A Habitual Traffic Offender is a person who has accumulated: Fifteen Moving Violations (in five years) Fifteen convictions for moving traffic offenses for which points may be assessed will result in an HTO Revocation

Three Major Violations (in five years) Three or more convictions of any one or more of the following offenses arising out of separate acts will result in an HTO revocation.

HTO revocations are calculated by conviction dates. The earliest connector conviction date and the latest connector conviction date must be no more than five years apart. The term of HTO revocation is 5 years.

Effective October 1, 2010 House Bill 795 established an amnesty period for Habitual Traffic Offenders. The amnesty period begins October 1, 2010 and ends June 30, 2011.
When customer calls in requesting information about the HTO amnesty program, review the record and verify that there is an HTO, with all 3 connectors being:
1) 2) Driving While License Suspended Revoked criminal and non-criminal (DWLSR) And All Offenses occurred before 7/1/2010

Once verified send the HTO Amnesty Work Request. Advised the customer that they will receive a call back once the review is completed (whether approved or denied). The turnaround time is about 10 - 15 business days. If determined that the customer is eligible to be considered for the amnesty program; a letter will be mailed to the customer instructing them to go to the clerk of the courts. This will be notated on the record in the correspondence section HTO Amnesty Approved. The clerk of court determines IF they will grant amnesty by changing the disposition of the DWLSR, and therefore removing the HTO.
If determined that the customer is NOT eligible to be considered for Amnesty, then they will receive a call advising they are not eligible. The correspondence section on the record will be notated Amnesty Review.
