BACKGROUND

Background
The parliament has enacted the Right To Information Act 2005 to set out the practical regime of right to information for the citizens of India, to secure the access to the information available under the control of the Public Authorities, to promote transparency and accountability on the working of every public authority. Section 3 of the Act provides that all citizens shall have the right to information subject to the provisions of the Act and Information means any material in any form including records, documents, memos, e-mails, opinions, advices, press releases, circulars, orders, logbooks, contracts, reports, papers, samples, models, data, material held in any electronic form and information relating to any private body which can be accessed by a public authority under any other law for the time being in force. The Tamilnadu Industrial Investment Corporation Limited (TIIC) is a government company incorporated under the Companies Act, 1913 and continues to be a government company and it is a public authority under Section 2 (h) of the Right to Information Act. In view of the mandatory requirement, it is necessary for the TIIC to publish this hand book containing information under the Right to Information Act.

OBJECTIVE OF THE HANDBOOK

Objective of the Handbook


The primary objective of this handbook is to provide the necessary information to the person interested in knowing the information of TIIC. Every endeavor is made in providing all information, duties and responsibilities of the officers in TIIC in discharging their functions in achieving the avowed objects of the organization. This handbook contain all necessary information in detail, procedure followed in decision making, records maintained and used by the employees, directory of officers and employees, details of Assistant Public Information Officers, Public Information Officers and the Appellate Authority for TIIC.

11 1. The particulars of Organisation:


1.1 Organisation: The Tamilnadu Industrial Investment Corporation Limited (TIIC), a government company incorporated under the Companies Act 1913 and continues to be a government company under The Companies Act, 1956. The authorised share capital of the company is Rs.300 Crores and the paid up capital of the company is Rs.283.4956 Crores. 1.2 Board of Directors : TIIC is governed by the Board of Directors. The Directors are nominated by the Govt of Tamilnadu and one of the Directors is nominated as Chairman of the Board. At the time of nominating Managing Director, Small Industries Development Bank of India is consulted. The details of Directors are as follows : (As on 15.11.2011) Tvl. 2. Functions of the organization: TIIC as a State Level Financial Institution, offers long and medium term financial assistance to various industries including service sector in the following forms: Term Loans Term Loan and Working Capital Term Loans under the Single Window Scheme. Special types of assistance like Bill Financing Scheme, etc.
2.1. Type of Assistance:

TIIC offers long and medium term financial assistance in the following forms:Term Loans Term Loan and working capital assistance under the Single Window Scheme Bill Discounting Schemes operated: General Term Loan Micro / Small Enterprises Funding Assistance for ISO 9000 Certification TAHDCO Equipment Finance Scheme Bill Finance Scheme for TNEB / TWAD Board Contractors Assistance for Wind Power Projects Single Window scheme covering working capital Open Term Loan Clean Term Loan Working capital term loan for Rice Mills Business Space Rental Scheme Drawee Bill Finance Scheme Term loans for the replacement of high cost loans Information Technology Projects scheme Computer Training Institute / Training Institute Commercial Complex Community centre / Convention centre / Marriage hall Hotels Scheme for Non Banking Finance Cos (NBFC) Marketing Assistance Scheme Scheme for Qualified Professionals Generator loan Transport loan scheme Warehouse / Cold storage Scheme for doctors growth / Nursing home Working capital term loan for manufacturing and processing industries (WCTL-MPI) Grow an entrepreneur scheme The details of some of the schemes are available in the Annexure I.

