GOVERNMENT OF ANDHRA PRADESH ABSTRACT Primary Education RTE Act 2009 -Providing 25% provision for children belonging

g to weaker Sections & disadvantaged groups for admission in Class I in Private un-aided and aided Schools in the State under RTE Act - Constitution of Committee for finalization of Modalities Orders Issued. 1. Gazettee of India Extraordinary - Part II Section 1, No.39, New Delhi, issued by Ministry of Law & Justice on the Right of Children to Free and Compulsory Education Act, 2009 (Central Act No.35 of 2009) dt.26.08.2009. 2. ORDER:Government of India enacted Right of Children to Free and Compulsory Education Act 2009. As under Clause (c) of the Sub Section (1) of Section 12 of the Act, all Private Unaided Schools shall admit in Class I to the extent of atleast 25% of the strength of that class children belonging to weaker sections and disadvantaged groups and provide free and compulsory Elementary Education till its completion. The State government of A.P have issued orders framing rules for implementation of the provisions of RTE Act vide reference 2nd to 4th read above. 2. In the reference 5th read above, the State Project Director, Rajiv Vidya Mission(SSA), A.P., Hyderabad has stated that recently the Honble Supreme Court of India has given judgment in WP (c) No. 95 of 2010 filed by Society for Unaided Private Schools of Rajastan that all Private unaided schools shall admit 25% Children belonging to weaker sections and disadvantaged groups in Class I every year as per sec 12 (1)(c) of RTE Act 2009 till completion of Elementary Education. As per the said judgment of the Honble Supreme Court the right of Children to Free and Compulsory Education Act, 2009 constitutionally valid and apply to the following institutions. i) ii) a school established, owned or controlled by the appropriate Government or a local authority; an aided school including aided minority school (s) receiving aid or grants to meet whole or part of its expenses from the appropriate Government or the local authority; a school belonging to specified category; and an unaided non-minority school not receiving any kind of aid or grants to meet its expenses from the appropriate Government or the local authority.

3. Further the State Project Director, Rajiv Vidya Mission(SSA), A.P., Hyderabad has informed that the Government of India insisting for finalization of the modalities for implementation of the provision of 25% and send the proposals to constitute a Committee with certain members for the said purpose. (PTO)

Government after due consideration of the proposal of State Project Director, Rajiv Vidya Mission (SSA), AP., Hyderabad hereby constitute a Committee under the Chairmanship of Commissioner and Director of School Education with the following members to finalize modalities for implementation of the 25% admissions of Children belonging to weaker sections and disadvantaged groups in Class-I in all Private Un-aided and aided schools in the State from the academic year 2012-13.
1. Commissioner and Director of School Education 2. Sri K.Ananda Kishore, Consultant TET 3. Director, SCERT 4. Joint Director (Elementary Education) 5. RJDSE, Hyderabad 6. DEO, Karimnagar 7. MEO, Farroqnagar, Mahabubnagar 8. State Project Director, RVM(SSA) : : : : : : : : Chairman Member Member Member Member Member Member Member convener

5. The committee has to submit a report on the following items related to the provision of 25% admission of Children belonging to weaker sections and disadvantaged groups in Class-I in all Private Un-aided and aided schools in the state from the academic year 2012-13.
1. Identification of Private Schools 2. Identification of the Neighborhood Schools. 3. Admission procedure 4. Monitoring mechanism 5. Awareness campaign to parents 6. Orientation to field functionaries 7. Sensitization of Private Schools management

6. The above committee is requested to submit its report on or before 15.05.2012.
