Affidavit of Lost Note

STATE OF California SS COUNTY OF Marin I Ryan Myers, residing at 123 Main St., Mill Valley, California 94941, being of legal age, depose and say that: 1. I am the owner of the Loan Agreement dated February 17, 2011 secured by a Mortgage Deed on the residence located at 123 Main St., Mill Valley, CA 94941 executed by Myers Electronics, Inc, 440 Montgomery St., San Francisco, California 94103 and recorded in Marin Superior Court, Marin, California in Archive 13, 42. 2. The note has been lost, misplaced, or destroyed and after the exercise or due diligence, the same cannot be located. 3. The note is in the amount of $620,000.00, with interest of 4.7% per annum. The Note provides for monthly payments, beginning on April 01, 2011 and continuing thereafter until April 01, 2026, when all remaining principal and interest is due. The outstanding balance on the note as of April 19, 2012 is $590,000.00 which is inclusive of interest. 4. Ryan Myers is the current holder of the Note and the Note, nor any part thereof, has not been assigned to any other person or entity. 5. A copy of the Note is attached hereto and it is a true and correct copy of the original Note.
