2. a. Yes I agree with all three scenarios.

The first is correct because using company computer and office time for personal use is a no no Company pay you for the work that you do for them, so an employee must do his best to strive to work and give full concentration while he is in the workplace. The second scenario is also agreeable because company computer can be only used for company work, that is also true for internet usage, internet researches can be done through internet, it is best if employees stop using it for their personal work or entertainment. The third scenario is also somewhat true, except for the instance that Jane Smith thought it was sexual harassment for her, I think she is over reacting, she is thinking that everything that happens pertains to her, except for that I agree with the advice of the attorney, the company should set strict rules regarding internet opening websites, they can block certain websites and adult sites. b. My advice will be to set rules regarding internet usage, whoever gets caught using internet or computer for personal reasons will receive 2 warnings, on the third time, they will either be suspended or fired. The company should also install camera with maintenance people looking at it, so they can know and supervise what the employees are doing. c. Using company materials for personal gain or personal use is against the rules because employees are paid to do the work of company and not to do personal work. Internet privileges must be limit due to many people using the internet. Sexual harassment in any way is banned in the workplace even in society.

3. a. No strict rules is implemented online so hackers can easily access information from a company. b. They must create passwords upon entering a site. Intranet usage is not accessible to all employees, only for the higher position ones. Do not post pertinent information online because some people may find a loophole for that and take that against your company. c.
MEMO: To: All systems administrative employees.

Impostors posing as employees may request accounts, passwords, and other information. Even by giving out employee names or instructions about how to obtain access, you may be helping a hacker gain access to our systems. Our performance ratings and our jobs depend upon keeping our systems secure.

All requests for account changes, passwords, or access changes must come through our normal request process. This process has been designed to ensure that the requestor is who they say they are and that the appropriate managers have approved the request. If you receive a phone call requesting access, employee names, or information about our security policies and procedures, do not answer these questions over the phone. You may e-mail this information to any employee, but you must use our company's e-mail address. Under no circumstances should you e-mail any information to an outside e-mail address. If the caller claims to not have company e-mail access, then you may e-mail this information to the employee's supervisor. Use our company's directory to determine the correct addressee, use only our company's e-mail addresses, and do not give out the employee names to the caller. The caller should know how to contact their own supervisor, and the supervisor should be able to affirmatively identify his or her own employees.

If you receive a subsequent call from the employee's supervisor rather than a change request through our normal processes, treat this caller in accordance with this memo.

4. a. Spyware is a type of malware (malicious software) installed on computers that collects information about users without their knowledge. The presence of spyware is typically hidden from the user and can be difficult to detect. Typically, spyware is secretly installed on the user's personal computer. However, some spyware such as keyloggers may be installed by the owner of a shared, corporate, or public computer on purpose in order to secretly monitor other users. While the term spyware suggests software that monitors a user's computing, the functions of spyware can extend beyond simple monitoring. Spyware programs can collect various types of personal information, such as Internet surfing habits, a history of visited sites, and user logins and passwords. Spyware can also interfere with user control of a computer in other ways, such as installing additional software or redirecting web Web browsers. Some spyware can change computer settings, resulting in slow Internet connection speeds, un-authorized changes in home pages, loss of Internet connection, or functionality of other software. Sometimes, spyware is included along with genuine software, and may come from an official software vendor. In an attempt to increase the understanding of spyware, a more formal classification of its included software types is provided by the term privacy-invasive software. Spyware is any technology that aids in gathering information about a person or organization without their knowledge. On the Internet (where it is sometimes called a spybot or tracking software), spyware is programming that is put in someone's computer to secretly gather information about the user and relay it to advertisers or other interested parties. Spyware can get in a computer as a software virus or as the result of installing a new program.

Data collecting programs that are installed with the user's knowledge are not, properly speaking, spyware, if the user fully understands what data is being collected and with whom it is being shared. However, spyware is often installed without the user's consent, as adrive-by download, or as the result of clicking some option in a deceptive pop-up window. Software designed to serve advertising, known asadware, can usually be thought of as spyware as well because it almost invariably includes components for tracking and reporting user information. However, marketing firms object to having their products called "spyware." As a result, McAfee (the Internet security company) and others now refer to such applications as "potentially unwanted programs" (PUP). The cookie is a well-known mechanism for storing information about an Internet user on their own computer. If a Web site stores information about you in a cookie that you don't know about, the cookie can be considered a form of spyware. Spyware is part of an overall public concern about privacy on the Internet. Many Internet users were introduced to spyware in 1999, when a popular freeware game called "Elf Bowling" came bundled with tracking software. Spyware is a general term used to describe software that performs certain behaviors, generally without appropriately obtaining your consent first, such as: Advertising Collecting personal information Changing the configuration of your computer

