The Department of Defense announced today the death of a soldier who was supporting Operation Enduring Freedom.
Spc. Justin D. Ross, 22, of Green Bay, Wis., died March 26 in Helmand province, Afghanistan, of wounds suffered when his unit
was attacked by small arms fire. He was assigned to the 863rd Engineer Battalion, Wausau, Wis.

Ross Executive Order Information:
Corporal Justin David Ross will not be laid to rest for a few more weeks, because his will be buried at Arlington National
Cemetery.
However, he will be having a memorial service here in Wisconsin on Monday,
April 4th. I have attached an example of an executive order for another
soldier who was not laid to rest on the same day as his memorial service.
The important thing to note about Cpl. Ross is that his DOD News Release was slightly incorrect.
Correction:
#1- Ross is a Corporal, not a Specialist (he was posthumously promoted)
#2- He was assigned to the 428th Engineer Company, attached to the 863rd Engineer Battalion, Wausau, Wis.
With regards to the number of Executive Orders to bring to the Church for the family meeting: One mounted copy for
his parents and two un-mounted copies (one for each of his brothers).

Funeral plans are pending until he returns to Wisconsin. The Casualty Assistance Officer informed me they don't expect
to have a funeral service before the middle of next week. Funeral services will take place at First Assembly of God

29. COLLECTIVE BARGAINING FOR DAY CARE PROVIDERS
Joint Finance/Legislature: Authorize, under Subchapter I (Employment Peace) to
Chapter III (Employment Relations), a single collective bargaining unit for a certified or
licensed day care provider who provides care and supervision for not more than eight children
who are not related to the day care provider. Include a certified or licensed day care provider
who provides care and supervision for not more than eight children who are not related to the
day care provider in the definition of employee under Subchapter I. With respect to such day
care providers, define the employer as the state, counties, and other administrative entities
involved in regulation and subsidization of the day care providers. Modify the definitions in
Subchapter I of"fair-share agreement," "maintenance of membership agreement," and
"referendum" to reflect the inclusion of such day care providers and the labor organization
representing them.
Provide, as a nonstatutory provision, that the terms of the Memorandum of Agreement
betweenDHS, the Department of Workforce Development, and the Wisconsin Child Care
Providers Together, American Federation of State, County and Municipal Employees, AFSCME
Councils 40 and 48, AFL-CIO, entered into on July 21, 2008, would remain in effect until the
earlier of June 30, 2011, or the date on which a collective bargaining agreement is ratified
between an employer, as specified above, and a labor organization representing the day care
providers. Provide that, upon ratification of the collective bargaining agreement, the collective
bargaining agreement would supersede the Memorandum of Agreement with regard to wages,
hours, and conditions of employment of the employees.

At yesterday's meeting you asked about whether there were other laws related to Executive Order 172 and
the MOA in addition to the Chapter 111 ones we discussed. There's was a non-statutory provision in 2009
Wisconsin Act 28 that is in the attachment below, 9156(21), which states:
9156(2!) DAY CARE PROVIDER COLLECTIVE BARGAINING.
The tenns of the Memorandum of Agreement between
the department of health and family services and the
department of workforce development and the Wisconsin
Child Care Providers Together, American Federation
of State, County and Municipal Employees, AFSCME
Councils 40 and 48, AFL-CIO, entered into on July 21,
2008, remain in effect until the earlier of June 30,2011,

or the date on which a collective bargaining agreement is
ratified between an employer under section 111.02 (7) (a)
4. of the statutes, as created by this act, and a labor organization
representing employees under section 111.02 (6)
(am) of the statutes, as created by this act. Upon ratification
of the collective bargaining agreement, the collective
bargaining agreement shall supersede the Memorandum
of Agreement with regard to wages, hours, and
conditions of employment of the employees.
I assume whoever worked on eliminating the employee/employer language in the current budget bill was
also aware of this non-statutory provision. I don't know if it was also addressed by the budget bill. Maybe
it wasn't worth dealing with because it has an expiration date.
Also, here is an LFB summary of Act 28's Collective Bargaining provisions for day care providers:

. Sunday evening, producing rain, high winds, large hail, and tornadoes.
Although major metropolitan areas like Madison, Milwaukee, and Chicago were spared,
the NWS confirmed at least 10 tornadoes, including three strong tornadoes (EF2 or EF3),
touched down in portions of rural central and northern Wisconsin.
Eau Claire County. An EF-1 touched down near Augusta, with winds up to 105 mph,
leaving a path 1.5 miles long. A second EFc1 touched down in the same area, with winds
up to 100 mph, leaving a path% mile long.
Marthon and Lincoln Counties. An EF-3 touched down near Hamburg, with winds up

to 140 mph, leaving a path 22 miles long andY. mile wide. According to a UDSR
submitted by Lincoln County regarding damage in Merrill:

Waushara and Waupaca Counties. An EF-1 touched down near West Bloomfield, with

Starting today, March 16, FEMA will begin sending out Notice of Debt letters to disaster assistance applicants
who received improper federal disaster assistance payments. FEMA will send letters from the most recent
disasters first. These letters will inform applicants of the amount and reason for their debt, and provide
information on how to repay the debt or appeal FEMA's determination.
Regional Administrator Velasquez sent each of the State Directors a breakdown by state and county of
recoupment cases. I have attached a plain-language list of recoupment reasons. Additional information
outlining our new and improved recoupment process for improperly distributed or overpaid disaster assistance
funds can be found in Federal Register Notice Document Number 2011-6036

At FEMA we are committed to being responsible stewards of taxpayer dollars, and we have been actively
working to recoup misspent funds, while continuing to support communities as they recover. As a recent
Inspector General audit reinforced, FEMA and other federal agencies are required by law to recoup funds that
are paid in error.
We are on track to begin our new recoupment process in the coming days, which will be another important step
toward protecting our tax dollars, while ensuring that those in need are receiving assistance as quickly as
possible. Our priority is to make sure this new effort is one that operates in the best interests of both taxpayers
and disaster survivors.
The Regions are working with Headquarters to provide additional information. Below you will find an
overview of the Recoupment process:
As reviews are completed, Notice of Debt letters will be sent to those applicants who must return funds
that were improperly provided or overpaid. FEMA will mail letters on a rolling basis beginning March
16, 2011. Each letter will inform the applicant that they must return improperly awarded funds and will
outline the specific reason(s) for the improper payment, while providing a detailed explanation of the
appeals and repayment processes.
Individuals who receive a Notice of Debt may choose one of the following options:
o Pay the amount owed in full.
o Request a copy of their FEMA records for inspection or review and/or to file an appeal within 60
days.
o If applicants choose to file an appeal, they submit a written request for an oral hearing as
part of that appeal. Cases which raise issues of truth, veracity or other appealable concerns
and cannot be resolved using documentary evidence will be granted an oral hearing.
FEMA will make a decision on their appeal and send them a follow-up letter explaining
the basis of the decision along with a description of the next steps in the process.
o If individuals choose not to file an appeal or they file an appeal and it is denied, applicants
will have the opportunity to request a payment plan and/or a waiver or compromise of the
debt based on inability to pay.
FEMA is committed to working with all individuals identified for potential recoupment to ensure they
have a complete understanding of the determination made in their case and the various options available
to them to resolve this debt. If an individual has immediate questions about their case, they may contact
FEMA's Recoupment Helpline at 1-800-816-1122 or TTY at 1-800-462-7585 for persons who are Deaf,
Hard of Hearing or those with speech disabilities, between the hours of9:00 a.m. and 8:00p.m. EST,
Monday through Friday.
The letters that FEMA is sending will explain that the applicant has received funds from FEMA that
needs to be repaid. The letter also explains why the applicant has to pay back the money, and the
applicant's right to appeal the decision.
Headquarters and the Regions are working on providing additional clarification IF AQs regarding the
recoupments and I hope to share that information with you soon.

Starting today, March 16, FEMA will begin sending out Notice of Debt letters to disaster assistance applicants
who received improper federal disaster assistance payments. FEMA will send letters from the most recent
disasters first. These letters will infmm applicants of the amount and reason for their debt, and provide
information on how to repay the debt or appeal FEMA's determination.
Regional Administrator Velasquez sent each of the State Directors a breakdown by state and county of
recoupment cases. I have attached a plain-language list of recoupment reasons. Additional information
outlining our new and improved recoupment process for improperly distributed or overpaid disaster assistance
funds can be found in Federal Register Notice Document Number 2011-6036

