PRAECIPE THE CLERK OF THE COURT will please add Janice Wolk Grenadier to the list of people who will speak to the Grand Jury on October 11, 2011 at 9am. As a citizen of the United States & the State of Virginia I am exercising my right under Virginia Law to go in front of the Grand Jury.

1. Research online in the Code of Virginia, with the Center for Jury Studies of the National Center for State Courts in Williamsburg, and with counsel with some experience in this narrow niche of the law where you as an elected servant as a Constitutional Officer have a key role, reveals:

Code of Virginia 19.2-191 (2) and on, plus the October 2010 edition of the Virginia Supreme Court Handbook for Grand Jurors Section 23, titled Convening, states:

Any citizen or group of citizens may ask the Circuit Court of a city or county to convene a Special Grand Jury.

2. Section 26, titled Functions of a Special Grand Jury states:

As has been set out in Section 3, a Special Grand Jury is composed of from seven to eleven citizens of a city or county, selected by the Circuit Court and summoned to investigate any condition which tends to promote criminal activity in the community or by any governmental authority, agency or official.

The Special Grand Jury, composed entirely of private citizens, is the one non-political body with legal authority to make such investigations.

3. Further legal research reveals there are three paths for a Citizen to petition for a Special Grand Jury to be convened: (1) By compliance to a Petition (request) of a Citizen made to the elected Commonwealth Attorney. (2) By compliance to a Petition of a Citizen made to the Presiding Judge of the Circuit Court. (3) By a Presentment to the Regular Grand Jury, (a) whereupon with a minority vote of its members, the Presiding Judge MAY convene a Special Grand Jury, (MAY denotes an OPTIONAL action upon the judge, where now both the Petitioner and some other Citizens in the capacity of Grand Jurors have indicated a need for a Special Grand Jury, the Presiding Judge may be more favorably disposed than in option (2), above.) OR (b) whereupon with a majority vote of its members, the Presiding Judge SHALL convene a Special Grand Jury. (SHALL denotes a MANDATORY action upon the judge.)

4. Petitions to both the Commonwealth Attorney Randy Sengel, and Presiding Judge Donald Haddock for a Special Grand Jury have been properly delivered, and in one case denied by mail a reply, the other case, to date, ignored, effectively a denial.

5. Given the above, this Citizen exercises the Right to exercise the third path for a Petition for Special Grand Jury, that is to make a Presentment at the next session of the Regular Grand Jury for the City of Alexandria Circuit Court, scheduled for 11 October 2011 at 9am.

6. This PRECIPE calls on you to perform your Duty as an elected Constitutional Officer to place this Petition for Special Grand Jury before the Regular Grand Jury.
