In exercise of the powers conferred by subsection (1)of section 25 of the Civil Servants Act, 1973 (LXXI of 1973), read wi th FundamentalRules 45 and 45 A, the President is pleased to make the following rules for the allotmentof residential accommodation to the Federal Government Se (1). rvants namely:-CHAPTER I - GENERAL1.Short title, extent and commencement. These rules shall be called theAccommodation Allocation Rules, 2002.(2). They sh all apply to allotment of accommodation at Islamabad and other stations.(3). The y shall come into force at once.2. Definitions. In these rules, unless there is anything repugnant in the subject orcontext. (a) accommodationmeans residential a ccommodation including a house or flatowned, hired or requisitioned by Governmen t and placed on the pool of the EstateOffice;(b) allotteemeans a Government servan t possessing a valid allotment letter dulyissued by the Estate Office for an acc ommodation in his occupation;(c) annexmeans an annexure to these rules;(d) emolumen tsfor the purpose of recovery of rent include pay, special pay,technical pay, dep utation allowance, pension, non-practicing allowance, adhocrelief, qualification allowance, teaching allowance, performance evaluationallowance, special researc h allowance, computer allowance and such other pay andallowance as the Governmen t may decide, from time to time, for the purpose of calculating normal rent; (e) entitlementmeans the entitlement to accommodation as specified inrules 5,8 and 9; (f) familymeans spouse, legitimate children and step children of aGovernment serva nt residing with him and wholly dependent upon him andincludes his parents, real unmarried sisters and minor brothers, if residing with himand dependent upon hi m;(g) Federal Government Servant (FGS)means a person who is appointed ina Ministry , Division or an Attached Department against a regular post and certifiedas such by the concerned Ministry, Division or Department excluding incumbentsof posts filled on daily wages, work charged basis or hired from contingencies, andad-hoc basis;(h) Governmentmeans the Government of Pakistan in the Ministry of Housing a nd Works (Works Division);(i) GWLmeans General Waiting List maintained under rule 6;(j) normal rentmeans the rent calculated at the rate of five percent of themonth ly emoluments of theFGS;(k) occupantmeans an individual or group of individuals oc cupying wholly orpartially an accommodation;(l) other stationsmean any city or pla ce other than Islamabad andRawalpindi;(m) rental ceilingmeans the ceiling fixed by the Government for hiring of private houses as notified from time to time;(n) se

rvicesmean electricity, water, gas supplies and telephone connections;(o) standard rent,in relation to Government owned accommodation, meansthe rent fixed by the G overnment and notified from time to time and in relation tohired accommodation, means the assessed or sanctioned rent and actually beingpaid to the owner of the house;(p) trespassermeans an individual or group of individuals who occupyGovernm ent or hired accommodation without valid allotment letter issued by theEstate Of fice for its occupation; and (q) unauthorized occupantmeans a person whose allotme nt is no longer validunder these rules. CHAPTER II-ELIGIBILITY3. Eligibility. (1) All married FGSs in the Ministries or Divisions and theirAttached Department s except those maintaining their own pool of accommodation orfunds for hiring of houses, shall be eligible for accommodation from the Estate Office.(2) Unmarrie d FGSs shall be eligible for house rent allowance or single or bacheloraccommoda tion so earmarked for them. However, unmarried FGS will be eligible forgovernmen t accommodation provided he is living with his dependent parents.(3) When both h usband and wife are employed at the same station, only one of themshall be entit led to allotment of accommodation and in case they are serving at twodifferent s tations, one of them shall be allotted Government accommodation and otherone sha ll be allowed single or bachelor accommodation or house rent allowance.(4) Perso ns employed or re-employed on contract in Government pay scale in aneligible Gov ernment department mentioned in sub-rule (1) shall be eligible in accordancewith terms and conditions of his appointment for Government or hired accommodationfr om Estate Office.(5) A FGS who owns a house in his own name or in the name of hi s spouse ordependent children, at the station of his posting shall not be allowe d Governmentaccommodation and shall be allowed self hiring of the house. Such FG S shall be entitledto six months grace period from the date of completion of his house. All the FGSs whoare already in possession of government accommodation sh all also be allowed period of six months to shift to their own houses.