Spyware is often associated with software that displays advertisements (called adware) or software that tracks personal or sensitive information. Trading tracking for services That does not mean all software that provides ads or tracks your online activities is bad. For example, you might sign up for a free music service, but you "pay" for the service by agreeing to receive targeted ads. If you understand the terms and agree to them, you may have decided that it is a fair tradeoff. You might also agree to let the company track your online activities to determine which ads to show you. What spyware does Other kinds of spyware make changes to your computer that can be annoying and can cause your computer slow down or crash.

These programs can change your web browser's home page or search page, or add additional components to your browser you don't need or want. They also make it very difficult for you to change your settings back to the way you had them. Know what you're installing The key in all cases is whether or not you (or someone who uses your computer) understand what the software will do and have agreed to install the software on your computer. A common trick is to covertly install the software during the installation of other software you want such as a music or video file sharing program. Whenever you install something on your computer, make sure you carefully read all disclosures, including the license agreement and privacy statement. Sometimes the inclusion of unwanted software in a given software installation is documented, but it might appear at the end of a license agreement or privacy statement. There are a number of ways spyware or other unwanted software can get on your computer. To learn more about spyware, read How to help prevent spyware.

How Do I Avoid Spyware? Be selective about what you download to your computer Read licensing agreements Watch out for anti-spyware scams Beware of clickable ads Keep your Internet browser up to date Scan your computer often

How to choose the best spyware removal tool? Not all spyware removal applications can satisfy all your needs. Moreover, not all of them are safe some spyware programs disguise themselves as free online malware scanners and spyware cleaners! When choosing a spyware removal tool at antispyware download websites, pay attention to the following: Usability

Take a look at the spyware detector interface. Is it intuitive and well-designed? Are the control names descriptive enough? Are there any additional tooltips or explanatory popups? As you know, first impressions are half the battle. Therefore, no matter how functional the malware removal tool may be, usability aspects decide whether a person will continue using the program or search for a simpler solution. Spyware Detection and Removal Efficiency If a malware remover does not detect any malware on your PC, it does not mean that there's actually no malware. Maybe the problem is with the program. Maybe itsspyware scanner is not efficient enough, its malware protection mechanism is weak and therefore misses out some dangerous files. Another important aspect is real-time protection, meaning that the program can detect and remove malware on the spot, preventing it from lurking into your system. Finally, there are various types of malware, and it's nice if the program can deal with many of them. Impact on System Performance Some spyware removal software solutions are pumped full of various features. On one hand, such versatility is nice to have. On the other hand, it may cause your system to hang up and slow down. Some anti spyware software solutions offer a "quick spyware scan", but is it really quick? Find out how much time a malware scanner needs to detect the harmful files and your ability to use the PC during the online spyware scan; then draw your own conclusion. Customer Support Check your spyware blocker tool for decent customer support service. If your requests are left unanswered, it's hard to reach the call center on the phone and the support quality is poor, then it will cross out the program's efficiency, features and design. Data not collected on this Site or in connection with the Products and Services Personal information that is not collected on the Site or in connection with the Products and Services is not generally subject to this Privacy Policy. However, personal information submitted on physical product registration cards is classified as Registration Information and is subject to this Privacy Policy. This Privacy Policy also covers licensee information (such as contact name and address) provided in connection with Adobe's volume licensing program. If you wish to access and/or correct such information, please see instructions for doing so in the section entitled "Updating your personal information and privacy preferences." Tracking, use of cookies, web beacons and similar devices In order to improve our Products and Services and the Site and provide more convenient, relevant experiences to our customers, we and our vendors and agents may use "cookies," "web beacons," and similar devices to track your activities. A cookie is a small amount of data that is transferred to your browser by a web server and can only be read by the server that gave it to you. It functions as your identification card and enables Adobe to record your passwords, purchases, and preferences. It cannot be executed as code or deliver viruses. A web beacon is a small transparent gif image that is embedded in an HTML page or email used to track when the page or email has been viewed. A similar device may be used by which a Product and Service may send data to a server when a set of user-initiated events occur such as the "Add to Cart" button is clicked. This device is similar to a cookie in that it tracks your visit and the data can only be read by the server that receives the data. It is different than a cookie in that it is not browser-based,

may not function as an identification card, and does not store any data on your computer.

While Adobe uses cookies and similar devices to track your use of the Site and the Products and Services (such as the number of downloads, types of Products and Services used and downloaded, how many users we receive daily, the Site pages visited), and web servers automatically log the IP/Internet address of your computer, Adobe does not generally use this information to identify you personally. Exceptions to this are noted in this Privacy Policy. If you expressly provide consent for the Site or the Product and Service to "remember" the unique identifier that you select when you register for various activities on the Site or the Products and Services, that unique identifier will be stored on a persistent cookie on your computer and that unique identifier will be linked to your Registration Information. As a result, your navigation path around the Site and the Products and Services will be tracked in identifiable form. Adobe may also collect data about your online activities on the Sites for use in providing content and advertising tailored to your interests; if this occurs, you will be able to choose whether or not to have your information collected for such purpose. Some Products and Services allow the tracking of access to or use of Products and Services by users, as opposed to Adobe. For example, certain Products and Services allow document authors to restrict access to documents, track access to or use of those documents, or involve communications and transmission of data over the Internet to verify the authenticity of documents, authors and recipients. In many cases, this type of tracking will be obvious to you as a user of the Products and Services, and in others, the software and services license or terms of use, pop-up boxes, or email messages will inform you of these features and your options, such as disabling options. Some Products and Services require activation, which tracks information including installation rights and number of installations. Please see http://www.adobe.com/activation/main.html for more information. Personal Information that users provide about other individuals for tell-afriend or other referral features on the Site or within Products and Services is used by Adobe to send an initial communication to the person whose details you have provided, and is not retained in Adobe's systems. If you are invited by someone else to participate in shared editing or viewing of documents, photos, websites or other content, you will typically be required to contact the person who invited you to update, correct or delete the personal information they provided about you. In general, even though we may delete an account you hold with us in these types of shared editing or viewing areas, we may continue to retain information regarding your past actions with respect to content reviews or sharing initiated by others. We may also ask you to provide information of others such as when reporting suspected piracy. In this instance, we will ask for the person's or company's name and contact information so that we may investigate. Personal

information supplied in these instances will only be used for the purpose being submitted.

Most browsers are initially set to accept cookies, and most Products and Services that include similar devices are typically initially activated to collect data. You can set your browser to notify you when you receive a cookie, giving you the chance to decide whether or not to accept it. (For some web pages that require an authorization, cookies are not optional. Users choosing not to accept cookies or similar devices will probably not be able to access those pages or the related Products and Services.) Information about noncookie tracking devices and their features, including disabling options, are contained in the information materials provided with such Products and Services or on Site pages relating to such Products and Services. Adobe also hires other companies to place our banner ads on other websites. Such companies perform tracking and reporting activities on ads served and user reaction ("third-party advertisement servers"). They do not collect any information other than IP addresses and behaviors associated with those IP addresses on our behalf, and we do not give any personal information to them. Third-party advertisement servers are subject to their own privacy policies. Adobe may also allow other companies to display advertisements on certain pages of the Site or within the Products and Services. If you click on these advertisements these companies may place a persistent cookie on your computer which may allow them to display further advertisements to you. It is our policy to require these companies to provide accessible methods for you to disable these cookies. Should you have any complaints about the practices of any of these companies you should contact privacyofficer@adobe.com. Privacy complaints Adobe takes its users' privacy concerns seriously. The information collected by Google when you enable a third party application is processed under this Privacy Policy. Information collected by the third party application provider is governed by their privacy policies. Location data Google offers location-enabled services, such as Google Maps and Latitude. If you use those services, Google may receive information about your actual location (such as GPS signals sent by a mobile device) or information that can be used to approximate a location (such as a cell ID). Unique application number Certain services, such as Google Toolbar, include a unique application number that is not associated with your account or you. This number and information about your installation (e.g., operating