2.2 Eligible activities: The assistance of the TIIC is available to the concern engaged in or proposing to be engaged in:Manufacturing, processing or preservation of goods Service sector Generation of electricity or any form of power including wind mills Setting up of nursing homes and purchase of electro medical equipments Hotels and Restaurants Purchase of public carrier vehicles for material / goods transportation and for transport of passengers. Facilities for preservation of marine products and food item including cold storage Commercial complex / storage godown / marriage hall / community hall Computer Training Institutions / I.T projects including I.T Parks 2.3. Quantum of Loan Assistance: TIIC provides Term Loan assistance normally upto a maximum of Rs.800 lakhs to Proprietary and Partnership concern. In respect of Limited Companies and Co-operative Societies normally a maximum term loan assistance of Rs.2000 lakhs can be considered. However higher loan assistance may also be considered for bigger projects on a case to case basis. The Branch Offices have been classified into A, B, C categories for the purpose of consideration of loan assistance based on the number of loan account in a Branch Office. Branches can sanction loans upto Rs.50 lakhs for new clients. Regional Loan Sanction Committee can consider sanction of loans upto Rs.100 lakhs for new clients and Rs.150 lakhs for existing clients. The Board of the TIIC has delegated appropriate powers for sanction of loans to the Branch Manager, Branch Sanction Committee, Regional Loan Sanction Committee. The Executive Committee consisting of Directors of the Board / Board of Directors will consider sanction of loans beyond the power of RLSC (i.e) beyond Rs.100 / 150 lakhs upto Rs.300 lakhs. The Board of TIIC consider sanction of loans above Rs.300 lakhs. 2.4. How to apply: For getting financial assistance from TIIC, one has to apply in the prescribed application and the applications are available in all the TIIC Offices. There are separate application for certain schemes. Application for financial assistance to industrial units can also be downloaded from TIICs website www.tiic.in. Application is issued free of cost.

2.5. Appraisal of Project by TIIC: TIIC appraises the project for its technical feasibility, financial and economic viability while sanctioning loan. The applicant should satisfy TIIC regarding the scope for marketing and furnish the details of the cost of production, cash flow etc., to assess the pay back period and for assessing the various financial ratios / norms. 2.6.Rate of Interest : The interest rate structure for various loans are given below : 2.6.1. SWITCH OVER LOAN SCHEME: Under this scheme, the lending rate may be fixed as applicable to general term loans under the respective sector. SUBSIDY BRIDGE LOAN: The Subsidy bridge loans are charged with interest rate as applicable to term loans. The rate of interest is revised periodically based on market conditions, cost of borrowing etc by TIIC. 2.7. Financial Norms: Following financial ratios are considered as favourable in appraisal of a project : i) Debt Equity Ratio: The maximum debt equity ratio (DER) for both small and medium enterprises shall be 2:1. ii) Promoters Contribution: Promoters contribution varies from 15% to 40% depending upon the scheme of assistance. A higher promoters contribution will be fixed if the risk perception of the proposal is high. iii) Margin of Security: A minimum of 10% to 25% security margin on fixed asset is stipulated. iv) Collateral Security: In addition to primary security of assets, collateral security is also stipulated based on the risk perception of the proposal. v) Repayment period: Loan repayment is generally spread over a period of 5 to 9 years with a moratorium ranging from 3 months to 2 years depending on the project and the cash flow projections. 2.8 Subsidies from Government : TIIC is the nodal agency for the State Capital Subsidy provided by the Government of Tamilnadu for projects implemented under New Anna Marumalarchi Thittam scheme and other subsidy for Micro / Small / Medium Enterprises and mega projects and 3 % Back Ended Interest Subsidy for micro / SSI units going in for Technology Upgradation and Modernisation and ISO certification. It is also the nodal agency on behalf of Govt. of India for providing capital subsidy to its assisted units under Credit Linked Capital Subsidy scheme, Technology Upgradation Fund scheme and Food processing subsidy.

