    U.S. Congressloon Todd Akin (R-MO) has introduced an amendment to the 2012 National Defense Authorization Act that would protect service members and chaplains who oppose gay and lesbian service members. The underlying bill, HR 4310, is presently in the House Armed Services Committee, and Akin's amendment will be considered there, perhaps today or tomorrow (May 9 or 10, 2012). Akin’s amendment would require the Defense Department to “accommodate the conscience and sincerely held moral principles and religious beliefs” of every member “concerning the appropriate and inappropriate expression of human sexuality.” It also prohibits discrimination against a chaplain who reuses to perform any duty, rite or ceremony that is “contrary to the conscience, moral principle or religious beliefs” of either the chaplain or of the faith group sponsoring the chaplain.

    SEC. 5ll. PROTECTION OF RIGHTS OF CONSCIENCE OF MEMBERS OF THE ARMED FORCES AND

    CHAPLAINS OF SUCH MEMBERS.

    (a) PROTECTION.Chapter 53 of title 10, United

    5 States Code, is amended by inserting after section 1034 6 the following new section: 7 1034a. Protection of rights of conscience of mem8 9 10
    bers of the Armed Forces and chaplains of such members

    (a) PROTECTION OF RIGHTS OF CONSCIENCE.The

    11 Armed Forces shall accommodate the conscience and sin12 cerely held moral principles and religious beliefs of the 13 members of the Armed Forces concerning the appropriate 14 and inappropriate expression of human sexuality and may 15 not use such conscience, principles, or beliefs as the basis 16 of any adverse personnel action, discrimination, or denial 17 of promotion, schooling, training, or assignment. Nothing 18 in this subsection precludes disciplinary action for conduct

    2 1 that is proscribed by chapter 47 of this title (the Uniform 2 Code of Military Justice). 3 (b) PROTECTION OF CHAPLAINS.(1) For purposes

    4 of this title, a military chaplain is 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 (A) a certified religious leader or clergy of a faith community who, after satisfying the professional and educational requirements of the commissioning service, is commissioned as an officer in the Chaplains Corps of one of the branches of the Armed Forces; and (B) a representative of the faith group of the chaplain, who remains accountable to the endorsing faith group for the religious ministry involved to members of the Armed Forces, to (i) provide for the religious and spiritual needs of members of the Armed Forces of that faith group; and (ii) facilitate the religious needs of members of the Armed Forces of other faith groups. (2) No member of the Armed Forces may (A) direct, order, or require a chaplain to perform any duty, rite, ritual, ceremony, service, or function that is contrary to the conscience, moral principles, or religious beliefs of the chaplain, or con-

(c) REGULATIONS.The Secretary of Defense shall

    10 issue regulations implementing the protections afforded by 11 this section.. 12 (b) CLERICAL AMENDMENT.The table of sections

    13 at the beginning of chapter 53 of title 10, United States 14 Code, is amended by inserting after the item relating to 15 section 1034 the following new item:
