Dam as water reservoir and for which reason the dams water level has to be maintained at its maximum level and cannot be released preemptively during typhoons. She also referred to the irresponsible action of the management of Bustos Dam when it released water at the height of typhoon Pedring for fear that the dam would collapse. She thereafter presented the following recommendations: 1) to amend the law creating the National Water Resources Board by including in its membership the chief executive of the province where a national wealth is located; 2) for the concerned agencies to fast-track the installation of closed-circuit television (CCTV) cameras at the spill gates and immediate vicinities of dams for proper monitoring of water releases and rise of water levels; 3) to immediately pass a bill that would provide safety measures and standards for the construction, operation and maintenance of all dams; 4) to immediately repair and rehabilitate the Bustos rubber dam and for Maynilad to construct its own water reservoir for Ipo dam; 5) to reconstruct the Bulo water impounding facility and prioritize construction of secondary water impoundment facilities in Ipo dam and Bayabas River; 6) to intensify the governments antiillegal logging efforts and dredging programs; and 7) to amend the Local Government Code to give fair and equitable share of the national wealth to the province of Bulacan. MOTION TO EXTEND REP. SY-ALVARADOS TIME Rep. Sherwin N. Tugna moved to extend Rep. Sy-Alvarados time in order to accommodate Rep. Edgar S. San Luis interpellation. On motion of Rep. Tugna, there being no objection, the Body resumed consideration on Second Reading of House Bill No. 4244, as contained in Committee Report No. 664 and reported out by the Committee on Population and Family Relations. Upon direction of the Chair, the Secretary General read the title of the Bill, to wit: AN ACT PROVIDING FOR A COMPREHENSIVE POLICY ON RESPONSIBLE PARENTHOOD, REPRODUCTIVE HEALTH, AND POPULATION AND DEVELOPMENT, AND FOR OTHER PURPOSES. Upon Rep. Tugnas motion, the Chair recognized Reps. Rodante D. Marcoleta and Pedro P. Romualdo for sponsorship and interpellation, respectively. INTERPELLATION OF REP. ROMUALDO (Continuation) Rep. Romualdo refuted Rep. Marcoletas claim that the countrys population growth rate was increasing at an exponential rate by citing the allegation of the 2011 United Nations State of World Population (UNSWP) that said rate was only below two percent. The Sponsor argued that Rep. Romualdos statistics were mere projections. He stressed that the real problem was overpopulation and that the Reproductive Health (RH) Bill was not only trying to address the issue of population but more importantly, reproductive health. REMINDER FROM THE CHAIR At this point, the Chair reminded Reps. Marcoleta and Romualdo to speak one at a time so that the discussion on the floor could be recorded correctly. INTERPELLATION OF REP. ROMUALDO (Continuation) Rep. Romualdo followed through on the arguments that he had raised the previous day, specifically contending that there is no such thing as freedom of choice inasmuch as the law mandates social institutions what rules and guidelines should govern behavior wherever possible. He also reiterated what

WEDNESDAY, NOVEMBER 23, 2011 he deemed as inconsistencies in the provisions of House Bill No. 4244 and underscored that the measure was an insidious population control program and enacting it into law would contravene the tenets of the Constitution. Rep. Marcoleta clarified that the Bill allows the exercise of freedom of choice since it does not impose upon the Filipino families which family planning methods to avail of. He also maintained, among others, that the Bill seeks to provide the future direction of the governments policy on population by striking a balance between the countrys increasing population and its resources. Reps. Romualdo and Marcoleta then continued to argue on the pertinent provisions of the Constitution with regard to responsible parenthood, protection and promotion of the right of health of the people, particularly womens reproductive rights. Rep. Romualdo then enumerated laws and executive issuances which he deemed sufficient to protect the interests of children, women, and families, but Rep. Marcoleta disagreed and stressed that they merely complemented the instant Bill. The former also argued that the measure contravened constitutional provisions on ethical and spiritual values and the protection of the family as a basic social institution, but the latter emphasized that it protects the health and socio-economic well being of the family. After Rep. Marcoletas explanation that the measure aims to provide couples with the option to live better lives, and to execute the mandate of the Constitution on the promotion of family values, Rep. Romualdo inquired into the real beneficiaries of the Bill. At this point, Rep. Romualdo said that he was willing to continue with his interpellation when the Body resumes the consideration of the measure on Monday. MANIFESTATION OF REP. BELLO At this point, Rep. Walden F.