At FEMA we are committed to being responsible stewards of taxpayer dollars, and we have been actively
working to recoup misspent funds, while continuing to support communities as they recover. As a recent
Inspector General audit reinforced, FEMA and other federal agencies are required by law to recoup funds that
are paid in error.
We are on track to begin our new recoupment process in the coming days, which will be another important step
toward protecting our tax dollars, while ensuring that those in need are receiving assistance as quickly as
possible. Our priority is to make sure this new effort is one that operates in the best interests of both taxpayers
and disaster survivors.
The Regions are working with Headquarters to provide additional information. Below you will find an
overview of the Recoupment process:
As reviews are completed, Notice of Debt letters will be sent to those applicants who must return funds
that were improperly provided or overpaid. FEMA will mail letters on a rolling basis beginning March
16, 2011. Each letter will inform the applicant that they must return improperly awarded funds and will
outline the specific reason(s) for the improper payment, while providing a detailed explanation of the
appeals and repayment processes.
Individuals who receive a Notice of Debt may choose one ofthe following options:
o Pay the amount owed in full.
o Request a copy of their FEMA records for inspection or review and/or to file an appeal within 60
days.
o If applicants choose to file an appeal, they submit a written request for an oral hearing as
part of that appeal. Cases which raise issues of truth, veracity or other appealable concerns
and caunot be resolved using documentary evidence will be granted an oral hearing.
FEMA will make a decision on their appeal and send them a follow-up letter explaining
the basis of the. decision along with a description of the next steps in the process.
o If individuals choose not to file an appeal or they file an appeal and it is denied, applicants
will have the opportunity to request a payment plan and/or a waiver or compromise of the
debt based on inability to pay.
FEMA is committed to working with all individuals identified for potential recoupment to ensure they
have a complete understanding of the determination made in their case and the various options available
to them to resolve this debt. If an individual has immediate questions about their case, they may contact
FEMA's Recoupment Helpline at 1-800-816-1122 or TTY at 1-800-462-7585 for persons who are Deaf,
Hard of Hearing or those with speech disabilities, between the hours of9:00 a.m. and 8:00p.m. EST,
Monday through Friday.

The letters that FEMA is sending will explain that the applicant has received funds from FEMA that
needs to be repaid. The letter also explains why the applicant has to pay back the money, and the
applicant's right to appeal the decision.
Headquarters and the Regions are working on providing additional clarification I F AQs regarding the
recoupments and I hope to share that information with you soon.

In an attempt to mislead the public, Walker now faces legal repercussions for misuse of AFL-CIO logo
Gov. Walker continues to show that he believes himself to be above the law. On his "Governor Scott Walker,
Public Figure" Face Book page Walker proudly displayed the AFL-CIO logo in an attempt to trick the public
into thinking that the AFL-CIO has endorsed his extreme anti-worker policies.
Today the Governor was delivered a letter from Trister, Ross, Schadler & Gold, PLLC law office to
immediately "cease and desist from any and all unauthorized uses of the AFL-CIO name and marks."

Starting with FY07 I started defunding local Councils and funding state wide efforts to prepare citizens and manage
volunteers. Local councils were doing little more than meeting and complaining about the lack of funding. CERT dollars
are still going to CERT and expanded trainings and building greater capacity more on a "regional" basis.
We are encouraging VOAD driven organizations and activities on an increasing number. These require little or no federal
funds and encompass a broader range of capacity and efficiencies for emergency management.
It might be suggested to the folks at HQ to allow the registration of capacities rather than how many government centric
organizations are established without regard for sustainability. Registering this way gives them a better picture of
progress.
Any subsequent registrations in Wisconsin will probably come from a VOAD that incorporates CERT in their repertoire.

Hi, All, please get back to me with any issues that stand in your way of completing re-registration by the 3/30
deadline. HQ has found fewer re-registrations than the previously registered numbers. One reason that HQ came up

with is that previously, CERT teams registered and now we have CERT programs ---so there will be fewer than the
original numbers. As for Councils, states are getting more discriminating as to the construct of a council-so that may be
the reason for fewer. I would be interested in your experience. As always with everything that you do, I want to thank
you superstars for the good work you have done.
I reviewed the latest report and these are our numbers as of 3/14. Your thoughts please:

The deadline for Citizen Corps Council and CERT Program Registration is two weeks away/ Now is the time to push hard on local Councils and CERT
Programs to either start or continue with the registration process. One area of weakness we have overall as a Region is not with pending

Preparedness Division support contractor, ICF Macro, was making calls to essentially achieve the same goal- to encourage participation among
Councils and CERT Programs at various stages in the registration submission process. For your convenience, I'll be following up shortly to send
contact information for Councils and CERT Programs in your State that have started but not yet submitted their registration proft1e should you want
to contact that individual to remind them of the upcoming March 3dh deadline.

be created, there will be more claims for "tax benefits", which is defined in s. 560.799 (1) (c) as the
income and franchise tax credits under ss. 71.07 (3w), 71.28 (3w), and 71.47 (3w), the expansion of
which require a 3/5 quorum.