system type, version number) may be sent to Google when you install or uninstall that service or when that service periodically contacts our servers (for example, to request automatic updates to the software). Other sites This Privacy Policy applies to Google services only. We do not exercise control over the sites displayed as search results, sites that include Google applications, products or services, or links from within our various services. However, some Google features and services may not function properly if your cookies are disabled. Google uses the DoubleClick advertising cookie on AdSense partner sites and certain Google services to help advertisers and publishers serve and manage ads across the web. You can view and manage your ads preferences associated with this cookie by accessing the Ads Preferences Manager. In addition, you may choose to opt out of the DoubleClick cookie at any time by using DoubleClicks opt-out cookie. Information sharing Google only shares personal information with other companies or individuals outside of Google in the following limited circumstances: We have your consent. We require opt-in consent for the sharing of any sensitive personal information. We provide such information to our subsidiaries, affiliated companies or other trusted businesses or persons for the purpose of processing personal information on our behalf. We require that these parties agree to process such

information based on our instructions and in compliance with this Privacy Policy and any other appropriate confidentiality and security measures. We have a good faith belief that access, use, preservation or disclosure of such information is reasonably necessary to (a) satisfy any applicable law, regulation, legal process or enforceable governmental request, (b) enforce applicable Terms of Service, including investigation of potential violations thereof, (c) detect, prevent, or otherwise address fraud, security or technical issues, or (d) protect against harm to the rights, property or safety of Google, its users or the public as required or permitted by law.

If Google becomes involved in a merger, acquisition, or any form of sale of some or all of its assets, we will ensure the confidentiality of any personal information involved in such transactions and provide notice before personal information is transferred and becomes subject to a different privacy policy. Information security We take appropriate security measures to protect against unauthorized access to or unauthorized alteration, disclosure or destruction of data. These include internal reviews of our data collection, storage and processing practices and security measures, including appropriate encryption and physical security measures to guard against unauthorized access to systems where we store personal data. We restrict access to personal information to Google employees, contractors and agents who need to know that information in order to process it on our behalf. These individuals are bound by confidentiality obligations and may be subject to discipline, including termination and criminal prosecution, if they fail to meet these obligations. Accessing and updating personal information When you use Google services, we make good faith efforts to provide you with access to your personal information and either to correct this data if it is inaccurate or to delete such data at your request if it is not otherwise required to be retained by law or for legitimate business purposes. We ask individual users to identify themselves and the information requested to be accessed, corrected or removed before processing such requests, and we may decline to process requests that are unreasonably repetitive or systematic, require disproportionate technical effort, jeopardize the privacy of others, or would be extremely impractical (for instance, requests concerning information residing on backup tapes), or for which access is not otherwise required. In any case where we provide information access and correction, we perform this service free of charge, except if doing so would require a disproportionate effort. Because of the way we maintain certain services, after you delete your information, residual copies may take a period of time before they are deleted from our active servers and may remain in our backup systems. Please review the service Help Centers for more information.

1.

What Information We Collect Ticketmaster gathers two basic types of information through the Site: "Personally Identifiable Information" (or "PII") and "Non-Personally Identifiable Information" (or "Non-PII"). PII is information that identifies or can identify you as an individual (such as residential address, telephone number, or billing information) and Non-PII is aggregated information, demographic information, IP addresses, geographic location and any other information that does not reveal your specific identity.

a.

Non-Personally Identifiable Information. When you visit and interact with the Site, Ticketmaster and third parties with whom Ticketmaster has contracted to provide services to Ticketmaster may collect Non-PII (for example, a catalog of the Site pages you visit). Non-PII is anonymous and does not identify you personally. Non-PII is generally collected through the Site from four different sources: Internet protocol addresses and web logs; cookies; pixel tags and other similar technologies; and other NonPII that you voluntarily provide (as explained below). In addition, if you opt in to use our Site from your mobile device, we may receive information about your actual location (such as GPS signals sent by your mobile device) or information that can be used to approximate a location (such as a cell ID).

i.

IP Protocol Addresses and Web Logs. This Site's web servers automatically collect the Internet Protocol (IP) addresses and log files of visitors. Your IP address is an identifying number that is automatically assigned to your computer by your Internet Service Provider (ISP). This number is identified and logged automatically in our server log files whenever you visit the Site, along with the time(s) of your visit(s) and the page(s) that you visited. This information is collected in an aggregate form only and does not contain any PII. We use your IP address, and the IP addresses of all users, for purposes such as calculating Site usage levels, helping diagnose problems with the Site's servers, and administering the Site. Collecting IP addresses is standard practice on the Internet and is done automatically by many websites. In addition to the Non-PII usage of IP Addresses described above we also may link your IP address to personally identifiable information for fraud prevention purposes.

ii.

