RA 7164 Phil. Nursing Act of 1991: ARTICLE III: RA 9173 Phil.

Nursing Act of 2002: repealed RA 7164 Sec3: creation & composition of the Professional Regulatory Board of Nursing (PRBON) -the PRBON will represent 3 areas of nursing: SEC nursing service, nursing education & community health nursing -7 people: 1 Chairperson & 6 Members -appointed by Pres. Of Phils from 2 recommendees per vacancy by PRC, from a list of 3 nominees per vacancy from an accredited professional nursing organization in Phils EO496: Instituting procedures & criteria for selection & recommendation of nominees means any person who aspires to become member of board will have to pass thru the process of selection w/c includes nomination,recommendation & appointment. Sec. 4 Qualifications of the Chairperson & Board Members. The qualifications must be present AT THE TIME OF APPOINTMENT: NMRTenOffense a. Natural born citizen & resident of Phils b. Member of good standing of any accredited professional nursing org. in the Phils c. Must be an RN & Masters degree holder in nursing, education or any allied medical field (pag board member). The chairperson must be a masters degree holder in nursing d. Must have practiced the profession for (10) continuous yrs prior to appointment. And last % yrs shld have been rendered in the Phils e. Not convicted of any offense involving moral turpitude Sec.5 Reqmts upon qualification as board chair person or member Any person appointed to board must resign from his teaching position in any school/univ offering BSN or review program for local nursing board exam or from employment in the govt, GOCC, or any agency or subsidiary thereof.He cant supervise or hav an interest any institution offering nursing review classes. RA 9173 enumerates the 4 fundamental responsibilities of a nurse: RAPP 1. 2. 3. 4. To promote health To alleviate suffering To restore health To prevent illness

1. Need for nursing is universal 2. Respect for human rights is inherent in nursing 6 main features of RA 9173: 1.Organization of Board of Nursing (Art 3) 2. Examination & registration (Art 4) 3. Nursing Education (Art 5) 4. Nursing Practice (Art 6) 5. Health human resource production, utilization & devt (Art 7) 6. Penal & Miscellaneous provisions (Art 8) Sec 6: Term Of Office Term of office of the chairperson & board members shall be 3 yrs and until their qualified replacements have been appointed. The chairperson & board members can be reappointed for another term. Sec 7: Compensation of Board Members The Chairperson & Board Members shall receive compensation & allowances comparable to that of members of other professional regulatory boards Sec 8: Administrative Supervision of the Board, Custodian of its Records, Secretariat & Support Services The Board shall be under the administrative supervision of the Commission. All of its records such as applications for examination, administrative & investigative cases shall be under the custody of the Commission. The Commission shall designate the secretary of the Board to provide the secretariat & support services to implement the provisions of this Act. SECRETARIAT an administrative unit responsible for maintaining records Sec 9: Powers & Duties of the Board: CIMECPPR a. Conduct licensure examination for nurses b. Issue, revoke or suspend certs of registration c. Monitor & enforce quality standards of nursing practice in the Phils. and exercise its powers to ensure the maintenance of technical, ethical, efficient, moral & professional standards in nursing practice taking into account the health needs of the nation d. Ensure quality nursing education by examining facilities of universities/ colleges of nursing or depts. Of nursing education & those seeking permission to open new nursing courses to ensure that the standards of nursing education are properly complied with & maintained at all times.

The authority to open or close nursing colleges/ nursing education programs shall be vested in the CHED upon the written recommendation of the Board. e. Conduct hearings & investigations to resolve complaints against nurse practitioners for unethical & unprofessional conduct & violations of this Act & its rules & regulations; to issue subpoena ad testificandum & subpoena duces tecum to respondents & witnesses, to produce documents & to punish with contempt persons obstructing, impeding or interfering with the conduct of such proceedings upon application with the court. SUBPOENA AD TESTIFICANDUM a written subpoena issued by the court commanding a person to appear & testify in court at a certain time regarding a specific matter SUBPOENA DUCES TECUM court order to produce documents as evidence f. Promulgate a Code of Ethics in consultation & coordination with the accredited professional orgnztn of nurses w/in 1 year from the effectivity of this Act. g. Recognize nursing specialty orgnztns in accordance w/ accredited professional orgnztn h. Prescribe, adopt, promulgate & issue guidelines, regulations, measures & decisions necessary to improve the nursing practice, advance the profession or fully enforce this Act, subject to review or approval by the Commission. Sec 10 Annual Report The Board shall submit an annual report to the Pres of the Phil at the end of the calendar year thru the Commission giving a detailed account of its accomplishments & its proceedings during the year & its recommendations to improve & upgrade the conditions affecting the nursing practice . Sec 11 Removal or Suspension of Board Members The Board Member after being given the opportunity to defend himself/herself in a proper administrative investigation, The President may suspend or remove any Board Member on any of the ff. grounds: a. Incompetence or continued neglect of duty b. Commission or tolerance of irregularities in the licensure exam c. Unprofessional, immoral or dishonorable conduct ARTICLE IV: LQ-SROI-FAR-SNRR Sec 12 Licensure Examination All applicants to the license to practice nursing are required to pass an exam, to be given by the Board (PRBON), in places & dates designated by the Commission (PRC) in accordance with RA 8981 or PRC Modernization Act of 2000. Sec 13 Qualifications for Admission to Licensure Exam The applicant, at time of filing of application, must:

a. A Filipino citizen or a citizen/subject of a country that permits Filipino nurses to practice within its territorial limits on the same basis as the subject/citizen of such country. Provided that that the reqts. For registration or licensing of nurses in such country are substantially the same as those prescribed in this Act. b. Of good moral character c. A holder of Bachelors Degree in Nursing from a college/univ that complies with standards of nursing education recognized by the proper govt. agency Sec 14 Scope of Examination Shall be determined by the Board taking into consideration the broad areas of nursing & other related disciplines, objectives of nursing curriculum and competencies in determining the subjects of exams. Sec 15 Ratings To pass, the examinee must get a gen. average of atleast 75% without a rating below 60% in any subject. In case an examinee obtains an ave rating of 75% or higher but gets a rating below 60% in a subject/s shall be required to take the exam again but only in the subject/s where he/she received a rating below 60% and to pass he must get atleast 75% in the subject/s repeated. Sec 16 Oath Prior to entering the practice, the all successful candidates in the exam shall be required to take an oath of profession before the Board or any govt. official authorized to administer oaths. Sec 17 Issuance of Cert.of Registration/Professional License & Professional Identification Card A CoR/PL as a nurse shall be issued to the applicant who passes the exam after payment of prescribed fees. Every CoR/PL shall bear the registants fullname, serial number, official seal of the Board, signature of the Chairperson of the Commission & Members of the Board. A PIC shall also be issued to the registrant after pyment of required fees. The PIC should be signed by the Chairperson of the Board and shall bear the license number, registration date, date of issuance & expiration. Sec 18 Fees for Examination & Registration Applicants for examination & registration must pay the fees prescribed by the Commission Sec 19 Automatic Registration of Nurses Nurses whose names appear at the roster of nurses shall be automatically or ipso facto registered as nurses under this Act upon its effectivity. Sec 20 Registration by Reciprocity

A CoR/PL may be issued w/o an exam to nurses registered under laws of a foreign state or country. Provided, that the reqts for registration or licensing of nurses in such country are substantially the same as those prescribed in this Act. Provided further, that the laws of such state or country grant the same privileges to Phil. RNs on the same basis as subjects/citizens of such state or country. Sec 21 Practice Through Special/Temporary Permit A special/temporary permit may be issued by the Board, subject to Commissions approval & upon payment of prescribed fees, to the ff persons, provided that the tempo/special permit shall be effective only for the duration of the project, medical mission or employment contract. Licensed nurses from foreign states/countries: a. Who are internationally well-known specialists or outstanding experts in any branch/specialty of nursing and whose service are either free or for a fee. b. On medical mission & whose services are free in a particular hospital,center or clinic c. Employed by schools/colleges of nursing as exchange professors in a branch/specialty of nursing Sec 22 Non-Registration, Non-Issuance of COR/PL or Special/Tempo Permit No person convicted by final judgement of a criminal offense involving moral turpitude or any person guilty of immoral or dishonorable conduct or any person declared by court to be of unsound mind shall be registered or be issued a COR/PL or special/tempo permit. The Board shall provide a written statement to the applicant stating the reasons for the actions and incorporating written statement in the records of the Board. Sec 23 Revocation & Suspension of COR/PL and Cancellation of S/T Permit The Board shall have the power to revoke or suspend the COR/PL or cancel the S/T of a nurse on any of the ff. grounds. Provided, that the suspension of COR/PL shall not exceeding a period of 4 years: CUMUG VP a. b. c. d. e. f. For causes mentioned in Sec 22 For unprofessional and unethical conduct For gross incompetence or serious ignorance For malpractice or negligence in the practice of nursing For use of fraud, deceit or false statements to obtain a COR/PL or S/T permit For violation of this Act, its rules & regulations, Code of Ethics for nurses and technical standards of nursing practice, policies of Board & the Commission, or conditions & limitations on special/tempo permit g. For practicing his/her profession during suspension from practice Sec 24 Reissuance of Revoked Certificates & Replacement of Lost Certificates

