1.0

SCOPE OF WORK FOR FIELD QUALITY ASSURANCE SERVICES:

PROJECT AT DULIAJAN, ASSAM, (B) 1 X 20 MW STG + 1 X 150 TPH GAS/OIL FIRED BLR, BASED CPP AT IOCL BARAUNI REFINERY PROJECT & (C) 1 X 53 MW GAS BASED CCPP AT BCPL/LEPETKATA, ASSAM. Additional suitable manpower shall have to be provided, if

The work for Field Quality Assurance services comprises of following three areas: a) b) 1.1 1.1.1) CIVIL WORK FOR MAIN POWER HOUSE,BOP, FABRICATION & ERECTION OF STRUCTURES MECHANICAL WORK FOR ERECTION OF BOILER,PIPINING & TG CIVIL CIVIL (MAIN & BOP)

Main civil consists of following structures/ packages :-Main Power House, Boiler foundations, ESP foundations, Equipment and machine foundations, Mill bay foundations and super structures, Transformer yard, Misc. foundations, pavements, switchyard, Roads & Drainage etc. Auxiliary buildings, consists of but not limited to following major areas:-Cooling water Pump House, Raw Water Pump House, CW duct, ESP Control Room, Chlorination Plant building, Compressor House, DG building, Clarified Water Pump House & Sump, Filtered water Pump House, & DM make up Pump House, Administrative Building, Technical building, Workshop, permanent stores, etc. Scope of the work under this contract shall comprise mainly of following:i. Sample checking of input materials (consisting mainly of steel, cement, sand, stone chips, bricks etc.) as per BHEL standards/ approved Field Quality Plans or IS codes/standards. This shall include inspection after receipt at site and verification of test certificates. ii. Contractor shall carry out checks/ witness various tests at respective Project site as per BHEL approved Quality Plans applicable for the project to be made available at site during work execution / relevant IS codes. Collection and compilation of various test results, certification/ authentication of test results and distributing it in mutually agreed format for respective Project on weekly/monthly basis.

Quality test check certification on completed works at various stages and finally on completion of work as per the approved quality plan. Proper documentation and record keeping of Inspection data, log sheets, protocols, test certificates etc.

1.1.2 CIVIL: STRUCTURURAL FABRICATION AND ERECTION (FOR POWER HOUSE, MILL BAY , MISC. BUILDINGS & TRESTLE STRUCTURE) Scope of contractor under this area shall mainly comprise of following: 1.1.2.1 Sample checking of input materials (consisting mainly of steel/ steel sections/ steel materials etc.) as per BHEL standards/approved Field quality plans for respective project or IS codes/standards. This shall include inspection after receipt at site and verification of test certificates. Contractor shall carry out checks/witness tests as per Statement of checks covered in field quality plan for structural steel works/ BHEL approved Quality plans to be made available at site during work execution / relevant IS codes/standards. Collection and compilation of various checks/test results, certification / authentication of test results and distributing it in mutually agreed format for respective projects on weekly/monthly basis. Quality test check certification on completed works at various stages and finally on completion of work as per the approved quality plan. Proper documentation and record keeping of Inspection data, logsheets, protocols, test certificates etc. MECHANICAL ERECTION OF BOILER & AUXILIARIES/TG & AUXILIARIES / MECHANICAL SYS. Scope of contractor under this area shall mainly comprise of quality checks in welding/NDE, as follows:For pressure parts, Contractor shall carry out all checks/witness tests under WELDING & NDE head as per FQP/QPI for boiler pressure parts welding schedule and drg. For structure, Contractor shall carry out all checks/witness tests under WELDING & NDE head as per FQP/QPI for boiler structures erection /welding schedule and drg.

For piping, Contractor shall carry out all checks/witness tests under WELDING & NDEs. Document/Quality plan /welding schedule /drg shall be provided to contractor during execution stage. This document/FQP etc. will also be in line with/similar to other FQPs/QPIs mentioned above. This includes welding of P-91 material also. 1.2.1.1 Collection and compilation of various check/test results, certification / authentication of test results and distributing it in mutually agreed format for respective projects on weekly/monthly basis. Quality test check certification on completed works at various stages and finally on completion of work as per the approved quality plans. Proper documentation and record keeping of Inspection data, log sheets, protocols, test certificates etc. TENTATIVE DEPLOYMENT PERIOD AT PROJECT SITE The tentative requirement and deployment period of Safety Engineer as per project requirement is mentioned below.

