ORDER ON EMERGENCY PRE' ~IMINYARY ~JUNCTION

This matter is before the court on plaintiff's verified Petition for Emergency

PreliminarylPermanent InjW1ctiOn. The dispute between these parties concerns real

property located at 3836 Panola Road, Lithonia. Georgia. On December 16, 2008.

defendant obtained a writ of possession against plaintiff regarding this disputed property

in the Magistrate Court ofDeka1b County. Plaintiff Cl.U'1'eD.tly resides at the property.

Because immediate and irreparable harm will result if the writ of possession is enforced

before plaintiff is given an opportunity to be heard, it is ORDERED that defendant be

temporarily restrained from eDforcing the writ of possession issued by The Honorable

Gary Leshaw on December 16. 2008 until such time as this court sets the matter for a

hearing, which shall be within thirty days.l Both parties will receive notice of the date

and time they are to appear before this honorable court .