2.9 The norms set by the Corporation for discharge of functions: Quality Policy : The Corporation has obtained an ISO 9001:2008 Certification under Quality Management Systems (QMS) for sanction of loans. fixed for sanction of loans. TIIC is committed to achieve excellence in formulation and implementation of various schemes for the accelerated industrial development in the State of Tamilnadu by providing timely financial services to the satisfaction of its customers. It is also committed to lay down measurable standards for customer service and constantly improve its Quality Management System by the full involvement of the personnel at all levels . 2.9.1. Norms set up in TIIC for sanctioning loans : Immediate issue of loan application to the applicant who requires in person and within 3 days by post. Immediate issue of acknowledgement for receipt of loan application form. Status information about loan application within 5 days, if all the required particulars have been furnished with the application. Loan sanction within 18 working days by Branch Sanction Committee for loans upto Rs.50.00 lakhs Loan sanction within 25 working days for loans above Rs.50.00 lakhs and upto Rs.3.00 crores by Executive Committee and RLSC. Loan sanction within 35 working days for loans of above Rs.3.00 crores by Board. Simultaneous scrutiny of legal documents within 15 working days, if, within office and 4 weeks if external legal advise is needed. 2.9.2. 3) Powers and duties of Officers and Employees: TIIC is governed by a Board of Directors consisting of senior level Govt Officers, nominees of SIDBI, a retired senior Bank official. The day to day functions are administered by MD / CMD who is appointed by Govt. of Tamilnadu in consultation with SIDBI. The MD / CMD is assisted by officials at various levels to discharge the functions. Responsible for enhancements, modifications and all related matters and follow-up of disbursements of all sanctions. ii) Responsible for loan enquiries and he should also handle the clarifications sought by the Branches. Also responsible for development of new products and marketing of various products of the Corporation at the corporate and field level. iii) Responsible for sanction and disbursement of subsidies where the Corporation is assigned as the Nodal Agency. i)He is responsible for conducting marketing and other development seminars / Business Promotion meeting at various centres. v) The Officers of Development Wing also meet the customers directly to explain the various schemes of the Corporation. vi) He is also responsible for evolving various schemes in tune with the market situations / requirements. 3.1.10 Assistant General Manager (Recovery) : i) ii) To introduce loan review mechanism, credit audit, standard asset monitoring and identification of special mention accounts. To protect the slippage of standard accounts and also to upgrade the level of substandard accounts / NPA accounts. 3.1.11. He is also responsible for the Sales tax, VAT & Service tax matters of the Corporation. ii) He is Public Information Officer designated under the Right to Information Act, 2005. He is also look after disciplinary division.

3.1.14 Manager (Law): i. He is responsible for giving advise / guidance on legal matters to Officer (Legal) at Regional Offices and Branch Offices for completion of legal documentation. ii. iii. He is responsible for monitoring the entire process for completion of legal documentation within the Lead Time stipulated under QMS. He is responsible for monitoring and following the court cases with panel advocates. 3.1.15. Senior Managers / Managers / Deputy Managers / Assistant Managers / Senior Officers: There are also senior officials in the cadre of Senior Managers / Managers functioning in the Head Office who are allotted to various Departments to oversee the smooth functioning of the Head Office. These officials are reporting to the concerned HODs / DGM directly or through A.G.Ms as the case may be.

Officers, Junior Officers, Assistants / Stenographers : There are also Officers, Junior Officers and Assistants / Stenographers in the Head Office who are either doing original work or assigned tasks in a section such as MIS, ISO, Recovery, Project, HRM, Systems, Funds Planning and Risk Management, & Resources, Legal, Loan monitoring, Policy Internal Audit, Rehabilitation and Board & Secretariat