The deployment schedule as indicated is tentative and for guidance only and may vary as per actual site requirement. Such deployment shall be subject to approval and clearance of BHEL-Site authority only on submission of biodata and work experiences and necessary interview, if required.

However, actual man month deployed at project sites may vary to any extent. The quoted Unit rate shall remain firm for such variation, affecting upto +/- 30% variation in total contract value. Provision for extension: Deployment period of each of the above engineers may be extended by a period of maximum 6 months by BHEL at its discretion in case the work is not completed and the requirement exists. However this shall be confirmed by BHEL in writing. 3.0 3.1 GENERAL SCOPE OF WORK FOR FIELD QUALITY ASSURANCE SERVICES Contractor shall submit periodic reports after scrutinizing the results about their findings and making recommendation for corrective action during the course of the work. Contractor shall render assistance during periodic discussions among BHEL, customer, consultant and vendor/subcontractors in the event of corrective actions related to the scope of work. To emphasize defect prevention, Contractor shall participate in planning prior to start of major and critical work executions pertaining to the scope of work as detailed above. Contractor shall carry out checks to ensure that requirements of specifications and procedures have been met. A protocol will also be made by BHEL, other contractors (doing execution as per work awarded to them by BHEL) and Contractor in each case. In case of detection of defects/ non-conformities, suggestions for short term and long term remedial measures as a part of development effort should invariably be forthcoming. BHEL /its sub-contractors (other executing contractors) shall consult contractor in advance in this regard. Contractor shall Submit Monthly Progress Report (pertaining to their scope of work) every month to BHEL Site In-charge at respective Sites, BHEL Head Quality/ PSER and BHEL Project Manager at PSER Kolkata. Contractor shall provide necessary support services to BHEL site management in preparation for ISO /TQM audits/ HSE activities. Inspection documents/ results shall be retained/stored by contractor in such a manner that the same can be produced as quality documents during ISO/TQM/HSE audits at site. Contractor shall co-ordinate with the customer and respective consultants for carrying out joint checks wherever applicable. Necessary co-ordination with BHEL and its other sub-contractors/its follow-up will also have to be done by the contractor.

Contractor shall take insurance policies as per provision of GCC (Vol-I of tender document). Contractor shall send power of attorney in favor of their respective site representatives, who shall be signing the documents connected with this contract. BHELs competent authority will have right to regulate strength of deployment of contractors manpower as per requirements. Payment will be made on pro-rata basis. In case, the contractor fails to provide manpower for conducting checks in time (due to absence of contractors person, away from site) BHELs competent authority will have option to carry out the same by other suitable agency. Additional cost of such checks together with BHELs overhead charges will be borne by contractor, which shall be adjusted from any sum payable to the contractor. SPECIAL CONDITIONS OF CONTRACT 4.1 Reasonable office space for proper functioning of the Contractor's supervising personnel will be provided by BHEL at site, free of any charges. However, contractor has to arrange his own furniture, P & T telephone connection, lighting arrangements and other facilities as required by them, at their cost. For P & T telephone, BHEL shall render necessary assistance in getting the connection. No electricity charges will be levied by BHEL for the electricity used in the office space of contractor. All charges for telephone connection/uses shall be borne/paid by contractor. Accomodation and transportation at site shall be in the scope of the contractor except IOCL BARAUNI REFINERY PROJECT. The contractor has to arrange for medical facilities, fooding and necessary insurance facilities for his supervisory personnel posted at Respective sites at their cost. For witnessing of testing outside the Project Site, in Kolkata or elsewhere in India All testing Instruments, such as level, theodolite etc., any other instruments will be arranged by BHEL/ its other contractors working at site. However, contractor shall check accuracy and calibration of measuring equipments before they are put to use. Contractor will do the visual/physical checking of instruments and ask BHEL/ its other sub-contractors for producing valid calibration certificates, before using any instruments. However calibration/re-calibration of instruments is not in the scope of this contract. 4.4 All data/findings obtained from this work shall become the property of BHEL. This can not be published/utilized by any one/ Contractor without written permission of competent authority of BHEL.