After the expiration of max of 4 yrs from date of revocation, and after the cause of revocation has disappeared, has been cured or corrected, the Board for reasons of justice & equity, may issue another copy of the COR/PL upon proper application & payment of required fees. A new COR/PL to replace the lost, destroyed or mutilated one, may be issued subject to the rules of the Board. ARTICLE V: NURSING EDUCATION: NIQ Sec 25 Nursing Education Program The nursing education program shall provide sound and professional foundation for the practice of nursing. Learning experiences shall adhere strictly to specific requirements prescribed in the curriculum as promulgated by CHEDs policies and standards of nursing education. Sec 26 Requirements for Inactive Nurses Returning to Practice Nurses who have not actively practiced the profession for (5) consecutive years are required to undergo (1) month didactic training and (3) months practum. The Board shall accredit hospitals to conduct such training program. Sec 27 Qualifications of the Faculty A member of college faculty of nursing teaching professional courses must: 1RBM a. b. c. d. Be a registered nurse in Phils. Have atleast (1) year clinical practice in a field of specialization Be a member of good standing in accredited professional organizations of nurses Holder of masters degree in nursing, education or other allied medical & health sciences from a college or university recognized by the govt. of the Phils.

In addition to above reqts, the dean of a college must have: a. masters degree in nursing. b. atleast (5) yrs of experience of nursing. ARTICLE 6: NURSING PRACTICE: SQ Sec28 Scope of Nursing Meaning of nursing practice singly or in collaboration with another, initiates & performs nursing services to indls, communities and families in any health care setting. It includes Nx care from conception to old age (includes but not limited to conception, labor, delivery, infancy, childhood, toddler, pre skul, skul age, adolescence, adulthood and old age). CLDICTPSAAO -as independent practitioners: Nx primary responsibility is promotion of health & prevention of illnesses

-as members of health team: collaborate with other health care providers for curative, preventive & rehabilitative aspect of care, health restoration, alleviation of suffering, and peaceful death. It shall be the duty of the nurse to: TUNEL a. Provide nursing care thru the utilization of the Nx process. --Nx includes, but not limited to, traditional & innovative approaches, therapeutic use of self, executing health care techniques & procedures, primary health care, comfort measures, health teachings, administration of written rx treatment, therapies & medications (oral, topical & parenteral). In case of suturing of perineal lacerations, special training shall be provided accdg. To established protocol. b. Establish linkages with community resources & coordination with health team c. Provide health education to individuals, families & communities. d. Teach, supervise & guide students in nursing education programs includes undertaking consultation services, administering Nx services in hospitals & clinics, engaging in activities that require decision-making skills & use of knowledge of an RN. e. Undertake Nx and health human resource development training & research which includes, but not limited to, development of advance nursing practice. Sec 29 Qualifications of Nursing Service Administrators persons occupying supervisory or managerial positions; must be: 2RBM a. Registered nurse of the Phils b. Atleast (2) yrs experience in general service administration c. Possess a BSN dgree with atleast (9) units in management & administration courses at the graduate level d. Member of good standing of the accredited professional organization of nurses In addition to above rqtms, a chief nurse or director or nursing shall possess: a. Atleast (5) yrs experience in a supervisory or managerial position in Nx b. Masters degree major in Nx Provided further, that MOPP

a. the maximum academic qualifications & experiences for a chief nurse in primary hospitals shall be shall as specified in a, b and c of this section 2RB b. the chief nurses in public health agencies who have a masters degree in public health/community health shall be given priority c. for chief nurses in military hospitals, those who have finished a masters degree in Nx and have competed the General Staff Course (GSC) shall be given priority d. those occupying positions such positions before the effectivity of this Act shall be given (5) yrs to qualify ARTICLE VII HEALTH HUMAN RESOURCE PRODUCTION, UTILIZATION & DEVT: SCSFI