3.2 REGIONAL OFFICE: 3.2.1 Regional Manager: i) RMs are responsible for the performance of the branches under their control. ii) RMs are the Chairpersons of the BSC meetings for sanction of loans / for settlement of loans as per the delegation of powers prescribed by the Board of the Corporation. iii) He shall review all LAOs / LAAs every month at Branches. iv) He is responsible for forwarding of the PIR with his recommendations to Head Office. v) He is responsible for relaxation of the Terms & Conditions, changes in the scheme within the delegated powers. vi) He is also a member of Regional Loan Sanction Committee. 3.2.2 Officials of Regional Audit Team : Officials of Regional Audit Team will ensure that : i) All sanctions and disbursement accounts of the Branch are in order. ii) All the assisted units in the Regions are visited by them atleast once in a year. iii)Officers in the auditing team will ascertain the assets inventory of the assisted units. 3.3 BRANCH OFFICE: 3.3.1 Branch Manager: i) BMs are responsible for overall performance of the branch. ii) BMs are responsible for sanction & disbursement of loans and recovery as per the delegation of powers prescribed by the Corporation. iii)He is responsible for the routine administrative functions and to canvass new business and to supervise and support the LAOs / LAAs. 3.4 SPECIAL RECOVERY BRANCH 3.4.1. Branch Manager : Branch Managers are responsible for recovery of dues from the accounts which are categorized as Non Performing Assets.

3.5.1. Field Officer : i) Field Officer is responsible for overall performance of the Branch. ii)He is responsible for canvassing loan and recovery as per the delegation of powers prescribed by the Corporation. iii)He is responsible for administrative functions of the Field Office and supervise and support LAO / LAAs. 3.5.2. LAO / LAA: The field level Officers / Assistants are re-designated as Loan Administrative Officers (LAOs) and Loan Administrative Assistants (LAAs). The LAOs and LAAs are responsible for disbursement of loans including inspections, recovery and follow-up including court cases assigned to them individually. 3. Project Officer (PEO): i)The Project Officer in the Branch is responsible for appraisal of all Branch cases assigned to him. He also place preliminary appraisal notes in respect of cases to be sanctioned by MD / EC / Board before their Branch Manager. ii)He is responsible for preparing the appraisal note and place it before the Branch Sanction Committee / PSC within the stipulated time as per QMS. 3.6.4. Legal Officer: i)The Legal Officer at Branch / Regional Office will be responsible for scrutiny of title deeds and approval of all security documents and documentation and custody of documents. The particulars of any arrangement for consultation with, or representation by the member of the public in relation to the formulation of its policy or implementation there of: Project Department at Head Office and Branches are handling the customer representation, any representation whether written or oral that indicates a deficiency in the prescribed quality of service provided by the corporation will be deemed as a customer representation and handled as per the procedure laid down by the corporation as follows: Concerned officer shall analyse and investigate the problem, represented by the customer. After a detailed analysis / investigation, remedial measures shall be decided. Remedial measures decided shall be implemented by the Officer identified for the purpose. The Advisory Committee consisting of industrialists, promoters of assisted units and members from industrial association was constituted for periodical interaction atleast once in a quarter for consultation and advice as regards the requirement of various industries in the State.

8. Details of Board / Committee :


8.1.Board of Directors: The Board of Directors is the highest controlling authority comprising of Directors appointed by the Government from time to time and headed by the Chairman / CMD which deliberates and decide on policies / directions for the Corporation and supervises the functioning of the Corporation. There are various Sub - committee of the Board such as Executive Committee, Default Review Committee, Audit Committee and Staff Committee and neither the meetings nor the Minutes are open or accessible to the Public. As on 15.11.2011, TIICs Board comprising of seven Directors. The particulars of Directors are in Annexure III : The Board consider all policy matters and proposals for sanction of loans above Rs.300 lakhs. 8.2 Executive Committee:

The Executive Committee (EC) of the Corporation consists of 3 Directors of the Board as members. The Executive Committee consider proposals for sanction of loans between Rs. 100 lakhs and Rs.300 lakhs. The members of the present E.C (as on 30.9.11) are as follows: 1.Chairman & Managing Director of the Corporation 2.Nominee by SIDBI 3.Retired CGM, SBI 8.3 Advisory Committee: Advisory Committee is a honorary committee constituted by the Board of the corporation consisting of leading Industrialists in this State and promoters of assisted units of the corporation and members from Industrial Associations in the State. This committee has been constituted by the Board of the Corporation for having periodical interaction to offer suggestions as regards to the requirements of various industries in the state for follow-up action by the corporation. 8.4 Default Review Committee (DRC): Default Review Committee (DRC) is a sub-committee of the Board with TIICs Chairman & Managing Director as its Chairman. It reviews the default cases periodically and also considers granting of reliefs and concessions to settlement cases apart from reviewing the affairs of sick units under rehabilitation. All the 3 Directors at the Executive Committee are the members of this committee also. 8.5 Audit Committee: The Audit Committee is constituted in terms of Sec.292 A of the Companies Act 1956. The Committee comprises of the following Directors: 1.Retired CGM, SBI 2.Director from SIDBI The suggestions made by the Audit Committee will be carried out then and there by the Corporation. 8.6 Regional Loan Sanction Committee (RLSC) : The Regional Loan Sanction Committee is headed by the Chairman and Managing Director / Managing Director along with other members viz., General Manager/ Deputy General Manager (Project) / AGM (Project) and Regional Manager concerned. The Committee sanctions loans upto Rs.100.00 lakhs for new units and Rs.150 lakhs for existing clients. In respect of Bill finance proposals for amount exceeding Rs.200 lakhs, CMD / MD will be the delegated authority to sanction and such cases should be first placed before RLSC and forwarded to CMD / MD with Regional Loan Sanction Committees recommendation (if CMD / MD is not heading RLSC). 8.7 Branch Sanction Committee (BSC): The Branch Sanction Committee is headed by the Regional Manager, other members are the Branch Manager concerned and one more Branch Manager (to be nominated by the Regional Manager). The Committee sanctions loans upto Rs.50.00 lakhs.

TIIC has been appointed as operating agency for various subsidy schemes operated by Govt. of Tamilnadu / Govt of India. The Govt of Tamilnadu is granting the following incentives to the small scale entrepreneur for setting up of agro-based industries : 11.1. Mega Subsidy : The Govt of Tamilnadu has announced capital subsidy to new industrial units and new units located in Govt promoted Industrial Parks and approved private Industrial Parks in terms of New Industrial Policy 2008. TIIC is the Nodal Agency from 01.04.2011 for all projects both assisted and non-assisted projects whose investments is upto Rs.300 crores. A. All New Micro Manufacturing Enterprises set up anywhere in the State (including non backward areas and industrial estates located within the radius of 50 Kms from Chennai city centre). All New Micro, Small and Medium Agro based and Food Processing Enterprises set up in all 385 blocks in the State (except the items listed in para 8.4 of MSMI Guidelines). All New Small and Medium Manufacturing Enterprises set up in backward areas and industrial estates, excluding the industrial estates located within the radius of 50 Kms from Chennai city centre. Existing Manufacturing Enterprises of the above three categories which taken up substantial expansion / diversification of the existing activities. The scheme aims at extending financial assistance to our existing and assisted manufacturing unit to meet their need based working capital for purchase of raw material. 1) The borrower should have been in operation at least for the last 5 years. 2) The borrower should have been assisted by the Corporation / Associated with us at least for last 3 completed years. 3) The unit engaged in manufacturing activity / processing and units with huge purchase of consumables / chemicals shall be eligible. materials for manufacture of sub component as per the requirements of buyers can also be considered.

c) Bill Financing Drawee Bill :


Sanction Limit 25% of Average Amt. of raw material purchased during preceeding 3 years. Drawal Limits 75% Invoice Value (Individual Invoice Value shall not be less than Rs.20 lakhs 120 Days The limit will be utilized towards financing of bills for purchase of raw materials / consumables required for the unit.