Cookies. We and our third party service providers may use a standard technology called a "cookie" to collect information about how you use the Site. Cookies reside on your computer and help the Site recognize your computer's browser as a previous visitor. For example, when you sign in to your My Ticketmaster account, cookies will be used to save your email address and name so the next time you visit your My Ticketmaster account from the same computer we will "remember" your email address and name in order to make your experience faster and simpler. On occasion our Site may also set a "session cookie" which helps us administer the Site. The session cookie expires when you close your browser and does not retain any information about you after it expires. If you do not want information collected through the use of cookies, you should be able to modify your browser preference to provide you with choices relating

to cookies. If you choose to reject cookies, you may be unable to use certain Site services (e.g., those services that require you to log on to the Site in order to participate). iii. Pixel Tags. We and our service providers may also use so-called "pixel tags," "web beacons," "clear GIFs" or similar means (collectively, "Pixel Tags") in connection with some Site pages and HTML-formatted email messages to track your use of our website in order to provide you with more useful information and a more personalized experience the next time you visit. A Pixel Tag is an electronic image, often a single pixel (1x1), that is ordinarily not visible to Site visitors and may be associated with cookies on the visitors' hard drives. Pixel Tags do not contain any PII and allow us to count users who have visited certain pages of the Site, to deliver branded services, and to help determine the effectiveness of promotional or advertising campaigns. When used in HTML-formatted email messages, Pixel Tags can tell the sender whether and when an email has been opened.

iv. OpenID.
Portions of our site allow you to log in using an OpenID provider. These services will authenticate your identity and provide you the option to share certain personal information with us such as your name and email address to prepopulate our forms. OpenID services give you the option to post information about your activities on this Web site to your profile page to share with others within your network. 2. How Information We Collect Is Used We know it is very important to protect the information you share with us. We take appropriate security measures to help safeguard this information from unauthorized access and disclosure. For example, only authorized employees are permitted to access your personal information, and they may do so only for limited reasons. We also encrypt credit card numbers and other sensitive information before it is sent from your computer to ours using secure socket layer technology (SSL). We also use firewalls to help prevent unauthorized access to your personal information. You should feel confident using our website. However, no system can be completely secure. Although we take very significant steps to secure your information, there is always a chance that your information will not always remain secure, and you should always take great care in handling and disclosing your personal information. For example, avoid sending personal information through insecure email. Please refer to the Federal Trade Commission's website at http://www.ftc.gov/bcp/menus/consumer/data.shtm for information about how to protect yourself against identity theft. Non-Personally Identifiable Information. Because Non-PII does not personally identify you, we may use such information for any purpose. For example, we may use Non-PII to measure the number of visits, average time spent on the Site and pages viewed as well as to diagnose problems with our servers and to administer the Site. We may then use this information to analyze and improve the features and functionality of this Site. We may use non-PII information about you and other Site visitors to sell and deliver advertising, promotions and content that we believe will be of interest to you. We may use thirdparty companies and networks to help us deliver this customized advertising to you based on your behavior on our Site. All information and data collected for those services is anonymous and cannot be used to identify you individually, but allows us to deliver online advertising that is more likely to be relevant and useful to you. To learn more about online behavioral advertising, visit http://www.networkadvertising.org/managing/learn_more.asp. If you would prefer not to receive ads delivered to you based on your behavior on our Site, please visit http://www.networkadvertising.org/managing/opt_out.asp. In addition, we reserve the right to share such Non-PII, which does not personally identify you, with third parties, for any purpose. For example, we may share information with advertisers or other third parties that are not part of the Ticketmaster family on an aggregate or other basis that does not disclose any of your PII.

a.

In some instances, we may combine Non-PII with PII (such as embedding email addresses in cookies). If we do combine any Non-PII with PII, the combined information will be treated as PII. This "combined" PII is not shared with third parties, except as described in this Policy. b. Personally Identifiable Information

i.

Site. We may use PII you give us to better tailor your website experience to your interests, to show you content in which you may be interested and to display the content according to your preferences. We may also share your PII within the Ticketmaster business family in order to enhance your experience on other Ticketmaster websites. To the extent we do so, we make sure that your PII receives the same level of protection throughout the Ticketmaster business family. All Ticketmaster companies comply with applicable privacy and security laws and, at a minimum, in any commercial e-mail they send to you, will give you the opportunity to choose not to receive such e-mail messages in the future. Please note that such sharing may involve the collection use, storage, or disclosure of PII outside the United States of America.

ii.

