" What is Executive Order 585-A?

It is the law granting amnesty to persons in possession of loose firearms;


provided, that the concerned individuals or holders of said firearms submit
same to the Philippine National Police for registration and licensing. This
amnesty program aims to account for the approximately 105,000 loose
firearms, which when used as an instrument in the commission of crime, can be
hardly traced to its owner. Another purpose is to generate funds for the
procurement and establishment of a Ballistics Information System, which, with
the widely used principle of “gun fingerprinting”, will aid investigators in the
speedy resolution of crimes committed with the use of firearms. Said law was
signed by Her Excellency President Gloria Macapagal Arroyo on August 28,
2007 and the subsequent Implementing Rules and Regulations was signed by
the Chief, PNP on September 18, 2007.

" What is the effectivity and duration?

Applicants may register a loose firearm within one (1) year upon the issuance
of the IRR of EO 585-A which is on November 14, 2008.

" Who are qualified under EO 585-A?

Filipino citizens who are at least 21 years of age.

"What kind/type of firearms may be registered or possessed?

*The following firearms may be registered subject to the approval of C, PNP, as


mandated by law:
1. Handguns (Pistols/Revolvers) Caliber .22 to .357
2. Shotguns (all gauges)
3. Rifle Caliber .22
4. All other low-powered firearms
* High-Powered Rifles shall be on case to case basis and upon approval by the
C, PNP.

" How many firearms can an individual register?

A qualified applicant may register any number of firearms.

• Handgun and other low-powered firearms P3,000.00


• High-Powered Rifles or Firearms P5,000.00

" Discounts?

The fifty percent (50%) discount usually given to government officials and
employees applying for Special Permits (SPs) for privately owned firearms shall
not be applied under the firearms amnesty program. However, the privilege will
be given upon renewal of the said license to possess firearm.

"Are government property FAs in the possession of private individuals included in the
amnesty?

No. FAs found to be owned by the government will be turned-over to FED, CSG
for proper disposition.
" Can a FA with expired license be registered as loose FA?

Under the Law, unregistered FAs are considered loose FAs. Thus, such FAs
can be registered under EO 585 if the said FAs are not included in the FED
data base (FIMS). However, if the FAs are verified to be included in the FIMS,
the same is not covered in this EO, but subject to usual process of license
renewal.

" Will the applicant have to pay additional fees or surcharges if the firearm has an
expired license?

Yes. Applicant will pay additional penalty and surcharge.

" What happens if the serial number of firearm submitted for licensing already exists in
the FED’s FIMS or database?

If the firearm submitted for licensing is not the same firearm with data existing
in the FED’s FIMS, a serial number will be assigned to the submitted firearm by
the FED, CSG.

" If the vintage or antique firearm is not serviceable, can it be licensed under the
amnesty program?

No.

" What happens to the firearm submitted for licensing if it is found out that it is listed as
lost or wanted?

The owner shall be notified of the status of the firearm in his/her possession
and will be requested to turn-over the said firearm to FED, CSG or to the
nearest police unit for deposit until the adjudication process is completed.

" Will the possessor of the lost/wanted firearm be criminally liable?

Yes, if the possessor is proven to be responsible for the theft of said firearm.

" How many firearms can a juridical entity register?

Juridical entities can register any number of firearms provided that they comply
with existing rules and regulations based on RA 5487 and its Implementing
Rules and Regulations.

" Can an individual register for license a “paltik” firearm?

“Paltik firearms are allowed to be licensed under the approved IRR. However,
processing of these firearms is held in abeyance pending clarification being
made with the higher authorities.

" Can a jjuridical entity license a “paltik” firearm in its name?

No, juridical entities are not allowed to license “paltik” firearms in their names in
accordance to RA 5487.
" Can a juridical entity license a high powered rifle in its name?

Yes, but subject to existing rules and regulations.

" Who are the authorized signatories for the Provisinal or Temporary License?

C, FED

" Who are the authorized issuing Officers for Permit to Transport (PTT) firearms and
ammunitions for EO 585-A?

• C, FED
• PD, PPO
• RD, PROs

" How much is the fee for the PTT?

The Permit to Transport (PTT) firearm is for free,


NOT FOR SALE.

" Does Permit to Transport cover the route of the application from residence to office
and back?

A PTT is valid for one way trip only. However, if the Temporary License has not
been issued or finished within the day, the applicant may be issued another PTT
by the concerned office.

" Can one PTT be valid for more than one firearm?

Yes, one PTT may cover several firearms owned by the same applicant.

" What therefore is the duration of the Permit to Transport FA?

The duration of the Permit to Transport FA may vary depending on the


accessibility of the offices involved in the process of registration (i.e. Land Bank,
Ballistics Testing Center, etc.) but shall not be more than seven days. Valid for
back and forth of the source of a FA scheduled for ballistic/stencil.

" Can the applicant bring home his/her FA after applying for amnesty even if he/she
has not yet completed the process?

Yes, the applicant can bring home his/her FA even if the ballistics test is not yet
finished and may return for the scheduled testing. Provided, however, that the
applicant secures the necessary PTTs.