4) The account should have been classified as Standard Asset continuously for the last 3 completed financial years. 5) The unit should have earned Cash Profit for last 3 completed financial years. 6) The net worth of the unit for the last 3 completed financial years should be positive after taking into account of the accumulated loss and

Service sector and Trading units are not eligible. f) The applicants will be in the industrial sector (i.e not in trading / servicing sectors); the activity should not be in any high risk sector. g) The borrowings from Banks / NBFC/FIs may or may not have created assets and this would depend upon the cause of borrowing. h) The loan might have been used for improving general Infrastructure and upgradation of plant and machinery.

To facilitate repayment of costly debts availed from Bank/NBFC/ financial institutions availed to meet their urgent needs.

20) Business Space Rental Scheme :

21) Assistance to NBFCS :

TIIC/HO/REC/2008-09 Eligibility Criteria and General Guidelines for Compromise / Negotiated and OTS Schemes 2008-09: Eligibility Criteria / General Guidelines: Units which are classified as Doubtful as on 31/03/2005 are eligible. Units, which are classified as Sub-Standard Assets as on 31/03/2005, which had subsequently, became Doubtful Assets/Loss/ Written-off Assets as on 31.03.2008 are also eligible. Settlement of individual loan accounts of the concerns is not permitted. OTS concessions can be considered only for a borrower / unit as a whole. Seed Capital /Soft loan cases already written off will be eligible for waiver as applicable to term loan. In respect of Seed Capital / Soft Loans not written-off, Seed Capital / Soft Loan principal outstanding and simple interest at term loan interest less remittances towards principal and interest subject to a minimum of Seed Capital / Soft Loan principal outstanding have to be paid. OTS settlement amount in case of compromise / negotiated settlement / SLSS, the quantum of waiver will be arrived at taking into consideration, the total outstanding in Term Loan, WCTL, Generator Loan etc and seed capital / soft loan account. The Branch Manager shall assess the realisable value of the assets wherever required under the schemes. Units of wilful default, fraud and malfeasance as per RBI guidelines will not be covered under this scheme except under the specific instances by the Board. Wilful default would also include disposal / removal of movable / immovable assets financed by the institutions and given as security. Whenever necessary, compromise proposals in the case of willful defaulters coming under the expanded definition, will be placed before the Board for approval. For loans above Rs.10.00 lakhs, wherever, the quantum of waiver of Penal / Penal and Compound Interest (without any Simple Interest waiver) is less than Rs.5.00 lakhs in Term Loan, Transport Loan, Working Capital Term Loan, Generator Term Loan, the proposals are to be placed before MD for consideration. In respect of other cases (for loans above Rs.10.00 lakhs), the proposals shall be placed before the DRC/Board as per the existing delegation. The practice of reworking the interest at the earlier prevailing rate for Roll over cases by merging the funded interest with the term loan is discontinued.

The penal interest portion in the funded interest component under roll over cases for 2003-2004 will be eligible for waiver and it will be considered by BSC. No processing fees need be collected. The units would be eligible for waiver of penal interest on merits where the realizable value is higher than the loan outstanding as per the present practice. The borrower shall remit 15% of the principal outstanding as down payment to become eligible for OTS concessions subject to eligibility. Processing fees with applicable Service Tax as indicated shall be collected: i. For loans disbursed upto Rs. 10.00 lakhs Rs. 5,000 ii. For loans disbursed beyond Rs. 10.00 lakhs and upto Rs. 25.00 lakhs Rs. 10,000 iii. For loans disbursed beyond Rs. 25.00 lakhs and upto Rs. 100.00 lakhs Rs. 20,000 iv. For loans disbursed above Rs. 100.00 lakhs Rs. 25,000 The concern shall remit the OTS amount along with broken period interest at 13.5% p.a. on simple basis from the date of settlement committee meeting till the date of communication of the OTS approval together with other dues, other charges, interest tax, if any within 30 days from the date of communication of OTS approval. No further interest will be charged if the loan is settled within 30 days from the date of communication of OTS approval. The borrower has the option to pay the settlement amount in instalments provided 20% of the balance OTS amount and the other dues, incidental charges, interest tax if any, is paid within 30 days from the date of communication of OTS approval, failing which, the waiver concessions granted stands cancelled automatically. The balance 80% of OTS amount shall be remitted in five monthly instalments with simple interest at 13.5% p.a. till the date of settlement of account and Subsidy Bridge Loans. There is no change in the guidelines for settlement under OTS Schemes for Short Term Loans, Hire Purchase, Lease Finance and Subsidy Bridge Loan towards One Time Settlement of loan account. If the borrower fails to pay the settlement amount or 20% of the OTS amount together with the other dues, incidental charges, interest tax if any, within 30 days from the date of communication of OTS approval, the waiver concessions granted stands cancelled automatically.