Communications. Unless you opt out, we may use your PII to send you information about Ticketmaster and its services as well as promotional material on behalf of some of our partners. If at any time you change your mind and prefer to no longer receive such marketing communications from us, please see the "Opt-Out Policy" section below.

iii. Administrative Matters. Ticketmaster reserves the right to contact you in the event of a change in the Site's Terms of Use and/or this Privacy Policy, or to notify you of other administrative matters in connection with the Site (e.g., contacting you to facilitate, complete or confirm a transaction). Because this information may be important to your use of the Site, you may not opt-out of receiving such communications. iv. Fulfillment of Requests. Ticketmaster may use your PII to fulfill the purpose for which such PII was provided (e.g., using your name and email to confirm your registration or using your credit card information to fulfill your purchase). v. Facilitation of Transactions. Forms on the Site may sometimes be pre-populated with your PII in order to facilitate a transaction between you and Ticketmaster. vi. Internal Business Purposes. We may also use your PII for our internal business purposes, such as to target advertising, for data analysis, for audits, for fraud prevention and for other internal purposes. vii. Shopping/Commercial Services. This Site may offer merchandise and/or ticket purchase services, which may be offered by us or by one of our ecommerce partners. To the extent the merchandise and/or ticket purchase services are offered by one of our ecommerce partners, such e-commerce partner will be collecting and using the PII you provide. For more information regarding your transactions with our e-commerce partners, please refer to Section 4(b) below. To the extent Ticketmaster is the entity offering the purchase services, when you make a purchase through the Site, we may collect your credit card number or other payment account number (for example, your PayPal account number), billing address (including zip code) and other information related to such purchase (collectively, "Payment Information") from you. We will use the Payment Information that you provide to bill you for your purchase and to fulfill your purchase. We may also use your Payment Information to allow us to ship or deliver tickets and/or receipts to you, respond to customer service requests, review and enforce limits on the number of tickets purchased per event and to help prevent credit card fraud. By providing your Payment Information, you are authorizing us to give that information to third parties as necessary to confirm and fulfill your order (for example, to process your credit card or payment account number and to send you products you have ordered). viii. Email This to a Friend.

The Site may allow you to forward certain items posted on Site or links to Site features by email or Instant Messenger to other parties who you believe may be interested. If you wish to use this feature, you may provide us with such other party's email address or Instant Messenger screen name so that we can facilitate your sending of such message to such other party. To do so, any PII you provide in connection with sending such other party the message, such as your name and your email address or Instant Messenger screen name, will, of course, be disclosed to such other party. While, due to technical restrictions, the recipient's email address or Instant Messenger screen names may be retained in our log files, we do not knowingly share it with third parties and we do not use this PII for any purpose except to send this one-time message (unless the recipient has already consented to such use of his/her PII). ix. Online Surveys/Sweepstakes and Contests. From time to time, we conduct online surveys and offer online sweepstakes or contests on the Site (each, a "Promotion"), and we may collect PII in connection with the same. We may use your PII to contact you regarding your Promotion entry, or to contact you if you win a Promotion (if applicable). You should carefully review the rules, if any, of each Promotion in which you participate through the Site, as they may contain additional important information about Ticketmaster's use of your PII. To the extent such rules conflict with this Privacy Policy, such rules will govern that particular Promotion. x. Newsletter and Magazine Subscriptions. When you complete the ticket purchase for our shows, you will be automatically enrolled in our newsletter. In addition, for some shows you may receive a complimentary subscription to a trade magazine. For this purpose, we will provide your name and mailing address to the magazine subscription fulfillment company. You may choose to opt out of such subscriptions during the checkout process. xi. Data Retention. We will retain your information for as long as your account is active, as needed to provide you services and will use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements. 3. How Personally Identifiable Information We Collect Is Disclosed We will disclose your personal information with third parties only in the ways that are described in the following sections. a. Affiliate Communications and Third Party Communications. Unless you opt out, we may share your PII with our affiliates, including venues, promoters or sponsors of events, artist representatives and fan clubs, teams, leagues and others who are involved in or bring you events. When you buy or sell tickets or bid in an auction on our Site (or try to do these things), you consent to allow us to provide your PII to these event providers and their contractors. We share this information so these event providers may send you announcements and notifications of events, products or services that might be of interest to you. For further information, please see the "Opt-Out Policy" section below. b. Ticketmaster Service Providers. We work with third parties who provide services including but not limited to data analysis, order fulfillment, credit card processing, email communications and other services of an administrative nature. If you use our services, we reserve the right to share your PII with such third parties for the purpose of enabling these third parties to provide such services. We take reasonable steps to ensure these third parties treat PII in a manner comparable to how we do so. c. Public Forums and Other Interactive Features. Please be aware that when you disclose PII through a chat room, forum, message board, news group or Facebook feature on the Site, the information may become public and accessible to all or a part of the Site community, so it is