Hi Rob:
You've asked whether an expansion of the refundable individual income, and corporate income and
franchise, enterprise zone jobs credit (ss. 71.07 (3w), 71.28 (3w), and 71.47 (3w), stats.) would be
subject to the 3/5 quorum requirement under Article VIII, section 8 of the Wisconsin Constitution. I
believe that such an expansion of the credit would be subject to Article VIII, section 8.
This tax credit is funded by a sum sufficient general fund appropriation under s. 20.835 (2) (co),
stats. Any expansion of the credit would almost certainly require DOA to pay by check additional
claims from that appropriation to an eligible claimant. For example, sees. 71.07 (3w) (c) 1.
Article VIII, section 8 of the Wisconsin Constitution states, in part, that " ... any law which ...
continues ... an appropriation of public ... money ... " is subject to the 3/5 quorum
requirement. It seems to me that a bill which would continue, and likely expand, payments from a
general fund appropriation to claimants of this tax credit clearly falls within the plain language of this
constitutional provision and is thus subject to the 3/5 quorum requirement.

Hi Rob:
You've asked whether an expansion of the refundable individual income, and corporate income and
franchise, enterprise zone jobs credit (ss. 71.07 (3w), 71.28 (3w), and 71.47 (3w), stats.) would be
subject to the 3/5 quorum requirement under Article VIII, section 8 of the Wisconsin Constitution. I
believe that such an expansion of the credit would be subject to Article VIII, section 8.
This tax credit is funded by a sum sufficient general fund appropriation under s. 20.835 (2) (co),
stats. Any expansion of the credit would almost certainly require DOA to pay by check additional
claims from that appropriation to an eligible claimant. For example, sees. 71.07 (3w) (c) 1.
Article VIII, section 8 of the Wisconsin Constitution states, in part, that " ... any law which ...
continues ... an appropriation of public ... money ... " is subject to the 3/5 quorum
requirement. It seems to me that a bill which would continue, and likely expand, payments from a
general fund appropriation to claimants of this tax credit clearly falls within the plain language of this
constitutional provision and is thus subject to the 3/5 quorum requirement.

Yesterday, through their attorneys, Ehlke, Bero-Lehmann & Lounsbury, S.C., several labor unions representing employees of the City of Madison and nearby municipalities filed In Dane County Circuit
Court the first legal challenge to the substance of the so-celled 'Budget Repair Bill."
The Plaintiffs in the case include Laborers local 236, local311, AFSCME local60 and an individually named plaintiff, Jamie O'Brien, who is a member of the Laborers Union. The sult was
brought against both the State of Wisconsin and Governor Scott Walker. Circuit Court Judge Peter Anderson has been assigned to the case.
In the lawsuit, lhe Plaintiffs request that the court find Act 10 unconstitutional and therefore declare It null and void. The lawsuit asserts that the Act Impermissibly infringes on employees' constitutionally
protected rights to equal protec!lon and freedom of speech and association.
EQUAL PROTECTION: The lawsuit asserts that many of the limitations Imposed on employees who are in a unions do not apply to employees who are not in a union. It also treats members of some
unions differenlly.than members of other unions.
FREEDOM OF SPEECH AND ASSOCIATION: The lawsuit further alleges that Act10 imposes an impermissible burden on municipal employees' abil!ty to exercise their cons!ltu!lonal right to associate
and assemble, and to express their views in concert with one another, and to petition their State and local governments regarding matters that are of mutual concern to them.
STATEMENT ON THIS LAWSUIT: Plaintiffs' attorney, Bruce Ehlke, said, "Wisconsin has a long and admirable history of encouraging labor and managemenl peace through collective bargaining. Even
before public sector unions were granted the statutory right to bargain, public employers and employees in fact engaged in an early form of collective bargaining known as meet and confer. This Act
sets Wisconsin's labor rela!lons back 80 years.
"Employers in Wisconsin have long benefitted from the certainty and stability afforded to them through collective bargaining agreements. During the last several weeks, the support of public employers
for collective bargaining has become obvious, as municipalities across the stale have sccambled to gel new and extended agreements Into effect before the enactment of this Act, in order to preserve
their ability to operate with a full contract in place for as long as possible.
"Regardless of how individuals feel about the level of compensation and benefits received by public sector employees, it Is without a doubt 111at those employees, citizens of our state, are entlt!ed to
equal protec!lon and freedom of association, and this Act improperly attempts to strip public sector workers of those rights.

At yesterday's meeting you asked about whether there were other laws related to Executive Order 172 and the
MOAin addition to the Chapter 111 ones we discussed. There's was a non-statutory provision in 2009
Wisconsin Act 28 that is in the attachment below, 9156(2l), which states:

I assume whoever worked on eliminating the employee/employer language in the current budget bill was also
aware of this non-statutory provision. I don't know if it was also addressed by the budget bill. Maybe it wasn't
worth dealing with because it has an expiration date.