Sec 30 Studies for Nursing Manpower Prodn, Utilization,Needs & Devt The Board shall initiate, undertake & conduct studies on human health resource, prodn, utilization & devt in accordance with the APO (accredited prof. org.) and appropriate govt and private agencies Sec 31 Comprehensive Nursing Specialty Program Within (90) days from effectivity of this Act, the Board shall be required to formulate a comprehensive Nx Specialty Program in coordination with the APO, recognized specialty orgs & DOH to upgrade the level of skill & competence of specialty nurse clinicians in the country such as, but not limited to, the areas of renal, oncology, critical care. Beneficiaries of this program will be required to serve any Phil hospital for atleast (2) consecutive years of continuous service. Sec 32 Salary The minimum base pay of nurses working in public health institutions shall not be lower than salary grade 15 under RA 6758 Compensation & Classification Act of 1989. Provided that for nurses working in local govt units, adjustments to their salaries will be in accordance with Sec 10 of said law. Sec 33 Funding for Comprehensive Nursing Specialty Program Annual financial reqt needed to train atleast 10% of the nursing staff of the participating govt. hospital shall be charged against the income of PCSO & PAGCOR, they shall equally share in the costs and shall be released by DOH subject to acctg. And auditing procedures. Provided that DOH shall set the criteria for availment of this program. Sec 34 Incentives & Benefits PRBON, in coordination with DOH, other concerned govt agencies & the APO, shall establish an incentive & benefit system for nurses and their dependents in the form of free hospital care, scholarship grants & other non-cash benefits. Govt and private hospitals shall be mandated to maintain the standard nurse-patient ratio set by DOH ARTICLE VIII PENAL & MISCELLANEOUS PROVISIONS Sec 35 Prohibitions in the Practice of Nursing FAPA vuv IEU Fine of P 50,000 to 100,000 o imprisonment for 1 to 6 yrs, or both, upon the discretion of the court, shall be imposed upon any person practicing nursing in the Phils. Within the meaning of this Act who:

1. gives false evidence to the Board to obtain a certificate or registration/prof license, professional ID card or special permit 2. falsely poses or advertises as registered/licensed nurse or uses any other means to convey the impression that he/she is a registered/lincensed nurse 3. appends RN/BSN or any similar appendage to his/her name without having been conferred said degree or registration 4. as an RN/licensed nurse, abets or assists the illegal practice of a person not lawfully qualified to practice nursing: a. any person/employer of nurses who violate the minimum base pay of nurses and benefits & incentives that should be accorded them as specified in sec 32 and 34 b. any person/CEO of a juridical entity who undertakes in-service educational programs or conducts review classes for local & foreign examinations without permit/clearance from the Board and Commission c. any person/CEO of a juridical entity violating any provision of this Act and its rules & regulations 5. uses an invalid COR/prof license, suspended or revoked COR/Prof license, or an expired or cancelled special/temporary permit 6. without a COR/PL and prof ID card or special/tempo permit without having been declared exempt from examination 7. uses as his/her own COR/PL and prod ID card or special/tempo permit of another ARTICLE IX FINAL PROVISIONS EARSRE Sec 36 Enforcement of this Act It shall be primary duty of the Commission or Board to effectively implement this Act. The Board or Commission can request or call upon any law enforcement agencies and officers of national/provincial/city/municipal govts. To render assistance to enforce the provisions of this Act and to prosecute persons violating the same. Sec 37 Appropriations Chairperson of PRC shall include the implementation of this Act in its program. Funding for such program shall be included in the Annual General Appropriations Act Sec 38 Rules & Regulations Within 90 days from effectivity of this Act, The Board, Commission, DOH, APO, Dept of Budget & Management & other concerned govt. agencies, shall formulate rules & regulations to carry out the provisions of this Act. The rules & regulations shall be published in the Offical Gazette or in any newspaper of general circulation Sec 39 Separability Clause

If any part of this Act is declared unconstitutional, the remaining parts shall not be affected and shall continue to be valid & operational Sec 40 Repealing Clause RA 7164 Phil Nursing Act of 1991 is hereby repealed. All other laws, decrees, orders, circulars, issuances, rules & regulations & parts thereof inconsistent with this Act are hereby repealed, amdended & modified accordingly Sec 41 Effectivity This Act shall take effect 15 days after its publication in the Official Gazette or any (2) two newspaper of general circulation in the Phils.
