ARTICLE XI.

ACCOUNTABILITY OF THE PUBLIC OFFICERS (PANANAGUTAN NG MGA PAMBUBLIKONG OPISYAL)


SECTION 1. This section informs us that the public officials together with their staffs are accountable to the people. They must serve them with utmost responsibility, integrity, loyalty, and efficiency, act with patriotism and justice, and lead modest life to the Filipino people. One good example is the administration of President Aquino. President Aquino together with the Congress are accountable to the people as they are the servants of the people. SECTION 2. Section 2 of this article explains to us the manner on how a government official can be removed from the office. Either he may be the president, the vice president, the members of the Supreme Court, the members of the constitutional commission, or the ombudsman if he can be caught violating the constitution he can be removed to his position by means of impeachment for or conviction of. SECTION 3. Section 3 states the power and responsibility of the house of the representative throughout all the impeachment cases. One example of this is the impeachment case of the former President Joseph Estrada. Impeachment Case- a formal process in which an official is accused of unlawful activity, the outcome of
which, depending on the country, may include the removal of that official from office as well as other punishment.

SECTION 4. Section 4 states that the present Sandiganbayan shall continue to function and exercise its jurisdiction that may be provided by law. Sandiganbayan- is a special court which was established under Presidential Decree No. 1606. Its rank is equivalent to the Court of Appeals. SECTION 5. Section 5 notifies us the creation of an independent office of the Ombudsman. That It must be composed of the ombudsman known as the Tanodbayan, one overall Deputy and at least one Deputy each for Luzon, Visayas, and Mindanao. A separate Deputy for the military establishment may likewise be appointed. Office of the Ombudsman- an ombudsman responsible for investigating and prosecuting Philippine government officials accused of crimes. The Offices of the Ombudsman independently monitors all three branches of the government. The Ombudsman is also responsible for

receiving complaints from citizens and organizations from the country. The Ombudsman usually prosecutes officials accused of graft and corruption. SECTION 6. The officials and employees of the office of the ombudsman, other than the deputies, shall be appointed by the ombudsman, according to the civil service law as stated in this section. SECTION 7. In this section, it informs us about the existing tanodbayan that shall hereafter be known as the office of the special prosecutor. It shall continue to function and exercise its powers as now or hereafter may be provided by law, except those conferred on the office of the ombudsman created under this constitution. SECTION 8. Every natural-born citizen in the Philippines, and at the time of their appointment, at least forty years old, of recognized probity and independence, and members of the Philippine bar, and must not have been candidates for any elective office in the immediately preceding election are the qualifications of the ombudsman and his deputies. And specifically the ombudsman must have, for ten years or more, been a judge or engaged in the practice of law in the Philippines as provided in this section. SECTION 9. In this section, it explains to us how the Ombudsman and his deputies are appointed by the president of the republic. SECTION 10. Section 10 states that the ombudsman and his deputies shall have the rank of chairman and members, respectively, of the constitutional commissions, and they shall receive the same salary which shall not be decreased during their term of office.

SECTION 11. This section tells us that the ombudsman and his deputies shall serve for a term of seven years without reappointment. They shall not be qualified to run for any office in the election immediately succeeding their cessation from office. SECTION 12. Section 12 states that the ombudsman and his deputies, as protectors of the people, shall act promptly on complaints filed in any form or manner against public officials or employees of the government, or any subdivision, agency or instrumentality thereof, including government-owned or controlled ARTICLE XI- Accountability of Public Officer

corporations, and shall, in appropriate cases, notify the complainants of the action taken and the result thereof. SECTION 13. Section 14 states that the office of the ombudsman shall enjoy fiscal autonomy. Its approved annual appropriations shall be automatically and regularly released. SECTION 15. SECTION 16. Section 16 states the limitations of public officials. Either he may be the president, the vice-president, a member of the cabinet, the congress, the Supreme Court, or even the constitutional commissions, and the ombudsman, or to any firm or entity in which they have controlling interest, during their tenure. SECTION 17. This section states that a public officer or employee shall submit a declaration under oath of his assets, liabilities, and net worth, upon assumption of office and as often thereafter as may be required by law. And in the case of the president, the vice-president, the members of the cabinet, the congress, the supreme court, the constitutional commissions and other constitutional offices, and officers of the armed forces with general or flag rank, the declaration shall be disclosed to the public in the manner provided by law. SECTION 18. This section states a law that must be followed by the public officials and employees during their tenure.