Sub-letting of jobs within the agreed scope of work, in any way is not permitted. Contractor shall make available suitable personnel/ senior level technical personnel (personnel, other than those posted at site) for discussions/ interactions with BHEL, Customer and consultants, vendors / sub-contractors wherever need arises. Senior level personnel of contractor will visit periodically to site to ascertain the quality of jobs performed by their site personnel. Such visits of senior personnel will be free of any additional charges to BHEL. BHEL reserves the right to make final decisions on rejections of the work by the Contractor and such decisions shall be binding on Contractor and become conclusive. However in this case, BHEL will be responsible for the consequences. BHEL reserves the right to terminate the above contract at any point of time without assigning any reason, upon giving 15 days notice to the Contractor. BHEL reserves the right to short close the contract/reduce the deployment (strength) of contractor manpower (Engineer/Senior level Engineer) upon giving 15 days notice, depending upon requirement. In such cases, the payment shall be made for the completed months and part thereof on pro-rata basis, based upon approved rate of the contractor and no other compensation will be granted by BHEL.

Contractor's personnel posted at site shall not move outstation without the prior permission of Construction Manager of BHEL. Contractor has to follow the holidays at site as per BHEL site holidays. Working hours and timing shall be as per BHEL site practice. However, work may continue round the clock including Sundays and holidays and contractors staff shall have to be at site along with BHEL personnel subject to requirement, for which no extra payment will be made. No compensatory off/leave will be granted in case of such working on Sundays/holidays/extended hours. It is the sole responsibility of the contractor to insure the supervising personnel against accident and injury while at work. BHEL reserves the right to discontinue the deployment of supervisory manpower with 15 days notice, in case the performance of the concerned supervisor/Engineer is found to be unsatisfactory. No further payment shall be made against deployment of unacceptable supervisor/Engineer. Replacement of such persons will have to be arranged by contractor within 15 days.

Rate/Price schedule/Additional manpower Rate schedule is enclosed in VOL-III. BHEL Project sites may ask for additional Safety service manpower, if needed. Contractor shall provide manpower within 15 days notice period. Payment for additional manpower will be made as per individual item rates of accepted rate schedule. The quoted Unit rate of various groups shall remain firm for such variation, affecting upto +/- 30% variation in total contract value.

Qualification of Field Quality Assurance officer The required qualification of supervisory field quality assurance engineers in reference to rate schedules for separate groups, are as follows:Group-a (CIVIL WORK FOR MAIN & BOUGHT OUT PACKAGES) Field quality assurance engineer should be at least a graduate engineer in civil engineering with minimum 3 years related job experiences or diploma engineer in civil engineering with minimum 4 years related job experiences. Group-b (ERECTION OF BOILER/ TG &GT & PIPING/ MECHANICAL SYSTEM) Field quality assurance engineer should be graduate engineer in mechanical / metallurgical engineering with minimum 3 years related job experiences or diploma engineer in mechanical / metallurgical engineering with minimum 4 years related job experiences. Engineer must have valid Level II certificates in RT/UT as approved by INST/ANST.

The deployment of above manpower by contractor is subject to submission of bio-data and Interview/acceptance by respective BHEL Project site and getting necessary concurrence/approval from respective BHEL Project site in this regard. Contract period The contract period of field quality support services for the scope of work is for a period of 12 (Twelve) months for Duliajan, 8 months for Barauni & 14 months for Lepetkata project from respective date of start of work. However, this contract may be extended (up to a maximum of another six months) at the same terms and conditions, at the same rates, at the discretion of BHEL.

Mobilisation Contractor shall mobilize the manpower and start the work at site within 15 days from the date of written intimation from respective site.

9.0

MOBILISATION ADVANCE No mobilisation advance is payable in this contract.

10.0 PRICE VARIATION CLAUSE / RATE REVISION The accepted rates shall remain firm throughout the execution period including extension period, if any, and no escalation / revision shall be payable. 11.0 OVER RUN CHARGE No ORC is applicable to this contract. 12.0 TERMS OF PAYMENT/WORKING HOURS/LEAVES Subject to any deduction which BHEL may be authorised to make under the contract, payment shall be made on the certification of the BHEL engineer at site, as explained hereunder:12.1 For all items of work as per vol.-III, rate/price schedule, the monthly interim payment shall be limited to 95% of the gross value of interim bill (RA bills) on item rate basis. All admissible recovery / adjustments etc. shall be made from the interim payable amount. The balance 5% shall be payable along-with final bill which shall be released on completion of all the works, smooth closing / winding up of the site and on certification of respective BHEL site in-charge. Contractors invoices shall be accompanied by progress report for the month (with details of man-days etc.), duly signed by BHEL Engineer. Payment shall be made within 30 days of receipt of correct invoice by BHEL site office. Payments will be made as per rates accepted. The contractor shall submit the RA bill for the period between 25th of the last month to 24th of the current month latest by 30th of the month to respective BHEL site and payment shall be made within 30 days by respective BHEL site subject to correctness and completeness of the invoice. For the payment of staff deputed by contractor for this work, the months shall be computed as comprising of number of days worked at respective Project site, which at present are 6 days a week and 10/12 hours per day. However, in special cases work may continue round the clock, or may continue on Sundays/holidays for which availability of quality supervisor personnel should be ensured if required by BHEL. However, no extra payment will be made for working beyond normal hours in such special cases. No compensatory off/leave will be granted in case of such working on Sundays/holidays/extended hours. Casual leave will be admissible for personnel posted at site on full time basis subject to maximum 10 days in a year or on pro rata basis. In addition, Sundays and other holidays observed by BHEL site will also be admissible. BHEL shall not pay during the

period of earned leave/sick leave to be availed by contractors personnel. However, if earned leave/sick leave exceeds 7 days in any one stretch, the contractor will have to make suitable alternative arrangements. For any leave other than casual leave as mentioned above, pro-rata deduction shall be made on monthly bill by BHEL site.

13.0 SITE VISIT


The Bidder must visit Project Site mentioned in the tender before quoting and apprise himself of all prevailing conditions. 14.0 PROJECTS SYNOPSIS AND GENERAL INFORMATION A) INTRODUCTION (1) Project name: 20.28 MW Open Cycle Gas Turbine Power Plant (1 X Fr 5) at Duliajan. No of units x capacity: 1 x 20.28 MW (1 X Fr 5) Project setting up by: Oil India Limited. The 1 X 20 MW STG + 1 X 150 TPH GAS/OIL FIRED BIR, BASED CPP AT is set up by M/s INDIAN OIL CORPORATION LIMITED(IOCL) at Barauni,Bihar. The proposed 53 MW Combined Cycle Power Project at LEPETKATA being set up by M/s BCPL, ASSAM. And the site is approachable by road

It is essential that the bidder visit site and acquaint with the conditions prevailing at site before submission of the bid. The information given hereunder is for general guidance and shall not be contractually binding on the /BHEL. B)

The proposed project site is located at LEPETKATA, Assam. Nearest important town: Dibrugarh (15 Km). Nearest railway station: Dibrugarh (15 Km). Proposed railway approach: Proposed Dibrugarh-Moran Rail link. Nearest Airport: Dibrugarh (25 Km). Nearest Highway: Tinsukia-Dibrugarh-Sibsagar (NH-37), 500 M. OWNER : BRAHMAPUTRA CRACKER AND POLYMER LTD

15.0 EXTRA WORK There is no provision of any extra work in this contract /package. 16.0 TAXES AND DUTIES All taxes (except service tax), charges, duties, other incidental charges etc. and other taxes for execution of the contract under the scope of work shall be borne by the contractor and shall not be payable extra. Any increase of the same at any stage during execution of the contract shall have to be borne by the contractor. Any new tax imposed by Govt./statutory authority during the contract period also need to be borne by the contractor. SERVICE TAX : Service Tax as legally leviable & payable by the Contractor under the provisions of applicable Service Tax Law/Act , shall be paid by BHEL-P.S.E.R on Contractors Gross Bill. The Contractor is required to submit Service Tax reimbursement Bill , showing Service Tax Registration No , amount of Gross Bill , date etc on which they have remitted Service Tax to the Exchequer . The Contractor shall furnish proof of Service Tax registration with Central Excise Division covering the Services . Registration should also bear endorsement for the premises from where the billing shall be done by the Contractor on B.H.E.L-P.S.E.R for this Project. B.H.E.L-P.S.E.R will not be held to be responsible for non-compliance of various Service Tax Rules, being framed from time to time. 17.0 CONTRACT OPERATION After placement of LOI, Security deposit shall be deposited by successful bidder within 30 days in the following form -

Bank Guarantee/NSC/FDR/other similar options permitted as per GCC. In case of bank guarantee, its initial validity shall be above mention months for respective site. BG shall be revalidated as per provisions of GCC till the said work is actually completed at respective sites. After receipt of total initial security deposit as mentioned above at PSERHQ / Kolkata , work order shall be issued. Based on the confirmation/intimation from site in-charges, contractor shall deploy manpower as mentioned in clause no. 2.0 above. Contractor shall raise RA Bill/ Final bill at sites and payment shall be made from sites based upon accepted rates as per rate schedule (vol-III). Bill shall be accompanied with list of services rendered during the month (certified by BHEL Engr.) In case the contractor decides to deposit 50 % of security deposit by way of deducting from their running bills, then such deduction shall start from first RA bill at site. This SD shall be recovered by deduction from running bills @ 10% of the gross value of each running bills till the full Security Deposit is made up. The Bank Guarantee furnished towards Security Deposit for respective sites should be kept valid by proper renewal till the said work is actually completed at respective sites. Contractor shall deploy manpower at site in different categories/groups as per project requirement. BHEL site in-charge shall be the paying authority cum controlling officer for contractual dealing of the site. Contractor shall also nominate one of their senior Engineer/ Engineer as site-in-charge for all contractual dealings/payment purpose etc for the site and power of attorney shall be issued in his name. All payments shall be made from BHEL site office. Manpower (Engineer / Senior level engineer) shall be deployed by contractor for which payment shall be made based upon unit rates quoted/accepted as per vol-III. Rates quoted for different groups shall remain firm affecting up to +/- 30 % of contract value. For additional security deposit, clause no. 1.15.3.6 of GCC (vol-I) shall be applied. 18.0 SECURITY DEPOSIT Since separate order shall be placed for indivisual project, security deposit shall be calculated for respective order separately. 19.0 MODE OF EVALUATION & AWARDING

Evaluation of offer will be done on Grand Total Price for Duliajan, Barauni and Lepetkata together and awarding will be done on single agency. However, Project wise separate order shall be placed. 20.0 LIQUIDATED DAMAGES: Since time is the main essence of the contract, the deployment of manpower is to be made within the time limit specified in this Tender. In case Contractor deploys the manpower beyond the period specified in the Contract, BHEL will have no obligation to accept the same and reserves the right to levy liquidated damages at the rate of 0.5% (half percent) of the project wise awarded contract value delayed for each week of delay or part thereof without prejudice to any other relief or compensation due to BHEL under any other conditions of the order subject to a maximum limit of 10% of the project wise awarded total contract value. In case of delay in deployment of manpower at site, for reasons not attributable to BHEL, the Liquidated Damages clause shall be strictly enforced, unless extension of delivery date is granted through an amendment to the order. 21.0 GUARANTEE Contractor shall stand guarantee for the quality of the services rendered by them, including correctness / interpretation of test results for a period of 12 (Twelve) months from the date of start of guarantee period (date of completion of contractors work, as certified by BHEL at respective site). Contractor shall render free quality assurance services including use of required equipments, if any, as per provision of contract, during rectification work arising out of faulty quality assurance services rendered by contractor. In case contractor fails to render the required quality assurance services during such rectification works, within the time specified by BHEL Engineer, BHEL may proceed to get such services from any other agency at contractors risk and cost without prejudice to any other rights of BHEL and recover the same from contractors security deposit/other dues. This supersedes clause no. 2.13 of vol-I/GCC. 22.0 GENERAL Any terms & conditions not mentioned in VOL-II of tender document, shall be as per GCC (Vol-I) of tender document.
