PHILIPPINE SUPREME COURT DECISIONS DATA SET The Philippine Supreme Court Decisions Data Set contains a record for each individually-docketed case whose disposition is reported in the principal record of the Court's work, the Supreme Court Reports Annotated (SCRA) (Quezon City: Central Lawbook Publishing Company, 1961- ), beginning with volume 1 (January 1, 1961). The initial release contains all such cases through volume 150 (June 17, 1987). Data Files The initial release of the data contains six files per volume consisting of fixed length data records, one record per individually-docketed reported case per file. Thus it consists of 900 separate files which may be aggregated or used individually as a user chooses. The data in the files consists only of alphanumeric codes, i.e., blanks, numbers (the decimal digits 0 through 9) and the letters of the English alphabet. The variables coded for each case are recorded in fixed locations (columns) in each record of each file. The files should thus be usable by any computer program that has the capacity to read "text" or "ASCII" data in a fixed format. This certainly includes every reputable microcomputer and mainframe text editing/word processing, data base management, and statistical analysis program. Users of the data set may thus work with it using any program available to them that is appropriate for their interests. No program is provided with the data set. The first four files for each volume, labelled imaginatively "Card 1," "Card 2," "Card 3," and "Card 4," contain the basic information recorded about each case the first time it was coded (see below for discussion of coding procedures). Barring errors, there will be exactly the same number of records in each of these four files for any given volume of SCRA. The fifth file, the "second coding" file, contains data recorded for each case in a completely independent re-coding of the key variables from the first coding which required most discretion to code, and which, therefore, were presumed to be most subject to unreliability or, perhaps, alternative interpretations. Because the second coding was conducted independently, and because it was possible for different coders to occasionally disagree as to exactly how many cases were disposed of in a particular report, there are rare instances in which the number of records in the second coding file for a given volume is not exactly the same as the number in the Card 1 through Card 4 files for the same volume. A subsequent editing of the data for a later releaase will resolve these disagreements, if they are not already resolved by the third or resolution coding. The sixth file is the "third or resolution coding" file. It contains codes on the same variables contained in the second coding files. However, the third coding data represent the conclusion of an experienced coder as to the most appropriate code for each key variable after directly comparing the choices of the first and second coders. File Naming A standard system of naming has been used to identify the data files. The file names are legal file names under the PCDOS/MS-DOS operating system used by IBM and IBM-compatible microcomputers. They may or may not be legal files names under other computer operating systems, whether microcomputer, minicomputer, or mainframe. In each file name template given below, the three characters "vol" stand for the SCRA volume number to which the file applies. For example, 007CD1.TXT is the Card 1 file for volume "007," 019CD2.TXT is the Card 2 file for volume "019," 145COD2.TXT is the second coding file for volume 145, and so on. Note that leading zeros are included in the volume numbers within the file names. The first coding was the most extensive. An individual coder was assigned to code all the cases in a single SCRA volume before moving on to her/his next assigned volume. Much of the data recorded in the first coding was relatively non-controversial and required care, but little discretion, to code. It was available "on the face of" the case report, and needed only to be accurately recorded. That it was accurately recorded was insured by having the results of the first coding thoroughly checked by a group of "checkers," coders who were assigned to the checking task after they had themselves already coded enough data to understand the requirements of the coding process well. After the first coding of a SCRA volume was completed and the first coding results for the volume had been checked and corrected, as necessary, the volume was assigned to a different coder for its second coding. To the maximum extent possible, the second coding was done by a coder with a different amount of experience from the first coder. Thus if a particular volume was coded by a relatively inexperienced coder in its first coding, it would be assigned to an experienced coder for its second coding. This tactic insured that cases would not be coded with differential reliability as a result of their having been inadvertently coded twice by less experienced or by more experienced coders. The second coding was an independent replica of the first coding, done in complete ignorance of the results of the first coding. However to save time and make the project fit within its budget, the second coder did not record again on paper the relatively non-discretionary items already recorded by the first coder and carefully checked for accuracy by an independent checker. Instead, the second coder concentrated on coding only the most difficult to code items listed in the full codebook, those items about which project leadership concluded there was most ambiguity and greatest likelihood for unreliability in coding, or, as we later thought, for equally valid but different coding choices to be made. The items subject to the second coding are listed under the "second coding" heading of the codebook. The work of the third coder involved checking the results of the second coding for obvious mistakes and, most importantly, resolving differences in the codes recorded by the first and second coders. Hence the "third" coding is a "resolution coding." In the vast majority of instances, the work of the resolution coder involved choosing between the two codes suggested by the first and second coder when those codes were different. Ordinarily, the third coder would not "second guess" the first and second coders when they agreed. In occasional instances, however, the resolution code recorded may actually be different from either the first or second code for a particular variable in a particular case because, in these instances, the resolution coder was convinced on the basis of his/her work with the case that both previous coders had misinterpreted the data. Such cases were normally checked with project leaders before a different third code was assigned.

The abbreviated case/dispute name is given in italics between lines as the heading for the decision report on the first full page of text devoted to the decision report. Most frequently, this will be the page on which the decision report begins. But sometimes when a new decision report begins in the middle of a page, and its title heading may not appear until the next page. Code the first 29 characters of the name exactly as listed (including blanks) in the decision report title heading. When more than one titled dispute (see the instructions for coding docket number above) is included in a single decision report, the decision report title used as a heading for the decision report is that of the first case/dispute title listed. In these instances, the names to be coded for the second (and subsequent) titled case/dispute(s) will normally be given in an abbreviated case/dispute title listed alphabetically in the table of "Cases Reported" at the beginning of the volume. Should an abbreviated case/dispute title for a second or subsequent docket numbered case/dispute, create one according to the following rules: For the names of individuals, code last name (surname) only. Code the first 29 characters of the names of corporations, government agencies, associations, etc. just as listed in the complete case title. If more than one party is a petitioner, code only the first party. Flag the coded case for checking of the case/dispute name by your supervisor. 52-80 Name of Respondent/Appellant in abbreviated case/dispute name (i.e., party listed after the vs.)

Docket identification codes for "regular" cases begin with the capital letter L, as noted in the Type of Case code (Col. 15). This letter is followed by a five digit docket number. This number is to be coded left justified and omitting any separating hyphen beginning in col. 16, after a "1" has been coded in col. 15. For example, the case Escaler vs. Court of Appeals (SCRA 138:0001) has docket number "L-42636". For this case 42636 omitting the leading hyphen should be coded in cols. 16-20, leaving col. 21 blank, after coding a "1" in col. 15. Administrative case docket identifications begin with "Adm. Case No." or "Adm. Matter No." This is followed by an alphanumeric identification code. It is this code which should be coded left justified and omitting any separating hyphen beginning in column 16, after a "2" has been coded in col. 15. For example, the case Moya v. Basig (SCRA 138:0049) is identified as "Adm. Matter No. 2796-P". For this case 2796P omitting the hyphen should be coded in cols. 16-20, leaving col. 21 blank, after coding a "2" in col. 15. NO DOCKET NUMBER In the rare event when there is no docket number, leave these columns BLANK. MULTIPLE DOCKET NUMBERS IN ONE CASE REPORT On occasion, the Supreme Court disposes of more than one docketed case with a single decision report or resolution. This occurs when more than one case arises from the same dispute or, perhaps, when the Court considers more than one case to raise the same issue. When this occurs, the decision report will begin with more than one docket number assigned to a single case title (for example, 138:0206 includes docket numbers L40367, L40368, and L40369, all listed under the title People vs. Sto. Tomas) or it will have more than one case title with each title preceded by its normal docket number(s) (for example, SCRA 138:0146 includes docket number L67766, Hildawa vs. Enrile, and L70881, Valmonte vs. Integrated National Police). The coding rule we shall follow to deal with this situation is to code each individual docket number as a separate case or decision. In coding jargon, the individual case dispute represented by a discrete docket number is our proper "unit of analysis" or analytical "case." (There is unfortunately, some confusion is possible because of the use of the word "case" in social science data coding and analysis and the use of "case" to refer to a legal dispute that comes before a court!) A complicated example that involves both types of multiple docket numbers being disposed of in a single decision report is SCRA 138:0294. It disposes of two case disputes, Galman vs. Pamaran and People vs. Sandiganbayan. Each of these titled disputes has two docket numbers assigned (L71208 and L71209 for the former and L71212 and 71213 for the latter). Follow the instructions for coding name of Petitioner (cols. 23-51). Occasionally, especially in administrative cases or matters, the case name will not have a vs. and a second party listed. For example, decision report SCRA 138:0517, a disbarment petition, is titled In re: Per Oglandesca. Write the word "none" in this field in such circumstances. 81-83 Sequence Number

This is a three digit number which is the case's sequential position within the file for its volume. Sequence numbers are intended to be used to match the data for the same case across the six different files which contain data on the case. Thus in every file for volume 124, for example, the case with sequence number 034 is the same, and any or all of the data for all the case 34 lines within the files for volume 124 may be merged into a common record for the case. Never code the Supreme Court as the Court of Immediate Origin, unless the case concerns administrative disciplinary action against a Supreme Court justice. (To my knowledge, no such case has ever been heard by the Supreme Court.) For all disciplinary cases, always code the appropriate Type of Action (Card Two, cols. 19-20), code 80 (lawyers), 81 (judges), 82 (non-judicial court employees), 85 (bar exams cases), or 86 (Integrated Bar regulations). For administrative/disciplinary cases concerning judges and non-judicial court employees, always code a Court of Immediate Origin and a Province of Immediate Origin, if possible and appropriate. These should be the court and place where the accused judge holds his/her appointment. Never code a court or province of initial origin for such cases.

This is the last court/agency to act on the case/dispute, except in the special case of a case/dispute that falls under the Supreme Court's original jurisdiction and has not been acted on by another court/agency.
