General information
The purpose of cash benet
Cash benet is intended to help families to have more time to take care of their own children themselves, families to have real options with regard to the kind of care they want for their children, and to bring about greater equality in the help individual families receive from the state for childcare.

Claim for cash benet for parents of young children


entitlement to cash benet is dependent on the agreed attendance. If the child makes use of a kindergarten place in an EEA country other than Norway, entitlement to cash benet is dependent on whether the kindergarten receives public operating support. The phrase agreed time spent in the kindergarten means the maximum time that the child can spend in kindergarten. Cash benet is not paid if the child has a full-time kindergarten place, i.e. the agreed attendance is less than 33 hours or more per week. If the agreed attendance is less than 33 hours per week, partial cash benet can be paid according to the following rates: 80 % of full cash benet for an agreed attendance of up to and including 8 hours per week. 60 % of full cash benet for an agreed attendance of 9 to 16 hours per week. 40 % of full cash benet for an agreed attendance of 17 to 24 hours per week. 20 % of full cash benet for an agreed attendance of 25 to 32 hours per week. Cash benet is paid according to amounts set by the Norwegian Parliament (Stortinget), and it is a taxfree benet.

The child must be aged between one and three. If a child is adopted the upper limit for receiving cash benet is from and including the month in which the child starts school The child and the person who shall receive the cash benet must be resident in Norway. People are regarded as resident if they have lived in or shall live in Norway for more than 12 months. Under the EEA rules, cash benet may be granted on certain conditions if one of the parents is working in Norway, regardless of which EEA country the child lives in. The child must not, or only partly, make use of a kindergarten place for which public operating support is given. The kindergarten can provide information about this.

Conditions for receiving cash benet

Time from which cash benet may be paid


Cash benet cannot be paid until the month after the child reaches the age of one or until the month after it leaves kindergarten. The claim should therefore be lodged the month before, since NAV Local Services needs to have updated information. The benet may be paid up to and including the month before the child will be three. Cash benet for adopted children can at the earliest be paid after the period for full adoption allowance has expired or would have expired had the right to such a benet been granted. The same operative date would apply to a lump sum payment. The cash benet can be given for up to 23 months and until the adoptiv child starts school. The cash benet is changed as from the month after the amount of time the child attends kindergarten is changed. Cash benet cannot be backdated for more than three months before the calendar month in which the claim was submitted (Section 8 of the Cash Benet Act).

Who is entitled to cash benet?


It is the person with whom the child lives on a permanent basis that is entitled to cash benet. The assessment of who it is that the child lives with on a permanent basis is governed by the rules contained in the Childrens Act. In cases where the childs parents live together, the benet is paid to the parent who submitted the claim. If both parents submitted the claim, the cash benet is paid to the mother. In cases where the parents do not live together, but an agreement on dual residence has been entered into under Section 36, of the Child Act, the cash benet can be divided if the child does not make use of a public operating supported kindergarten place.

Amount of cash benet


Cash benet may be paid for 23 months at a maksimum. The right to the benet is connected to children who have a kindergarten place which receives government funding,

Procedure
You must always complete pages 3 and 4 of this form. When you have completed pages 3 and 4, you should tear off and keep this general information. You should send pages 3 and 4 of the application to the National Insurance Ofce where you live. If the child is not registered in the Population Register in Norway, the childs birth certicate must be enclosed. When the case has been processed and a decision has been taken on whether or not you full the requirements to receive cash benet, you will receive written notication from the National Insurance Ofce.

