TERMS & CONDITIONS

DEFINITIONS: 'Exhibition' shall mean the event, Sanjivani will take place from 7th to 11th June 2012 at Ganesh Kala Krida Exhibition Hall, Pune. Exhibitor shall mean any person, firm or organization who is allocated a space by the organizers in the above-said exhibition. This Booking Form for exhibit space at Sanjivani Exhibition will become a contract with Axion Events and Promotions. (hereinafter called ' organizer') upon its written acceptance. APPLICATION FOR PARTICIPATION: All applications for participation should be made in the prescribed form submission of this form along with the deposit within the stipulated time will be deemed as confirmation of participation and acceptance of the terms & conditions. The organizer reserves the right to accept or refuse any application without assigning any reason for the same. ALLOTMENT OF STALLS: Location will be allocated to meet the Exhibitor's preference to the extent possible. However the organizer reserves the right to change the location allotted to the exhibitor at any time prior to the commencement of the exhibition. The decision of the Organizer shall be final and binding on the Exhibitor. TERMS OF PAYMENT : Full payment is to be made along with the Booking Form thirty days before the start of the exhibition. (Service tax @ 12.36% has not been included in the cost of the stall and it is to be paid over and above the stall costs as applicable) For other additional services, payments must be made in full and in advance when placing orders, payment by the stipulated date is a prerequisite condition for the Exhibitor's participation in the exhibition and the use of the stall. In the event of default of payment by the stipulated date (a) the Exhibitor's application shall be deemed to be cancelled and the deposit forfeited; and (b) the Organizer shall reserve the right to claim all payment due from the defaulting Exhibitor. The organizer also reserves the right to take into custody the products & belongings of the defaulting exhibitor at any time during the exhibition. The Exhibitor shall not be entitled to any form of compensation whatsoever. DATES, AREA AND LAYOUT OF STALLS: The Organizer reserves the right to change the venue, the dates of the exhibition, the layout of floor plan & media plan. The stall numbers as shown in the layout plan are given for booking reference only. SCHEMES FROM ASSOCIATES: The Organizer does not take responsibility of the special schemes and promotional packages offered by its associates. The exhibitors may take their decisions independently. POWER: Exhibitors are required to take suitable measures to safeguard their equipment against power fluctuations. The Organizer will not be responsible for providing stabilized power. CHANGE TO THE TERMS AND CONDITIONS: The Organizer may add or amend the terms and conditions, for the benefit of exhibition. In such a case, the exhibitors will be informed in writing. APPLICATION FOR PARTICIPATION & ACCEPTANCE: All applications for participation shall be made on the prescribed Booking Form. The submission of the application form shall be deemed to be confirmation of participation and full acceptance of the 'Terms & Conditions' for participation as stated herein. The application shall become a valid contract upon the organizer accepting the application. The application and confirmation of its receipt do not constitute grounds for any claim to approval, or to any specific location or site space. In particular, the organizer is entitled to implement reduction in the number of square meters applied for if the exhibition area available is oversubscribed. WITHDRAWALS: The Exhibitor will not be permitted to withdraw/cancel/ alter / reduce or claim refund in any way once booked. MOVEMENT OF EXHIBITS: Exhibits or other goods will be permitted to be taken out of the exhibition venue only after the closure of the exhibition. The Exhibitor shall indemnify the Organizer against any loss or damages by reason of the delay or damage to any goods or materials in the exhibition. LIABILITY & INSURANCE : Organizer will employ reputable guards and will take reasonable precautions to safeguard exhibitors' property. However, organizer assumes no liability whatever for loss or damage, through any cause, of goods, exhibits or other materials owned, rented or leased by the exhibitor. If insurance is desired each exhibitor is responsible for providing his own fire, workmen's compensation, public liability, theft and property damage insurance. The exhibitor shall indemnify organizer and the exhibit facility against and hold them harmless from any complaints, suits or liabilities resulting form negligence of the exhibitor in connection with the exhibitor's use of display space. SECURITY RESPONSIBILITY: During all periods, security of exhibits, stands and furniture is wholly the responsibility of the exhibitor, his agent or contractor. The organizer, its Directors, Trustees, Officers, Employees, Agents and Representatives shall not be responsible for any losses, damages to property or injuries to person incurred. SUPPLEMENTARY CLAUSES: Whenever necessary to ensure the smooth management of the exhibition, the organizer shall have right to issue supplementary regulations and instructions in addition to these 'Terms & Conditions for participation. All such supplementary regulations will form a part of the 'Terms & conditions' for participation and will be binding on all. INFRINGEMENT OF TERMS & CONDITIONS FOR PARTICIPATION: In case the infringement of the mentioned 'terms & Conditions' for participation and any other further rules and regulation determined by the organizer, will result in the exclusion of the exhibitor from the event, then the Exhibitor shall have no right to claim compensation or demand refund on any payments already preceded, loss or expenses, nor shall the Exhibitor be released from their contractual obligation to pay. UNFORESEEN OCCURRENCES: In the event of any occurrence not foreseen in these 'Terms & conditions' for participation, the decision of the organizer shall be final.