" Who may conduct Ballistic Test?

Only PNP Crime Lab in coordination w/ FED, CSG and PROs will conduct the
ballistic test. OP will be issued by PNPCL for this purpose.
" Can the applicant accompany his/her FA during ballistics test?

Yes, the applicant may accompany his/her FA.

" Who will provide for the ammunitions to be used during the ballistics test of the
firearm?

The Crime Laboratory will provide the ammunitions for the ballistic.

" What are the additional documents and why are they required if one is already
qualified?

ƒ Document to show proof of real identity/name of the applicant. This is to


prevent individuals from submitting fictitious/wrong names.
ƒ Document to show proof of address/billing or any document indicating the
applicant’s residence. This is to have an official mailing address in case this
office wants to communicate with the applicant in the future.
ƒ Any valid ID Card

" Can a Filipino citizen who is below 21 years old but a gun club member be allowed to
register a loose firearm under his/her name?

No, the IRR of EO 585-A is very explicit in its provision that only Filipino citizens
who are at least 21 years old are qualified.

" Are applicants required to submit other requirements like drug test certificate, gun
safety certificate, etc?

Yes, the applicants who have no license firearms yet.


PROCEDURE FOR LICENSING OF LOOSE FIREARMS

STEP 1 Applicant fills up information sheet for Permit to Transport (PTT).


(Information Sheet available at box located at Counter 13.

STEP 2 Submit Information Sheet at Counter 13.

STEP 3 Applicant waits for PTT and Application Form for Firearm License – EO
585-A from Counter 13.

STEP 4 After securing PTT, applicant secures his/her firearm from residence and
brings it to FED, CSG at Camp Crame for Ballistics Test and Stencil of
Firearm markings. Order of Payment (OP) will be issued right after the
ballistics/stencil procedures at the firing range.

STEP 5 After paying the necessary fees (license fee, license card and firearms
bond), applicant submits his/her application form together with the other
documents (SBR, Ballistics report, accomplished stencil form etc.) at
Counter 13/14.

STEP 6 After 14 working days, applicant will verify at EO Secretariat for the
release of approved Temporary License.

IMPLEMENTING RULES AND REGULATIONS OF
EXECUTIVE ORDER No. 585 AS AMENDED BY
EXECUTIVE ORDER 585-A

The following rules and regulations are hereby promulgated for the effective
implementation of Executive Order No. 585 dated December 11, 2006 as amended by
Executive Order No. 585-A dated August 28, 2007.

SECTION 1. Scope

These rules and regulations shall apply to all individuals and juridical entities
who, shall surrender unregistered/loose firearms from November 15, 2007 until
November 14, 2008 and may be issued licenses to possess the same.

SECTION 2. Basic Qualifications of Applicant

a. Filipino citizens who are at least 21 years of age.

b. Juridical Entities authorized by law to possess firearms.

SECTION 3. Procedure for Filing of Application

a. An applicant for a license to possess unregistered/loose firearm shall first


secure a Permit to Transport (PTT) before carrying the said firearm and ammunition
from its location to any of the following Police Offices where the application shall be
processed:

1) City Police Offices (CPOs);


2) Police Provincial Offices (PPOs); and,
3) Police Regional Offices (PROs).

b. In the National Capital Region (NCR), all applications and PTT shall be
processed only at Firearms and Explosives Division, Civil Security Group (FED, CSG).

c. The PTT may be issued by the following Heads of Offices:

1) City Directors, CPOs;


2) Provincial Directors, PPOs;
3) Regional Directors, PROs;
4) Director, CSG; and,
5) Chief, FED.

d. After securing the PTT, the applicant shall properly wrap and label the
firearm and ammunition and submit the same to FED, CSG or the Police Office where
the PTT was issued.

e. The FED, CSG or the concerned Police Office shall then transmit the said
firearm to the nearest PNP Crime Laboratory for stencil tracing and test firing for
forensic ballistic sample at the expense of the applicant. The PNP Crime Laboratory
shall provide the applicants the Order of Payment forms for the stencil tracing and test
firing. The applicants shall then pay the corresponding charges before the stencil
tracing and test firing will be conducted. The serial number, make, caliber, and other
markings of the firearm shall be stenciled and traced on the allocated space on the form
provided by the PNP Crime Laboratory. The applicant is allowed to be present during
the stencil tracing and test firing. The slugs and shells used as forensic ballistics sample
shall be placed in appropriate envelopes duly marked and collected by the PNP Crime
Laboratory for firearms ballistic database.

f. After the stencil has been taken and the test firing conducted, the firearm
shall be transmitted back to FED or to the concerned CPO, PPO, PRO that shall issue
the Order of Payment for licensing. The applicant shall then file with FED or with the
Police Office concerned his/her duly accomplished application form together with the
following:

1) Ballistics Test-firing and Stencil Certificate;


2) Firearms bond;
3) Special Bank Receipts (SBR); and,
4) Other required documents.

g. Required Documents for individuals:

1) Proof of Citizenship/Birth Certificate;


2) Proof of Identity/Name;
3) Proof of Address/Billing;
4) Proof of Qualification/Profession/Vocation;
5) Police and NBI Clearances;
6) Neuro-Psychiatric Clearance;
7) Drug Test Result; and,
8) Certificate of Training/Seminar on Gun Handling and Safety.

h. Required Documents for Private Security Agencies; Company Guard Forces;


and, Government Security Agencies:

1) Certification from SAGSD that the applicant is allowed to register a


specified number of firearms and qualified for the license to possess the same;

2) Neuro-Psychiatiric Evaluation, Drug Test Result, Police and NBI


Clearances of the person duly authorized by the juridical entity, who shall be
accountable for the firearm to be licensed;

3) For High-Powered Firearms (HPFAs) – Certificate of Training for the


users of the said HPFAs;

4) Certification from the CD, CPO; PD, PPO; or RD, PRO that the HPFAs
are needed for posting in crime prone or insurgency affected areas; and,

i. Required Documents for Other Juridical Entities allowed by law to own


firearms:

1) Authorization from the Head/Chief of Office or Chief Executive Of Local


Government Unit;

2) Certificate of Employment or Appointment Order, Neuro-Psychiatric


Evaluation, Drug Test Result, and Police and NBI Clearances of the person duly
authorized by the Juridical Entity, who shall be accountable for the firearms to be
licensed;
3) For High-Powered Firearms (HPFAs) – Certificate of Training for the
users of the said HPFAs;

4) Certification from the CD, CPO, PD, PPO, RD, PRO that the HPFAs are
needed for posting in crime prone or insurgency affected areas; and,

j. The CPOs, PPOs, and PROs shall coordinate for the availability of bonding
companies that will issue the required firearms bond to the applicants. The FED, CSG
will provide the forms for Application, Permit to Transport, and Order of Payment for
distribution.
k. The Chief, FED or the concerned CD, CPO; PD, PPO; and, RD, PRO, upon
receipt of the application may order to have the firearm deposited for safety
precautions or issue a Provisional Authority which shall serve as the applicant’s permit
to keep the firearm in his/her residence pending approval of the application and
issuance of appropriate license.

l. All applications processed by CPOs, PPOs and PROs shall be forwarded to


FED, CSG for recording and issuance of licenses. The Chief, FED may approve
registration and issue licenses for Low-Powered Firearms (LPFAs). However,
registration of HPFAs shall be submitted for approval of the Chief, PNP prior to the
issuance of licenses by the Chief, FED. Approved licensed to possess firearms can be
claimed at FED, CSG or at the concerned CPOs, PPOs and PROs upon notice. The
approved license to possess firearm (yellow copy) is valid for two (2) years from the
date of approval.

SECTION 4. License to Possess Surrendered Unregistered Firearms

a. A qualified applicant may be allowed to possess any firearm in accordance


with existing laws, rules and regulations except for the following:

1) Crew served weapons like Light Machine Guns (LMGs), Heavy Machine
Guns (HMGs) and Recoilles Rifles (RRs);

2) High-Powered Rifles with caliber more than 7.62 millimeters;

3) High-Powered rifles with caliber below 7.62 millimeters which are belt-
fed; and,

4) Other weapons like Rifle Grenades/Grenade Launchers/Rocket


Launchers.

b. Application for registration or licensing of “Paltik Firearms’ are not allowed.


These firearms are homemade and/or fabricated by persons or entities that have no
license to make or manufacture the same, However, the PNP shall accept the
surrender of “Paltik Firearms” in favor of the government and for destruction.

SECTION 5. Schedule of Fees:

a. The applicant shall pay the amount of THREE THOUSAND PESOS (P3,000.00)
for the license to possess the following firearms:

1) Rifle caliber .22


2) Shotgun (all gauges)
3) All handguns (Pistols/Revolvers) Caliber .22 to .38 or 9mm.

b. The applicant shall pay the amount of FIVE THOUSAND PESOS (P5,000.00)
for the license to possess High-Powered Firearms or Rifles, and all other handguns
(Pistols/Revolvers) not mentioned in Section 5a.

c. The fees for test firing forensic ballistics sample shall depend on the
prevailing market prices of ammunition of the firearms.

d. All fees shall be paid by the applicant to the Land Bank of the Philippines
after the issuance of the Order of Payment.

e. The fifty percent (50%) discount usually given to government officials and
employees applying for Special Permits (SPs) for privately owned firearms shall not be
applied under the firearms amnesty program. However, the privilege will be given upon
renewal of the said license to possess firearms.

SECTION 6. Reports

a. All Provincial Directors and City Directors shall submit their monthly report to
their respective Police Regional Directors who shall then submit the consolidated
monthly report to the Chief, PNP (Attn: C, FED, CSG) NLT the 10th day of the
succeeding month.

b. Chief, FED shall submit a consolidated monthly report to the Chief, PNP.

SECTION 7. Repealing Clause

All orders, issuances, rules and regulations or part thereof inconsistent with this
Implementing Rules and Regulations (IRR) are hereby repealed.

SECTION 8. Effectivity

This Implementing Rules and Regulations shall be effective upon approval.