The cases not covered under the scheme for settlement for Loss, Written-Off cases, SLSS and scheme for settlement of Transport Loans under TAHDCO scheme can be considered under Compromise / Negotiated Settlement Scheme subject to the eligibility criteria. All guidelines earlier issued for OTS scheme under Compromise / Negotiated Settlement Scheme shall continue to apply except specifically modified under the current year scheme. Managing Director is authorised to waive the entire other dues in exceptional / deserving cases based on merits for all cases to facilitate settlement of accounts. By offering these concessions there should not be any refund. Removal of Memorandum of Interest need to be placed before BSC for approval as per earlier practice after settlement of OTS amount. All pending cases, who had already paid processing fees / down payment under the earlier schemes will be eligible for settlement under the present schemes. The fixed deposit (security deposit), in the name of the promoter to be adjusted / pre-closed duly observing all formalities and adjusted towards OTS under the above schemes. Any amount available after settlement of loan account shall not be refunded to the borrower. Small Loan Settlement Scheme (SLSS): Units, which were doubtful, Loss and Written off category as on 31.03.2005 are eligible. Units, which were sub-standard category as on 31.03.2005 and subsequently slipped to doubtful, loss and written off category as on 31.03.2008 are also eligible for concessions. Processing fee has to be collected as applicable for Compromise Settlement Scheme. In case of more than one loan sanctioned to the same unit, the latest date of sanction will be taken into account for determining the eligibility for settlement of all loan accounts. Settlement of individual account under the scheme, in case of multiple accounts, is not permitted. As per earlier practice, the loan amount mentioned in the eligibility criteria denotes the amount disbursed. The loan amount upto Rs.10.00 lakhs under SLSS includes soft loan / seed capital outstanding also. Loans availed for Rigs, Excavators etc. under Transport Loans under TAHDCO Scheme upto Rs.10.00 lakhs may be considered for waiver concessions under SLSS subject to eligibility criteria.

The fixed deposit (security deposit), in the name of the promoter to be adjusted / pre-closed duly observing all formalities and adjusted towards OTS under the above schemes. Any amount available after settlement of loan account shall not be refunded to the borrower. The amount remitted towards CGC should not be taken into account, while considering the quantum of remittance under the Scheme. Scheme for Loss and Written-off cases without asset backup: The cut-off date for cases under the category is 31.03.2008. The cases where assets are missing will not be eligible for settlement under this category. However, cases where the assets have been auctioned by the Corporation or disposed-off by the Borrower with the approval of the Corporation will be eligible for settlement. Letter shall be sent to all the eligible cases before 09.01.2009 as per the format enclosed in Annexure-(a) advising them to settle the account before 31.03.2009. If the parties pay atleast 25% of the amount before 31.03.2009, they may be permitted to settle the account by remitting the balance amount in monthly instalments with 13.5% interest at simple rate from 01.04.2009 before 30.06.2009. No processing fee is necessary as OTS amount is as per the fixed formula. Settlement of individual account is not permitted. In case, if more than one loan was sanctioned to the same unit, the latest date of sanction will be considered for determining eligibility. The amount remitted towards CGC should not be taken into account, while considering the quantum of remittance under the Scheme.