important for you to exercise discretion and appropriate caution when deciding to reveal PII in these areas. In addition, when you choose to make a posting on such services, certain PII may be available for other users to view. We urge you to exercise discretion and caution when deciding to disclose your PII, or any other information, on the Site. WE ARE NOT RESPONSIBLE FOR THE USE OF ANY PII YOU VOLUNTARILY DISCLOSE THROUGH THE SITE VIA THESE FORUMS AND OTHER INTERACTIVE FEATURES. Please note that we reserve the right, but have no obligation, to republish content posted in a chat room, forum, message board or news group (including any PII contained therein) as further set forth in our Terms of Use. In the event that you encounter any Site user who you believe is improperly collecting or using information about you or other users, please contact us at privacy@livenation.com. To request the removal of your PII from these public forums, please see the "Accessing, Updating or Deleting Information Collected About You" section below. In some cases, we may not be able to remove your personal information, in which case we will let you know if we are unable to do so and why. d. Online Surveys/Sweepstakes and Contests. We may share PII collected in connection with Promotions with the third-party sponsors of any such Promotions (irrespective of whether such Promotions are hosted by us), or otherwise in accordance with the rules applicable to such Promotion. You should carefully review the rules, if any, of each Promotion in which you participate through the Site, as they may contain additional important information about a sponsor's or other third parties' use of your PII. To the extent such rules conflict with this Privacy Policy, such rules will govern that particular Promotion. e. Other Purposes. We also may disclose your information: In response to a subpoena or similar investigative demand, a court order, or a request for cooperation from law enforcement or another government agency; to establish or exercise our legal rights; to defend against legal claims; or as otherwise required by law. In such cases, we may raise or waive any legal objection or right available to us. When we believe disclosure is appropriate in connection with efforts to investigate, prevent, or take other action regarding illegal activity, suspected fraud or other wrongdoing; to protect and defend the rights, property or safety of our company, our users, our employees, or others; to comply with applicable law or cooperate with law enforcement; or to enforce our website terms and conditions or other agreements or policies. In connection with a substantial corporate transaction, such as the reorganization or sale of our business, a divestiture, merger, consolidation or asset sale, or in the unlikely event of bankruptcy.

2. Collection of Information By Third Parties

a. Co-Branded Pages. We may enter into relationships with "powered by" partners, business partners, sponsors, and co-branded sites (referred to here as "co-branded pages"). These might include, for example, pages that share our name and that of another entity. There may be a specific privacy policy on any such co-branded page. Any PII that you provide when signing up at any co-branded page may be collected by, or shared with, our third party partner. We have no control over, and are not responsible for, our third party partners' use of your PII. If you want to learn more about other entities' privacy practices, please review the websites of those third parties.

b. Transactions With E-Commerce Partners, Vendors and Advertisers.

When you provide PII to one of our Site's e-commerce partners, vendors or advertisers, this transaction will occur in connection with the site of the e-commerce partner, vendor or advertiser, not on the Site, and, as such, the PII you provide is collected pursuant to and controlled by the privacy policy of such e-commerce partner, vendor or advertiser. Ticketmaster is not responsible for such parties' privacy policies and we encourage you to familiarize yourself with the applicable privacy policy of the e-commerce site with which you transact business or to contact the operator of such site for more information. Please be aware that at times, at the request of or on behalf of our e-commerce partners, vendors or advertisers, Ticketmaster may "pre-populate" forms with your PII for your review, and, if you so choose, for submission to such ecommerce partners, vendors or advertisers. Accordingly, we encourage you to review each pre-populated form