Duties of the benet recipient


You have a duty to provide the information and the statements and certicates which the National Insurance Service needs in order to be able to decide whether or not the conditions for entitlement to cash benet have been met. A municipal register has been set up with information about the use of kindergartens for children aged between one and three. The National Insurance Ofce is sent information from this register every month and checks the information you have provided (see Section 16 of the Cash Benet Act). You must inform the National Insurance Ofce if your child starts attending kindergarten, or if the amount of time spent in kindergarten changes. If the attendance is reduced, you may

be entitled to more cash benet and should submit a claim for it. If you receive cash benet under the EEA rules, and either you or the other parent starts or stops working, you must inform the National Insurance Ofce. You may be asked to repay any cash benet which has been wrongly paid out because you have negligently failed to give notication or have provided incorrect information. This also applies to cash benet which you have received and to which you knew, or should have known, you were not entitled (Section 1 of the Cash Benet Act). You may also be liable for prosecution in such cases (Section 23 of the Cash Benet Act).

Filling in the form


Below we have provided further information regarding some of the boxes on the form. You can provide additional information in Box 6 or on a separate sheet. 1.1 It is the person with whom the child lives on a permanent basis who should apply for cash benefit. If the child lives together with both parents, they can decide for themselves who should apply. If the child lives on a permanent basis with only one of its parents, it is that parent who should apply. If the parents have agreed to share custody (Section 36 of the Childrens Act (barneloven) and wish to have divided payment of cash benet, both parents must apply. In principle, cash benet can only be paid if you are resident in Norway. You are regarded as resident if you have lived here for 12 months or if it is probable that you will live here for more than 12 months. You must therefore give precise information about when you arrived in Norway and how long you plan to stay if you have lived here for less than 12 months. If you are an asylum-seeker, cash benet cannot be paid until a decision on asylum or residence in Norway has been made. Short, temporary periods of living aboad of up to three months do not affect your status as a resident. If you live for a continuous period of more than three months abroad, you will no longer be regarded as fullling the condition of being resident. You must provide information about plans to live abroad, even if it is for a period of less than three months. Use Box 6 if necessary. The main condition for entitlement to cash benet under Norwegian law is that the child is resident in Norway. Under the EEA Agreement, there may also be entitlement to cash benet from the EEA country in which the parents work or from which they receive a pension, even if the child lives in another EEA country. If the child lives in another EEA country, but one of the parents is working in Norway, there may be entitlement to cash benet from Norway, or on the Norwegian continental shelf. In such cases, evidence of your work situation must be enclosed with your application for cash benet. Cash benet may be paid for 23 months and covers children aged between one and three. Adopted children are excepted from the upper limit of three years. This means that cash benet can be paid for 23 months and until the child starts school. You must state whether the child lives with you on a permanent basis, or whether shared custody has been agreed with the childs other parent. Any agreement on shared custody must be shown. In that case, each parent may receive half of the cash benet if they agree to such an arrangement. Cash benet can only be divided if neither parent has the child in a kindergarten with public operating support (see Box 5 below). If no agreement is reached, the cash benet shall be paid to the parent who the child is registrered as living with on a permanent basis in the Population Register. 4.2 Cash benet for adopted children can at the earliest be paid from the month after the period when full adoption allowance expires or would have expired in the case of an entitlement to such an allowance. A lump sum adoption benet may be given at the same time as for cash benet. The cash benet can be given for 23 months and until the child starts school. You must therefore inform the national insurance ofce about the child being adopted. The regulation giving cash benet to adopted children beyond the age of three came into force on July 1st 2005 and will apply to children who have either received or would have been entitled to full adoption allowance after June 30th 2003. There is no entitlement to cash benet for foster children who are in your care under the provisions of the Child Care Act (barnevernsloven). Like you, the child must be resident in Norway (see the comments relating to Box 1.2 and the comments relating to Box 3 regarding exceptions). You are not entitled to cash benet if the child lives in a foster home, childrens home or similar institution under the provisions of the Child Act. Entitlement to cash benet is linked to whether or not the child makes use of a place in a kindergarten which receives public operating support. The kindergarten can provide information about this. Cash benet is not paid if the child attends such a kindergarten for 33 hours or more per week. If the attendance is 32 hours or less, cash benet is paid on a proportional basis. It is the number of hours which are agreed with the kindergarten at any particular time that determines whether or not cash benet can be paid and the amount that can be paid, not the actual time spent in the kindergarten.