carefully before agreeing to submit your PII to determine who is seeking to collect your information, and to familiarize yourself with the applicable privacy policy governing use of any PII collected about you. c. Job Postings. If you apply for a position with Ticketmaster and submit your personal information through our website, the information you submit will be used only in connection with considering and acting upon your application. We may retain your personal information for a period of time, but only for the purpose of considering your application for current or future available positions. If you choose to respond to a job posting on the Site, you may be directed to a third-party site (for example, a thirdparty site specializing in job postings, such as Monster.com). Any PII you provide will be collected by such third party. We have no control over, and are not responsible or liable for, such third party's use of your PII. Please consult such third party's privacy policy for information regarding their privacy practices. The third party collecting your PII will share such PII with Ticketmaster so that Ticketmaster can review your information and, if applicable, respond to your query or job application. Please note that Ticketmaster has no obligation to respond to all queries or job applications submitted. Any PII that Ticketmaster receives from such third party will be treated in accordance with this Privacy Policy. d. Third Party Advertising. Some of the ads appearing on this Site may be delivered to you by third party advertisers. In the course of serving advertisements to this Site, the third-party advertisers may place or recognize a unique cookie on your browser. NonPII about your visits to this Site, such as number of times you have viewed an ad, is used to serve ads to you. Some of these third parties may be advertising networks that are members of the Network Advertising Initiative, which offers a website to opt out of ad targeting from several advertising companies (www.networkadvertising.org). Third Party Links. The Site may contain links to third-party Internet websites, which are not owned or operated by Ticketmaster. We provide such links only as a convenience, and the inclusion of a link on the Site does not imply endorsement of the linked site by Ticketmaster. If you provide any PII through any such third-party website, your transaction will occur on such third party's website (not the Site) and the PII you provide will be collected by, and controlled by the privacy policy of, that third party. We are not responsible for the privacy practices or the content of such third-party websites, including such websites' use of any PII that you provide to them. We strongly encourage you to become familiar with the privacy practices of those sites. 3. a. Opt-Out Policy Ticketmaster Communications. When you supply Ticketmaster with PII, from time-to-time, in Ticketmaster's discretion, you may be asked to indicate whether you are interested in receiving information from us about special offers in connection with the Site, Ticketmaster and/or our advertisers and partners. Unless you opt out to receive such communications, we may, from time to time, send you marketing communications. At any time, you can choose to no longer receive commercial or promotional emails from us by clicking on My Ticketmaster and following the instructions to "manage your email alerts." You may modify your choices at any time in your My Ticketmaster account. Also, in any promotional email we send, you will be given the opportunity to opt out of receiving such messages in the future by clicking on the link at the bottom of the email that says "unsubscribe." It may take up to 10 days for us to process an opt-out request. Even if you have unsubscribed from receiving promotional emails from us, we may send you other types of important e-mail communications without offering you the opportunity to opt out of receiving them. These may include customer service announcements, administrative notices and surveys. Please note that changing information in your My Ticketmaster account or opting out of receiving promotional email communications will affect only future communications from us. If we already provided your information to a third party (such as an event provider) before you changed your preferences or updated your information, you may have to change your preferences directly with that third party as well.

e.

b.

Affiliate and Third Party Communications. From time-to-time in Ticketmaster's discretion, you may receive offers directly from our affiliates and/or from third parties. Unless you opt out to accept any such offer(s), any PII provided to Ticketmaster for such purposes may be shared with our affiliates and such third-party partner(s), to allow our affiliates and/or such third parties to provide you with such offers. If you would prefer that we no longer share your PII with our affiliates and/or with third parties for their marketing purposes, you may opt-out of such future sharing at any time by following the procedure above, provided however, you may not be able to opt out of certain third party offers that are displayed on our Site.

4.

Use of This Site by Children. The Site is not directed to individuals under the age of thirteen (13), and we request that such individuals do not provide PII through the Site. If a parent or guardian becomes aware that his or her child has provided us with personally identifiable information without the parent or guardian's consent by, for example, misrepresenting his or her age, that parent or guardian should contact us at privacy@livenation.com. If Ticketmaster determines that it has collected personal information of children under the age of 13, Ticketmaster will immediately delete such information and any accounts believed to be held by children under 13. Please see our Terms of Use for additional information regarding the use of this Site by minors. Accessing, Updating or Deleting Information Collected About You. This Site also gives you the opportunity to modify or remove PII that you have provided to us by way of this Site.
